TERMS & CONDITIONS

1. Pricing: All prices quoted, unless otherwise stated, are unit price ‘ex-warehouse’. All prices are subject to alteration without notice. All quoted pricing is applicable to approved Burke Marine retailers only. 2. Payment terms: Payment for goods supplied must be made within the terms stated on the invoice. Burke Marine accepts payment by cash, cheque, credit card or by electronic funds transfer. Early payment discounts may only apply to approved account holders and may only be deducted where payment has been received within the payment terms stated on all Burke Marine invoices and as outlined in the “Early Payment Discount” terms below. 3. Early Payment Discount: When the Early Payment Discount is offered, payment must be received in full with the Retailer’s “Early Payment” period as quoted on the invoice. The early payment discount is not deductible on any invoice payments received outside the “Early Payment” terms stated on invoices or on accounts with any payments in arrears. 4. Freight & Service Charges Free freight is available to mainland capital cities on orders exceeding AUD 450.00 exclusive of GST and invoiced freight charges. Freight will be charged on consignments at Burke Marine’s regular carrier fees. Freight charges may apply for bulkier items outside of the terms stated above. A ‘Small Order’ Service charge of AUD 5.00 exclusive of GST will apply to orders not exceeding AUD 450.00 exclusive of GST sent using a carrier outside of Burke Marine’s nominated carrier. Burke Marine accepts no responsibility for lost or damaged goods sent at the request of a retailer to a third party. 5. Guarantee of payment: The customer agrees with Burke Marine to be personally liable to pay all monies payable to Burke Marine pursuant to this agreement. The customer shall be jointly and severally liable for payment and that liability shall not be discharged until Burke Marine has been paid in full. 6. Overdue Accounts: In the event that Burke Marine extends a credit facility, then payment of all accounts not paid in cash on delivery must be paid, as per agreed terms stated on the invoice. After this date, Burke Marine may elect proceedings for any outstanding amount without notice. In the event of overdue accounts, Burke Marine may elect to impose a 5% administration fee per month until all monies are collected in full. The client signatory agrees to indemnify Burke Marine and pay all costs and expenses of a solicitor if legal action is necessary and Credit Control fees which we may incur by recovering from you any overdue amount. 7. Conditions of Sale: No products or goods purchased from or produced by Burke Marine shall be resold by the Retailer through any location other than the Retailers agreed bricks and mortar store or URL, including an online auction (e.g., ebay) or online store (e.g., Amazon) without the express, written authority of Burke Marine. If the Retailer resells via a third party, Burke Marine reserves the right to terminate the supply of goods immediately. The representation of the Burke Marine brand must be within the agreed Burke Marine Brand & Design Guidelines Version 2.0. 8. Ownership of goods: All stock remains the property of Burke Marine until all outstanding monies are paid in full. In the event of insolvency, bankruptcy, receivership, winding up, placement under official management or non-payment of goods then Burke Marine shall have unconditional and unfettered right of repossession of any goods held by the principal. The principal agrees that Burke Marine may, at its discretion; enter the premises of the customer for the purpose of recovering goods supplied by Burke Marine if the customer has failed to pay for those goods as per the terms described under “payment terms” above. 9. Return of goods: Prior approval must be obtained from Burke Marine prior to returning any goods for credit. All claims by the customer in respect of goods must be notified in writing within 7 days from delivery date. Burke Marine reserve the right to deduct a 15% restocking fee on returns accepted after this time or on items with damaged packaging. 10. Warranty claims: Prior approval must be obtained from Burke Marine prior to refunding or replacing any goods under warranty. Burke Marine may also request that a defective or damaged item be returned to Burke Marine for examination and / or digital images be supplied before authorising a replacement, repair of goods or account adjustment. 11. Disclaimer: Information and applications as suggested herein and, on any Burke Marine promotional material are guidelines only.
