Former mayor’s lawsuit dismissed by Circuit Court

A Miami-Dade Circuit Court dismissed a lawsuit last week filed against Miami Lakes by the town’s former mayor, Michael Pizzi, who’s seeking about $3 million for attorney fees for his 2014 criminal trial, according to a Town press release. A judge threw out the litigation on April 25, three years after Pizzi sued Miami Lakes. Following a series of bizarre depositions, Pizzi had to amend his lawsuit twice to resume pursuing legal action. The latest ruling is the third time the case was dismissed but Town Attorney Raul Gastesi said Pizzi is expected to appeal the court’s decision in hopes of forcing the town to pay his lawyers’ court costs from his bribery and kickback corruption trial. A jury acquitted Pizzi on all seven counts. “We believe the Appellate Court will agree with both prior judges that Mr. Pizzi does not have a viable case against the town,” Gastesi said. “Unfortunately, Mr. Pizzi is causing the residents unnecessary inconvenience to incur further and needless legal fees.” The town has reportedly spent more than $2 million in legal fees to fight Pizzi’s lawsuit. Pizzi’s team of high profile attorneys, Ed Shohat, Ben Kuehne, Michael Davis and Ralf Rodriguez, got him off the hook in 2014 after he was arrested on seven charges of public corruption.

Miami Lakes settled his civil lawsuit for attorney fees for about $400,000 when Pizzi sued Florida Governor Rick Scott for refusing to lift his suspension following his acquittal and the town for blocking his return to political office. Miami Lakes became part of the lawsuit to argue its case and tried to sway the Florida Supreme Court to uphold Scott’s decision but to no avail. Pizzi filed another lawsuit against the town in Circuit Court when then-mayor Wayne Slaton, who won a special election to replace him while awaiting trial, refused to give up his seat. The court ruled in Pizzi’s favor and the Third Court of Appeals upheld the decision, which returned Pizzi to the mayoral seat. Mayor Manny Cid said the lawsuit caused financial damage to Miami Lakes and hopes the latest court ruling finally puts an end to the legal drama. Pizzi told The Miami Laker his attorneys have filed an appeal saying both parties knew the case would be settled in the Appellate Court. “When I was reinstated as mayor, the Court of Appeals made the final decision.” He said his attorneys are also appealing court costs in the lawsuit against the town which a lower court threw out when he amended his litigation. “It’s not about the money, it’s about the principle.”

Miami Laker Profile: Carlos Fernandez Guzman THE MIAMI LAKER

By David L. Snelling The Miami Laker staff Long before he became President and CEO of Pacific National Bank, Carlos Fernandez Guzman had his sights set on a law degree and worked at a bank to earn the money for law school. But after he learned how to convert a small amount of cash into a gold mine, law school became a distant memory. “When someone explained to me that I can take this and turn it into this, I redirected my focus to finance,” Fernandez Guzman said at his office on Brickell Avenue. “Accounting was good but finance is a good fit.” The longtime Miami Lakes resident is the white knight of struggling financial institutions which, among his other accomplishments, recently earned him a place in Miami Dade College Alumni Hall of Fame. The enshrinement ceremony took place on April 3 at Hilton Miami Downtown. Fernandez Guzman said the honor was so special since his family was there and accepted the award from a man who he venerates as a self-made man, MDC president Eduardo Padron. “I think so highly of Padron,” he said. “He’s a dear friend and

it was so special to me to receive the award from him. I am truly humbled and honored.” Fernandez Guzman attended Miami-Dade College after he graduated from Belen Jesuit Preparatory. His father died when he was a teenager and decided to stay home closer to his mother instead of enrolling in a college out of town. “Miami Dade College is your first step to success,” he said. While studying marketing and finance at Florida International University, Fernandez Guzman worked as a national and correspondent accounts manager at Southeast Bank. He later worked for Consolidated Banks for 10 years but left the banking industry for a while since he no longer was able to build a strong relationship with his clients, which paled in comparison to the commodity portion of the banking business. After helping companies that were struggling financially, Fernandez Guzman accepted a proposal to retool American Savings and kept it from insolvency. Instead of staying on board, he returned to his own business but later embraced an offer to rebuild Bank United, which he

CARLOS FERNANDEZ GUZMAN said the government blamed for the 2008 economic meltdown. According to published reports in 2009, BankUnited was a high-profile casualty of the banking crisis, its problems stemmed largely from its forays into risky housing loans. The bank specialized in an exotic type of mortgage made to people living outside the U.S. who wanted to buy property in Florida. But Fernandez Guzman said Bank United was not at fault and pointed to its mark as once again the most profitable bank in the state of Florida.

According to the Federal Deposit Insurance Corp., the Miami Lakes-based bank reported a profit in the first quarter in 2017 of $66.2 million, moving ahead of St. Petersburg-based Raymond James Bank, which had been the most profitable bank in Florida for the previous two quarters. “We got blamed for something we didn’t do,” he said. Despite the success of Bank United, two banks turned him down for their President and CEO positions because of the blame for causing the economic crisis. So, since Fernandez Guzman has a knack for rebuilding companies and banks, he asked for a financial institution that was in the worst possible shape, Pacific National Bank. “I wanted a bank that the government was angry at, and a bank many thought that couldn’t be saved,” he said. “In 2010, I got Pacific National Bank back on its feet.” The private commercial bank was acquired by four Greenwich, Connecticut investors in 2014, and expanded for the first time since it started over 30 years ago to Coral Gables, Pinecrest and Aventura. At one point, Pacific National Bank was ranked 23rd in

terms of assets among South Florida-based banks with a reported $378.9 million. Fernandez Guzman said he’s passionate about his job and he loves to help people accomplish their dreams. But his biggest award extends beyond his banking office. As chairman of the Chapman Partnership in conjunction with the Miami-Dade Homeless Trust, Fernandez Guzman helps less fortunate people bounce back on their own feet. The organization focuses on empowering the homeless to achieve self sufficiency and independent living. Miami Lakes has been Fernandez Guzman and his family’s home for more than 30 years. He and his wife raised their three children here, and he was president of the Miami Lakes Optimist Club where they played sports. Fernandez Guzman remembers the cow pastures and watched Miami Lakes become a full-fledged city. “It’s like watching a child grow,” he said. “We have the best parks and good families and friends. The Grahams did a fantastic job with the community and it is unparalleled to any other city.”

Preview of May 1 Miami Lakes Town Council meeting The Miami Lakes Town Council held its May 1 regular meeting, where lawmakers were expected to approve two ordinance and a host of resolutions including business contracts. • Lawmakers were expected to give their initial approval for an ordinance to create a provision in the town’s code for proper paint colors for commercial and industrial buildings. The ordinance stems from Councilmember Marilyn Ruano’s proposal to address standards for architectural and designs for commercial buildings, where some structures can be painted different colors such as hot pink, purple and lime green. The Town’s Planning and Zoning Board passed an ordinance in April for the town to create a color palette for the buildings to reflect the city’s code for architectural designs and painting of structures. • Council members were expected to give their initial approval for an ordinance for the One-for-One Policy, which would delete obsolete provisions of the town’s code when a new regulation is adopted to eliminate the requirement of 12 copies of plans subject to a site plan public hearing as a companion item to the color regulations on business, industrial and commercial areas. • Lawmakers were expected to approve a resolution which authorizes a project to be added to the town’s Transportation Master Plan and to provide funding through the budget to extend the westbound outer left

turn lane on N.W. 154 Street by 180 feet approaching N.W. 77 Avenue to provide for more queuing capacity for southbound Palmetto traffic and throughput capacity for westbound traffic. The project is expected to cost $350,000. • Council members were expected to approve a resolution which authorizes the Town Manager to execute two contracts for grounds maintenance services for Miami Lakes Optimist and Royal Oaks parks. The town awarded the threeyear contracts to Brightview Landscape and Green Source Landscape and Sports Turf for a total of $738,970 a year. • Council members were expected to approve a resolution which instructs the Town Manager to apply for an FDOT County Incentive Grant Program for the N.W. 59 Avenue Roadway Extension and Redevelopment project for $4 million. Council members also approved a resolution to support the county’s donation of the property located at 6100 N.W. 153rd Street, to Miami Lakes as part of the project. • Council members were expected to approve a resolution for a proposed charter amendment to extend council members’ term limits from 8 to 12. The amendment will be placed on the November ballot. • Council members were expected to approve a resolution that authorizes a work order to R.J. Bear and Company for construction engineering and inspections services for the town’s Safe Routes to School program for Miami Lakeway North/South Project in an amount not to exceed $80,000. • Council members were expected to authorize the Town Manager to piggyback off Pembroke Pine’s contract with FPL Security Services in amount not to exceed budgeted funds to purchase security guard services for the town’s special taxing districts. The contract calls for Miami Lakes to spend about $800,000 a year for the services.

Lakes lawyer Nayib Hassan runs Boston Marathon THE MIAMI LAKER

By David L. Snelling The Miami Laker staff Even the torrential downpour couldn’t stop Nayib Hassan from crossing the finish line at this year’s Boston Marathon. The Miami Lakes resident was among the 30,000 plus runners who competed under rough weather conditions, as the 500,000 rain-drenched spectators on hand cheered

them on during the 26-mile journey. The event was a life-long dream of Hassan, who trained for 20 weeks to prepare for the world’s oldest annual marathon, which started in 1897. The event’s course runs from Hopkinton in southern Middlesex County to Copley Square in Boston on Patriots Day, a state holiday in Massachusetts on the

Pictured (from left) winning pairs were Dave Oliver and Janet Lieberman (1st place); Edith Fish and Gitta Kastner (2nd place); and Brenda Williams and Pat Blomberg (3rd place). The Duplicate Bridge Club meets Mondays at 11:45 at Mary Collins Community Center and welcomes new players and members. third Monday in April. The 40-year-old burly criminal defense lawyer said he thought about quitting the race but found the strength from his wife and spectators to cross the finish line in 5 hours and 30 minutes. “At times I wanted to give up,” he said. “But I couldn’t since this was on my bucket list. It was amazing running in the marathon.” At the finish line, Hassan was greeted by his wife, his biggest cheerleader, and the crescendo of spectators, who congratulated him for completing the race. “As soon as I finished, the emotions came out,” he said. “I’m witnessing a finish line in front of me, I believed I can complete something when I put my mind to it, especially in those weather conditions. My wife was there and it was just a great feeling.” Hassan, who ran in mini marathons in Miami and Orlando, said the spectators from different parts of the world such as France, Canada and Holland, played a role in his effort to finish the race. He said they handed him cups of beverages during his entire run and shouted words of encouragement. Boston’s hospitality, Hassan said, left a lasting impression on him. “Boston caters to the runners, at the airport terminals and the race, so many people showing

love,” he said. “It was nice running into a lot of people along the way. During the race, there were people every step of the way screaming at you to finish the race. The whole town of Boston was great and the race can’t compare to any other race I’ve run in.” Hassan started running in marathons in 2006, including the Miami Mini Marathon and Disney Mini Marathon. But the Boston Marathon is the “Granddaddy” of all marathons and Hassan made it a goal to compete in New England’s most widely viewed sporing event. After he was invited to compete in the race, he trained in Miami Lakes, where he ran about 50 miles a week. Hassan, who has an affinity for weight lifting, said he lost 20 pounds to give him a better shot at competing, engaging in better eating habits and cycling. Hassan said he still plans to run in the Miami Mini Marathon every two to three

Mater Lakes Academy principal Rene Rovirosa honored by Fla. Tax Watch Principal Rene F. Rovirosa of Mater Lakes Academy (MLA) was named one of the top nine principals in the State of Florida by Florida TaxWatch. On April 19, Florida TaxWatch held their Principal Leadership Award dinner, and amongst the three nominees in the high school category, he was awarded the top principal. Florida TaxWatch is an independent, nonpartisan, nonprofit taxpayer research institute. Florida TaxWatch established its Principal Leadership Awards Program in 2014. The criteria used to name the top three principals per grade division (elementary, middle and high school) is not done through a nomination basis, but it is data driven. Florida TaxWatch bases its criteria on data received from the Florida Department of Education, using assessment scores, learning gains, and the percentage of students that are English Language Learners (ELL), Special Education (SPED) and economically disadvantaged and their progress. Mater Lakes Academy had a 4 percent increase in learning English and Language Arts and a 14 percent increase in learning Mathematics. Mater Lakes Academy exceeded both the state and district percentage of proficiency at 71 percent. “I am honored, there are no

Shula’s Golf Club hosts Game of Thrones tourney Since its opening in 1963, Shula’s Golf Club, then known as Miami Lakes Country Club, has hosted an annual memberguest tournament. Each year, the event had themes like Country Western, Irish, Mardi Gras and countless others. This year was like no other, with the popular “Game of Thrones” TV show as the theme. For three days, 28 teams of members and their guests competed for prizes in five different skill flights each named after the houses in the popular TV show: House Stark, House Targaryen, House Lannister, House Baratheon and House Tyrell.

David Marks named new boxing coach at Shula’s Athletic Club THE MIAMI LAKER

After three days of golf, food and fun, including a final-day five team shootout, long-time member and clutch putter Miguel Salguero and his very skillful guest Jorge Iglesias from the House of Baratheon were crowned champions of the 2018 Shula’s Golf Club member-guest tournament. The fun did not stop there. As Director of Golf Kenny Fill served as master of ceremonies for the dinner and awards session inside Shula’s Steak house, two special guests, Tyron Lannister and Daenerys Targaryen, mingled with and posed for photos while carrying on medieval conversations.

By Kayleen Padron The Miami Laker staff David Marks may be new at Shula’s Athletic Club, but he has almost 50 years of experience in boxing. Marks was a professional boxer up until the 1970’s, but has continued his passion for the hobby long since then. He’s taught around the globe, and has made his way to teaching the sport at Miami Lakes. Marks began his journey teaching at the Canal Zone Penitentiary in Panama in the early 70’s where he was temporarily assigned as a corrections officer. Before that, he turned pro in the mid 60’s, even boxing in Panama in the years before he began working for the prison. “When I walked into my first day at the penitentiary, all the cons knew me,” reminisced Marks. “Boxing is a big deal in Panama. A lot of them saw me fight before,” Warden Walter E. Trout decided to include Marks in an experimental boxing program for the inmates. Soon enough, the program progressed to include U.S. Army boxers and even world champion professionals who participated in sparring and boxing exhibitions SHULAʼS GOLF CLUBʼS Game of Thrones event featured with the prisoners. Once the Panama Canal Princess Daenerys Targaryen, guest Juan Munoz, Tyrion Lannister and member Frank Rivas.

Treaty was ratified, Marks moved to Israel in the late 1980’s. There, he taught boxing to kids in a bomb shelter that was later turned into a gym. “It was nice,” Marks said. “It was really beyond what I’d imagine.” Shortly after, Marks moved back to the states and continued teaching at the South Florida Boxing gym facility in North Miami Beach. He was elected into the Florida Boxing Hall of Fame as a coach, and worked as a community service officer in the Hollywood Police Department. “I was retired, but I didn’t really want to retire,” Marks laughed. Currently at Shula’s, Marks teaches all possible age groups, and trains according to the necessary difficulty level. Anyone can join, and anyone can learn

Jose Marti MAST names three for Silver Knights THE MIAMI LAKER

Jose Marti MAST Academy (JMMA) announced its Silver Knight Award nominees for the 2017-2018 school year. One Silver Knight and three Honorable Mentions in each category will be selected by a panel of independent judges on April 24 at Jungle Island. The Silver Knight winners will be announced at a ceremony on May 17 at the James L. Knight Center in Miami. Silver Knight winners will receive a $2,000 prize and the Honorable Mentions winners will receive $500 each. Andrea Llamas Sanchez became the school’s first ever Papa John's Pizza Orgullo de Nuestra Juventud (Which means ‘Pride of our Youth’ in English) Winner, and is the General Scholarship Silver Knight Award nominee. Her major project was cofounding a non-profit organization, Silver Knights Take Action. She has over 2,000 hours of community service and through her nonprofit has provided students at JMMA with affordable options for uniforms through used uniform drives.

Additionally, her organization has aided students in developing countries like Panama, Colombia, and Cuba. Her organization has been able to donate educational goods like uniforms, notebooks, pencils, pens, erasers and other types of school supplies. Sanchez has also fundraised money through her nonprofit organization to help St. Jude Children's Research Hospital and the American Cancer Society in the hopes that children battling cancer will have the opportunity to complete their education. She has an unweighted grade point average (GPA) of 4.0, and is in the early admissions program at Florida International University because she’s exhausted the math and science curriculum at JMMA. Chelsea Escarmant is the Science Silver Knight nominee and was nominated because of her contributions through the Key Club. She is the president of the club, and has spent over 375 hours knitting and crocheting scarves, hats and sleeping mats for the elderly and people

ANDREA SANCHEZ in need. Miami residents and a nursing home in Colombia have benefitted from her service. Despite having to overcome obstacles like being the primary care-giver to her autistic younger brother, and taking the most rigorous curriculum a student at JMMA could enroll in, she found the time to give back in a way that others would not think of. Aaron Valdes Lobeiras is the Athletics Silver Knight nominee and is a varsity athlete on the Barbara Goleman badminton team and was on the swimming team last year. Although he attends Jose Marti MAST 6-12 Academy, he is eligible to play sports at his home school. Although he does not have transportation to participate in these sports, he committed himself to the team and would get to practice either through public transportation or making the 2.8 mile walk.

He is not physically attending JMMA, because he is in early admissions at Miami-Dade College. However, he left 15 students who are able to run the operation and he’s already appointed his predecessor for when he heads off for college.

By Guadalupe Cabrera Special to The Miami Laker On April 5 through 8, Key Club members at Barbara Goleman Senior High School (BGHS) achieved great success at the District Education and Leadership Conference (DCON) that took place in Orlando. The BGHS club took home 16 awards in a variety of fields, including seven awards in the Distinguished Club section, first place in the Bronze Division for Key Club Service and second place for their project display board. DCON allows students to run for leadership positions. Chang Lee and Huzaifa Bin Abdul-Rahman were among those to run for district board positions. These positions also come with extensive training, which include various workshops to attend. Some are in financial literacy, club budgeting and member recruitment. “Key Club is a family. It’s a very demanding club, so it can be tough sometimes. We have experienced so much with each other that we now have a bond which makes it even harder to say goodbye to the seniors this year,” said Bin Abdul-Rahman.
