89th Street Sings a New Tune as Sid Tepper Street

Dozens of family members, friends, neighbors and Town staff and officials attended a street naming ceremony honoring the late Sid Tepper, a 35-year resident who was famous for writing hundreds of songs, including 50 for Elvis Presley. Sid and his wife Lillian moved to Surfside in 1969 with their five children. His song Red Roses for a Blue Lady, was an international hit that climbed to number 3 on the Billboard charts. Sid was featured as a Surfside Star in the May 2015 Gazette, a month before his passing. Surfside proclaimed his 90th birthday Sid Sid Tepper’s close-knit family pose at the sign, including four of his five children Tepper Day.

Construction Work Days and Hours Did you know that the Town of Surfside has an Ordinance that regulates the days and hours of construction work? All residents, businesses, developers and contractors are required to adhere to and follow the Ordinance requirements. Going forward from the date of the adoption of this new Ordinance, all construction activities that require a building permit, such as electrical, plumbing, mechanical, roofing and structural work, are restricted to working on Monday through Friday, from 8 a.m. to 6 p.m., and are prohibited on Saturdays, Sundays and all federal holidays. There are some exceptions, such as work related to infrastructure and utilities, roadways, other public right-ofway construction, minor repairs and maintenance activities inside of private dwelling units as well as painting with manual tools (no commercial sprayers). The Town Manager may authorize construction activities outside of the established work days and hours on a case-by-case basis. For construction projects over 10,000-square-feet in size or valued over $1 million in cost, contractors are required to post notice signs at the property to state that the property is an active construction site. In addition, the contractor is required to provide contact information for public complaints and concerns. The Town’s Noise Ordinance provides additional rules and regulations as to noise that is generated from construction activities. In general, loud, excessive or continuous noise is prohibited. If you have any questions concerning construction work days and hours, then please contact the Town’s Code Compliance Division by calling (305) 861-4863, extension 230.

Blood Drive on Wednesday, January 11 The Surfside Police Department is hosting a blood drive in conjunction with the One Blood organization. The event will take place on January 11, 2017 from 12 noon to 4 pm. The Blood Mobile will be located in the Town Hall parking lot. Miami-Dade Public Library Open in Bay Harbor Islands A new Miami-Dade Public Library has opened within the Morris N. Broad Community Center at 1175 95th Street in Bay Harbor Islands. Surfside residents can use their library cards at the new location. The Library offers a a diverse collection of reading and audio/visual materials, as well as free WiFi and internet access, highspeed desktop and tablet computers and 21st century learning tools such as a SMART Table interactive learning center and gaming area for children and teens. The Center and Library are located on the ground floor of the 95th Street parking garage and are open TuesdaySaturday from 10 a.m. to 6 p.m.

Farmer’s Market Moves to Haulover Marina Park Surfsiders looking for fresh fruits and vegetables can find a Farmers Market on Fridays beginning on December 16 from 12 noon to 5 p.m. This is the Farmer’s Market that was previously in Bay Harbor Islands. The market features fresh baked bread, fresh produce, olive oils, coffee, flowers, butters, jams, pizza, honey, dog treats and more. Mayor Dietch Signs Pledge to Reduce Gun Violence

Mayor Daniel Dietch recently signed a pledge for the Do Not Stand Idly By campaign with school representatives and parents. The campaign seeks to engage community leaders to work with gun manufacturers to reduce gun violence through safety technologies, distribution and assisting law enforcement. Surfsiders Change A Family’s Life with Thanksgiving Gift Last November, Surfside residents Joe and Susan Miranda were watching a Neighbors 4 Neighbors television program profiling the Cosenos family. Neighbors 4 Neighbors is a non-profit organization helping families in South Florida who are in need. The family was struggling with their 8-year-old triplets – Ellie, Gigi and Carmina – all suffering with brain tumors. Because of medical bills, the family had sold much of their belongings, including their second car. Now, the reporter said, the father uses their only car for work and the mother does not have transportation to take the three girls to doctor’s appointments. “My wife and I both looked at each other and we both nodded. We needed to do something, there was no thinking about it,” said Joe Miranda. “I immediately called and left a message.”

Within 24 hours, Joe and Susan donated their used car, a Kia SUV, to the Cosenos. They also paid all the expenses for the family to visit Legoland in Orlando. The family got the good news on Thanksgiving morning. “I was in shock really. I couldn’t believe it,” said the triplets’ mom, Kim Coseno about getting the phone call. “We can get the girls to the doctors now.” Joe put new tires and brakes on the car before handing over the keys to the Cosenos. He also wants to make sure the triplets have a special Christmas this year. “I’m excited about meeting them. It was meant to be,” said Joe. The Coseno family is also overwhelmed by Joe and Susan’s generosity. “We’re blessed and just truly thankful they came into our lives,” added dad Joe Coseno. “We get to meet them and the things they’ve done for us. It’s truly amazing. It’s changed our holiday and our life.”

Commission Action at the December 13 Meeting Voted to approve the following Resolutions: 1. Authorizing the Town Manager to execute an agreement between the Town of Surfside and the State of Florida, Office of the State Attorney for the Eleventh Judicial Circuit of Florida to reimburse the state for the cost of State Attorney prosecution of certain criminal violations of the Surfside Code. 2. Reapproving holidays and one personal day for all employees; approving two additional personal days for full time employees with the exception of employees represented by the Fraternal Order of Police. 3. Accepting the Florida Department of Transportation (FDOT) grant for high visibility enforcement for pedestrian and bicycle safety in the amount of $5,000 for Fiscal Year 2016-2017 beginning October 1, 2016 through September 30, 2017. 4. Urging Bal Harbour Village to work cooperatively to address impacts identified by the Town of Surfside in development related to Bal Harbour Shops expansion; directing the Town Clerk to transmit a copy of this resolution to the Village Council of Bal Harbour Village and the Bal Harbour Village Manager. 5. Approving Title VI Program Plan, in accordance with Title VI, 42 U.S.C. §2000D, Civil Rights Act of 1964, as required for the Town of Surfside to receive federal pass-through funding from MiamiDade Transit Agency. 6. Approving Calvin, Giordano & Associates, Inc. (CGA) Work Authorization No. 99 (Town of Surfside Evaluation and Appraisal Amendments, CGA Proposal No. 16-9054) in a total amount not to exceed $57,565 from the General Fund. 7. Approving the sculpture by Pablo Atchugarry presented by the applicant, Chateau Ocean, LLC for the 94 Street end project. 8. Repealing Resolution No. 2007-1792 “Approving and Adopting Rules and Procedures for Committees created by the Town Commission”; providing that committees shall be governed by Town Code Article VI. “Rules of procedure for Town meetings.”

9. Urging the Florida Legislature to increase protections for residents of condominiums during the condominium termination process; directing the Town Clerk to transmit a copy of this resolution to the speaker of the Florida House of Representatives, the President of the Florida Senate, the Governor of the State of Florida and the Florida League of Cities.

Voted to approve the following Ordiannces on Second Reading: 1. Amending Chapter 90 “Zoning”, and specifically amending section 90-2 “Definitions” and 90-33 “Alteration or enlargement of nonconforming structures” to permit alternatives for the redevelopment of existing architecturally significant buildings in the H120 Zoning District. 2. Amending Chapter 54 “Offenses and miscellaneous provisions” Division 2 “Noise”; specifically amending section 54-78 “Prohibited noises”, and 54-79 “restricted noises– classified; enumerated”; creating section 54-80 “Enforcement by code compliance officer; notice of violation; warnings; responsibility to provide current address”; creating section 54-81 “responsibility for compliance.” 3. Amending Chapter 14 “Buildings and building regulations”; specifically amending Section 14-29, “Permit fees” to provide for a consistent calculation for the cost of construction for permit fees and for the right of the Town to conduct an audit of the construction costs at the conclusion of construction. 4. Amending Article VI - “Rules of procedure for Town meetings”; specifically amending sections 2-201, 2-202, 2-203, 2-204, 2-205, 2-206, 2-207, 2-208 and 2-209. 5. Amending Article II - “Local business tax receipt” of Chapter 70 “Taxation” and specifically amending “Section 70-41 “Local business tax schedule” to include beach furniture operation; amending Chapter 86 “Waterways”; Article II, “Public beaches”, specifically amending Section 86-26 “Definitions”; creating Section 86-30 “Beach furniture”; creating section 86-31 “Beach furniture permit”; creating Section 86-32 “Indemnification and insurance”; creating Section 86-33 “Violations, civil fines and penalties.” SURFSIDE GAZETTE JANUARY 2017


POLICE BEAT Marianne Durante is Newest OFFICERS OF THE MONTH Investigation Results in a Surfside Police Officer Quick Arrest

Chief David Allen swears in Marianne Durante as the Police Department’s newest Officer. Marianne Durante, a Surfside resident with a long association with the Town, was recently sworn in as the newest officer in the Police Department. A former teacher who grew up in Egypt, Marianne became a Surfside resident in 2002 and raised her son in the community. She earned a Bachelor’s degree in Special Education in 2012 and worked with students with disabilities. In 2015, Marianne decided to pursue a dream of working in law enforcement. She worked full time while attending the police academy at Miami-Dade College. She graduated in September and was awarded the Harry Everest Overall Outstanding Trainee award. Congratulations and welcome, Marianne!

Surfside Police Department participated in a Police Officer Assistance Trust (POAT) event at Aventura Mall on December 3 to collect donations for spouses and children of fallen officers. POAT is an organization dedicated to the law enforcement community of Miami-Dade County by providing assistance to the officers and their families in the times of hardship and personal crisis. During the holiday season, POAT volunteers collect at malls throughout the County. Volunteering was Officer Bryant Luke and Assistant to the Chief, Dina Goldstein along with officers from other departments. JANUARY 2017 SURFSIDE GAZETTE

Surfside Detectives Sergeant Marian Cruz, Kemuel Gambirazio and Edward Carrasquillo were named Officers of the Month for their efforts in arresting a doorman for lewd and lascivious conduct and providing drugs to a child. The detectives answered a call from a mother who had discovered her child was “sexting” with their building’s doorman.They reviewed the text messages and confirmed there were explicit conversations between the subject and the juvenile about sex and drugs. Detective Sergeant Cruz and Detective Carrasquillo conducted a controlled text message conversation between the child and the subject. The subject offered to provide marijuana to the child. The following day, Detective Carrasquillo and Detective Gambirazio approached the subject in the parking lot and found marijuana inside his shirt pocket. At the Police Station, the doorman gave a full confession, including providing drugs and sending sexual text messages. The subject was arrested for lewd and lascivious conduct on a child, electronic transmission harmful to minors, possession of controlled substance (Xanax) and possession of marijuana. Detective Sergeant Marian Cruz, Detective Edward Carrasquillo and Detective Kemuel Gambirazio’s skillfull and professional investigation resulted in a confession and arrest in just four days.

PARKS & RECREATION Parks and Recreation Partners to Create a Butterfly Garden Surfside Parks and Recreation Department has partnered with Friends of Oleta Community to create a Butterfly Garden at the Surfside Community Center. Members of the Teen Scene program and other volunteers helped to plant nearly 100 specific species that attracts butterflies, which are critical to the pollination process. Once completed, the trail will include signage, markings and information. It is located on the south side of the green space area east of the Community Center. The Butterfly Garden trail is a multi-community project that links together areas that attract butterflies within the larger urban areas of our region. PARKS & RECREATION Cool Fun at Winter Extravaganza!

Surfside children and families enjoyed climbing a cool pile of tropical snow, playing games, dancing, holiday characters, cookies, bounce house, arts and crafts, face painting and more at the Community Center’s 2016 Winter Extravaganza. The annual event is part of the Town’s holiday tradition and coordinated by the Parks & Recreation Department.

Dogs and Owners Gather at Park for P.U.P. LUV Event Families and pet owners attended a doggie etiquette training event held at the Town’s Paws Up Dog Park at 93rd Street and Byron Avenue. Guest speakers provided helpful information on dog health and safety, dog park rules, how to maintain a pet-friendly environment and kids and pets. Thanks to Leby Gonzalez of Rocco’s Pack Pet Services, veterinarian Dr. David Carmona and Magaly Madrid of EverydayHUMANE.

Families Find Finding Dory at the 96th Street Park ‘Movie Under the Stars’ November 18 was a perfect evening to be outside and under the stars. Surfside families and friends came to the 96th Street Park with their blankets and lounge chairs to munch on popcorn and enjoy the popular Disney movie Finding Dory.

December Brunch Bunch Features Speaker The December Senior Brunch featured Dr. Ranjan Duara, a neurologist and the medical director of the Wien Center for Alzheimer’s Disease and Memory Disorders. He provided a talk on healthy brain aging.
