Introducing the New GEN-XR and PNP-70!

GEN-XR

PNP-70

The GEN-XR is our easiest to install reduced steering system. The GEN-XR allows for 0-100%, and anywhere in between, reduction to the steering. The steering effort can easily be adjusted on the fly by the dealer and locked in. The GEN-XR is a plug n play installation on the Toyota Sienna and Chrysler Pacifica only needing 3 wires to be soldered (ignition and CAN).

The Plug N Play 70 offers 70 functions for the Pacifica with a simple box that plugs into the OBD-II. The functions are controlled via a tablet. An option is available for Toyota but is not fully plug n play and thus requires tapping a few wires.

Kudos to Ability Center’s Monique McGivney and the Industry & Public Relations (IPR) Committee for their great work in overseeing this summary and all of the association’s IPR efforts. after all, a DRS/CDRS doesn’t have any control over whether there is a qualified installer in his or her area…or does s/he? I’d like to ask you to try thinking about this dealer/installer thing in a whole new way. Where you, as the DRS/CDRS, don’t have circumstances dictated to you, but you actually exert some influence of your own. Sound intriguing? I hope so. It’s a paradigm change, but it IS do-able…and it all starts with you. The notion is basically this: Somebody is turning the wrench. What do I mean by that? I mean that the auto adaptive solutions you prescribe are being installed by somebody. There is no magic installation fairy waving a wand to get the equipment into the vehicle; therefore, somebody is turning the wrench. And that somebody is a person or business that you trust— otherwise you would never refer your clients there, right?

Accessible Canada Act Passes Canada’s first national accessibility law is now in force. Bill C-81, known as the Accessible Canada Act, came into force after passing through Parliament this summer. The law looks to proactively identify and remove, as well as prevent, barriers to accessibility in areas that fall under federal jurisdiction. It will apply to Parliament, Crown corporations, the federal government, and private sector businesses under federal jurisdiction, such as banking, telecommunications, and transportation.

Mobility Way By Mike Savicki — Afterburner Communications NMEDA CONSULTANT

Holly Koester’s road to automotive mobility takes her (almost) everywhere (almost) every day.

is Holly Koester. If you do

one thing every Wednesday of the month, she does four different things depending on which week it is. Ditto for Mondays, Tuesdays, Thursdays, and Fridays. And if you look forward to the weekend as a time to rest, relax, and unwind, Holly looks at it as a time to get even more active; she competes at wheelchair and handcycle races anywhere and everywhere around the country, or stays local and handcycles along many of the paths and bikeways near her suburban Cleveland home.

Here’s how she fills her week.

She has been a K–8 substitute teacher for 25 years and, as of late, she’s the newly elected president of the Paralyzed Veterans of America’s Buckeye Chapter. She has completed a wheelchair marathon in all 50 states and is now doing it all over again, this time with her sister, Joy, who is competing alongside her in half marathons.

Following her August 1990 spinal cord injury, Holly added hand controls and a bike rack to the convertible Mustang she had recently purchased. Along with another wheelchair-using disabled veteran friend, she figured out a way to load two wheelchairs and, sometimes, a racing wheelchair too, for daily workouts. But it was complicated, time consuming, and unsustainable. “We had quite the system in place, but it was my mom,” Holly shares, “who watched me lift wheelchairs in and out over and over again, told me I was going to mess up my shoulders, and suggested I get a van.”

5 Questions With...

CONGRESSMAN GALLEGO By Amy Schoppman NMEDA DIRECTOR OF GOVERNMENT RELATIONS A Harvard University graduate who later joined the Marine Corps and served in Iraq with combat unit Lima 3/25, Ruben Gallego was elected to Congress in 2014. During his time in the House of Representatives, Congressman Gallego has demonstrated a noticeable dedication to veterans-related issues including reducing the burden of student loan debt on veterans, increasing veterans’ employment, and providing additional benefits to wounded or deceased veterans and their families. A member of the House Armed Services Committee, the Congressman and his staff have been incredibly helpful as NMEDA continues its work with the Department of Veterans Affairs (VA) to implement the Veterans Mobility Safety Act (VMSA) as well as address the VA’s chronic Prompt Payment Act violations. Recognizing the innovative and service-minded nature of NMEDA’s membership, Congressman Gallego has been especially engaged in NMEDA’s efforts to address outstanding VA invoices and to improve the timeliness and accuracy of the VA’s payment process so that automotive mobility equipment dealers can continue ensuring veterans with disabilities receive safe and appropriate equipment and services as they pursue automotive independence. Learn more about Arizona Congressman and Marine Corps veteran Ruben Gallego in this edition of “5 Questions With…”

1. What inspired you to run for public office? A lot of things went wrong when I was in the Marine Corp serving in Iraq with Lima 3/25. I lost my best friend to an IED attack because we didn’t have the proper armor, and we knew it. We later lost another group of Marines from my company for similar reasons. When I returned home, I saw the problems so many of my fellow Marines and service members had accessing care at the VA, readjusting to civilian life, and left with the physical and mental scars of war. QAP dealers have always been, and will continue to be, free to sell any conversion that complies with appropriate FMVSS standards, regardless of the manufacturer’s NMEDA membership status. However, this change to QAP is to emphasize that dealers are selling only vehicles that are fully compliant with federal regulations. NMEDA is proud to support, encourage and advance a healthy, open marketplace for safe, compliant wheelchair accessible vehicles. The association believes the ability to offer clear, objective, and reasonable paths to compliance, and the widest possible range of compliant manufacturer products, is essential for the success of our mobility dealer members and the satisfaction of the public they serve. And while these dealers may have thought (as I somberly stood there and said, “I don’t know, but I agree with you and we will look into making this better.”) that maybe I was full of something stinky, I promise you that those words from our dealers sunk in. Ultimately, the committee concluded that a label alone stating compliance was not sufficient evidence that a newly converted vehicle was compliant with federal law, nor was a statement on the company website or brochures, or even an email or letter from a company officer stating they were compliant. So what now? What would be acceptable evidence? And how would we be able to enforce compliance? The committee decided that someone independent of the company performing the conversion needs to verify compliance. So then, who is capable of verifying this compliance? Obviously, the existing NMEDA Compliance Review Program (CRP) engineers would be one, but to offer a solution for companies who do not

QAP STRAIGHT TALK wish to use NMEDA CRP, we decided that a qualified third-party test lab or independent engineering firm could be alternate choices. Great, so the committee now knows what objective evidence to ask for, and also how that evidence can be verified, but then the question came up: How will the dealers know that a vehicle conversion they are about to sell is accepted? And to this end, it was decided there has to be some sort of

necessary to proceed, the committee worked on the draft language for the new rule and in December 2018 moved the proposal to the NMEDA board of directors. Then at the January 2019 board meeting, the QAP committee proposal was discussed and sent back to committee with comments. Finally, after continued meetings and tweaking of the policy and the need to establish a communication and roll-out plan that would provide the dealers with ample time to comply, the QAP committee sent a final version back to the board and the new rule on regulatory compliance was approved by the board on September 19, 2019.

The Business Dictionary (www. businessdictionary.com) defines objective evidence as “Information based on facts that can be proved through analysis, measurement, observation, and other such means of research.” What this means is that a quote on a website stating that a conversion has “been crash tested and meets all safety standards” is not good enough, that an email from a sales person stating that “all of our conversions have been crash tested” is not acceptable, and a statement in a company brochure

conversion.

What this means is that all conversions you’re selling from MQAP accredited manufacturers are goodto-go, you don’t have to do anything else. This is because NMEDA has done all of the work in reviewing the data and analysis for the conversion. This is obviously the simplest path for our dealers. “However, for newly converted vehicles procured from a source that is not MQAP accredited and not listed on NMEDA’s website, the dealer shall be in possession of, and able to produce, evidence of regulatory compliance; typically F/CMVSS.” Now, this is where it gets a bit trickier. As a non-profit trade association, we are always careful to not restrict trade. That means that NMEDA cannot force dealers to buy only from NMEDA members. Dealers are always free to sell whatever vehicles or conversions they wish. The only change is that now NMEDA wants to make sure that the conversions being sold from these non-MQAP sources are safe and compliant with federal safety standards. In other words: Have they been crash-tested and accepted? So, if the new conversion you are selling is not posted on the

standards that apply to a conversion.

In Summary

You can use that list to understand

QAP has a new rule. Beginning July 1,

what data is going to be required. “Acceptable forms of evidence may include: a test report summary from a NMEDA authorized third-party test lab or engineering firm stating compliance to all applicable regulatory standards, or an acceptance statement from NMEDA CRP, based on all established, objective criteria.” As stated previously, and this is important, if the conversion you are selling or about to sell is currently posted on the NMEDA website none of this matters, we have all the data we need and you are good-to-go. The only time this matters is if you want to sell a conversion that is NOT posted. If the conversion is not posted, we will need to have evidence that the conversion is compliant (i.e., crashtested). Obviously, if such evidence is available, we would prefer it be made available to NMEDA so we can post said vehicle.

2020 all new vehicle conversions sold must be posted on the NMEDA website. The postings can be found at: www.nmeda.com/safetyreviewedvehicles. As the new rule does not go into effect until July 1, 2020, dealers have ample time to stop new orders and move all non-compliant vehicles out of inventory. That also gives the conversion companies who are not posted the time they need to conduct testing if needed and submit crash-test results to NMEDA for acceptance. Time is of the essence. If you routinely sell conversions not meeting the new criteria, now is the time to act so that there is no interruption in your business after July 1, 2020. NMEDA believes that all conversions should be safe and compliant with federal law and that this policy supports that belief. We hope you feel the same way. ---

“In the absence of either form of compliance evidence, delivery of the converted vehicle to the customer is a rule violation that can impact a Dealer’s QAP status.”
