A very warm welcome to Livinglife 2020. For some readers, it’s ‘welcome back’ as you’ll know that Livingroom previously produced 10 editions of Livinglife a few years ago. For our new readers – we hope you enjoy the publication. When we made the decision in early 2020 to bring back Livinglife we could never have foreseen what was to come. Our spring publication date was revised several times as a result of the global coronavirus pandemic. We feel exceptionally lucky to have been able to publish Livinglife at all this year – and that’s testament to our islands, their governments and their people. The Channel Islands are beacons of stability and security which has been further cemented in 2020. Whether it’s political unrest around the world, the Brexit process in the UK, or a global pandemic – the islands are fortunate to navigate the choppy waters and enjoy relatively smooth sailing. You can read about the islands’ responses to coronavirus, and why they were great places to be then as well as great places to live in the long term.

My team have shown enormous dedication to a busy market and worked tirelessly to match buyers and tenants to their new homes, listing record-breaking numbers of properties for vendors and landlords alike. Since we expanded to Jersey in 2018 the agency has continued to grow and I’m delighted that we’ve been able to add proven quality and experience that will enable us to fulfil our mission to be an ethical, award-winning company that brings an inspired customer experience to the Channel Island property market. I’d like to finish by saying ‘thank you’. Thanks to my team for their positive attitude and hard work, thanks to the clients who have stuck by us through a challenging year for everyone, thanks to those key workers who truly made a difference throughout lockdown and beyond, and thanks to the governments of Guernsey and Jersey for working so hard to get us through the pandemic as well as they have. I’ve been proud of our island communities and the ways we’ve pulled together to make the most of living on our beautiful island homes. The Channel Islands: stability and security


Anyone who lives in the Channel Islands knows how lucky they are. The golden beaches, stunning cliff walks and charming towns speak for themselves; but the intangible benefits of the islands are also enormous and perhaps sometimes underestimated. In recent times the islands’ stable political systems, independent governments, sound economic foundations and good international standings have all come to the fore as a sharp contrast to the uncertainty and upheaval around the world. Throughout 2020 these benefits have been even more obvious, as the world continues to grapple with the ongoing coronavirus pandemic. The islands’ governments have presented strong responses to the crisis, taking quick decisions and protecting islanders as best they can. Of course the Channel Islands have felt some of the catastrophic effects of the pandemic, but the decisive approach has mitigated the impact and given islanders a sense of reassurance.

Great places to be The lockdown period was characterised by fear for many people. Uncertainty will always breed a feeling of worry and media reports certainly emphasised the seriousness of the situation. The sense of community has rarely felt stronger, the appreciation for our key workers was palpable, communication took on a renewed sense of importance and the bonds that bind us became more important than the differences that divide us. People of Guernsey and Jersey truly came together to support each other, to provide for each other and to ensure that we all got through the lockdown together. As we heard of severe lockdown situations around the world the exercise/outdoor time provided for by both governments certainly felt like a blessing. Not everyone was lucky enough to enjoy what many on the islands could – long walks in tranquil lanes, swimming in the sea,

running on the cliffs and buying fresh produce from hedge veg stalls. Those activities were enhanced by a certain peace of mind. Amid the worry came a sense that the islands’ governments had clear strategies. Borders were closed and the islands were able to protect themselves from the very worst of the virus. The security of our island homes had never been more apparent.

Great places to live The virtues of the islands may have been more appreciated during the lockdown period, but the islands represent fantastic places to live at any time. Mature and stable economies underpinned by the financial services sector ensure that there is a wide range of recruitment in both islands with ample opportunity to work internationally. The housing stock is comparable to the best offered anywhere in the world. The education systems are top-tier and offer a number of private and public options. The islands are safe places to bring up young families and offer the benefit of an enviable work/life balance; you can leave your desk and be on the beach lighting a barbecue or jumping in the sea within 15 minutes. That’s just the start; vibrant gastronomic scenes, shops selling homemade and locally produced goods to quality international brands, world-class beaches, island hopping to rival the Mediterranean, storied histories, active lifestyles, friendly people, unique cultures – the list goes on and on. 2020 has been a challenging year, but in the Channel Islands there’s still plenty to be thankful for.

2019 successes at The Negotiator Awards In November we were extremely honoured to pick up three gongs at The Negotiator Awards. The Negotiator is the premier UK trade publication for the estate agency industry and has been running for 33 years. Its awards were first held in 2008 and estate and letting agents can enter free of charge. They are open to all agents throughout the British Isles. We were immensely humbled as our Jersey office was named Britain’s ‘best new agency of the year’. We also won a silver award for our bespoke websites and were highly commended in the ‘estate agency of the year (2-4 branches)’ category. Winning Negotiator Awards matters to us because they are judged by impartial industry professionals and are an inclusive awards initiative where everyone is equal. To be recognised on this scale was a privilege and a testament to the impact we made with our Jersey launch and our first year of operating on the island.

The International Property Awards The awards celebrate the highest levels of achievement by companies operating in all sectors of the property and real estate industry and winners are determined by a panel of expert judges from across the property world. The awards programme is open to residential and commercial property professionals from around the globe and there were more than 1,900 entries in 2019. That number makes it all the more amazing that we walked away with four awards in total, including the award for Best Estate Agency Marketing for the whole of the United Kingdom. As well as this national award, we won the marketing award for the Channel Islands region as well as the Best Estate Agency  Single Office awards for both Guernsey and Jersey.

Representing our islands Being recognised at any time, whether it’s by a satisfied client or an awards ceremony, is always rewarding but as an agency that takes promotion of the properties we list and the islands we represent seriously, it means a huge amount to win national awards. Being recognised on a national scale is a great feeling but it’s also positive for our vendors, our islands and of course our hard-working team – who work tirelessly to live our values of offering exceptional client service through creativity and open and honest communication. We’re proud to be the Channel Island estate agent and relish any opportunity to promote the islands on a wider stage – awards are a fantastic way to do this.

The impact that businesses can make with their charitable activity can be especially pronounced in communities like the Channel Islands. In a difficult year for our islands this is doubly true and it’s been inspiring to see the community pull together to face up to the adversity presented by the global coronavirus pandemic. For us at Livingroom philanthropy has always been a key part of our ethos and a crucial means of supporting our island homes. On behalf of our vendors, and in their name, we make a donation for every home sold to a local charity or community initiative. Since we launched in 2006 we’ve donated over £1m to local causes and know we’ve made a real difference. It is no exaggeration to describe the housing market in Jersey as ‘booming’, with the average property priced at £563,000 in Q1 2020, even exceeding the average of £482,000 in budget-busting London during the same period. Statisticians in the island monitor the market by type of housing, with latest figures showing a sustained, strong demand for two-bedroom flats. The average is now priced at £427,000 – the highest mean price ever recorded for this property class. Looking towards a family home, the average three-bedroom property comes in at £649,000 (£17,000 higher than Q4 2019). Meanwhile, four-bedroom homes dipped below the million-pound mark to an average of £934,000 which is £117,000 less than at the end of 2019. Unlike Guernsey, Jersey’s housing market isn’t split into Open and Local Market listings. However, there are benchmarks on the value of properties that high-value residents can buy; namely (as of September 2020) a minimum of £900,000 for an apartment and £1.75m for a house. Incoming residents must also contribute at least £145,000 per year in personal income tax payments and sustain an annual worldwide income comfortably in excess of £725,000 per year - however this does not guarantee your high-value-residency status and any potential resident/s should contact Locate Jersey to discuss. Contribution to the community is highly desirable; applicants need to show that they will benefit the island in other ways such as by setting up a business, becoming involved in charitable work or contributing interests and knowledge which add to the cultural fabric of Jersey. In addition to ‘high-value-residency’ there are differing entry requirements by bringing a business to Jersey that will add benefit to the local community and workforce. Each application for inward investment is handled by the Population Office and will be subject to comprehensive and individual assessment. Locate Jersey reports that it helped to facilitate the establishment of 18 businesses in 2018, alongside 29 high-value-residency applications, leading to more than 2,000 people being employed through inward investment. The government body also says that the demographic of incoming residents is getting younger, with five-year averages showing that 71% of incoming residents helped by Locate Jersey are under the age of 60. This – and the island’s buzzing nightlife and packed programme of events – firmly bucks the idea that the Channel Islands are purely a desirable location for retirees.

Property-wise, Jersey has it all – from sleek, modern apartments to traditional country homes – and if you have a required skill set then often your role will come with a qualifying housing licence, which will open up your options to buying or renting the home of your dreams. Having launched our Jersey office in 2018, it was named ‘best new agency of the year’ for the whole of the UK at the prestigious Negotiator Awards in 2019. The office continues to grow at incredible pace and, across both islands, we sold £130,000,000 worth of property on behalf of our vendors last year together with an impressive level of agreed lettings. Our Jersey team is expanding again to meet demand, with three additional and experienced negotiators together with a further business support professional and talented creative. A: “I do love living in Jersey but would find it very hard to pick one particular place or view as my favourite. I love our coastline and the variety it offers from north to south and east to west. Rural Jersey is also very beautiful and biking down some of our Green Lanes, discovering new places and lovely homes is always a delight. Stable, Low Taxation Environment Becoming a High Value Resident in Jersey The HVR route is specifically for individuals that can demonstrate a comfortable and sustainable worldwide income in excess of £725,000 on which they would pay 20% income tax. Tax is then levied at 1% on anything in excess of the £725,000.

The decision to grant High Value Residency status is taken by the Government of Jersey’s Housing and Work Advisory Group (HAWAG), who will consider the applicant’s suitability, including reputation, cultural, sporting and potential business contributions to Jersey.

Approval gives you the right to purchase property, live and work/start a business in Jersey as long as you remain resident. Should you leave the Island and domicile yourself elsewhere then you lose that right.

Your move to Jersey For decades, Jersey has opened its doors to a limited number of individuals and businesses attracted not only by the Island’s charm and beauty but also by the many advantages to be gained from its location. Here, Carey Olsen property partner Christopher Philpott summarises some of the key points to consider. How does Jersey’s residential property market operate? Special housing rules have been introduced and developed to aid population control in the Island and to maintain housing supply at affordable prices for locally qualified residents. The legal framework which prescribes an individual’s residential status is embodied within the Control of Housing and Work (Jersey) Law 2012 and its associated regulations. The authorities allow restricted housing access to people who are not otherwise entitled to reside in the Island by granting residential status to certain categories of people. The category which is available to prospective high-net-worth individuals, whose residence is justified on social or economic grounds, is known as the ‘2(1)(e)’ status or ‘high-value’ residency.

What houses are available to those granted 2(1)(e) residential status? Only certain properties in Jersey meet the criteria for being available for purchase by people approved for high-value residency. The current position is that these high-value properties, which include many of the finest properties in the Island, should be at least £1.75 million for a house and £900,000 for an apartment; however, consultation is currently underway that would likely see these amounts increase. Most local property agents offer a discreet and confidential service to assist in finding the perfect home for new residents and Carey Olsen can assist in providing introductions. Once a suitable property has been identified, our property team can give clear and comprehensive advice on the acquisition process, from start to finish. Whether a property is acquired directly or through a holding company, a significant amount of research and drafting is required to ensure that a client’s position is protected as a purchaser under the unique Jersey conveyancing system. Our property team in Jersey includes some of the most experienced lawyers and conveyancers in the Island. With considerable experience in Jersey property negotiations, we have a particularly strong record in assisting successful 2(1)(e)/ high-value residency applicants in their residency application and their subsequent property acquisitions.

Who decides who gets granted 2(1)(e) residential status? Relocation to Jersey on this basis is at the discretion of the Jersey Housing Minister and there is no prescribed limit on the number of high-value residency qualifications that the Minister may grant each year. Each application is considered on its own merits, with key considerations to include: • the applicant’s likely contribution to tax revenues • the business/social background of the applicant • the applicant’s likely business activities (if any) in Jersey • any other non-economic factors from which the Island may benefit if the qualification is granted. Successful applicants retain their residential status as long as they remain resident in Jersey. The conditions of 2(1)(e) residential status may include a stipulation of minimum property purchase price or rental, and a requirement that only one property be purchased and owned at any given time. Performance in Guernsey’s Open and Local Markets is at impressive levels. 2019 was the busiest year for completed transactions since 2007 and the transition to 2020 has shown enormous scope to surpass figures even further. The enforced business interruption caused by COVID-19 placed a huge impact on all of our lives. Without a crystal ball and amid a global pandemic nobody would ever have predicted the market bounce-back since Guernsey relaxed restrictions. In the six weeks from the beginning of May to mid-June, an amazing 78 properties were placed under offer by Livingroom’s Guernsey team and since then, the numbers have considerably multiplied as we continue to regularly agree sales within short periods of time from listing. Pricewise, the average value of a Local Market property in Q1 of 2020 stood at £444,150 which is 4.4% higher than the same period in 2019. On the Open Market, you can now expect to pay an average of £1.365m for a property with sustained demand in recent years from new island residents. As the UK has grappled with a succession of General Elections, Brexit and the effects of coronavirus, increasing numbers of HNWIs have considered the island as a safer and more stable jurisdiction. With low rates of crime and unemployment, high rates of life expectancy and 1,875 hours of recorded sunshine being a huge benefit for those seeking to enjoy the great outdoors – the pull factors are obvious. Recent figures from the government body Locate Guernsey reinforce the increasing popularity of the island as a des res. In the first five months of the year there was a 20% increase in enquiries from individuals looking to relocate to the island from as far afield as Canada. Guernsey was the first part of the British Isles to relax lockdown based upon collated evidence and the ability to contain an environment surrounded by water. The success of the island’s measures can be attributed to a scrupulous track and trace policy and 14-day quarantine for people arriving in the island. The island’s positive response to how it has contained COVID-19 has made waves globally and we are certainly feeling the effects across our team, as quality Open Market homes are proving to be hugely desirable. In response, we have expanded our Open Market team and increasingly used our multi-media capabilities to help clients based outside of the jurisdiction to view homes without having to cross borders. In fact, we have sold properties across both Channel Islands based on virtual viewings alone, which shows just how keen buyers are to make these beautiful islands their home.

Our market prediction for the remaining months of 2020 will depend on travel and accessibility. While Guernsey remains in a COVID-free state, we are very aware of the need of some prospective residents to sell their existing homes within regions that may be in a more complex state. According to Coutts, and rather unsurprisingly, activity in London’s high-end housing market dropped dramatically across April, May and June due to the coronavirus-caused lockdown. But their London Prime Property Index for Q2 2020 shows rays of hope for a turnaround and many have welcomed the UK Chancellor’s attempt to boost the London and wider UK housing market through the announcement of a temporary holiday on Stamp Duty on the first £500,000 of all property sales in England and Northern Ireland. In recent weeks, Cheshire and local areas in and around Greater Manchester have recorded some of the fastest-moving housing markets in England – all of which bodes well for those looking to sell up and relocate to the Channel Islands, providing that coronavirus remains in a manageable state. For some, renting Open Market homes is a solution for an immediate move that looks likely to see a market sector rise - provided quality homes are available to meet the discerning needs of a wealthy younger demographic and their families. Historically, there has been a notable void in Guernsey for well-designed and smartly presented rental stock for newcomers. Gone are the days when coloured bathroom suites and aged kitchens are acceptable to a new breed of savvy international tenants. We can foresee great buy-to-let potential in this sector over the next 12 months. Guernsey’s stability and safety has never been more prevalent and in our opinion the island has never been more desirable as a place to live.

Your move to Guernsey An increasing number of wealthy individuals, entrepreneurs and financial services principals have chosen to move to Guernsey with their families in recent years, with some also relocating their businesses to the Island. Here, Carey Olsen property partners Jason Morgan and Davey Le Marquand look at some of the practical issues to consider when contemplating a move to Guernsey.

(Guernsey) Law 1994. The Population Law requires everybody aged 16 and over who lives and/or works in Guernsey to hold either a certificate or a permit relevant to their residence. Certificates are issued to lawful householders – people who then have a right to live and work anywhere in Guernsey. There are three types: 1. Open Market Certificates (Part A for private home, Part B for hotels, Part C for residential care or nursing homes and Part D for a house in multiple occupation); 2. Established Resident Certificates; and 3. Permanent Resident Certificates. In broad terms, anyone can live and work in Guernsey indefinitely if they live in a Part A, B, C or D house on the Open Market Housing Register and they are the lawful occupier of that house. Open Market Certificate holders can accommodate immediate family members, while Part A Certificate holders can also house extended family members. A permit is issued to a person whose ability to live and/or work in Guernsey is conditional. This may include working in a specific job, living with a specific person or other appropriate conditions. When a permit holder completes eight years of continuous lawful residence on the Local Market, they can generally obtain an Established Resident Certificate. This gives the holder the right to live and work in Guernsey, provided the holder remains in Guernsey from this point until they have accumulated 14 years of continuous lawful residency.

What is the choice of property like on the Open Market? How does Guernsey’s residential property market operate? There are two designated classes of housing in Guernsey: Local Market and Open Market. The Local Market has significantly more properties on it and is available for occupation by people either born and brought up in Guernsey, or those qualified to live in such accommodation for other reasons, such as by virtue of their employment circumstances, or in some cases their potential economic contribution to the Island. The Open Market is therefore available to all those people who do not have the particular qualifications enabling them to live in Local Market accommodation.

Less than 10% of the current population lives on the Open Market, which has a stock of approximately 1,700 properties. As the properties are fewer in number and occupancy controls are less stringent, Open Market property prices tend to be higher than Local Market ones but the Open Market also includes many of the Island’s most desirable houses. Which market would be available to me? The Open Market is usually the most obvious option for people coming to live in Guernsey who do not hold local residential qualifications. That said, recent changes to Guernsey’s population management regime, combined with Guernsey’s entrepreneurial visa scheme, offer increased scope for people moving to the Island to live in Local Market properties. It is also worth noting that there are no financial criteria that need to be fulfilled to be able to live on the Open Market, making the process of moving to Guernsey easier than in some other jurisdictions. Ultimately, the right to occupy property on either market is controlled by domestic population management legislation, which also has a bearing on who can work in Guernsey. The Population Management (Guernsey) Law 2016 (“the Population Law”) came into force on 3 April 2017 and replaced the previous Housing (Control of Occupation)

Living across borders: what to consider when managing your assets Whether it’s a new lifestyle, professional opportunities or a warmer climate, many factors may influence your decision to relocate or spend part of the year abroad. Whatever the reason, you need to be organised to live across borders. Jean-Luc Le Tocq, Head of Private Banking at Julius Baer in the Channel Islands, highlights the complexities involved with international wealth planning, particularly for high-net-worth individuals (HNWIs). HNWIs are on the move more than ever before. In 2018, 108,000 HNWIs are reported to have changed their location, compared with 95,000 in 2017, according the 2019 Global Wealth Migration Review published by AfrAsia Bank and research partner New World Wealth. The Channel Islands are part of the global migration story, with Locate Jersey and Locate Guernsey together reporting almost 50 such relocations to the islands during 2019.

3 - Ensure that the journey is comfortable for the entire family Family members dotted across multiple countries can make for complex cross-border wealth planning. Marriage (and, sadly, separation and divorce) that involves multiple jurisdictions raises questions regarding wealth preservation such as division of assets on separation, pre-nuptial agreements, maintenance orders and matrimonial property regimes. Be realistic about your personal circumstances, engage in timely, regular and open dialogue with family members and your advisors about wealth-planning matters, and make adequate provision for the future. By planning well ahead of time, you will be giving yourself a head start to avoid pressured decision-making, so all that remains to be done is to enjoy the journey and the next exciting chapter of your life. What to remember before packing your bags:

1 - Familiarise yourself with the map Start by getting an overview of your wealth. This helps prepare for the pivotal moments in life, taking into account your family’s personal circumstances and cross-border planning implications for your different assets, such as real estate, valuable chattels (art and jewellery), business interests (especially family businesses), pension and retirement funds and insurance or life policies. What worked in a previous jurisdiction of residence may need a refresh upon relocating.

2 - Taxation is your constant travel companion A major challenge of migration is taxation. Each jurisdiction has its own types and rates of taxation and there may even be punitive consequences when exiting one country and entering another. Be sure to consider the fiscal, legal and succession-planning implications in the country where the asset is located, not only where you are resident. These might include ownership taxes, including on acquisition, sale or transfer of the goods. Local rules can limit how you pass on your home (and other assets) within the family and liquidity events, such as the sale of a business, can have unexpected tax consequences.

The property market in Guernsey has had a very interesting few months post lockdown. Transactions are increasing and we are seeing many properties selling more quickly. The figures speak for themselves with the total number of property transactions to end of July at 343 compared to 421 for the same period last year. Not bad when we consider the impact of COVID-19 and our conveyancing court being closed for close almost months. In fact we are at very similar amounts when compared to 2018 (342) and 2017 (335). Market sentiment is very positive and we have been busy helping clients move up the property ladder. This is largely down to clients wanting to move house (having spent nearly 3 months in lockdown) to have more living space, bigger garden etc. Non-purchase bonds (which are equity releases or mortgage moves) are also on the up. Year to date there have been 192 compared to 266 for the same period last year. 2018 & 2017 saw 193 and 212 transactions over the same period. What is interesting however is the total value of non-purchase bonds year to date is just under £100m compared to £117m last year. In 2018 and 2017, the figures were £60m & £76m respectively. These figures are evidence of the amount of us that are switching lenders to avail ourselves of better rates. Borrowing has never been so cheap and with the Bank of England base rate at 0.1% not likely to increase in the short term, now is a great time to review your mortgage. We have seen a significant increase in enquiries and have been able to help many clients move their mortgage and make significant monthly savings. Some lenders even help towards the cost of moving too by providing a free valuation and contributing towards bond fees. As an example, we can move a £300k mortgage for as little as £500. This cost can also be included in the borrowing amount. We have also seen increased enquiries from clients wanting to borrow for home improvements, a result of being in lockdown for so long. Clients want to modify their home to accommodate working from home, something that many of us expect to be doing more in the future, or simply build an extension to give themselves more space. Guernsey is a lifestyle choice offering safety, security and stability, ease of entry and fantastic Open Market properties. Julian Turian from LTS discusses. Right of Abode It is easy to move to Guernsey. Individuals with a British passport have an automatic right of abode as do EU/EEA nationals, although the latter need to apply for pre-settled status as a result of Brexit. EU/EEA nationals arriving post 31 December 2020 will need to meet new post Brexit rules. Non-British/EU/EEA nationals may be able to reside by virtue of the Islands Investor or Business “visa” system.

Tax System Guernsey has no capital gains, inheritance, wealth or gift tax, no VAT or GST and no minimum tax requirement. Income tax is fixed at 20% with tax caps available. Resident companies are subject to a standard rate of 0%. The tax year is the calendar year. Married couples and those in civil partnerships are taxed jointly although Guernsey is moving towards separate taxation.

Those “principally” or “solely” resident are subject to tax at 20% on worldwide income, subject to tax cap elections.

Guernsey Tax Caps Guernsey residents may by statute cap their annual tax liability, viz; • Open Market Cap of £50,000. Available for the first four years of Guernsey residence. Requires the purchase and occupation of an open market property within 12 months of tax residence. The purchase must generate minimum document duty of £50,000 (property cost of £1.4m) • Annual tax cap of £130,000. This is for non-Guernsey source income only. Guernsey source income remains subject to 20% tax. Guernsey bank interest is not considered Guernsey source. • Annual tax cap of £260,000. A global cap utilised by individuals with substantial Guernsey source income. Guernsey rental income is outside all tax caps. Married couples, including civil partnerships claim a joint tax cap and pay one cap.

Individual Tax Residence There are three types of tax residence status. All broadly based on the number of days spent on the Island in a tax year. A day is counted by presence at midnight. A broad overview of residence rules follows. Resident Only An individual is “resident only” if they are in Guernsey between 90 and 181 days during a year and at least 91 days in a second jurisdiction. They are subject to Guernsey tax at 20% on worldwide income. Alternatively, they may elect to pay the “Standard Charge”, currently £30,000 per annum. The standard charge payment covers all tax due on non-Guernsey source income and tax due on the first £150,000 of Guernsey source income. Principally Resident An individual is “principally resident” if they spend 182 days or more in Guernsey in a year. Solely Resident An individual is “solely resident” if they are “resident only” and are not present in a second jurisdiction for at least 91 days in the year.
