Living life

Welcome to the 12th edition of Livinglife magazine

SIMON TORODE CEO, FOUNDER LIVINGROOM PROPERTY

This edition of Livinglife marks a new beginning for Livingroom and our relationship with media. You’ll know that we’ve always been a forwardthinking company that leads the way and embraces change, and this year we’re taking the significant, and environmentally friendly, step of going paperless by the end of 2024. We realise this is a bit of an experiment. We’ve been known for our eye-catching advertising and high-quality print publications - both of which set the bar for Channel Island estate agents - so taking a leap to digital-only is pushing the boundaries. But we don’t grow or move forward if we don’t try new things, and it’s in that spirit that you’ll exclusively read this on a screen. There’s more about why we believe this is the right move for Livingroom on pages 6 & 7.

A market reset 2023 was an interesting year for the Channel Island markets, as the return to pre-COVID levels of activity combined with rising interest rates to result in a lower number of completed transactions.

But the islands’ markets are resilient, and properties still changed hands if priced realistically and marketed well. Looking ahead to 2024, economists are predicting falling interest rates and a broader recovery from various shocks, which will help to stimulate the markets. Since our launch just over 18 years ago, we’ve learned that the islands are always on the move and need sound advice. It’s always been the privilege of our profession to provide guidance to people making some of the biggest decisions of their lives, and we are humbled to have been trusted by thousands of islanders over the years. We’re embracing change in 2024, but our core values of being an agency that puts the customer first, and leads the way with stand-out design and visual media remain key to who we are. You’ll see plenty of evidence of our dedicated in-house creative team’s ability to present any property in its best light throughout Livinglife, and we hope you enjoy this latest edition. We look forward to working with you in 2024 and helping realise your property dreams and ambitions.

We know the islands. We’ve walked their cliff paths and explored their valleys. We’ve enjoyed their beaches and swam, fished and kayaked in their waters. We’ve attended their schools and sent our kids to them too. We’ve eaten in their restaurants and drank in their bars. And all of that means that we’re the perfect people to appraise, market and sell the properties that so many want to call ‘home’. Livingroom was conceived in the Channel Islands, specifically at the kitchen table of our Founder, CEO Simon Torode, and is the only born-and-bred Channel Island estate agent with a presence in Guernsey and Jersey. We’re so proud to call these islands home, and our team has more than 200 years of collective experience working in the property sector. We bring knowledge, passion and a keen eye for detail to every transaction we work on and use technology to support our offering and make the process as hassle-free as possible for our vendors, landlords, buyers and tenants. Livingroom is proudly independent and will always work for our islands and for you, our clients.

LIVINGROOM IS THE ‘ONE AND ONLY’ CHANNEL ISLAND ESTATE AGENT.

Our

paper-free pledge It’s time to do things differently. At Livingroom we’ve never been afraid of leading the way; we embrace revolution and change the way we do things. In 2024 that means saying goodbye to print media. When we launched Livingroom in 2006 we made our visual identity an intrinsic part of who we are, and that’s not going to change. The way we present vendors’ and landlords’ properties will remain market-leading thanks to our dedicated in-house creative team. But times have changed, and digital is the new normal. Our intention is to become a paperless company by the end of 2024.

That means minimal print advertising this year, and seriously reducing the amount of printing we do in our offices. We’re doing this because it’s good for our islands, and we believe it’ll spur us to be even more creative with how we market properties. Print advertising isn’t working We’ve long grown tired of the Groundhog Day nature of printed ads – list and repeat. So many publications are being delivered to properties that do not request them, they never get read and end up in the bin and then become the islands’ concern as they need to be recycled or, worse, go in landfill. You might know that we’ve previously produced our own print publications, which we remain extremely proud of, but we won’t be printing these anymore either. It’s time to have an open and honest conversation about print readership. It used to be the case that properties were advertised in a local paper to help them along in the sales or lettings process, but those days are gone.

The digital revolution is now accepted by all – regardless of demographic. Our website, previous iterations of which have been recognised as the best in the business by the International Property Awards, records over 3,000,000 hits per year. That’s a lot of eyeballs on properties we’ve been trusted to sell or let. A better way The possibilities afforded by digital are endless, and if you’ve ever bought, sold or even searched for a house with Livingroom you’ll know how advanced our technology is. Our subscribers receive instant notifications of suitable properties that match their search criteria (the minute they are listed) and our vendors know exactly how their promotion is going via a secure log-in area that tells them how many times their property has been viewed online, the average time a user is spending on their listing and new vs returning users. This is factual information, devoid of misinterpretation and demonstrates a level of transparency in an industry where our competitors cannot offer the same level of innovation. Here’s to progress.

Pêtchi in Jersey Native produce cooked over fire

Pêtchi has been open just 7 months, but Co-owners Joe Baker (who is also Chef-Patron) and wife Charlotte are fizzing with energy and excited to keep developing their offering. The grill restaurant, which cooks everything over live fire using wood & Holm oak charcoal, is located in a grade II listed building in Liberty Wharf. A building that’s had many lives from abattoir to Jersey Tourism, to the Harbourmaster’s office, and that to this day retains the flagpole where the Liberation flag was originally hoisted. The interior of Pêtchi is modern and paired back with a large open kitchen featuring a hand built grill by Rhys Allen (who has made grills for some of London’s top restaurants) and a Gozney woodfired oven for cooking signature Pêtchi dishes including their puffed grilled flatbreads topped with pecorino and herbs, hand-dived wood-roasted scallops with elderflower and spruce and their lobster rice. The large dining room emphasises craftsmanship with lots of wood, Ercol chairs and tables and large poured concrete passes and bar tops sprinkled with Jersey seashells.

Pêtchi is all about the food, and Joe has been fastidious in creating a menu that is not only hyper-local but treats these ingredients with respect. He believes ‘Jersey has some of the most pristine ingredients in the world right on our doorstep, our intertidal landscape, climate and clean waters mean we can get unbelievable produce.’ Pêtchi is inspired by the Basque reverence for their produce and culture, Joe worked in San Sebastian and the couple visit the city often. Charlotte reflects, ‘It’s just so cool there - one of our favourite places is Bar Nestor, a world-famous pintxos bar that serves only incredible ex-dairy beef, tomatoes and padron peppers. They also serve a beautiful tortilla but you have to queue at 11am to put your name down for it. By doing less they can give so much more.’ One of Pêtchi’s most-loved dishes is their own Ex-Dairy beef which is Jersey-breed, sourced from Europe. As Joe puts it, ‘We serve a beef chop, which is portioned before each service and stored in our dry-ager. It is simply the best beef we have tasted. It’s grilled hard over Holm oak, comes rare with a beautiful crust, served with just a lick of smoked olive oil.’ The couple have decided to offer an A la Carte menu with the onus on sharing and flexibility. Joe & Charlotte are thrilled to have already received recognition from the Michelin guide, who noted the ‘fabulous, flavour packed dishes’ and interesting wine list. But ultimately it’s keeping a buzzy, lively restaurant full of happy people that matters to them most. ‘It’s always been about the joy of cooking & sharing that, looking at this island we love and trying to showcase it in the best way possible through the restaurant’s food, atmosphere & people.’ To book a table at Pêtchi visit www.petchi.je/reservations or call +44 1543 733223. A new level by Jersey’s first female distiller. - and member of the Livingroom team!

Introducing Sea Level Eco Distillery, a harmonious blend of craftsmanship and sustainability, guided by the skilled hands of Sarah Gaudion, Jersey’s pioneering female distiller. In the heart of Gorey Village, Jersey, our small-batch gins embody the coastal vitality of the island, showcasing a commitment to conscious and traceable sourcing methods. From the outset, Sea Level Eco Distillery made a firm pledge to zero waste, which is reflected in every aspect of our production. Plastic-free and environmentally conscious, we proudly donate 1% of our sales to supporting ocean-based charities in Jersey, fostering a deeper connection to and helping to preserve the maritime heritage that inspires us. At Sea Level Eco Distillery, sustainability is not just a commitment; it’s a way of life. Our gins, crafted in limited quantities, prioritise locally sourced ingredients, supplemented by home-grown botanicals. This approach ensures not only a distinctive taste but also a minimal carbon footprint, with an emphasis on reducing transport distances.

The ethos of sustainability extends seamlessly to our packaging, where every detail is considered for environmental impact. From responsibly sourced cork to eco-friendly labels, we collaborate with suppliers who share our unwavering commitment to sustainability in their own businesses. Unveiling the efficiency in elegance, our recycled glass bottles redefine perfection. In a process that welcomes imperfections, not a single bottle is disregarded for aesthetic defects, setting us apart from an industry that often discards up to 25% of manufactured bottles. Post Consumer Recycled (PCR) glass, the core material of our bottles, significantly reduces air and water pollution during production, making Sea Level Eco Distillery a beacon of sustainable innovation. As a drinks manufacturer we pride ourselves on using natural ingredients, and our garden is a haven of sustainable practice. We grow and cultivate botanicals for our gins without the use of chemicals or pesticides, and by recycling, re-purposing and reducing material wherever we can. Our green waste nourishes our next crop of botanicals, and any excess water nurtures our fruit and vegetable garden. Giving back is important to us. That’s why Sea Level Eco Distillery actively contributes to the community by donating 1% of our sales to Healing Waves in Jersey. This amazing charity provides safe access to water sports for individuals with conditions or disabilities. In the world of spirits, Sea Level Eco Distillery stands as a beacon of sustainability, where each sip is a celebration of craftsmanship, commitment, and care for our planet. Join us in the pursuit of exceptional gins, and let every moment be a toast to the beauty of sustainability in every drop. Comfortable, natural, beautiful.

Harry and Hannah Hambrook, founders of Maison Henry, share why they decided to make the most comfortable sofas. We started with a simple dream, to make comfortable furniture that makes a positive difference to people’s lives. The journey to creating Maison Henry started when we couldn’t find comfortable and practical furniture locally. Our belief from then was simple, create utterly comfortable furniture without compromising on any part of the product. We wanted to create furniture for homes that would cope with the practicalities of everyday life, which is why our preference is to use loose covers. They can be easily removed and dry-cleaned. We also make spare sets of covers, so you don’t have to buy a new sofa when you change the room’s colour scheme.

Acknowledging that buying furniture can be complex, we offer a range of services, such as design advice, floor planning and home consultations. If you are unsure about the ideal measurements or fabric, to get the most out of your room and your furniture, we can help. Simply send us the floor plan and measurements of your space, and we will create different configurations from there. Whilst on a family holiday to Tuscany, we visited an artisanal mill that makes the most beautiful natural linen. We fell in love with the textures, colours, and durability of the fabric - it’s now our most popular! To ensure that all parts of our furniture are sustainable, we work with a family run business in the South of England, who make our sofa frames from sustainably sourced hardwood – which are guaranteed for thirty years. As a result, our furniture isn’t just comfortable, they’re designed to last a long time. For 2024, we will be working with local artists to showcase artwork within the showroom, to promote the talent of local artists whilst making the most of the amazing wall space the showroom has to offer. If you would like to showcase art with us, please get in touch. If you would like try our furniture, our showroom is based in St Peter, Jersey. If you live in Guernsey, we offer virtual consultations and can arrange an overnight stay for you in Jersey at one of the our superb hotels. Torc. Crafted by hand to last a lifetime.

Torc sculpt everything by hand from their studio in the British Isles creating beautiful pots and outdoor elements. Their one-off designs are beautifully crafted and made by hand to last a lifetime. They make unique distinctive statements for both home and commercial settings. Their USP would be scale and texture as they make some of the biggest pots in the world (if not the biggest!). Their unique skill set and the material that they work in allows the designs to be very adventurous and push the boundaries of what has been achieved historically for these types of products. They are always developing new shapes and products to add to the range and are willing to work with designers and end-users to create one off pieces that are really special. Annually they have a big presence in the RHS Chelsea Flower Show Gardens as well as a trade stand which in 2023 saw an unprecedented number of visitors queuing to view the stand and in particular their elliptical shaped water bowl measuring 3m long and taking centre stage!

Torc are currently developing a range of hot tubs and ice plunge baths which will make a welcome addition to the currently mass produced plastic offerings which sit in many gardens around the world. They are proposing to offer a sculpted work of art as opposed to the aforementioned. Spas and hot tubs will be available in various shapes and sizes as well as bespoke offerings for those clients with that extra special design in mind. Working alongside a talented team of artisans this family run business really specialize in textures, scale and bespoke design. The design side of the business is well worth considering with landscape architects and garden designers appreciating the wealth of expertise this company has to offer. Torc are often commissioned to provide planter designs and outdoor furniture for both commercial and residential spaces. When we are surrounded by so much that is mass produced there is a real appreciation for hand-crafted objects created out of organic materials which appeal to our senses. They shape them by hand, layer by layer, enhanced by texture and finish until they take on their own unique form and because of this no two pieces are ever quite the same. Torc use various products to reduce their carbon footprint such as recycled glass and bi products of the steel and power industries – reusing waste! The addition of these materials increases the overall strength of the product, decreases permeability and therefore water requirement. www.torcpots.com

Rouge exceptional pairing in Guernsey. Rouge Wine & Cheese opened its doors in December 2019, at the time it was the fourth part of the Red series of hostelries including Red, Rosso and Tinto. It was an interesting beginning with Covid arriving weeks later. Fortunately we were able to provide deliveries of cheese, charcuterie and wine which really got our name out there and turned us all into packing experts and delivery drivers – sometimes we were delivering to 40 or 50 houses a day.

Thankfully normality resumed and we could focus on the original concept: to provide a unique collection of small to large producer wines of all styles and flavours, top-quality artisan cheese and charcuterie, and our incredibly popular toasties. All of these can be enjoyed as takeaways or in our small, cosy seated area. A unique feature of Rouge is that any wine is available to sit down and drink in our relaxed setting for just £12.50 corkage on top of the shop price. With almost all staff having WSET Wine qualifications there is always an expert on hand to help navigate the more-than-100 wines on the shelves, whether it’s for a special gift, an evening in, or to enjoy in the bar with a gorgeous curated plate of meats and cheeses from all over the world. The ability to travel again after Covid has reinforced our commitment to finding unique and incredible wines. We attend tastings whenever we can and visit as many vineyards as possible to bring the best wines to Guernsey’s tables and cellars. It’s a tough job, but someone has to do it. We put as much effort into the food as we do into the wine; we take great care to source cheese and charcuterie from some of the country’s best producers and suppliers

such as The Fine Cheese Company, La Fromagerie, Brindisa, Bermondsey Ham and Cheese, and former Masterchef champion Dhruv Baker and his incredible Tempus charcuterie. And then there is the ever popular Tasting Table on the little mezzanine floor. A beautiful round oak table sitting up to eight guests. The only table available for reservations, this is where we offer a myriad of wine tastings. We’ve staged A Journey Through Italy, pitted Old World vs New World, France vs Spain, Cabernet vs Merlot and many more. Reserve a tasting and you might just discover a new favourite. Available until the spring arrives and the weather warms up, our Raclette Evenings are the perfect winter warmer and a taste of Alpine life delivered straight to Guernsey. Or simply, get some friends together and make your own journey through the wine shelves and food menu. So for a small, cozy, little shop and wine bar there is a lot to enjoy at Rouge. Call +44 1481 700224, visit our website www.rouge.gg or just pop in to have a chat about all things wine and cheese.

National Trust Jersey protecting natural beauty, rich wildlife and historic places.

With its dramatic coastline, rich marine environment, hedge lined country lanes, distinctive architecture, and its history and heritage, Jersey retains a strong sense of place, identity and above all beauty. The National Trust for Jersey seeks to champion and protect the distinctive qualities of Jersey so that it remains at the very heart of Island life. We do this through vigilance, sustainable management and by promoting and increasing awareness of the value of our beautiful countryside, unrivalled coastline and historic environment to our economy and to our very way of life.

The threats to Jersey’s wild places, wildlife and historical buildings are as real today as when the Trust was originally established in the 1930s. Being a local self-funding charity totally independent of the States of Jersey, we are wholly reliant on memberships, donations, and bequests for the funding of our essential programme of repair works, ongoing maintenance, and conservation management. Without our many members and volunteers, we would simply be unable to carry on with our important work.

It costs nearly £4,000 each day to look after the lands and properties in our care for the benefit of our Island. Many people don’t realise that the footpaths they walk upon, the meadows and woodland where they walk their dogs, or the beautiful places they visit and enjoy will be owned and maintained by the Trust, Your membership will help us to manage over 1600 vergees of land, maintain and repair over 30 historic buildings, deliver 19,000 metres of footpaths, and most importantly to undertake vital conservation work so that we can protect Jersey’s flora and fauna such as red squirrels, puffins, marsh harriers, choughs, and Jersey orchids. Your support will enable us to create wild flower meadows and to manage our woodlands, coastline, and wet meadows. Your membership also gives us a vital platform from which we can seek better protection for vulnerable habitat and historic buildings at risk of demolition. JOIN US and contribute towards the protection of Jersey’s natural beauty and historic places forever and for everyone. Plus, free entry to the Trust’s properties in Jersey, over 300 National Trust properties in the UK and selected properties worldwide as well as a diverse range of activities and events and reduced rates for the hire of historic properties. Move to Guernsey Livingroom talks to Jo Stoddart of Locate Guernsey

Relocators choose Guernsey for a variety of reasons. Some desire a mild climate, others want a home by the sea in an English-speaking environment; for others the appeal of a flat rate of 20% income tax is the driver, as well as the lack of Inheritance and Capital Gains Taxes. Whatever the initial reason for considering a move to Guernsey, recent arrivals relish the island’s fantastic work/life balance and its friendly and welcoming community. Guernsey residents live life to the full – they work hard but make the time to relax and have fun, to make the most of the island’s natural beauty and the fact that they have so many opportunities on their doorsteps.

Time is your most precious asset, make more of it here. With an attractive tax system, it’s easy to see why your business will flourish. But, with our pristine waters and award winning beaches, have you considered how your family would benefit? This allows them to live in Guernsey indefinitely if they wish to, and they can work or set up a business, or simply live off savings and investments. Once they have arrived in Guernsey there’s usually just a few simple forms to complete and that’s it, residents are then free to enjoy all that Guernsey can offer. Visa routes are also available. Locate Guernsey has the great honour of promoting the island as a destination of choice for personal and business relocation and is on hand to provide free of charge support throughout the relocation process. Staffed by a small team with extensive experience in both the private and public sectors, they are passionate about the island. The team has immediate access to a wealth of information and contacts and its confidential service is always tailored to meet the client’s specific requirements there is no ‘one size fits all’ approach. Locate Guernsey’s support can start at any stage, from an initial discussion about whether Guernsey could be a suitable option for themselves and their families, to answering those burning questions throughout the relocation process. And it doesn’t stop there, the team also offer support to those new to the island and run several settling-in events throughout the year to help relocators establish their networks by introducing them to like-minded people. The South Coast The cliff path network of the South Coast of Guernsey meanders from La Valette for 28.5 miles before finishing at Pleinmont. The south coast cliffs are the largest continuous expanse of semi-natural vegetation on the Island, consisting mainly of maritime heathland and cliff-top grassland.

“The way back to the top is very demanding and probably best walked. This way the true grandeur of the cliffs and wild beauty of the woods and valley can be imprinted upon the memory.” www.visitguernsey.com/experiences/cycling/cycling-routes/cliffs-and-country-lanes

Op Mar The Open Market is the easiest and quickest route to establishing residency in Guernsey for those who do not have any previous family connections with the island or an existing right to live in the Local Market. Approximately 7% of Guernsey’s properties, around 1,600, are on Guernsey’s Open Market Register. They can be found all across the island. Open Market property prices do tend to be higher than Local Market prices but this is a question of supply and demand –

living in an Open Market property allows residency in Guernsey to people who otherwise would not be able to live in the island. The advantage of buying or renting an Open Market property in Guernsey is that you are free to work for any employer, for any length of time – it’s flexible and you are not reliant on a time-limited Employment Permit that employers apply for and secure for specific roles.

Intuitive & accomplished. Amanda first joined Livingroom in 2020 with enviable experience of people-facing roles. As an accomplished negotiator, her intuitive ability to get to the heart of what a client is looking for is a huge asset to Livingroom. Before property, Amanda gained 15 years’ experience in Guernsey’s finance industry specifically in the trust management sector. Amanda is familiar with finding solutions to meet bespoke requirements and applies her problem-solving nature to the island’s property market. Since moving to Guernsey in 2003 – Amanda’s mum is originally from Alderney, so she has strong Bailiwick roots – she and her family have purchased and renovated a number of Open and Local Market homes. This first-hand experience in seeing the potential in a building is valuable insight for our clients and Amanda’s interest in property makes her a reliable and dynamic negotiator in the hunt for the right home. Amanda regularly makes the most of Guernsey’s great outdoors – cycling is one of her favourite ways to see the island – and she enjoys travelling, especially skiing holidays with her family.

The original Ebenezer Church was founded in Sausmarez Street in 1816 then moved to the Brock Road on 10 October 1878. The two churches amalgamated on the Brock Road site and took the Ebenezer name in 1960, when the building was further altered. The first proposals to demolish the building were made in April 1986, when future plans for the Methodist Circuit were discussed. The last service at Ebenezer Methodist Church was held on 26 July 1993. Sophie Turian, Senior Residential Negotiator at Livingroom, said: “It’s been fascinating to watch the development evolve and we’re excited to announce the preliminary launch of Ebenezer. Due to Covid and complexities

with builders, it has taken longer than expected but it will certainly be worth the wait when it’s finished. As you’d expect from the development of an iconic building, the renovations will be done sensitively, and homage is being paid to the intricate decorative detailing. There are going to be some really unique features in some of these apartments and we’re excited to see the finished development. For those interested in purchasing one of the 17 properties in the development, we will be releasing further information over the coming weeks. The information released so far is to provide an indication as to where the apartments will sit in the current market and we actively ask those interested to contact us to discuss the development and their requirements. We expect the development to be completed by May 2024.” Ebenezer breathes new life into a building of architectural importance with stunning, restored character features working in synchronicity with the very latest modern inclusions. Arranged over three floors, the 17 one and two-bedroom apartments are completely unique and designed to provide notably light and spacious living. Externally, the development enjoys allocated parking. Move to Jersey by Kevin Lemasney of Locate Jersey

Livingroom talks to Kevin Lemasney, Head of High Value Residency Engagement at Locate Jersey. Jersey has long been an attractive location for High Net Worth Individuals (HNWIs), their families, and their businesses to move to. It is a wonderful place to live, work and bring up a family offering a true work-life balance in a beautiful, safe and secure jurisdiction. Kevin is well placed to advise those looking to relocate to Jersey having himself moved here from Switzerland with his family in 2001.

Image Copyright Livingroom

Originally from Ireland, he has worked in the UK, France, Switzerland and Jersey and has carried out consultancy work in Greece, Malta, Kenya, Zimbabwe, Ethiopia, Australia and New Zealand. Married to Cora, with two grown-up children, he is a champion of sport, education, culture and community projects in Jersey. He is also a keen traveller, skier, fluent French speaker and a former chairman of the Jersey Rugby Football Club Academy. Kevin maintains that he has the best job in the world, acting as an ambassador for Jersey and a single point of contact for all interested, and established, HNW families. He assists and guides them through the process of applying for residency and works with them on their relocation by providing comprehensive, independent, confidential and free advice throughout the process. Q: Kevin, you say you have the best job in the world – why is that? A: “For me, the way I carry out my role is directly influenced by my own personal experience over the years. I’ve worked in several countries, with a variety of clients of different nationalities and I’ve also relocated to Jersey with my own family, so I know how it feels. You have to understand the unique circumstances each client has when they are looking to move and adapt the process to ensure it is as seamless as possible – some moves are easy, some are more complicated, but my role is to ensure that our client’s experience is smooth, memorable and enjoyable.” Q: So, what happens once they’ve arrived? A: “At Locate Jersey we also believe that our assistance doesn’t end once the client has landed and moved into their new home. We know that a move isn’t complete without a strong support network of friends and contacts, so we provide a friendly after-care service, which includes hosting events and introducing contacts, to ensure our clients are happy and comfortable – we want them to settle and stay.” Q: You obviously enjoy living in Jersey, what is your favourite place or view, and why? A: “I do love living in Jersey but would find it very hard to pick one particular place or view as my favourite. I love our coastline and the variety it offers from north to south and east to west. Rural Jersey is also very beautiful and biking down some of our Green Lanes, discovering new places and lovely homes is always a delight. If pushed for one view in particular, like a lot of my clients the view of Jersey from a returning flight to the Island is always a welcome sight and provides a very comforting feeling of coming home.” Contact Details: Kevin Lemasney Head of High Value Residency Engagement, Locate Jersey T: +44 (0) 7797 783457 E: k.lemasney@gov.je

LEGAL ADVICE IN BVI, CAYMAN ISLANDS, GUERNSEY & JERSEY | ADDITIONAL OFFICES IN LONDON & SINGAPORE

Q&A

Navigating Jersey’s unique property landscape A Q&A with Jeff O’Boyle from Bedell Cristin What makes Jersey property law different from the UK? Our legal system has evolved from NormanFrench customary law, as the Island was actually part of Normandy until 1204. One significant difference is that Jersey doesn’t have a land registry is and the government doesn’t guarantee good title. Instead, it’s the responsibility of the buyer’s lawyer to ensure that the property benefits from a good and marketable title. In practical terms, the biggest change is that contracts are passed in court and only on a Friday – the process is straight-forward and smooth, but it can be a bit of a shock for newcomers to the Island! If issues arise late in the day, they can delay or derail a transaction or chain entirely.

What are the two different categories of property in Jersey and the difference between them? Jersey law classifies property into “immovable” and “moveable” categories. Immovable property includes land, buildings, and leasehold interests for over nine years. Moveable property includes company shares and leases for nine years or less. Let’s discuss property tenure in Jersey. What is the significance of freehold, flying freehold, and share transfer properties? Freehold is the most robust form of ownership, giving title to land, everything above, and everything below it. Flying freehold, introduced in Jersey in 1991, is common for apartments, where owners technically have two interests – exclusive title to their unit and a share in communal areas. Share transfer involves ownership through shares in a Jersey company, with exclusive rights to occupy specific parts of a development. We don’t have the English law long leasehold model, which is arguably more complex.

Can you shed light on the various modes of ownership in Jersey, such as individual, company, and trust ownership? Individuals can buy property in their name, subject to certain qualifications for residential purchases. Companies are limited in buying residential property but can acquire share transfer property. Trusts cannot hold Jersey immovable property directly, but they can hold shares in a Jersey company that owns such property. Given these nuances, what advice would you offer to potential property buyers in Jersey? Comprehensive legal advice is crucial. Our team at Bedell Cristin has experienced Jersey property experts who are ready to assist with any queries and to guide buyers through this distinctive legal landscape. For the vast majority of transactions, the process is very straight-forward (even if some of the language and terminology used is challenging) but where there are title, planning or boundary issues, our experienced lawyers will help to identify and resolve them at an early stage. What final piece of advice would you give to buyers? Whilst the Jersey legal system (especially in relation to property) may seem rather quirky, it has been in operation for many hundreds of years and remains in good working order today. Given the nuances of Jersey property law, my main advice is for buyers to seek comprehensive legal advice at the outset – if issues arise late in the day, they can delay or derail a transaction or chain entirely. The Channel Islands: Where business and pleasure go hand in hand. An increasing number of fund managers are establishing themselves in Jersey and Guernsey. Leading a team of specialists in both HNW and business relocations across BVI, Cayman, Guernsey, Jersey and Luxembourg, Ogier partner Jonathan Hughes has a unique perspective on trends and factors driving fund managers’ relocation to the Channel Islands.

What are the principal drivers for relocations? They are both economic and regulatory, but re-domiciling to Jersey or Guernsey is often also a lifestyle choice for many senior fund management professionals and their families. The move has to work for both. Shorter commutes allow managers to spend more time with their families and some like the active island lifestyle. These and future planning have been contributing factors to the stream of enquiries we have received about fund manager relocations. The islands’ sophisticated fund services offerings have operational advantages for managers. A desire to diversify economies has also resulted in the introduction of tax regimes and policies which have encouraged high-value industries, such as the fund management and digital sectors, to the Channel Islands. Financial regulation in the Channel Islands allows for faster company and investment vehicle approvals than some other domiciles, with regimes that can fast-track the management of certain established investment strategies.

making critical business decisions in those jurisdictions. Fund managers must demonstrate that their “core incomegenerating activities” are carried out in the respective islands and that they are “directed and managed” there, with adequate employees, expenditure and premises. The introduction, in response to the EU Code of Conduct Group’s ‘fair taxation’ requirements and the OECD’s BEPS initiative, of economic substance rules for fund managers which are tax resident in the Channel Islands has played to both islands’ strengths because their respective models have always been to have substance on the ground. How does Ogier support relocations? Our services for relocating ultra-HNWs, their businesses and families goes beyond basic conveyancing. We introduce our clients to our trusted networks of local suppliers and professionals.

The continued success of Guernsey’s and Jersey’s fund sectors – especially against global financial and political instability – shows why so many managers are increasingly attracted to the jurisdictions.

Our work can involve advice on tax, trusts, property, investments and estate planning. Our teams combine the necessary insight and experience. Ogier can help with the property purchase process and can advise on the wider personal and business legal implications of a move, including helping clients to make those essential ‘settling-in’ connections.

What are the key trends you’re seeing in fund manager relocations? We see a full range of relocations and outcomes sought. It may be just portfolio managers on the ground or broader, including back office, and some firms may retain footprints in other jurisdictions. There is no single model.

What are some of the key questions in relation to fund manager relocations? As well as property and residency criteria, people need to understand the rules in relation to relatives, infrastructure services such as transport links, healthcare and education and more.

Taxation is one of a number of considerations – there is no capital gains or inheritance tax in Jersey or Guernsey. The latter has a basic corporation tax rate of 0% on profits arising applicable to most Guernsey tax resident companies, with a 10% rate applicable to income arising from certain regulated. There are also no sales taxes in Guernsey.

It’s important to know how to acquire rights to live and/or work in the Channel Islands and how your family can accompany you. Upon arrival, how easy is it to buy a house, or start a business? What is the education system like? How’s the healthcare? You will also need to understand how the move impacts on your overall tax and reporting obligations. How will your business activities be affected by local substance legislation?

Other considerations include political stability and high quality of services and infrastructure. How much of an impact have substance regulations had? Individuals and companies must meet Economic Substance requirements in their respective islands by living and

Expert guidance, precisely tailored. Relocation has to work for your family, lifestyle and future as well as your business. Ogier’s specialist relocations teams have experience in all aspects of advising high-net-worth individuals and fund managers on relocating their businesses and families, including immigration, property, estates and corporate matters. When she’s not matchmaking, Angela loves spending time with her family and walking around the beautiful bays of St. Brelade and Ouaisne.

SIMON TORODE FOUNDER, CEO E. SIMON.TORODE@LIVINGROOMPROPERTY.COM W W W.LIVIN GROOM P R OP ER T Y.C OM

The Channel Island estate agent. Our founder & CEO. Guernsey born, Simon left the island to seek a degree in Graphic Design and Photography before forging a career in London in the advertising industry. Returning to the island of Guernsey, Simon combined his creative skills with another of his passions – property – which led him to found Livingroom in January 2006.

Estate Marketing. Livingroom solely represented the UK and beat 48 other countries including finalists from Abu Dhabi, Germany, New Zealand, Mexico and the USA. In 2021/22, Simon led Livingroom to the highest industry accolade of all - World’s Best Single Office Estate Agent at the International Property Awards.

Alongside Livingroom, in 2008 Simon jointly founded The Potting Shed Advertising & Digital Agency.

The panel of judges for the International Property Awards is large (more than 100 people are involved in judging the entries) and comprises leading figures from all aspects of the property industry including architects, designers, journalists, academics, estate agents and industry bodies - including the former group chief executive of the NAEA and global property standards director for RICS.

In 2012, Simon led the Livingroom team to win three awards at the prestigious Guernsey Awards for Achievement – including the overall pinnacle award of Guernsey’s Best Business. In 2015 Simon founded Soldstory, a marketplace for authentic, hand-crafted creative works.

Livingroom is the ‘one and only’ Channel Island Estate Agent and, as the judges decided, worthy of the highest international accolade possible. Not only can Livingroom stand tall with international multi-office networks, it can also offer a service where all revenue remains in the Channel Islands, re-investing in our communities while helping local charities and incentives through The Livingroom Foundation. Livingroom is the true definition of applying an international mindset to a local property market.

In 2016, Simon jointly founded Acorn Interiors providing home retail and interior design solutions, before leaving in early 2020 to focus on the expansion of Livingroom. In 2018, Simon became a Jersey resident and established the second Livingroom office, cementing the company as the only Channel Island Estate Agent. Livingroom soon secured its place as a leading Jersey agent, delivering high levels of customer service and presentation to an island market that deserved evolution. Simon continues to work across both islands with ‘hands-on’, knowledge-based practice.

Simon was a co-founder of the Guernsey charity Young People Guernsey. YPG commissioned Barnardos to provide an advice and guidance centre for young people aged 11-16 called ‘The Hub’. The Hub has since been adopted by the local government and the charity is now part of the Youth Commission for Guernsey and Alderney.

Simon has grown Livingroom into a truly recognisable brand that leads the way not only in the Channel Island property market - but further afield. Livingroom has won 32 regional, national and international awards to date including the industry pinnacle award at the International Property Awards for Best International Real

When not working, Simon enjoys travelling, photography, interior design, music, boating and spending time with his husband and dog.

TVM ™ Transparent Vendor Management, a fully transparent service. WHAT’S TVM ™ ? Livingroom invented TVM in 2012 and commissioned our Channel Island digital agency to build it for us so that we’d have a bespoke platform that exceeded our clients’ expectations. TVM collates all notated, honest viewing feedback, access arrangements, file notes, advice, and market comparables, all the way through to completion – documenting the process in an easy-to-view timeline of events. ACCESS TVM Once registered online, your property will be attached to your private and secure profile where you will receive updates, data & analytics of your listing. Vendors can also approve their property details before they’re listed on the website and stay in touch with Livingroom’s unique invention. TVM enables us to provide a personal approach in a digital world; something an ‘off-the-shelf’ solution could never have achieved. It’s available to anyone who sells their home with Livingroom – irrespective of value and condition – and offers a multimillion-pound service to all. We know that you can never keep vendors too informed on their sale so we evolved TVM to encompass online analytics, statistics and data capture to ensure that TVM is not only the first platform of its kind, but it’s also the most intuitive and user-friendly. As part of TVM, vendors have access to web analytics on their listing including page views, visitors per day, the average time spent on their listing and new vs. returning visitors. TVM, AN IMPARTIAL MEDIATION TOOL TVM has even acted as an impartial mediation tool and has been well received by opposing beneficial owners/landlords of property, where each legal owner/landlord can register, and any information added is sent to all parties with synchronicity and without bias. Each owner can review the information without any priority given to a specific individual. We have seen this implementation work perfectly for acrimonious divorces and family disputes where communication between parties is complicated. By providing data-driven insights we increase our accountability to our clients and give them access to information about their listing that allows them to track our success – it’s all part of our pledge to communicate openly, honestly, and proactively with our vendors.

Professio

onal photography as standard. Livingroom is the only estate agency in the Channel Islands to employ a team of professional photographers and videographers as standard and is one of the only agents in the UK with a dedicated, in-house creative team including established photographers, videographers, designers and licensed drone pilots. The photographers at Livingroom are not just estate agents with cameras; they are specifically trained, award-winning professionals with an eye for what will help your property to sell or rent. Livingroom follows the principle that first impressions last and pledges that it will always present clients’ property in the best possible light.

Qualified, in-house drone pilots as standard. Our fully qualified and licensed drone pilots use high-tech equipment to get a unique perspective of some of the properties on our books. Many of the homes we sell are situated in truly incredible surroundings – whether sprawling woodland or on the islands’ spectacular coastlines – and taking to the sky helps us to market properties in context. Drone shots, captured with the same creativity and eye for detail that drives all of our imagery, can truly elevate a listing to a new level and give prospective buyers a view that would otherwise be simply unavailable. Drone technology is another way we can show off some of the Channel Islands’ finest homes, and we also use drone imagery to promote the islands themselves, capturing vistas that others will never achieve.

10+ years of evolution at Livingroom. Toby is one of Guernsey’s most experienced property photographers and as a senior creative he has a major influence on Livingroom’s visual identity and image-led approach to marketing. Toby has been with Livingroom since 2013 and works on everything creative from photographing some of the island’s most stunning properties, to designing advertising and marketing, and working on our print and online publications. With a distinct eye for what makes a good photograph, Toby is responsible for some of Livingroom’s most spectacular imagery in recent times and his technical and design expertise are vital for helping us, and our clients’ homes, stand out in the market. When not behind the lens, Toby has built an admirable reputation as a DJ – playing locally and further afield.
