We just enjoyed a winter birthday party with bon fires blazing, and marshmallows late into the crisp night and we all just gushed at how blessed we are. We have a jam packed edition and there is alot of reading work to do and take note of! But as residents it is all very important stuff. I want to take a moment here to just drop a personal note to my “now husband of 20 years!” – Omgosh Justin how the time has flown. Young and stupid 20 year olds is what we were told when we chose to marry. I would NOT have done it any differently!! Never !! best decision we ever made. I love that I still get butterflies when I see you, that I am still very much INLOVE with you and that you love me as much back. What an awesome 20 years it has been. Hard work all the way has paid off and as we celebrate our 20th wedding anniversary on the 02 july, I love you more than ever! Hi all, hope you are enjoying the winter weather as much as we are, so nice to be able to breath crisp air and not stale humidity, I must admit being an early riser and late leaver going to and from work in the dark has it’s disadvantages, the only time I see my garden is on weekends.

Whilst on the subject of building, planning permission from SEMHOA is required for ANY temporary structure, these include wendy houses, fences and awnings. From a technical perspective if one brick or block is placed upon another you need plans, this is especially vital if these bricks or blocks are retaining soil. All retention work has to be approved by an Engineer, this is vital, as should yours collapse for any reason, you could well face legal claims for damages, if the wall is engineered it becomes the Engineers problem and not yours, providing of course that the wall is built to the engineers specification – short cuts do not work.

Elsewhere in the mag we have included an article called “Building Plans and Voetstoots” which we have reproduced with the kind permission of Chantelle Gladwin of Schindlers Attorneys. This article highlights why we insist on proof of and Occupation certificate and proof of survey, to ensure that what the buyer is buying, is reality. Whilst some see our requirements is a pain in the butt, we are actually doing it to protect YOU. The reference to the voetstoots clause is also important – if the seller and or agent is aware of a defect and does not make the buyer aware, they could be in for the high jump. An example of the reason for insisting on a property being properly pegged has again reared its ugly head, a resident purchased believing the fence on his property was the boundary,

We are receiving a lot of complaints and comments that people are driving around our Estate with minors on their laps (behind the wheel) as well as standing on the front seat and not belted in.

Most, if not all roads within these gated estates are not “private roads” but they are in fact “public roads” in terms of the law and they are regulated by the provisions of the National Road Traffic Act 93 of 1996 (NRTA) National Road Traffic Act “public road” means any road, street or thoroughfare or any other place (whether a thoroughfare or not) which is commonly used by the public or any section thereof or to which the public or any section thereof has a right of access, and includes a) the verge of any such road, street or thoroughfare, b) any bridge, ferry or drift traversed by any such road, street or thoroughfare; and c) any other work or object forming part of or connected

Building Plans

and Voetstoots Introduction If you have bought a property only to realize 6 months down the line that it does not have approved building plans, this constitutes a latent defect and you may be able to claim damages as a result. Rights related to latent defects Where a latent defect is discovered after ownership has passed to the purchaser, the seller and/or agent may be found reliable for the cost's of rectifying the defect if they warranted that the property was fit for the purposes for which it is was sold or if the defect was deliberately concealed. 8| Seaward Estate

Legal recourse against latent defects The law therefore affords you the following rights which can be used to remedy the situation: 1. Cancel the contract of sale and claim damages/losses [ if it is a material or serious defect ]; 2. Claim a reduction in the purchase price and damages/ losses (if it is a less serious defect]; 3. Claim specific performance [repair) and damages/losses [in either situation]. The latent defect and the voetstoots clause Most sale agreements contain a voetstoots clause, which usually states that the property is sold

as it stands', with all defects, and that the purchaser has accepted the property in such a condition. But a voetsoot’s clause has no effect where a defect was knowingly and deliberately concealed; and you would have to have reasonable evidence that whomever sold the properly to you, had knowledge of this latent defect. If there was no voetstoot’s clause in your sale agreement, then you can claim from the seller for the cost of legalizing your home (for example, the costs of getting new plans drawn up and approved and any alterations that you might have to make]. If the cost of legalizing your plans is very high,

Time limits and your legal recourse Since your legal recourse in respect of latent defects is based on Roman Law called the aedilitian remedies, there are time limits as to when you need to claim from the seller. For example, if you want to return the house. you can normally only do so within 6 months of taking ownership, If you want to claim only a refund of part of the purchase price, you must normally have done this within 12 months of taking ownership. Unapproved building plans and the Municipality If your plans are not approved, your local Municipality would be entitled to send you notices warning that you are non-compliant with building regulations. You would then have to have new plans drawn up and submitted for approval. If the fact that the plans were not approved was concealed from you, you could claim your costs in doing position. You may also have to prove to the Municipality

that the structure is reasonably fit for dwelling, or else you might be ordered to vacate pending the approval of the newly drafted plans. Should the Municipality disapprove any attempts to bring the property under compliance, liability will fall on the seller and/ or agent to restore you to the position you were in before you bought the property. This liability would include, amongst others, a refund of the purchase price, providing you with alternative accommodation and a claim for wasted costs for the transfer of the property and/or any other financial loss you might have suffered as a result. Taking legal action If your loss is less than R 12.000.00, you could claim from the seller in the Small Claims Court. If your loss exceeds this amount, you will then need to institute your claim in a Magistrates Court or High Court, in which event it is recommended that you approach an attorney for assistance. Tell us about Chris’s career? Chris currently works for an International affiliated company who design and manufacture components for the South African Motor industry where he holds the position as the Senior Manager of Engineering. As a major stakeholder on the KZN North Coast this company employs approximately 1600 people from the local community.

The benefits or perks should I say for working there, is the flexibility to start at 07h00 in the morning and leave work at 15h00, therefore allowing her to fetch her son in the afternoon’s for swimming.

Cameron has two passions the first being swimming where he finished in first place in SA for the 200 backstroke and 50 backstroke and second for the 100 backstroke at SA National Level 3 in Cape Town in March. In the same month he was selected by KZN and Speedo to be part of the 2014 KZN Speedo team, with Rene Warne and Chad Ho being their Captains.


He currently swims for Seals Swimming Club in Ballito, they are based at Umhali Primary School, where he swims 6 days a week for approximately 2 hours day. His second passion is mountain or road biking. When he is not in the pool, Cameron, his father and our neighbour from down the road, Eben Bouwer, participate in mountain or road biking. Amongst the three of us, there is lots of competition, bantering, laughter and pure fun. Cameron also completed his first 106km Amashova Cycle race in Oct 2013. We can’t forget about our two small little boys, Spike the quiet sophisticated Jack Russell with short legs and short body and Milo the Jack Russell with long body and short legs who we adopted from friends about two years ago, he is extremely naughty and has no ears, however we love them both. Why the North Coast? The reason for us moving to the north coast was because we wanted to be half-way between Stanger, where Chris’s work, and Umhlanga where I used to work before my company relocated their offices back to Durban.

Ballito was our first choice 12 years ago, because on a clear day you could see the green mountains in the distance and on the other side the blue ocean with its rolling waves. Not to mention when you sit on your verandah and can hear the sound of the birds calling to each other. Tell us what you love about living in Seaward Estate? The most important part of living in the Estate is the security aspect, especially when I am out of the country - I know that my family is safe. Your favourite quote or words to live by – or just some general interesting information Live today as if there is no tomorrow as life is too short and always remember to be grateful for what you have as many don’t have. Favourite place to holiday We love spending a lot of our time in the African bush with our special place being the Kgalagdi Transfronteir Park, this is where we escape to. A place where there is no electricity after 10pm and no cell phone signal at all. This is where you realise how hard it is to survive in extreme conditions. It’s all about survival of the fittest and those with skill.

Get to know your

Neighbour’s Getting to know the people who live nearby helps create a sense of belonging, and shared identity in our local area. It also helps to strengthen connections and trust in our wider communities and contributes to a happier neighbourhood for everyone. Our lives are often so busy we don't get to connect with the people who live close to us. This is especially true in big cities, where everyone comes and goes at different times and new neighbor’s move in and out. Yet research has found that that wellbeing is higher amongst people who have regular contact with their neighbor’s and that knowing people in our local area, even if it is just to say hello, can have a big impact how secure and happy we feel about where we live. Sometimes it's obvious what we can do and other times it's not. We don't have to make big gestures small things can make a difference too. It might take a bit of confidence but it gets easier. Here are some ideas of ways to connect: • If you regularly pass someone in your street start by smiling and saying hello. Find an opportunity to 12| Seaward Estate

introduce yourself. Tell them a little about you and what you enjoy about the area - then ask them what they like too. • If someone new moves in close by, then make them feel welcome. Take the opportunity to introduce yourself and offer to help with any questions about the local area. For example you could offer advice on when bins are collected or local facilities etc if they are from out of town. • You all remember what it is like moving to a new home; how about taking your new neighbour’s some dinner and a beverage for the first evening? • If you're new to an area, be sure to go round and introduce yourself to your neighbour’s. Tell them what brought you to the area and find out a bit about them and their lives. • Look out for ways you can help your neighbor’s and don't be afraid to ask if you need support too. Giving support and receiving it from others improves our happiness and well-being


Two really cool initiatives to support this year “The Winter Warmer” - It’s cold out there especially when you are homeless!

• Look out for opportunities to connect with people in your Local Community - for example a local community group, residents association, volunteer opportunity, exercise or activity class, book group etc. Try checking out local websites or keeping an eye on local notice boards etc. • Exchange numbers so that you can contact each other should you ever need to. • Invite your neighbour for a beverage, a chat or even a dinner. It might just be the beginning of a beautiful friendship. • Why not have a street braai with your neighbour’s? Invite everyone in the street, and do not inconvenience those that are not able to attend. This would work better in a cul-de-sac area. Remember to be responsible, respectful and keep the area clean.
