In an event at Howard University attended by civil rights and education reform groups, federal education officials today released new data from a national survey of more than 72,000 schools serving 85% of the nation’s students. The self-reported data, Part II of the 2009-10 Civil Rights Data Collection (CRDC), covers a range of issues including college and career readiness, discipline, school finance, and student retention.

Education Secretary Arne Duncan said the CRDC findings are a wake-up call to educators at every level and issued a broad challenge to work together to address educational inequities.

“The power of the data is not only in the numbers themselves, but in the impact it can have when married with the courage and the will to change. The undeniable truth is that the everyday educational experience for many students of color violates the principle of equity at the heart of the American promise. It is our collective duty to change that,” Duncan said.

Among the key findings are: African-American students, particularly males, are far more likely to be suspended or expelled from school than their peers. Black students make up 18% of the students in the CRDC sample, but 35% of the students suspended once, and 39% of the students expelled.

•Students learning English (ELL) were 6% of the CRDC high school enrollment, but made up 12% of students retained.

•Only 29% of high-minority high schools offered Calculus, compared to 55% of schools with the lowest black and Hispanic enrollment.

•Teachers in high-minority schools were paid $2,251 less per year than their colleagues in teaching in low-minority schools in the same district.

Assistant Secretary for Civil Rights Russlynn Ali said that for the first time, this survey includes detailed discipline data, including in-school suspensions, referrals to law enforcement, and school-related arrests.

“These new data categories are a powerful tool to aid schools and districts in crafting policy, and can unleash the power of research to advance reform in schools,” Ali said.

The CRDC also provides a comparative picture of college and career readiness, school finance, teacher absenteeism, student harassment and bullying, student restraint and seclusion, and grade-level student retention.

Under state law, suspending or expelling students is the responsibility of the local school district. California is in the process of collecting more detailed student level data when reporting suspension and expulsion reports, as part of the state’s conversion to the California Longitudinal Pupil Achievement Data System.

County and school district superintendents are required by state law every three years to develop Countywide Plans for Expelled Students and submit them to the State Superintendent of Public Instruction. These plans outline educational alternatives for expelled students, identify gaps in educational services to them, and develop strategies for filling those service gaps. The plan also identifies alternative placements for expelled pupils in community day school programs, but who fail to meet the terms and conditions of their rehabilitation plan, or who pose a danger to other students. The goals of the plan are to: Ensure that expelled students have appropriate options, Decrease the dropout rate, Increase the graduation rate and Close the achievement gap.

new citizens, neighbors, and friends.”

The walkers will visit 13 states as they walk from coast to coast raising awareness of the Dream Act — the legislation that will give undocumented students a path to citizenship. They plan to arrive at the U.S. Capitol in time for the November election.

“We cannot sit back and wait any longer for the change we so desperately need. We cannot sit back and wait any longer for our leaders to abuse our power as people, as communities,” wrote Lucas Da Silva in his blog on March 13.

Highlights of the benefits Californians are already enjoying from the provisions launched so far, the report points out, include: • More than 8,600 Californians who were denied private health insurance coverage because of a preexisting health condition have enrolled in the state’s Pre-Existing Condition Insurance Plan (PCIP), a high-risk federally funded program that provides insurance for eligible individuals.

• More than 355,000 young adults under 26 now get coverage through their parents’ health insurance plan.

• About 6.1 million Californians get preventive care with no cost sharing.

• More than 319,000 of the state’s seniors have been able to purchase their medications for less outof-pocket costs through the prescription drug program.

• Hundreds of thousands of Californian consumers saved more than $100 million in health insurance rate hikes that were retracted, rolled back or withdrawn due to added scrutiny and rate review that came in part from the new law.

• More than 12 million Californians no longer have a lifetime limit on their health insurance plan.

“Millions have already experienced benefits, and millions more will,” noted Betsy Imholz, special projects director of Consumers Union, Inc.’s west coast regional office.

Santa Barbara, Calif., resident Bill Strong said in a telephone interview that since his daughter was diagnosed in 2007, at age six months, with the degenerative and terminal disease, spinal muscular atrophy, the 24/7 care and the frequent intensive care unit admissions his child needs could have quickly dried up the $5 million lifetime cap on his private insurance plan.

“A day in the hospital costs around $1,000 a day, and she sometimes needs to be in hospital for a month at a time,” Strong said, adding: “If the Affordable Care Act had not been instituted, we would have been constantly

worrying that our insurance company will drop us.”

Kevin Ferreira said he was able to put his 20-yearold daughter, whose dance training made her highly susceptible to injuries, on his employer-sponsored insurance plan, saving him around $17,000 in insurance premiums each year.

“The Affordable Care Act was a godsend to my family,” Ferreira said at the briefing.

Two leading legislators on implementing health care reform in the state – Assemblyman Bill Monning and Sen. Ed Hernandez, the chairs of the Assembly and Senate Health Committees, respectively, highlighted new legislation they have introduced to maximize ACA’s benefits.

Health care advocates and lawmakers are concerned that come 2014, which is when the ACA will be fully implemented, there will be some 4 million newly insured Californians but not enough primary care doctors to care for them.

“Just because you have a health care card doesn’t mean you will have access to a health care provider,” Hernandez said. “We need to make sure we have an (adequate) work force.”

He is currently holding hearings to see how the health care workforce can be expanded to meet the state’s needs.

Kathleen Hamilton of The Children’s Partnership and 100 Percent Campaign noted how the $14 million California has already received from the federal government under the ACA to support and expand its school-based health centers has helped scores of students, who were deprived of basic health care services because of the state’s budget cuts. The money allows schools to provide primary care, dental care, behavioral health services and substance abuse counseling.

“Cuts are not allowing our system to properly prepare,” he said, adding: “But the ACA is the light at the end of the tunnel.”

Next week, the US Supreme Court will hear three days of arguments related to the legal challenges to the ACA. That issue never came up at this week’s event.

IRS Encourages Small Employers to Check Out Small Business Health Care Tax Credit March 13, 2012 WASHINGTON — With business tax-filing deadlines fast approaching, the Internal Revenue Service today encouraged small employers that provide health insurance coverage to their employees to check out the small business health care tax credit and then claim it if they qualify.

The recently-revamped Small Business Health Care Tax Credit page on IRS.gov is packed with information and resources designed to help small employers see if they qualify for the credit and then figure it correctly. These include a step-by-step guide for determining eligibility, examples of typical tax savings under various scenarios, answers to frequently-asked questions, a YouTube video and a webinar.

The small business health care tax credit was included in the Affordable Care Act enacted two years ago. Small employers that pay at least half of the premiums for employee health insurance coverage under a qualifying arrangement may be eligible for this credit. The credit is specifically targeted to help small businesses and tax-exempt organizations provide health insurance for their employees.

Depending upon how they are structured, eligible small employers are likely subject to one of the following three tax-filing deadlines, which fall in coming weeks: • March 15: Corporations that file on a calendar year basis can figure the credit on Form 8941 and claim it as part of the general business credit on Form 3800, both of which are attached to their corporate income tax return.

• April 17: Individuals have until April 17 to complete and file their returns on Form 1040. This includes

Sole proprietors, as well as people who have business income reported to them on Schedules K-1—partners in partnerships, S corporation shareholders and beneficiaries of estates and trusts.

They also attach Forms 8941 and 3800 to their return. The resulting credit is entered on Form 1040 Line 53.

• May 15: Tax-exempt organizations that file on a calendar year basis can use Form 8941 and then claim the credit on Form 990-T, Line 44f.

Taxpayers needing more time to determine eligibility should consider obtaining an automatic tax-filing extension, usually for six months.

See Form 4868 for individuals, Form 7004 and its instructions for businesses and Form 8868 for tax-exempt organizations.

Businesses that have already filed and later find that they qualified in 2010 or 2011 can still claim the credit by filing an amended return for one or both years. Corporations use Form 1120X, individuals use Form 1040X and tax-exempt organizations use Form 990-T. Some businesses and taxexempt organizations that already locked into health insurance plan structures and contributions may not have had the opportunity to make any needed adjustments to qualify for the credit for 2010 or 2011. These employers can still make the necessary changes to their health insurance plans so they qualify to claim the credit on 2012 returns or in years beyond.

Eligibale small employers can claim the credit for 2010 through 2013 and for two additional years beginning in 2014.

Nacida y criado en California, Juárez estudió arte y Estudios Chicanos.

“Estoy muy orgulloso de ser llamado una Chicana”.

“Averigüe acerca de mí misma, mi historia y cultura...... y eso me llevó a Estudios Chicanos, me estaba perdiendo una parte de mi vida y yo no quería eso para mis hijos, así que los he criado sabiendo todo sobre su cultura y la historia de su gente.”

El movimiento de derechos civiles nunca se terminó, dice Juárez, “hay todavía un demasiadas de inequidades en la sociedad, especialmente para nuestra raza.”

“I am Passionate about Change” Mirna Juárez is the Cofounder of the non-profit GRASSROOTS and a passionate Aztec dancer.

Born and raised in California, Juárez studied art and Chicano Studies.

“I am very proud to be called a Chicana.”

Describing her experience, Juárez stated: “I came to find out about myself, my history and culture... it led me to Chicano Studies, I was missing out in a part of my life and I didn’t want that for my kids, so I raised them knowing all along what their culture and people`s history is.”

“The civil rights movement never ended,” says Juárez. “There’s [sic] still a lot of inequities in society especially for our race.”

During her college years she learned and discovered her passion for the Aztec culture, dance and is currently part of the group Quetzalcoatl Citlali based in Sacramento.

Juárez describes Danza Azteca as a discipline. “What [danza Azteca] is doing for

me emotionally, spiritually and physically is all I can ask for.”

Juárez is also known for her different taste of music.

“I like ska, reggae, punk, the kind of music that you do not hear in the radio.”

“The fusion and the evolution of music: our cultures all intermingling together is what I wish for society as a whole, for that unity and exchange to happen between people.”

Along with Javier Gardea and Michelle Ruiz-Esparza, in 2010 Juárez founded the non-profit GRASSROOTS, an organization dedicated to provide youth with the knowledge and the skills to be self-sufficient.

Juárez is currently working in collaboration with other organizations on two projects: a UnityFest and a Peace and Dignity Run to be held on April, 21st. UnityFest is an event designed to promote peace and the power of prayer in Stockton.

“This year the prayer is for water, anybody that lives in this valley knows that water is a crucial element, it’s very elemental in our life.”
