7 STEPS TO A FLU-FREE WORK STATION

re you diligent enough about preventing computer viruses?

I talk a lot about the importance of keeping your computer safe from viruses, malware and other things that can expose you and your information to security risks But today I’m talking about good oldfashioned, low-tech germs. They can shut down your productivity just as quickly as a so-called indestructible computer virus. It’s that time of year, no matter where you live, when cold- and flu-season is spreading like wildfire. We just experienced a mini-epidemic at our office, complete with both the upper respiratory stuff and the stomach version s w e e p i n g through whole depar tments for days at a time.

There are many ways to disinfect your work space and minimize your exposure when these nasty viruses are spreading. But there’s nothing we touch more than our desktops, laptops, tablets and cell phones. I kept hearing the office germophobes say, “Too bad there’s no way to clean a computer.” Nonsense. Some digital gadgets are easier to disinfect than others, but there’s plenty you can do to lessen your exposure at work. Here are seven steps to a flu-free work station. 1) Attack that germy keyboard and mouse. They get touched the most at work and in your home office. If your keyboard and mouse are wired, unplug them from the computer. If they’re wireless, shut them off and remove the batteries. Then use bleach-free wipes to clean and disinfect the keyboard and mouse. Go over the accessories again with a d r y

and soft lint-free cloth. You want to avoid getting moisture into openings. Never use spray cleaners or spray disinfectants. If a wipe is very damp, squeeze it to remove the excess liquid. Also avoid using paper or cloth towels, because the lint can be harmful. 2) Have a laptop? Clean off the internal keyboard and trackpad the same way. Again, be sure to shut down the computer and unplug the power supply first. 3) To clean a desktop computer, shut it down and unplug the power cord. Disconnect peripherals. Use a disinfectant wipe to go over plastic and metal surfaces. For the display, use a soft, slightly damp lint-free cloth. 4) Phones with keyboards can be swabbed with a slightly damp disinfecting wipe. Most smartphone makers recommend using only a soft cloth to clean touchscreens. But several studies have reported that the average cell phone is more germ infested than a public toilet. And you put that to your face how many times a day? Your best line of defense may be to consider buying a screen protector for your smartphone. They’re available for the more popular touchscreen phones, so that you can clean and replace them as needed. Meanwhile, don’t forget to disinfect the handpiece and mouthpiece on your wired desk phone. 5) Place a bottle of alcohol-based hand sanitizer and a box of tissues next to your computer and use them frequently. This will go far to help control the

FLORIDA’S INSURANCE COMMISSIONER KEVIN MCCARTY’S STATEMENT ON THE PASSAGE OF FL PIP FRAUD BILL HB1065

F

lorida’s leaders showed vision by enacting the first-in-the-nation Motor Vehicle No-Fault Laws that became effective in 1972. Commonly referred to as Personal Injury Protection (PIP), the goal was to help accident victims by reducing legal delays, streamlining the payment process, and providing an automatic “pot of money” for injured drivers to take care of immediate injuries through visits to doctors and hospitals.

and radio jingles all aimed at gaming the system. Clearly, the law is not working as it was originally intended.

Instead, the law that made emergency medical care “quick and easy” for accident victims has been targeted by fraudsters and hucksters who have perfected methods for exploiting the system by creating a cottage industry unique to our state. The Unfortunately, if you say the word “PIP” National Insurance today, one does not think of the benefits Crime Bureau reports of this innovative legislation. Instead, PIP that Florida now leads conjures images of proliferating pain the nation in staged clinics, billboard advertisements littering auto accidents where Florida’s highways, and catchy television numerous alleged “passengers” each access their $10,000 of PIP benefits from providers who are neither licensed, nor have an identifiable address. This pervasive fraud has led to a number of other market distortions. From 2008 to 2010, the amount Florida insurers paid for PIP benefits increased from $1.45 billion to $2.45 billion – a 70 percent increase. This increase is even more astounding when you consider the number of drivers was constant, and the overall number of reported traffic accidents actually declined during the same period. Ironically, the number of lawsuits also doubled in the last two years, which undermines the entire premise of the “nofault” legal system. The Florida Department of Financial Services under the leadership of Chief Financial Officer Jeff Atwater has done

an admirable job in attempting to prosecute those perpetrating fraud, but the growth and sophistication of this cottage industry has outstripped both government resources, and the resources of insurance companies to investigate fraudulent activity. PIP only represents two percent of all insurance premium collected annually in Florida, yet accounts for 50 percent of all fraud referrals. When one fraud ring is shut-down, another one takes its place. Gov. Scott made PIP fraud one of the focal points of his administration’s goals this legislative session and he featured it prominently in his State of the State address. PIP fraud has become more than an arcane insurance issue – it directly affects Florida’s families, and negatively impacts Florida’s economy and the governor’s goal of job creation. Our Office began a review of the PIP structure in 2010 by conducting a data call of leading PIP writers in our state. In our report, issued to the Florida Legislature in April of 2011, we reached one indisputable conclusion: PIP claims are a major cost-driver of auto insurance rates, and the cost trajectory is

simply not sustainable. To fix the problem, we must return PIP to its original mission – to provide emergency care for injured passengers. To accomplish this mission, we need legislation that encompasses four primary components: 1) limiting providers and venues for providing PIP coverage 2) creating a reasonable fee and utilization schedule 3) targeting a reduction in litigation costs, and 4) improving methods for investigating fraud. More specifically, we need to move away from “fly-by-night” PIP benefit providers, and instead rely on more traditional providers of emergency care such as EMS services, emergency care facilities, hospitals, and follow-up care ordered by physicians. A 72-hour window for accessing PIP benefits will also decrease fraud. Creating a fee schedule based on Medicare will be helpful, but we must also put in place incentives to decrease over-utilization. Lowering litigation costs should also be a priority. Finally, we need to give law enforcement more tools to investigate fraud including a requirement that police officers fill out uniform accident reports. Let me be clear, requiring Florida drivers to have Personal Injury Protection (PIP) may be a good idea. Yet, our state cannot continue to endure fraud and rising insurance costs as a result of this well-intentioned law. Instead, we must overhaul the system to return PIP to its original purpose. We need to structure PIP laws to make emergency medical coverage quick and easy for accident victims – not quick and easy for fraudsters and hucksters. FLORIDA RELEASES PRELIMINARY 2011 FINANCIAL PIP DATA

ALLAHASSEE, Fla. – The Florida Office of Insurance Regulation issued preliminary financial data involving the personal injury protection (PIP) market that directly pertains to bills being debated by the Florida Legislature.

The preliminary data shows that in 2011, Florida’s insurers collected an increase of 19.7%, or $0.5 billion for PIP premiums, and that PIP costs (both direct losses, and direct containment and defense costs) have continued to increase as a percentage of the premium dollar for Florida’s insurers. A snapshot of the PIP data based on annual filings in 2010 and 2011: The Loss ratio is the percentage based on company filings to the 2010 Direct Written Premium: $2.4 billion of premium dollar dedicated National Association of Insurance to paying direct losses based Commissioners for 2011 that were Incurred Loss Ratio: 97.7% on PIP claims. FLORIDA ANNOUNCES ARREST OF JACKSONVILLE MAN CHARGED WITH ARSON AND INSURANCE FRAUD

T

ALLAHASSEE—Florida Chief Financial Officer and State Fire Marshal Jeff Atwater today announced the arrest of Christopher Koepke, of Jacksonville, after a joint investigation involving the Division of State Fire Marshal’s Bureau of Fire and Arson Investigations (BFAI), Jacksonville Fire Rescue Department (JFRD), the Jacksonville Sherriff’s Office (JSO), the Division of Insurance Fraud (DIF) and the www.underwritersinsider.com

Bureau of Alcohol, Tobacco and Firearms determined that Koepke set fire to five vehicles and an apartment building in an attempt to commit insurance fraud. “This man intentionally endangered the lives of others in an attempt for personal gain through insurance fraud,” CFO Atwater said. “Anyone who attempts any form of arson will be put behind bars. I’m proud of the work done by

my office, the Jacksonville fire and law enforcement professionals to bring these individuals to justice.” On Sept. 15, 2011, Jacksonville Fire Rescue responded to a fire at the Columns Apartment Complex on Laurina St. in Jacksonville. The investigation revealed that Koepke intentionally set the fires, hoping to collect insurance money on the damage to the contents of his apartment. The fires caused more than $200,000 in damage. Koepke was arrested and booked into the Duval County Jail on five counts of second-degree arson to a vehicle, one count of 1st-degree arson to a dwelling and one count of insurance fraud. If convicted, Koepke could face up to 135 years in prison. 15


2ND ALLEGED CONSPIRATOR ARRESTED FOR N. CAROLINA INSURANCE FRAUD

R

ALEIGH -Insurance Commissioner Wayne Goodwin today announced the arrest of Jessica Shamere Key, 29, of 2571 Hudson Poultry Road, Iron Station; she is charged with 1 count of insurance fraud. Investigators allege that Key conspired with Christona Shante Ross to obtain an Allstate Insurance policy on Key’s 2003 Cadillac, a vehicle with prior damage for which an insurance claim had already been filed and paid. On Jan. 30, 2012, investigators allege that Ross filed a claim with Allstate for the same vehicle N. Carolina Ins. Comm. damage Wayne Goodwin that had already been settled. Before Allstate representatives realized there was a problem, Ross was issued a $1,102.65 check for the claim.

Key was arrested on March 14 in Lincoln County and held on a $3,000 unsecured bond. Ross was arrested on March 12 at the Gaston County Detention Center and was released after posting a $5,000 secured bond.

Hudgens estimates insured losses in Georgia from March 2nd’s severe weather has now reached approximately $40 million. “I want to remind everyone that these are very preliminary numbers,” Hudgens said. “It takes many weeks for both the insurers and insureds to fully assess the extent of the damage from the storm. “The Final Authority on Everything!” Solid State or Hard Disk Drive?

I

was shopping for a laptop the other day and the salesman told me I would be crazy if I didn’t select a model with a solid state hard drive. It cost extra. What’s it all about and is it worth the price? T.R., Chattanooga, TN Traditional computer hard drives are complex electromechanical devices that store data on internal rapidly spinning disks (as much as 10,000 RPM!) similar in appearance to CDs although data is stored magnetically rather than optically as on a CD. Hard drive technology has been around for a long-time and it is a cheap and efficient method of storing massive amounts of media. The first hard drive I had the opportunity to price was in the early 80’s as I attempted to add storage to my floppy-only IBM PC. The drive was 10 Megabytes and was contained in a box about the size of a small suitcase. It cost $2,200 and I didn’t buy it. Today, you can easily pick up a 1 Terabyte (1 million Megabytes!) drive for $95.00. Cost per megabyte in the first drive: $220. In the second? .000095 of a cent. It’s a helluva bargain. So why the introduction of Solid State Drives - where data is stored on solid-state memory chips - if hard drive technology is so advanced and affordable?

FLA ARRESTS NAVARRE CONTRACTOR FOR WORKERS’ COMP FRAUD SCHEME

ALLAHASSEE - Florida announced today the arrest of a Santa Rosa County construction company president on charges of falsifying payroll information to avoid workers’ compensation premiums. Randall Morton Seltzer, 43, president of Navarre Industries Inc., was charged with multiple felony counts, including workers’ compensation fraud and grand theft. “Workers’ compensation insurance is vital to the health and protection of businesses and Florida’s economy as a whole,” www.underwritersinsider.com

CFO Atwater said. “Just last week, the Legislature passed reforms that target schemes just like this one that are diverting a billion dollars from Florida’s economy.” The investigation revealed that Seltzer intentionally and systematically under-reported his corporation’s true payroll to his insurance carrier, Guarantee Insurance Company. The fraud investigation was based on a referral from the department’s Division of Workers’ Compensation,

which issued the company two stop work orders within a five-year period. Seltzer allegedly established a shell corporation in 2011 under the name Hip Roof & Valley Inc. to intentionally violate the stop work orders and continue operating his construction business illegally. Seltzer was booked into the Santa Rosa County Jail and is awaiting bond. If convicted, he could face up to 30 years in prison and be forced to pay over $2.8 million in restitution. 27

Instead, Ambe relied on a computer-based template to generate the letterhead used for his firm’s correspondence.

In Maryland the purpose of attorney discipline is the protection of the public, not the punishment of the erring attorney. Ambe’s transgressions in the instant case are not as severe in nature as those in cases cited by the state. Ambe was a newly practicing attorney who never specifically solicited any clients on Maryland matters. It is uncontradicted that his various contacts with insurers in a settlement context originated with his immigration clients who sought his assistance in communicating with various insurers. He never entered his appearance in any Maryland court case and never assisted any other attorney in doing so. Ambe did violate Rule 5.5(a) by representing clients in Maryland state tort law matters while not licensed to practice law in Maryland. But, as we have indicated, it does not appear he actively solicited any clients in respect to Maryland issues. Lastly, because Md. Rule 16-760(f ) provides for the protection of the public by authorizing Bar Counsel to take further action against Ambe in the unlikely event that Ambe ever again engages in the unauthorized practice of law – - the main charge for which these disciplinary proceedings were brought we believe that the public is adequately protected by reprimanding Ambe.

The extraordinary spring tornado season in the U.S. in 2011, coupled with severe winter weather and Hurricane Irene, reduced the P/C insurance industry’s cumulative policyholders’ surplus—the amount of money remaining after an insurer’s liabilities are subtracted from its assets— to $538.6 billion as of September 30, 2011, 3.3 percent lower than the $556.9 billion policyholders’ surplus at year-end 2010.

The court, after finding a criminal violation, should have referred Ambe to the state attorney general for prosecution for the unlawful practice of law. Insurers, dealing with lawyers they do not know should make it a practice to check the status of the lawyer before dealing with the person as a licensed attorney. Every state has a web site listing each licensed attorney. That is what State Farm and Allstate did. Their mistake was reporting Ambe to the Bar rather than to the prosecutor. Criminal actions by people pretending to be a licensed lawyer need to be punished. That the crime is only a misdemeanor is silly and does not protect the public. This decision is a travesty. Hopefully Maryland will keep a watch on Mr. Ambe and if he ever claims to be a Maryland lawyer again they will try him and spend millions to suspend his non-existent license for 30 days.
