The Order addresses issues related to the Office of Insurance Regulation’s target market conduct final examination report, which is incorporated into this Order. UPCIC is ordered to pay an administrative fine in the amount of $1.26 million and to comply with pertinent portions of Florida Statutes and the Florida Administrative Code,

5 THINGS TO KNOW BEFORE YOU CUT YOUR CABLE BILL

eed more proof that the world is changing? Last week, the President of the National Cable & Telecommunications Association, Michael Powell, told the Senate that “the largest subscription video provider in the country today is Netflix.” If you haven’t paid attention to the entertainment landscape for the last few years, Netflix is an online streaming video service. You pay $8 a month and can watch all the TV shows and movies you want on your computer, mobile gadgets or TV. It was the first, and not the last, serious challenge to the cable companies’ dominance. Even if cable companies won’t admit it, they’re working hard to stay relevant a g a i n s t growing

competition from Netflix, Amazon, Google Play, Hulu, iTunes, YouTube and many other online video services. Millions of consumers have already been lured away from cable with promises of lower prices and the freedom to watch what they want, when they want. I know, because I’m one of them. Of course, like any big change to new technology, there are challenges to overcome. Here are five things I’ve discovered that will help make your transition easier - or might convince you to wait a bit longer to make the jump.

Know what’s available Watching what you want, when you want is like a dream come true. Once you try it, you’ll never want to go back to scheduled

programming. Unfortunately, finding ways to watch all your favorite shows and movies is a bit of stumbling block. You might find some are available on Hulu, YouTube or other free TV and free movies sites. Many will only be available on a paid subscription service, such as Netflix, Amazon or Hulu Plus, which generally cost you $7 to $8 a month. Not every service carries every show, so you could be forced to sign up for multiple services. Due to licensing restrictions, some shows are only available as paid digital downloads on iTunes, Google Play and Amazon. These can cost $1 to $2 per episode, and they might not be available the same time the episodes air. Buying a full season of a show can set you back from $20 to $50, just like a regular DVD box set. You can see how this starts to add up quickly. If you don’t plan ahead, you might find yourself paying as much as cable to keep up with everything. You could visit the major streaming sites and look through their catalogs to find out what shows and movies they have. Or you can visit a site like Can I Stream It? It will tell you which online providers have the shows you want to watch.

Don’t miss out on live TV While on-demand viewing is nice, some people still want the option to watch live TV. It’s great for news and sports, two things streaming

Prior Suit

I

n a prior lawsuit, Edmond and Rhonda Bisland sued Richard Simmons and Lindig Construction and Trucking, Inc. (“Lindig”) for injuries that Edmond sustained in a car accident. At the time of the accident, Financial Indemnity Company (“Financial”) was the insurer for Lindig. The Bislands initiated a lawsuit against Financial arguing, among other claims, that Financial breached the terms of its insurance policy by failing to timely pay on the judgment they had obtained against Lindig.

Before trial in the prior suit, Simmons and Lindig “stipulated to negligence and vicarious liability,” and a trial was held regarding damages. At the conclusion of the trial, the jury awarded a total of $2,557,000 and also awarded prejudgment and post-judgment interest on the award. The award exceeded the limits for the insurance policy covering Lindig and Simmons. After a trial, the jury found in favor of Financial. Subsequent to the jury rendering its decision, the Bislands moved for judgment notwithstanding the verdict and argued that Financial breached its policy and that they were entitled to damages as third-party beneficiaries to the policy. After considering the Bislands’ assertions, the district court granted the motion for judgment notwithstanding the verdict. Financial appealed and in Edmond L. Bisland Iii and Rhonda T. Bisland v. Background In 2004, Simmons worked for Lindig. While driving one of Lindig’s trucks, Simmons rear-ended a car driven by Edmond Bisland. As a result of the accident, Edmond sustained significant injuries, including injuries to his spine. Consequently, Edmond and his wife, Rhonda Bisland, filed suit against Simmons and Lindig.

After the appeal in the prior suit was filed, Simmons entered into an agreement with the Bislands under which he agreed to assign to them any claims that he had against Financial. In exchange, the Bislands agreed to not enforce the prior judgment against Simmons and to release him from all liability under that judgment. Similarly, Lindig entered into an agreement with Financial under which Lindig agreed to waive any potential claims against Financial in exchange for Financial agreeing to fully cover the costs of the prior judgment against Lindig and Simmons even if those damages exceeded the policy limits. Subsequent to Simmons and Lindig entering their respective agreements, the appeal in the prior suit became final, and this Court affirmed the district court’s judgment. N. CAROLINA ARRESTS FIVE IN STAGED ACCIDENT INSURANCE FRAUD Two others wanted for suspected insurance fraud

ALEIGH -Insurance Commissioner Wayne Goodwin today announced the arrest of five people in an insurance fraud scheme involving a staged auto accident in Durham County. The Department of Insurance requests assistance from the public in locating two additional suspects. Natoyia Barbee, 29, of Wyldewood Drive, Durham, was charged with one count each of obtaining property by false pretense, attempting to obtain property by false pretense, conspiracy to obtain property by false pretense,

and two counts of insurance fraud. Barbee was placed under a $30,000 secured bond. Ernest Bostic, 30, 3439 Glasson St., Durham, was charged with one count each of obtaining property by false pretense and attempting to obtain property by false pretense, as well as two counts each of conspiracy to obtain property by false pretense and insurance fraud. The bond amount for Bostic has not been set; Bostic was incarcerated at the time of the arrest. Tomika Green, 33, of 1819-D Haverford Road, Durham, was charged with two counts each of obtaining property by

false pretense, conspiracy to obtain property by false pretense, insurance fraud and misdemeanor child abuse. Green was placed under a $20,000 secured bond. Walter Harris, Jr., 36, 1512 Wabash St., Durham, was charged with one count each of obtaining property by false pretense, conspiracy to obtain property by false pretense and insurance fraud. The bond amount for Harris has not been set; Harris was incarcerated at the time of the arrest. Lachuante Rankin, 30, of 300 Macon St., Durham, was charged with one count each of obtaining property by false pretense and attempting to obtain property by false pretense, as well as two counts each of insurance fraud and misdemeanor child abuse. Department of Insurance criminal investigators allege that between May 4, 2011, and May 22, 2011, the suspects staged three automobile accidents, during which several suspects claimed to be injured and submitted fraudulent insurance claims to Nationwide Insurance Company and Progressive Insurance Company. Nationwide and Progressive representatives alerted the Department of Insurance after discovering that all three accidents involved the same suspects as either passengers or drivers. More than $14,000 had been paid by the insurance companies to the suspects for their medical claims. The alleged child abuse charges stem from allegations that Green and Rankin’s children were passengers in the vehicles during the time of the staged accidents.

WASHINGTON EXAMINER: HEALTH INSURANCE PREMIUMS COULD INCREASE 400% AS A RESULT OF OBAMACARE

ashington D.C. - The Affordable Health Care Act? Really? Not according to 17 of the nation’s largest health insurance companies who predict that premiums will at least double - some saying they will soar to 400% of current prices. The 17 companies include Aetna, Blue Cross Blue Shield and Kaiser Foundation. According to a recent report by the Washington Examiner, “New regulations, policies, taxes, fees and mandates are the reason for the unexpected “rate shock,” according to the House Energy and Commerce Committee, which released a report Monday based on

One company said that new participants in the individual market could see a premium increase of 413 percent when new requirements on age rating and required benefits are taken into account, said the report. “The average yearly cost for a new customer in the individual market grows from $1,896 to $3,708 -- a $1,812 cost increase.”

INSURE.COM SURVEY OF MARRIED ADULTS SHOWS MEN MORE DECEPTIVE ON ACCIDENTS AND TICKETS THEN THEIR WIVES

W

hen your spouse drives away from home, there’s a good chance they’re harboring some secrets about their driving. Like having dinged the car and blamed someone else, or knowing they’re driving uninsured.

In a new survey of married adults by Insure.com: 35 percent of respondents admitted to dinging the car and telling their spouse someone else did it. 25 percent said they’d received a traffic ticket and kept it secret from their spouse. 24 percent said they’d kept a car accident secret from their spouse. 19 percent hadn’t told their spouse that they had forgotten to pay an auto insurance bill. 15 percent admitted they had knowingly driven without car insurance but not told their spouse. Men have a higher propensity for lying across the board. When results for wives vs. husbands were examined, Insure.com found that 42 percent of men dinged the car and blamed someone else, compared to 27 percent of women. Married men also display a high distrust of their wives, albeit 14

unfounded. Husbands suspect their wives of lying far more than their wives actually do.

Investigation involved 3 arson fires set to defraud insurance companies

ALLAHASSEE – Florida Chief Financial Officer and State Fire Marshal Jeff Atwater, Marion County Sheriff Chris Blair and the Bureau of Alcohol, Tobacco, Firearms and Explosives today announced multiple arrests in “Operation Christmas Tree,” an investigation into a series of residential structure fires in Marion County. The investigation resulted in the arrest of five individuals charged with organized fraud, arson and burning to defraud the insurer.

ALLAHASSEE Florida Chief Financial Officer Jeff Atwater announced today the arrests of Derek Shawn Kellog, 31, Crawfordville; Corey Jermaine Brownlee, 30, Jacksonville; and Sean McCaslin, 49, Tallahassee; employees of Roofmasters, Inc., for acting as unlicensed public adjusters while

soliciting homeowners for roof repairs in the Tallahassee area. An investigation by the Department of Financial Services’ Division of Insurance Fraud revealed that Roofmasters, Inc., based in Jacksonville, used high-pressure sales tactics and informed homeowners they were “insurance specialists” and could assist them in dealing with their insurance companies. Company literature notes that homeowners may be entitled to a new roof with no out-of-pocket expense. Roofmasters, Inc. submitted an insurance claim on behalf of a homeowner, violating Florida law. Kellog, Brownlee and McCaslin were booked into Leon County Jail. If convicted, they each face up to 5 years in prison. tlanta – Insurance and Safety Fire Commissioner Ralph Hudgens announced today that Smokey, the state’s fifth arson dog, passed away this morning after a brief illness. “We’ll always remember Smokey as a valuable employee in the fight against arson,” Hudgens said. “His death leaves a great sadness within

lthough I never thought I’d see the day, I’m going to be 62 this year and I’m eligible for Social Security. I know that if I wait longer to apply, the benefit amount increases but I’m not sure how to calculate the wisest course to maximize my benefit over the long term. I’d appreciate any assistance the Advisor can offer. I love the Insider - can I still receive if I retire? J.D. Atlanta, GA Your question will be one asked often by “baby boomers” moving into retirement age - and it does require some analysis. The first question you need to ask yourself is this: “How long am I going to live?” If you are in excellent health and plan on living to age 100 like both of your parents, you may decide differently from someone morbidly obese with a family history of premature death due to heart disease. If you have a reasonable belief that you will not survive beyond, say, age 75, you clearly want to begin taking benefits as early as possible. Conversely, you may do better by waiting longer to take your benefits if you have reason to believe you will live long - and don’t participate in base-jumping, motocross racing or mountain climbing. According to the SS administration, you may start receiving benefits as early as age 62. However, if you start your benefits early, your benefits is reduced about one-half of 1 percent for each month you start your Social Security before your full retirement age. full retirement age is 66 and you sign up for Social Security when you are 62, you would only get 75 percent of your full benefit. Sounds like a person should wait to receive more? Not necessarily... The Advisor ran the numbers on a typical recipient born in 1951 and eligible for $1659 per month now at age 62 - or $2200 if they wait till age 66. If you take your benefits now, you will have already received just under $80,000 before your 66th birthday. If you wait to age 66 to begin benefits - you will be in your 78th year before you break even on total benefits paid - much longer (well into your eighties) if you account for the time value of the $80,000! The Advisor says to take your benefits now and don’t bet on living to 100. Like it or not, the average life span for a person living at 65 years is another 19.1 years - or age 84. If you

die at a younger age and waited until 66 to take your benefits, you lost! In our opinion, J.D., it makes no sense to gamble that you are going to beat that statistic by a sufficient amount to risk losing that initial $80,000. Note also: If you work but start receiving benefits before full retirement age, $1 in benefits will be deducted for each $2 in earnings you have above the annual limit. In 2013, the limit is $15,120. In the year you reach your full retirement age, your benefits will be reduced $1 for every $3 you earn over a different annual limit ($40,080 in 2013) until the month you reach full retirement age. Once you reach full retirement age, you can keep working, and your Social Security benefit will not be reduced, no matter how much you earn. TEXAS CONGRESSMAN TED POE SHINES LIGHT ON COMPACT FLUORESCENT BULBS

Congressman Ted Poe, (R-TX) offers an excellent summation of the ineptedude of our well-meaning but naive lawmakers as it concerns legislation (Energy Independence & Security Act of 2007) prohibiting the manufacture or sale of incandescent lightbulbs after this year. Like so many earnest, well-intentioned, save-the-planet efforts, this legislation creates a boat load of unintended consequences - some of which run completely contrary its stated purpose of securing our environment by saving energy.

On top of that list would be serious concerns regarding the mercury content contained in each CF bulb sufficiently dangerous for end-users (you) so that the EPA has published a 3-page, singlespaced paper docmenting the procedures that must be followed in the event a CF bulb is broken, including evacuation of the area for at least 15 minutes - and disposing of the refuse in designated collection centers. When you break a CF bulb, be prepared to take half a day off from work to deal with the emergency. How many will?

Watch on the go Streaming video isn’t just for TVs and computers, however. Maybe you want to watch video on the go with a tablet or smartphone. Because online services are Web-based, it’s no problem, as long as you have a decent Internet connection. Certain services work best with certain types of mobile gadgets. For example, Amazon will stream video to almost any tablet, but it works best with Amazon’s own Kindle Fire. However, it doesn’t have a smartphone app, while Netflix does. If you already have a mobile gadget, or are planning to purchase new ones, make sure they play nice with the services you use.

Mix and match There’s no rule that says you have to choose just one of the options above. You can stick with cable for now and gradually explore free streaming video services.

Don’t forget that cable companies want to keep you as a customer. They’re upgrading their services and trying new promotions to make their offerings more attractive. ZALMA pay $1,449,233.06. Accounting for the fact that Financial did ultimately pay the full amount of the prior judgment as well as post-judgment interest on that amount, the Bislands concede that Financial was entitled to a credit of $1,449,233.06. Even assuming that the Bislands were in the correct procedural posture to bring a third-party-beneficiary claim against Financial, a person who sues for performance of a contractual obligation, whether as a party to the contract or as a third party beneficiary, must prove that all contractual conditions have been satisfied. Any right to enforce the policy would have been extinguished when Financial paid the full value of the prior judgment and accompanying interest, including the value of the policy limits that the Bislands insist that they were entitled to when the trial court’s judgment in the prior case became final. In other words, once

Financial complied with the terms of the insurance policy and fulfilled its obligation to pay, the Bislands’ ability to enforce the agreement and compel Financial to pay was exhausted. Although the Bislands attempt to morph Financial’s alleged failure to timely pay into a new and independent cause of action, the amount requested for that claim as well as the credits that the Bislands afforded to Financial for paying the prior judgment demonstrate that the relief that the Bislands were seeking in the current suit was the time value for the delay in payment; however, as discussed previously, the Bislands were compensated for the delay in payment when Financial paid postjudgment interest on the damages awarded by the prior judgment, and the Bislands have not asserted that the amount paid as post-judgment interest was somehow deficient. Since the appellate court overruled all of the Bislands’ issues on appeal and determined that the district court erred by granting the Bislands’ motion for judgment notwithstanding the verdict, the judgment was reversed and the trial court was ordered to render judgment in favor of Financial in accordance with the jury’s verdict.

ZALMA OPINION This is an example of greed going too far. It is an expenditure of time and lawyers fees to gain more money from an insurer who agreed to, and did, pay a judgment in excess of its policy limits by a factor of three only to be sued for more.

Insurance should only pay what it promises to pay. The plaintiffs should have thanked Financial for agreeing to pay the full judgment plus interest rather than sue for more.

OBAMACARE DRIVES UP INSURANCE PREMIUMS BY UP TO 146 PERCENT IN CALIFORNIA And it’s named “The Affordable Care Act?”

orbes reported recently that California’s brand of Obamacare, Covered California, will cause residents to experience rate increases ranging from 64 to 146 percent. In the Forbes report, they wrote that a healthy, non-smoking 25-year-old man now paying $92 per month for the cheapest available plan could expect to pay $184 per month under California’s Obamacare, dubbed “Covered California.” The news is worse for the next age group over 30. A healthy, nonsmoking 40-year-old would be forced to pay $261 per month under CC’s cheapest plan (Bronze) with the least benefits while pre-Obamacare rates averaged less than $125. News of the increases contradicts specific claims made by President Obama early in May when he remarked, “Whenever insurance premiums go up, you’re being told it’s because of Obamacare — even though there’s no evidence that that’s the case.”
