5 SIMPLE STEPS TO A FASTER COMPUTER

ne of the best things about a new computer is the speed. It boots fast, opens programs like a dream and generally doesn’t leave you checking your watch.

Of course, the longer you use a computer, the slower it gets. It’s tempting to buy a new computer or call a professional, but I wouldn’t just yet. You can get back most of the speed with a few free tricks. They’re simple enough for anyone to do, and your wallet will thank you. Before going on, I’m going to bring up one caveat. If you’re using a Windows XP computer, plan to get a new one soon. XP’s end of life is coming up on April 8, 2014. It’s already lacking newer security features. It will only g e t

less secure once Microsoft stops releasing security updates. Click here to learn more about the future of XP.

1. Speed up your startup The most annoying computer slowdown for most people is startup. Even new computers can take a few minutes to start. After years of use, it can seem like hours. Your computer spends much of that time starting third-party programs. Security software, printer software and driver updaters are just a few examples. The frustrating part is that many of these don’t need to run at startup. Autoruns is a freebie that can help reduce the load. It finds and disables u n n e e d e d programs so they don’t slow you down. But it won’t stop impor tant startup

processes, like security software. Startup Delayer is a good program if you want more control. You can tell what programs to start when. That way, they’re not fighting for system resources. If you have a Windows 7 or 8 computer, you might invest in a solid-state hard drive. These are much faster than conventional hard drives. It can bring your startup times to well under a minute. SSDs are still small and expensive - a 128 gigabyte SSD costs $110 to $150 - but that’s less than a new computer. Before you put down any money, however, read on.

2. Clean the clutter Another thing that slows down your computer is a cluttered hard drive. In the past, you had to worry about a full hard drive. Thanks to modern large-capacity drives, filling the space isn’t easy. Still, even coming close can slow down your system. So, if you have less than five gigabytes of free space, it’s time to clean. Use a free disk-visualizing program such as WinDirStat to see what applications and files are taking up the most space. Move spacehogging files you need to an external drive and delete the ones you don’t. Grab Revo Uninstaller to thoroughly remove any programs

In 2002, the General Assembly enacted the Medical Care Availability and Reduction of Error (MCARE) Act. The MCARE Act addressed a newly perceived crisis, i.e., the cost of medical malpractice insurance. There was concern that the cost of medical malpractice insurance in Pennsylvania had increased to the point that physicians educated and trained in Pennsylvania were leaving to set up practice in other states where the costs of this insurance were lower. Relevant to this case, the MCARE Act established the MCARE Fund. The MCARE Fund was set up to provide insurance coverage in excess of the mandatory levels of primary medical malpractice coverage. The MCARE Fund is scheduled for termination. To that end, the MCARE Act has established a schedule for continued increases in the amount of primary coverage that must be purchased by health care providers and continued decreases in the amount of excess coverage that will be available from the MCARE Fund. This past week President Barack Obama spoke at the NAACP, and announced that he is working hard to prevent those who would, from making Law where Voters must prove by showing their photo identification, like their Driver’s License, that they are entitled to vote. Forget that they must show their photo ID to enter the Democratic Party Convention Hall, forget that Voters must present their photo ID to enter an airplane, forget that Voters must present their Photo ID to enter a myriad of places designed to make certain that the person accessing that facility or receiving the “privilege” given them as a means of assuring those in charge that the individual is entitled to access or to receive that privilege, some believe that no one should have to prove that they are entitled to vote. Or is it that some know that those not entitled to vote will vote anyway, and they don’t want anyone or anything to stand in the way of a vote, legal, or Illegal? Addressing those present at the NAACP meeting, President Obama said, in effect, “I am 12

doing all I can to prevent those who promote Voter ID from succeeding. Now I need you to help me sell ObamaCare!” It’s called, “Tit for tat.”

NORTH CAROLINA INSURANCE AGENT CHARGED WITH EMBEZZLEMENT

R

ALEIGH -Insurance Commissioner Wayne Goodwin today announced the arrest of Gina Peeler Wagner, 46, no known address; she was charged with one count of embezzlement by an insurance agent. Department of Insurance criminal investigators allege that between January and September 2012, while working as a licensed insurance agent, Wagner received insurance premium payments of approximately $10,000 from 30 individuals, but did not apply the funds to their accounts. Investigators accuse Wagner of keeping the money for her own personal use. The N.C. DOI also announced the arrests of Johnny Ball, 49, and Joni Ball, 49, both of 154 Kitty Noecker Road, Pink Hill. Each was charged with one felony count of insurance fraud and one county of obtaining property by false pretense. Department of Insurance criminal investigators accuse Johnny and Joni Ball of submitting a fraudulent claim to Nationwide Agribusiness Insurance Company in the amount of $6,000 for the rental of a camper after a fire at their shared Jones County residence in February 2010. Investigators allege that the couple did not rent a camper and manufactured a fraudulent receipt. 13


FLORIDA ANNOUNCES FIRST CONVICTION OF STAGED MOTOR VEHICLE ACCIDENT IN LEE COUNTY

ALLAHASSEE – Florida Chief Financial Officer Jeff Atwater today announced the conviction of Alain Guevara, 29, of Lehigh Acres for staging a motor vehicle accident. Guevera pleaded guilty this week at the beginning of a jury trial scheduled in the 20th Judicial Circuit Court, making it Lee County's first conviction involving a staged motor vehicle accident, which carries a two-year minimum mandatory sentence. “I applaud the hard work of our fraud investigators for thoroughly investigating all leads to bring this individual to justice,” said CFO Atwater. “We will not tolerate anyone who cheats the system, because it steals from every honest Floridian.” An investigation by the Department of Financial Services’ Division of

OHIO DOI: HEALTH INSURANCE PREMIUMS TO INCREASE 41 PERCENT DUE TO OBAMACARE Insurance Companies’ Costs To Insure Increase 83% Premiums for Federal Exchange Show Higher Costs for Ohio Consumers and Small Businesses

OLUMBUS — The Ohio Department of Insurance announced today that individual consumers buying health insurance on the federal government's health insurance exchange for Ohio will pay an average of 41 percent more than they did in 2013. In addition, ODI confirmed previouslyreleased preliminary calculations that insurance companies’ costs to provide individual health coverage will increase by 83 percent. “Ohio has traditionally had a more competitive health insurance market than other states with a wider range of prices and choices – from simple, high deductible coverage to comprehensive, full service plans,” Lieutenant Governor Mary Taylor said. “That level of diversity is essentially outlawed under Obamacare so Ohio's rates and premiums are going up significantly, and going up more than in other states where prices were already high.”

Premiums Increase 41% The Department utilized a National Association of Insurance Commissioners (NAIC) report of www.underwritersinsider.com

Individual exchange plan premiums are expected to increase on average by 41 percent in 2014 compared to 2013, while exchange plans for Ohio's small businesses will increase on average by 18 percent. For individual health insurance plans, a total of 12 companies offering 200 different plans have been approved by the Department for the exchange. Open enrollment for the exchange will begin on October 1, 2013. For small group health insurance plans, 6 companies offering 184 plans have been approved to sell on the exchange. Based on premiums for the current individual market, plans in Ohio today cost on average $236.29 per month compared to $332.58 in 2014. For the small group market, today’s premiums average is $341.03 per month compared to $401.99 in 2014. An example of the difference between premium and the cost to provide coverage is that premiums do not include cost sharing paid by the consumer, whereas cost includes both the cost to the company to provide the coverage and the cost sharing paid by the consumer.

Insurance Companies’ Costs to Insure Increase 83% Estimates from a Society of Actuaries study released in 2013 showed Ohio’s

current average cost to provide individual health insurance coverage is $223. Based on the rate filings approved by the Department, the average cost to provide coverage for individuals purchasing health insurance on the exchange in 2014 is $409 representing an increase of 83 percent when compared to the Society of Actuaries study. During the two month review process, the Department requested changes to submissions that in some cases resulted in rate adjustments. Ohio law requires all companies selling products in Ohio, including on the exchange, to justify rate submissions and any rate changes for 2014 by using sound actuarial judgment. The intense review process the Department conducted (as it does with all insurance products sold in Ohio) is to protect consumers from rates that are too high and to protect against company insolvency in which rates are too low and companies are unable to pay a consumer’s claim. Ohio is one of many states to recently release final exchange rate numbers and each state’s experience is different. lorida Insurance Commissioner Kevin McCarty announced today that a life claim settlement agreement has been reached with ING Life Insurance and Annuity Company (ING) and its affiliates. The settlement with ING is the seventh life claim settlement agreement reached for Florida. These seven insurers represent approximately 40% of the market for life and annuity products. Nationally, the focus continues to be the examination of the 33 remaining top national life and annuity insurers. The settlements focus on the insurers’ appropriate use of the U.S. Social Security Death Master File (DMF) to locate beneficiaries and then promptly remit payment to the unclaimed property division of each state for beneficiaries that cannot be located.

he Federal Government has indicted a Texas lawyer alleging he siphoned over $12 million from insurance plan administrators in a scheme they characterized as Ponzilike. Hugh Lappe Scott Jr., 62, was charged with 22 health-fraud counts and an additional 20 counts of theft from the health care benefit program via his re-insurance business - which purported to provide “stop-loss” coverage to the plan. lorida Insurance Commissioner Kevin McCarty announced today the release of the Report of the Multistate Targeted Market Conduct Examination of MassMutual Financial Group (MassMutual). The examination of MassMutual began in December 2012 and was managed by New Hampshire as part of the ongoing efforts being guided and coordinated by the National Association of Insurance Commissioners (NAIC) Life/Annuities Claim Settlement Practices Task Force, which is chaired by Commissioner McCarty. The Task Force is focused on investigating how life and annuity insurers have utilized the Social Security Death Master File (DMF) to identify deceased life insurance policyholders and annuitants and the efforts these insurers have undertaken to either pay beneficiaries or report and remit unclaimed property to the appropriate agencies.

3. Pick up the pieces Files on a hard drive aren’t like files in a filing cabinet. On a hard drive, files become fragmented. Bits and pieces of them get scattered around the drive. This increases the time your computer takes to open them. That’s why there are defragmenting programs. These assemble the pieces so they’re easier to find. With Windows Vista, 7 and 8 this isn’t such a big deal anymore. They run the built-in defragmenter automatically on a schedule. To check when it runs, go to Start, or go to the Start Screen in Windows 8. In the search bar, type “defrag” (minus quotes). ZALMA The aggregate assessment must raise funds “sufficient” to meet the specified purposes in the statute. This means that the MCARE Fund must begin its annual aggregate assessment calculation with its unspent balance and add to it the amounts “sufficient” to cover the prior year’s claims and expenses and to “provide a 10% reserve” not a 64% reserve. The fact that the General Assembly chose to limit distribution of any balance in the MCARE Fund at termination to those that participated in the Fund in the preceding calendar year indicates that the legislature intended a direct correlation between the actual MCARE Fund balance at termination and the population of providers assessed in the prior year. Requiring health care providers to fund a new 10% reserve every assessment year, without regard to the monies already held by the MCARE Fund, defeats the stated goal of the statute to provide affordable excess insurance. Such an approach repeatedly and needlessly charges participating providers an assessment in excess of what is necessary to fund the statutorilyrequired 10% reserve. Because the population of providers changes over time, the providers who enter such a system in the earlier years will end up subsidizing the participating providers in the later years. This is unfairly discriminatory. For all of the foregoing reasons, the court reversed the order of the www.underwritersinsider.com

ZALMA OPINION The MCARE law was designed to die over time. It, and its predecessor, is an example why a governmental entity should never get involved in insurance because they do not understand what insurance is or how it works in the real world. Medical Malpractice Insurance is a risk sharing device where many health care providers pay into a fund so that there is sufficient money available to indemnify those who are sued for malpractice. The “crisis” laws like the MCARE law were designed to resolve arose because doctors who erred were sued regularly and successfully until insurers found a need to raise premiums to a level necessary to cover the payments and make a profit. To salve the “crisis” the government decided to provide a form of insurance rather than resolve the problem caused by its tort system. Since governments should not make profits and do not know what to do with a profit if it was made by accident or by a poorly designed system that has no relationship to the long term thinking of an insurer. The law here was made specifically to protect those who paid into the fund and to return excess, unspent, monies to the providers who paid into the fund. It is not a premium but a tax where health care providers are compelled to buy both primary insurance in the market and excess from MCARE. This case is instructive as government

continues to place itself into the business of insurance where, whatever the government calls insurance, is, in fact, a method of government largess. For example the National Flood Insurance Program, FAIR Plans, and the Affordable Care Act, have nothing to do with insurance since they are not risk sharing devises but are, rather, devises that take tax money from the country or state as a whole, to provide insurance like benefits to a special category of people like those who live near a river that regularly floods, people who live in high fire risk areas or people who are ill but decided not to buy insurance. The report, based on Allstate claims data, ranks America's 200 largest citiesi in terms of car collision frequency to identify which cities have the safest drivers. This year's top honor of "America's Safest Driving City" is Fort Collins, Colorado, the third time in report history that this city has held the top spot. Fort Collins has placed in the top ten every year since the report's inception. This year, the results indicate the average driver in Fort Collins will experience an auto collision every 13.9 years, which is 28.2 percent less likely than the national average of 10 years.

Allstate’s auto policies represent about 10 percent of all U.S. auto policies, making this report a realistic snapshot of what’s happening on America’s roadways. SAN ANTONIO TEXAS INSURANCE AGENT PLEADS NO CONTEST TO FELONY THEFT OF INSURANCE PAYMENTS

AN ANTONIO – Jennifer Marez, 35, of San Antonio pled no contest to a seconddegree felony of theft of $100,000 to $200,000 in Bexar County 187th District Court on August 27. As a

condition of her plea agreement, Marez faces up to 10 years in prison and is required to permanently surrender her insurance adjuster license. While employed as a licensed adjuster, Marez allegedly approved 19 payments to herself from the accounts of 18 unknowing claimants. Two of the payments were cancelled prior to issuance, but the remaining 17 payments totaling $157,727 were routed directly into her personal bank account. In order to avoid scrutiny by her employer, Marez issued the payments in the names of her son and husband. Marez’s employer discovered the theft and reported it to law enforcement. The Texas Department of Insurance Fraud Unit conducted the criminal investigation of the case. Sentencing is set for September 23, 2013.
