INDEPENDENT CONTRACTOR OR EMPLOYEE?

U

nder United States common law, a worker is an employee if the person for whom he or she works has the right to direct and control the way he or she works, both as to the final result and as to the details of when, where, how, and in which sequence the work is to be done. It is the IRS' view that the employer need not actually exercise control. It is sufficient that it has the right to do so. Here are 20 questions the IRS will use to determine if workers are company employees or true independent contractors. The IRS considers any “yes” answer to be evidence of an employer/employee relationship.

The 20 Questions

1. Do you provide the worker with instructions about when, where, and how the work is to be done? 2. Do you provide training to the worker to enable them to perform a job in a particular method or manner? 3. Are the services the worker provides integrated into your business operation? 4. Is the worker prohibited from delegating work to others? 5. Does the worker have the capability to hire, supervise, or pay assistants to help them in performing the services under contract? 6. Is the relationship between the person or company performing the services and you a continuing relationship? 7. Do you set the hours of service for the worker? 8. STOP SKIMMERS FROM STEALING YOUR MONEY

ne of the more successful tools of 21st century crooks is the skimmer. Thieves attach them to ATMs, gas pumps and other places people swipe their credit and debit cards. Once in place, this sneaky bit of electronics steals the magnetic strip information from your card.

The thieves use this information to clone your card, and once they have a clone, they can drain your bank account, or run up huge bills and trash your credit before you even know it. That’s one reason credit card companies and stores are switching to EMV cards, or “chip” cards, but it will take a while before every retailer supports them, which leaves you vulnerable.

An overlay skimmer is one that fits over the card reader slot of an ATM or gas pump. For old or lowquality overlay skimmers, there are a few things you can look for.

How bad is skimming? Using skimmers, thieves have stolen untold millions of dollars. Last year, four men were arrested for allegedly stealing $2.1 million using skimmers at gas stations across the South. Let’s say the average gas transaction was $50. Mr. Gohagan asserted claims against Campbell for the injuries, and Mrs. Gohagan sought compensation from Campbell for loss of consortium. The Gohagans reached a settlement with Campbell, which included Cincinnati’s payment of the $1,000,000 per-occurrence

limit under the Cincinnati-issued CGL policy held by Campbell and his wife. However, the Gohagans reserved the right to litigate whether Campbell’s BOP policy, which also had a $1,000,000 each-occurrence limit, provided additional coverage.

ANALYSIS

Cincinnati under the CGL policy, their appeal fails if the BOP and CGL policies’ anti-stacking provisions limit the combined total of coverage for Mr. Gohagan’s injury to $1,000,000. The declarations pages of both the BOP and CGL policies refer to an “Each Occurrence Limit” of $1,000,000 and a “General Aggregate Limit” of $2,000,000. The Eighth Circuit Court of Appeal saw no ambiguity in the wording of the various policies. An ambiguity exists when there is duplicity, indistinctness, or uncertainty in the meaning of the language in the policy. Language is ambiguous if it is reasonably open to different constructions. A contract or provision is not ambiguous merely because the parties disagree over its interpretation.

Although the parties stipulated to the fact that the BOP policy was in effect when Mr. Gohagan was injured, Cincinnati contended that the BOP policy’s bodily injury liability coverage did not apply to Mr. Gohagan because the injury did not arise out of Campbell’s ownership, maintenance, or use of certain business premises in Waynesville, Missouri, as the BOP policy required. The Gohagans’ last gasp interpretation – reading the “other insurance clause” standing alone – mistakenly relies on reading an individual provision in isolation from the rest of the policy, an approach that would leave the anti-stacking provisions meaningless. The district court correctly determined that the “Other Insurance” provisions apply when policies covering the same injury are issued by Cincinnati and another insurance company, not when two policies are issued by Cincinnati. have been writing about the political machinations involved in the corrupt development of this poorly designed and implemented law ever since Barack Obama and his Team ObamaCare began the process of creating this politically motivated law, but now the true harm of this law has hit home in the most personal of ways. My 44-year-old son and 47-yearold daughter have now become victims of this corrupt law that was supposed to help those who need it most. More on them in a minute. A close friend of mine has a 21-year-old daughter and 24-year-old son both of whom are facing the same problems and have been for years. They were declined coverage because they made too much money and

were kicked over to Medicaid. However, as the ObamaCare Internet structure has never truly worked properly they had to wait over a year to even be covered at all. Frustrated by the hurdles Mr. Obama placed in his secretly crafted law (“We have to pass it before we can know what is in it!” ~ Nancy Pelosi, then Speaker of the House), they dropped any attempt to be covered.

FLORIDA INSURANCE AGENT ARRESTED AFTER DEFRAUDING CLIENT OF MORE THAN $200,000 IN ANNUITY PAYMENTS

RADENTON, Fla.— The Florida Division of Insurance Fraud (DIF), which operates under the direction of CFO Jeff Atwater, today announced the arrest of Timothy T. Rush, a 38-yearold Bradenton-based insurance agent, for allegedly stealing $224,600 from an unsuspecting Port Charlotte resident; funds that were believed to have been used to purchase an insurance annuity. In the early 2015, the Manatee County Sheriff’s Office received a complaint involving Timothy T. Rush after one of his clients suspected that the money he had been paid was not being used for the insurance annuities that Rush and his client had agreed upon. Following that initial complaint, DIF and Florida’s Division of Agents and Agency Services launched an independent investigation into the practices of Timothy Rush.

VALLEY AND BUTTE FIRES CAUSE AN ESTIMATED $1 BILLION IN INSURANCE LOSSES IN CALIFORNIA

S

ACRAMENTO, Calif. — Two of the most destructive fires in California's history, the Valley and Butte Fires, ravaged nearly 150,000 acres in Northern California last fall and caused an estimated $1 billion in insurance losses. The Valley fire pillaged 1,958 structures in Lake, Napa and Sonoma counties, resulting in approximately $700 million in insured losses and making it the third most damaging wildfire in state history based on total structures burned. In terms of structures lost, the Butte Fire is the seventh most destructive fire to hit California, damaging 818 structures in Amador and C a l a v e r a s counties and causing an estimated $300 million in insured losses. "The Valley and Butte fires were sober reminders

UNLICENSED SOUTH FLORIDA CLINIC OWNERS USE STRAW OWNER TO DEFRAUD INSURANCE COMPANIES OF MORE THAN $650,000

M

IAMI, Fla. - The Florida Department of Financial Services’ Division of Insurance Fraud (DIF) today announced the arrest of two unlicensed clinic owners from MiamiDade County. Noel Ruiz of Miami and Alberto B Franco of Hialeah were involved in a “straw owner” scheme that defrauded numerous insurance companies, resulting in more than $650,000 in financial losses. An investigation led by DIF revealed that in the time between December 2012

through legal documentation, the actual owner of the business is essentially left off of the books. In some cases, this scenario would occur as a legal way to keep the identity of the actual owner of the entity hidden. In other cases, a “straw owner” would act as a pawn to establish a business in order for unlicensed agents to conduct nefarious or illegal transactions under a legitimate license. DIF’s investigation revealed that Noel Ruiz was the actual owner of Rehab and Wellness Inc., a physical therapy clinic

hat’s with the closing of our POW camp in Guantanamo Bay, Cuba? (GITMO). Seems like a good place to keep the bad guys. Please clear up my confusion! J.R. New York, NY President Obama’s fascination with closing GITMO, an ultrasecure prisoner-of-war facility maintained on our naval base in Cuba is bewildering to say the least. Those who are more concerned with the rights and comfort of the radical Islamist prisoners rather than the safety of the American people tend to focus on habeas corpus issues and human rights allegations at the facility. The president has held the laughable opinion that GITMO is one of the terrorist’s main recruiting tools - as if to say America has lost her moral authority along with the respect and admiration of the terrorists by maintaining a camp for captured prisoners that many have called a “resort.”
