AN LUIS OBISPO, Calif. - Neal Moriarty, 38, a Cal Fire Captain, and Ross Moriarty, 42, a licensed insurance agent, were arrested last week on multiple felony counts of insurance fraud. The Moriarty brothers allegedly submitted a fraudulent claim and provided false statements to an insurer in order to collect money following an automobile accident. "Insurance fraud is an expensive drain on the state's economy, totaling billions of dollars annually," said Insurance Commissioner Dave Jones. "The cost of these scams is passed along to consumers through higher rates and premiums."

Why a Claims Made Policy Requires Claim Be Made During Policy Period

laims Made and Claims Made and Reported policies contain traps for unwary insureds who do not understand the limitations of that coverage. Unlike “occurrence” based policies if a claim is not made during the effective dates of the policy there is no coverage at all although premium has been paid to the insurer for years.

At some time between January and March of 2010, the Brown litigation settled for $877,243.03. Neither ACS nor Evanston participated in that lawsuit or settlement.

On September 10, 2010, HFHS sued ACT–1 and ACS In The ACT-1 Group, Inc. v. in Michigan state court for Alternative Care Staffing, the Eastern District of Michigan. indemnification in the Brown Inc., Slip Copy, 2015 WL Background lawsuit. the National Premium Budget Plan (NPBP), and the NPBP cancelled ACS’ insurance policy when ACS failed to make its monthly payments on the loan. ACS’ policy was cancelled effective March 25, 2009. Between March 25, 2009 and June 24, 2009, ACS did not have medical malpractice insurance coverage through Evanston or anyone else. On June 23, 2009, an application was submitted and confirmed that it was unaware of “any circumstances which may [have] result [ed] in a malpractice claim or suit being made or brought against [ACS] or any of [ACS’] employees.” As a result of the application, ACS began a new Evanston insurance policy on June 24, 2009, with no retroactive coverage. That policy lasted until June 24, 2010.

HFHS Contacts ACS

ACT–1’s attorney to the claims services manager at Markel. Two days later, John Foley, the claims manager for Evanston, contacted ACT–1’s attorney for additional information. Foley then assigned the claim to Jagady Blue, senior claims manager for Markel, for handling. Blue searched the record and concluded that no claim was made against ACS during ACS’ policy period that would have triggered coverage. ACS’ policy through Evanston expired on June 24, 2010.

Indemnification Suit On September 10, 2010, HFHS sued ACT–1 and ACS in Michigan state court for its settlement costs, plus additional costs and fees. On August 5, 2011, that court ordered ACT–1 to indemnify HFHS and entered judgment against ACT–1 for $877,243.03.

On September 9, 2008, Paradiso sent a letter to Corner asking her to tell ACS about the Brown litigation. In his deposition, Paradiso referred to this letter as a “notification letter” that contained “no claim request.”

ACT–1 sued ACS, Evanston, and Markel on July 15, 2013, claiming that ACS breached its subcontracting agreement by failing to indemnify ACT–1 in the Brown litigation. ACT–1 also sued Evanston and Markel No one at Evanston or on behalf as a third-party beneficiary of Evanston had any discussion under MCL § 600.1405, claiming with the owners of ACS or Corner that Evanston breached its 2008 until Fall 2009. Defendant moves for summary judgment on two grounds: (1) that ACT–1 failed to file a claim with ACS or Evanston during the period of ACS’ insurance coverage and (2) that Markel Corporation is not an insurer. ACS’ insurance contract provides claims-made coverage, which means that only claims first made during the policy period will be covered. ACS was covered by Evanston insurance from May 28, 2003 to March 25, 2009, under a policy with a retroactive date of May 28, 2003, and from June 24, 2009 to June 24, 2010, with a retroactive date of June 24, 2009. The retroactive dates in the policies bar claims first made against the insured before those dates. Accordingly, plaintiff must show that HFHS first made a claim against it during one of these policy periods. On May 11, 2009, eight months after sending the first letter, Paradiso sent a second letter to the office manager of ACS. This letter stated that HFHS “ha[s] provided [ACS] with a copy of the Summons and Complaint which [have] been served upon Henry Ford Hospital.” It then conveyed the intent to hold ACS liable for the harm caused by ACS’ employee, Noel, advising ACS that HFHS had decided to apply the contract provision requiring ACT–1 to indemnify and defend HFHS with regards to the claims See ZALMA Page 24 11

Thankfully, Barack Hussein Obama will not have another year to further take America down this road of providing less access to many more millions of Americans than were helped, to the health care that they need and deserve. Only the election of Hillary Clinton could continue unabated, the Obamacare Train Wreck we are witnessing today, as Ms. Clinton demonstrated in the early 90’s her desire to crush the Free Market private insurance system with her HillaryCare, which fortunately never saw the light of day, with the exception of Washington State, who overturned that misguided and politically motivated law two years after implementation, in 1995.

It will behoove America to make sure that no Democrat is elected to the Office of the Presidency in 2016. Their track record in the area of health care reform is demonstrably lacking. That said, so is the Republican Party’s track record. Obamacare, aka the UnACA (UnAffordable Health Care Act) would never have seen the light of day had the Republicans not also obviated their responsibility to the American Insurance consuming and Health Care consuming Public as they did for so many decades prior to the PPACA enactment in 2010. The fact is that for as long as any reading this can remember, we have had millions of Americans who could not access health care unless they had insurance to cover against a health care loss. Far too many Americans chose to not carry coverage even though they could afford it because they: • Would never need it. • Would never use it. • Didn’t trust insurance companies. • Didn’t care. Until they got sick or hurt and needed it. Then it was the insurance companies’ fault for not making insurance more affordable in the first place. Many more Americans could not access health care delivery when needed because they could not purchase insurance because they: • •

Could not afford the premiums. Could not qualify for Insurance policies because of pre-existing conditions.

Had the Democrats or Republicans or both in a bi-partisan effort developed and implemented needed insurance company reform to address these issues, Health Care Reform (HCR) would not have been needed. And as a qualifier to any who choose to mention controlling health care costs, as the Godfather would say, fo’gedaboudit. The UnACA not only does not control costs, costs have skyrocketed expressly because of Obama’sCare. When Special Interest Groups

like the Insurance Companies themselves, Big Pharmacy, the Unions, the NEA, the AMA, the American Hospital Association, and other groups who stand to make or lose money because of specific legislation, are consulted within closed door back rooms with the shades drawn, and corrupt deals are cut to encourage those Special Interest Groups to go along to get along, the ultimate loser is always going to be the American Public. President Barack Obama made no bones about his willingness to negotiate those corrupt deals to the detriment of the American health care consumer. MIAMI INSURANCE AGENT ARRESTED FOR DIVERTING PREMIUM FUNDS

IAMI, Fla. – The Florida Division of Insurance Fraud today announced the arrest of Tania Michel, 41, for failing to notify the Department of Financial Services of a federal fraud conviction, continuing to work in the insurance industry after having her license expire, and knowingly misappropriated premium funds while working at an insurance agency. For nine months, Michel worked at a North Miami Beach agency with an expired agent’s license and with an unreported federal felony conviction. By failing to reapply for her license, she was able to further

ALLAHASSEE, Fla. – The Florida Department of Financial Services’ Division of Insurance Fraud (DIF) today announced multiple arrests related to a large-scale personal injury protection (PIP) fraud scheme spanning across Central Florida. Five individuals have been arrested for their various roles in the scheme, and arrest warrants have been issued for three additional individuals whose arrests are pending. Three related arrests have been made in the Fort Myers area. DIF partnered with the Federal Bureau of Investigation (FBI) to

“PLANNED PARENTHOOD AND THE CONSEQUENCES OF SPEECH” By Jeff Atwater, Florida CFO

B

y now the videos of Planned Parenthood executives casually discussing abortion outcomes over lunch have been broadly distributed and widely viewed. They have occasioned an appropriate and long-overdue conversation on the nature of women's health care, its availability and adequacy. Merely marketing oneself as a source of women's health care is insufficient. Health care, above virtually any other service, must reflect the highest standards of care, compassion, sensitivity and ethics. The callous and insensitive manner in which Planned Parenthood executives view abortion should not only strip away any pretext to claims of selfless outreach but thoroughly condemn the value structure of the organization. Our reaction as a civil society to this abhorrent and inexcusable behavior will speak volumes about our standards and values as well. There are passionate people on all sides of the abortion argument. The ideas they espouse are, for the most part, deeply felt. One may vehemently disagree with public policy or judicial decisions, but no responsible advocate on either end of the equation has appeared more cavalier and coarse in the

accurate reflections of core values, they offer crystal-clear insights into the very nature of the speaker, and they are prisms that capture and magnify the soul and conscience of the individual. In short, they have very real meaning. FOUR MIAMI PIP FRAUD CONSPIRATORS ARRESTED

IAMI, Fla. - The Florida Department of Financial Services’ Division of Insurance Fraud (DIF) today announced four South Florida arrests of individuals on charges related to their involvement in three separate personal injury protection (PIP) fraud schemes that resulted in the billing of more than $145,000 in fraudulent insurance claims. Nayef Casas Diaz, owner of Miami PIP clinic M & N Rehabilitation Center, was arrested after allegedly organizing a staged accident scheme. Diaz reportedly paid each participant in the staged vehicle accident $1,000 to receive treatment from M & N and another clinic, Magic Hands Medical Service, for phony injury claims. As a result, fraudulent claims in excess of $63,000 were filed against the two insurance carriers. In a separate undercover investigation led by DIF, Alexis A. Gonzalez, owner of Health Max Medical Center (HMMC) in Hialeah, and HMMC clinic employee Erick A. Perez were both arrested for their involvement in a PIP fraud scheme. Last month state regulators in Missouri, Ohio, Indiana and Washington announced a regulatory agreement with American Modern over allegations that the company charged excessive rates in lender placed homeowners policies. In the settlement, American Modern agreed to pay $6 million in penalties and establish a $20.3 million restitution pool. The company gave no further explanation of the Rios’ departure in the announcement.”

class action suit has been filed against ten auto makers by consumers over deaths “caused by keyless ignitions.” The suit claims the vehicles were inherently defective because they did not shut themselves off. We are not kidding here folks: In a world where an injured party takes zero responsibility for his/her own actions, the consumers content in their suit, because there was no key, somehow they had every expectation that the vehicle should have known it was parked in a garage, the driver had departed, and it was time to kill the engine. There seems to be no limit to the creativity exhibited by a hungry plaintiff’s lawyer. Superior Court (Hartford)) ensures policyholders are protected from insurers refusing to cover thirdparty liability claims when the insured transfers the insurance benefits after the events triggering coverage have occurred but before claims are fully resolved. The court relied heavily on the amicus brief field by Insurance Commissioner Dave Jones, which argued that once an insurer accepts premium for a risk and the covered events occur during the policy period, the insurer’s obligation is fixed and it must defend the insured against subsequent third-party claims even if the insurance benefits are transferred to another entity before claims are fully resolved. In the Fluor v.
