2007, James and Clara had a liability insurance policy (the “Policy”) for their home—the home where James abused Ekaterina. State Farm seeks a declaratory judgment that it need not indemnify nor defend James and Clara. In January 2010 James Estes was charged in Kentucky state court with committing sexual abuse in the first degree against his granddaughter, Ekaterina Estes, who was then a minor. Ekaterina was younger than twelve, an aggravating factor that raised the crime to a Class C felony. James pled guilty one month later. He supported his plea with an admission that he had sexual contact with Ekaterina between February 2001 and February 2004. In exchange for his plea, the prosecutors recommended that he receive a five-year sentence, probated for five years. When Ekaterina turned 18 she filed suit against her grandparents. Along with her grandparents, Ekaterina also sued their homeowners’ insurer, State Auto Property and Casualty Insurance Company (“State Auto”), as The Underwriter’s Insider


well as “unknown insurance companies.” State Auto filed a declaratory judgment action in October 2013 in this Court. Though State Auto acknowledged that its homeowners’ insurance policy was in effect during the alleged harms, it argued that exceptions to its policy applied. This Court agreed. Likewise, State Farm— the “unknown insurance company”—filed a declaratory judgment action. It argues that the Policy does not cover the harms done to Ekaterina for three primary reasons: (1) her injuries did not occur during the effective dates of the Policy; (2) even if the injuries happened during the coverage period, they are still not covered because they were not caused by an “occurrence” or accident; and (3) as a final alternative, the intentional acts exclusion bars coverage. THE POLICY In October 2007 James and Clara applied for a “condominium unit owners” insurance policy for their residence in Louisville, Kentucky. State Farm issued the Policy; it became effective in December 2007 for a oneyear period. It still remains in effect. James and Clara owned no State Farm policies prior to December 2007. e are entering the 2016 campaign season in earnest. The Republicans have had two debates, one sponsored by FOX and one by CNN. While the Republicans are already duking it out, the Democrats will have their first debate, October 13, at 9:00 pm. It is important to note that Hillary R. Clinton (HRC), her poll numbers plummeting, is taking on the repeal of ObamaCare’s Cadillac Tax as a personal campaign pledge. Oh what Hillary won’t say or do to get elected, email scandals be damned: “Hillary vows to repeal key ObamaCare component: the Cadillac tax”. [HERE ]. The Cadillac Tax, one of the primary drivers for funding Obama’sCare in the long run, is scheduled to go into effect in 2018. But “Surprise, surprise!”, as Gomer Pyle of the Andy Griffith Show would say, now the Democrats are finding that this very unpopular tax might make a great vehicle for them to use to prove that

they really care about the American health insurance consuming public after having rammed this very unpopular law down America’s throat in the first place, against the will of the majority of Americans.

What exactly does the Cadillac Tax do? CLICK HERE! of companies say they will pay it. How do you avoid it? Change to higher deductible plans, reduce benefits, shift more costs to employees, or even drop highcost plans altogether. The tax is increasingly under fire from Congress. This marketplace reaction is fueling the bonfire. If no one pays it, how else will we pay for Obamacare? The Supreme Court upheld Obamacare as a tax law, and it contains many taxes. One tax that hasn’t yet kicked in is the Cadillac tax. In enacting the law in 2010, the Cadillac tax was buried, not applying until 2018. As the IRS gets ready for 2018, it released guidance setting out approaches to the excise tax. Like all of Obamacare, the Cadillac Tax is enormously complex and nuanced. Of all the taxes in the ironically named Affordable Care Act, none is more onerous than the Cadillac Tax. It is a big tax too, a whopping 40% on top of all other federal taxes. What’s more, it is an excise tax, one www.underwritersinsider.com

ALLAHASSEE, Fla. – Chief Financial Officer Jeff Atwater today released the following statement in support of Florida’s right to divest state funds from organizations that are engaged in prohibited business activities with state sponsors of terror. CFO Atwater also sent a letter today to Senate President Andy Gardiner and House Speaker Steve Crisafulli explaining that the pending federal Iran deal could undermine Florida’s existing sanctions against such entities. CFO Atwater urged the legislative leadership to act quickly to defend Florida’s established law on this critical issue. CFO Atwater said, “The sinister machinery of the Iranian regime is not news to Floridians. In fact, Florida was a leader—the first in the nation—to pass a law requiring divestment of public funds from companies that do business with Iran. FLORIDA INSURANCE AGENT ARRESTED FOR STEALING MORE THAN $20,000 IN CLIENT INSURANCE PREMIUMS

DAVIE, Fla. - The Florida Department of Financial Services’ Division of Insurance Fraud (DIF) today announced the arrest of Lisa Dwyer, 49, a formerly licensed insurance agent employed by Southeast Insurance Agency in Davie, after she allegedly stole more than $20,000 in premium funds from her clients.

During an eight month window of time, the owner of Southeast Insurance Agency discovered that one of his agents, Lisa Dwyer, had misappropriated, or stolen, insurance premium payments from his company’s customers.

The owner fired Dwyer and reported her actions to the Division of Insurance Fraud.

An investigation led by DIF in concert with the Department’s Division Agent and Agency Services revealed that more than 50 customers had some if not all of their premium checks stolen by Dwyer, for a grand total of just under $22,000 in wrongfully allocated insurance premium funds. According to Dwyer, much of the stolen funds were kept for her own personal use, but she claims to also have used some of the premiums to make payments on a few of the insurance policies.

The owner of Southeast Insurance Agency compensated for the fraudulent actions of the employee by ensuring sure that all affected policies were paid for and current. Lisa Dwyer was booked into the Broward County Jail and charged with Misappropriation / Diversion of Fudiciary Funds, a second degree felony, and bond was set at $3,500. The case is being prosecuted by the office of Broward County State Attorney Michael J. Satz. If convicted, Dwyer could face up to 15 years in prison and up to $10,000 in fines.

Investigators allege Blanton forged checks belonging to United Insurance, fraudulently made them payable to himself and deposited the money into his personal account on two occasions. Blanton released on a $125,000 bond. Goodwin also announced the arrest of William Edward Leiss, 41, of 301 Winrow Drive, Jamestown; he is charged with 12 counts of obtaining property by false pretense and one count

of attempting to obtain property by false pretense. DOI criminal investigators accuse Leiss of receiving $13,175.82 in commission from Americo Insurance by presenting false information on life insurance apps from October 2014 to January 2015. Investigators allege Leiss presented 11 forged applications, one application with false medical information and an application on behalf of a deceased man. Leiss was arrested on Sept. 1 in Guilford County and released on a $1,000 bond. 21
