I

t’s not often that I find myself writing my ed’s letter on an iPad in a remote luxury tented camp in the heart of Zululand. And dawn under canvas is an awakening like no other, with the distant roar of lion, followed by the sounds of buffalo and hyena, bringing me to my senses in a nanosecond! As you might have gathered, time spent in the bush is an essential part of my survival in the urban jungle, and I’m equally passionate about both. Every so often, I can see myself living on a wildlife estate – but then the attractions of the city on my doorstep pull me right back. But before I go all Out of Africa on you, let me tell you about this issue, one of my favourites to date. It has an undeniably global theme, with ‘Seventh Heaven’, our first international Show House, on page 18. A designer Parisian apartment nestled in the 7th arrondissement, a stroll away from the Seine’s right bank in the gracious Boulevard Saint-Germain, it couldn’t be better located. And yes, I could live in its designer interiors too… If you’re in the mood for a taste of the most inspirational art and design fairs overseas, our choice of three of the best, in Word On The Street on page 11, will take you to London, Paris and Bologna. But, having chosen to escape to the bush, I’ll be making appearances instead at 100% Design South Africa at Decorex in Jozi and also Open Design in Cape Town, both during August. See you there!

It’s that time of year again, when international jetsetting design and art aficionados have their itineraries full. Here’s what’s on. LONDON DESIGN FESTIVAL | 19-27 SEPTEMBER For the last 12 years, London Design Week has been an important event on the European design calendar, and this year is no different, with an exciting programme of over 350 events and installations planned. A pivotal part of the festival is its showcase of sitespecific landmark projects around London, demonstrating the full creative capacity of the city’s designers as well as the ability for design to stretch the limits of the imagination and reach a large audience. One such project is a collaboration between Hong Kong-based property developer Knight Dragon and conceptual artist Alex Chinneck in the Greenwich Peninsula called ‘A Bullet From A Shooting Star’, comprised of over 1 000 metres of steel and weighing 15 tons. Another, an installation by Mexican architect Frida Escobedo entitled ‘You Know You Cannot See Yourself So Well As By Reflection’, is a pavilion inspired by Tenochtitlán, an ancient Aztec city built on a lake. londondesignfestival.com

HENNESSEY 250 TOUR AND EXHIBITION | 20–25 AUGUST Premier cognac brand Hennessey celebrates its 250th anniversary this year with a global travelling art exhibition, featuring specially commissioned works that draw on the brand’s archival materials, portraits and films. Winter wonders Every detail of Jacques Erasmus’s Hemelhuijs restaurant in Cape Town’s CBD has been thoroughly considered, from his display of homeware items to the presentation of his delectable food. And his new winter menu, themed ‘humble beginnings’, has been given the same attention. An ode to wholesome homecooked comfort food, it centres on a myriad of tastes and flavours. JOIN THE CLUB Cape Town Club, established in 1858, has recently moved back to its original residence at 18 Queen Victoria Street, a beautiful labyrinthine building with chandeliers and winding polishedwood banisters, purpose designed as a clubhouse by Sir Herbert Baker in 1898. In classic members’ club style, its facilities are accessible to members only. However, it breaks the mould by holding occasional non-member evenings. Also open to the public is its new coffee kiosk. oulevard Saint-Germain’s wide tree-lined streets and grand decorative buildings are a relic of the reign of Napoleon III. Inspired by the architecture of the time in England, the emperor tasked Baron Haussmann to transform the face of Paris to reflect the same sense of grandeur, with the result that the avenue’s buildings feature beautiful balconies and cut-stone facades. Somewhere along this gracious avenue, in the 7th arrondissement and within walking distance of the Seine’s right bank, you’ll find an apartment that reflects every bit of that aspired-to prestige. Designer Gérard Faivre, instantly captivated by the space, was also sensitive to the importance of celebrating its heritage and retained many of the original features in his ultra-luxe final design, from the restored herringbone parquet and marble fireplaces to mouldings, door handles and stained-glass windows. While respecting these architectural elements, Gérard was mindful of rethinking the spaces in line with a more contemporary concept of comfort. This entailed reorganising spaces and upping the luxe factor for the bedrooms (adding ensuite bathrooms and designated dressing spaces), and creating a state-of-the-art kitchen, as well as introducing all the modcons that are de rigueur in 21st-century daily life, like home automation and air conditioning. In addition, to soften what he felt was a slight severity in the architecture of the Haussmannian

style, but at the same time honouring its stateliness, he introduced more organic shapes through high-end fittings and furniture. These curves now form a consistent theme throughout the apartment, rounding out its formality. From the curved padded headboards in a guest room to iridescent hanging panels that stand proud of the original moulding in the entrance hall, the effect is calm and feminine, and extremely polished. This sense of harmony illustrates just how clever Gérard has been in highlighting the apartment’s existing beauty, while updating it. As a specialist in creating luxury apartments, often in old buildings, he has mastered the balance of taking inspiration from the soul of a space as well as imprinting his own creativity on it, subtly paying homage while creating something entirely unique and new. The 11 large windows, for example, let in loads of light, which Gérard has played up with glossy surfaces and sheer and lustrous fabrics – velvet, silk. You can also see subtle nods to the decorative codes of the era in which it was built in the tones of gold and black that Gérard has peppered throughout – these were symbols of opposition used by the bourgeoisie. These also serve to ground the space, which on the whole is light, airy and ethereal. Then, at the other end of the scale, he’s custom-designed contemporary features and fittings in line with his specific vision. From large pieces like the curved freestanding headboards

and bookshelves down to decorative objets and even rugs, each decor element had to speak specifically to the apartment’s sensibility. The same applied when it came to choosing pieces by other designers, which Gérard selected to correspond with the themes of luxury and femininity he’d set in place. It’s for this reason that Spanish designer Jaime Hayon’s pieces are so prevalent throughout the apartment. In addition to his signature curvaceous aesthetic, which suited the concept for the space perfectly, his ability to blur the boundaries between decor and design resonated with Gérard, whose ‘Art Homes’ concept is about creating spaces that are complete works of art (more on this overleaf). As such, he views the spaces as blank canvases as well as a source of inspiration, where all the elements must work together to form a harmonious final picture. And, because he creates homes that are sold ready to move into, each aspect must be resolved to perfection. Not unlike an artist, Gérard has expertly wielded colour in accordance with the design philosophy of the spaces, and a muted but luxurious palette echoes the softness of the forms and fabrics. Pale blues, greys, pinks and oyster tones, with crisp white, are fresh and modern, yet understated enough not to overwhelm the subtle beauty of the restored herringbone floors and original wall mouldings. THE GÉRARD FAIVRE FORMULA A promoter of both pleasure and practicality, designer Gérard Faivre’s niche approach to design has secured him a reputation as a designer of desirable luxury homes. The ‘Art Home’ concept entails creating and selling apartments that are works of art – finished and ready to live in. The idea is that by choosing a Faivre design, the process is simplified and shortened. ‘Going through the whole process of looking for a property, acquiring it, refurbishing and decorating it, people often have to wait at least two years before fully enjoying the new property. We aim to reduce this delay to a maximum of two months,’ says Faivre. But convenience isn’t the only reason for going this route. Art Homes are also high design by definition, and by selecting only prestigious addresses and the finest design elements, Gérard has made his creations one of a kind – uniqueness being one of the three core principles of the concept. Gérard takes inspiration from each individual site when formulating his designs, and often decorates them with custom-designed furniture or one-off antiques, so no two properties are ever the same. The second principle is luxury – Gérard aims to push the standards of the homes he designs to the level of the best Parisian five-star hotels. Luxury to him means practicality as well as aesthetic value, so the electronic and homeautomation aspects are also always carefully considered. And, as is the case with hotels, the homes are 100 per cent ready to live in – the third key principle of this concept – and from art to objets, you can move in wihout hassle. Q&A Graphic artist and illustrator Atang Tshikare has put his creative design talents to a number of surfaces, from sneakers and murals to skateboards and wallpapers. We chat to him about how the growing trend of bespoke design and art translates onto wallpaper. zabalazaa.com Q: How different is your design process when designing wallpaper as opposed to other mediums? A: Wallpapers are more technical because you have to consider the size of the artwork and repetition. The colour range determines the flexibility of the type of rooms they can be placed in. You also have to be aware that wallpaper needs to make sense in combination with everything else in a room. Q: If there were one artist or designer whose work you’d love to see translated into wallpaper, who would it be? A: I think Tracy Lee Lynch is boundlessly creative and her work speaks for her as a stylist and curator. Looking at her office and her projects, I believe she’d make some pretty interesting wallpapers. For creative people who flow naturally between diverse projects, it’s usually easy to create a range of designs that can fit into many spaces. I think we’re similar because we create varied products and experiences from one inspiration.

FOR ART’S SAKE More and more designers, artists and photographers are finding new expression through wallpaper design, and as a result, new audiences. The spinoff for buyers? don’t like to live with clutter, although I find it interesting in other people’s houses,’ says Galia Gluckman. It’s a reasonable comment from a woman who is a wife, the mother of two children and ‘mother’ to two dogs, and who works from home and runs her household like an MD. But Galia isn’t your average housewife. She’s also an acclaimed mixed-media artist whose work is as untamed as it is controlled and intricate, an intriguing paradox that appeals to collectors, corporate and private, around the world. Her observation about other people’s clutter might seem flippant but it provides insight into her work, which is informed by the everyday tensions between chaos and order. Her largescale textured artworks are mesmerising – you can spend time getting lost in her detailed use of vibrant colour, crafted shapes, and textures achieved through tiny strips of multi-pigmented cotton paper. ‘I’ve always been drawn to collage to create abstract landscapes and cityscapes,’ she says. ‘This culminated in my most recent solo exhibition, “Scapes”, at Everard Read Gallery in Cape Town. It was an exploration of the fine line between order and disorder in our modern lives.’ How she and her husband, Gary, came to live in their beautifully curated family home provides further insight. ‘We moved from Long Island, New York, to Cape Town in 2010 to be closer to family. There was a definite adjustment period of letting go of the fast-paced life over there, and while I still miss the expansive arts and culture scene in New York and living in an incubator of innovation, what I received in return was coming home, not being treated as a foreigner with an accent, the nature walks that are practically outside our front door, and having more elbow room to move,’ she says.

Located in a cul-de-sac in Constantia, the Gluckmans’ home offers plenty of elbow room, while the views onto the abundant wildness of the Constantia forests, interspersed with neat, patterned vineyards, befit Galia’s themes of order versus chaos. Inside, the home shows angular open-plan spaces that hold the couple’s neatly and eclectically curated collectables, all framed by her impressive body of work (there’s a piece on almost every wall). Although it had good bones, the home still underwent a necessary renovation before every centimetre of the 350m2 interior could house the Gluckmans, their artwork and the selected pieces they’ve consciously gathered over the years. The refurb included the removal of interior walls to reflect the open surrounds of Constantia, the installation of wide-planked oak floors and the inclusion of a guest bathroom. Galia admits that her curation process is ongoing (a notion to which anyone with an appreciation for aesthetics can relate), but the common thread is a sophisticated, modernist look that accommodates the bold artworks with ease. ‘I love restored mid-century furniture and try to save pieces by refurbishing them. My general rule of thumb is “less is more”, and I stay clear of cheap homeware thrills – they become expensive and hard to get rid of,’ she says. Her favourite space in the home is her children Ella and Levi’s playroom, an expansive, elevated area where pre-teen chaos abounds on one side, while an effortless retro lounge area flanked by a beautifully composed tableau sits in contrast on the other. Here, a chest of drawers, a brightyellow artwork and an organically shaped vessel that was designed as part of a collaborative series with ceramic artist Martine Jackson provide a sophisticated foil to the cheerful children’s paraphernalia. The large windows of the playroom let in beautiful natural light, offset by the panoramic mountain views. ‘Gary and I love to sneak in here and have our first cup of coffee in the morning before the kids are awake. It’s become a bit of a ritual,’ Galia says. It’s the perfect spot from which to appreciate nature’s ever-present paradox. ‘There’s tranquillity in Constantia’s natural beauty, specifically the unruly mountains and endless fynbos, as well as the vineyards,’ comments Galia. ea Point is no longer just a holiday destination for the well-heeled or an idyllic place to retire. It’s having a prolonged renaissance, with what seems like a continuous rise of new commercial and residential developments. Brothers Paul and Saul Berman of the Berman Brothers Group (BBG) have been pivotal in this change and believe wholeheartedly in the potential of the area and its cosmopolitan vibe. Their new offices in the suburb’s biggest commercial development, The Point, which they developed with HCI, are testament to this – and the fact that they plan to be here for a very long time.

HOW DID BBG COME ABOUT AND WHAT IS YOUR BUSINESS? Saul: BBG was founded in 1994 when we decided to create a company that would exceed all expectations in construction and property development. Today we have in excess of 150 employees, in our new 1 000m2 offices. Paul: We have very different qualities that make us uniquely complementary – Saul comes from a construction background, and I have a legal one. construction, project management, and property investment, management and development. Recently we launched BBG Properties, a real estate agency with the aim of providing excellent service in residential transactions. WHY THE INVESTMENT IN NEW PREMISES? Paul: We’re never going to retire, and we wanted our new cutting-edge offices to be our last move, so we invested in the interiors, which include all the bells and whistles and sophisticated technology that identify with the BBG brand, to take us through the next few decades. The employees of BBG, we believe, are more motivated and inspired to be working in a sophisticated space. INHOUSE BRAND ARCHITECTS OVERSAW THE INTERIOR AND SPATIAL DESIGN. WHAT WAS THEIR BRIEF? Saul: We spend most of our time here and so wanted to create an attractive place to work. We took 1 000m2, which is more than we needed, and we designed it luxuriously to accommodate our needs as the business has grown. Paul: Saul and I have different tastes in terms of design, so we thought it appropriate to completely outsource the architectural configuration and interior design to Inhouse Brand Architects and the execution to Construct Plus, both of which took the best of our respective ideas and interpreted them into what we have now. The overriding theme is one of construction – specifically, the raw materials, like the steel rebar we used for the balustrades, and the coffee tables made from spades and wheelbarrows. WHAT ARE YOUR FAVOURITE FEATURES OF THE SPACE? Saul: I love the height – and the views, of course. Paul: We invested heavily in technology, furniture, sculptures and artwork. We complemented the space with sophisticated art and sculptures from the likes of Dylan Lewis, Paul du Toit and Guy du Toit, to name a few. HOW DOES THE SPACE REFLECT THE BUSINESS? Saul: The space reflects the standard and quality of what we provide in every aspect of the business through its sense of modern elegance, sophistication, and in the superior finishes we’ve used. The whole development embodies a higher quality, which is one of the pillars we strive to encompass. WHY IS SEA POINT SO HAPPENING? Paul: There used to be a disjoint between the multimillion-rand houses in Fresnaye and the decaying properties on the high street of Sea Point. We believed that Main and Regent roads needed significant investment to bring them in line with the residential values of the Atlantic Seaboard. So, through the City Improvement District (an NPO, which aside from cleaning up the area, is involved in a range of initiatives to help Sea Point operate at its full potential – www.seapointcid.co.za), we’ve provided a platform to entice developers to reinvest in the suburb. The rejuvenation of Sea Point is apparent in the number of new developers who have entered the market on the Atlantic Seaboard and the high demand for residential, retail and commercial space. ROOTS REVISITED The design of the new Dakar Congress Centre, which opened earlier this year, was inspired by the iconic baobab trees endemic to Senegal. The baobab is a significant cultural marker, as traditionally policy decisions were made under these trees. The new West African conference centre has already earned an award in the business category of The Plan awards programme at international architecture forum Perspective Europe 2015 for ˘ Architects (left). T

here’s nothing new about investing in property. Why would there be, when mid- to long-term, property delivers? As Samuel Seeff, CEO of Seeff, says, ‘Consider, for example, that during the pre-2007/8 economic boom, property values were growing at upwards of 20 per cent per annum across many areas – although there are always exceptions, you certainly can’t get this on the stock market. ‘Even since the economic downturn, values have continued to grow at inflation-beating rates, and while the banks are now pointing to an inevitable slowdown in the national average house-price growth, capital value growth is nonetheless still expected to keep up and even outpace inflation, at least for this year.’ Clearly, over the medium to long term – five to 10 years – property is an excellent investment vehicle, especially, says Basil Moraitis, Pam Golding Properties’ area manager for the Atlantic Seaboard and City Bowl, in recession-proof areas like the Atlantic Seaboard which, despite

global downturns in the past, has retained its values, unlike highly volatile stock markets. ‘The advantage of the buy-to-let market is that in addition to rental yields, you also benefit from good capital growth in sought-after areas with limited stock due to geographic constraints,’ he adds. There’s a sizable demand in South Africa for rented accommodation, and the factors contributing to this trend haven’t abated. ‘The introduction of the National Credit Regulator (NCR) in 2007, and the subsequent economic downturn, meant the South African consumer was faced overnight with challenging economic times and tight home-lending application criteria, which further boosted the demand for rental accommodation,’ says Seeff. Add to that the influx of people to urban areas, and the growing middle class, for whom renting is often the first step before buying or, indeed, the only option if they have a poor credit rating. The demand is there, so too the buy-to-let opportunities – but what does it take to succeed? The first step in the pre-purchase homework is identifying the right location. However, when talking about buying-to-let investors, it’s best to differentiate between seasoned investors with substantial portfolios, and the new investor keen

to put a toe in the water. Long-time investors will have a more ‘adventurous’ outlook in terms of where they buy – in up-and-coming areas or those with promise – while newcomers are more comfortable investing in those with a highdemand profile. Investors need to identify which type of market they’re aiming for, and that, to a large extent, determines location – will it be a standard apartment or a unit in a sectional-title complex, high-end short-term corporate rental, holiday rentals? Each has its own set of criteria. ‘At the moment,’ says Bill Rawson, chairman of the Rawson Property Group, ‘the best returns for standard rentals – often giving a positive cash flow from the outset – are found in those suburbs conveniently sited in relation to the CBD. These are now throughout South Africa, often zoned for high density, and they’ve therefore been able to attract developers who by and large create the affordable multi-unit stock which has proved a particularly good investment of late.’ Most popular countrywide for tenants, and therefore for buy-to-let investors, are two-bedroom sectional-title apartments, or units within complexes or gated estates. ‘In general, the lower the purchase price of the property, the higher the yield,’ points out Trish

Identifying the lower-end home value as below R600 000, and the middle end at between R600 000 and R900 000, she says, ‘The rental yield is currently estimated at 9.75 per cent in the lower- and middle-end property segment. This is higher than that of upper-middle-income properties, which have a rental yield of 8.06 per cent.’ A more sophisticated buy-to-let market lies with corporate and business rentals. Seeff says, ‘Anything upwards of one to six months – and often up to three years in top-end areas for visiting business delegates – has boosted demand in top-end areas, especially those close to airports and commercial centres. Think areas close to the Sandton CBD, Cape Town’s Southern Suburbs, Northern Suburbs areas such as Durbanville, Atlantic Seaboard and City Bowl, and Ballito near King Shaka Airport in Durban.’ In addition, ‘The growth in tourism has boosted the demand for short-term rentals – anything from one week to four months and often more,’ he says. ‘All of these present potential buyto-let opportunities, both in terms of existing housing stock, but also new, affordable housing developments which meet the demand for rental accommodation from the middle class.’ And when it comes to homework by investors, Tony Clarke, MD of the Rawson Property Group, stresses the importance of identifying and understanding demand in a particular location. ‘The prospective buyer has to find out what prices have been achieved recently, and to assess what returns buy-to-let investors are getting,’ he says. In his opinion, wherever possible, the purchase should be a property where the yield per square metre is significantly above average. ‘Such properties are usually found in the high-density, high-demand suburbs which have become the flavour of the month,’ he adds. He also feels the landlord should assess the ambience of the area, because tenants want to feel part of the community, and safe: ‘Find out such factors as the average age and income of the inhabitants (look at the Lightstone website), any community functions, and importantly, the crime situation in the area.’ Advice to investors from Carol Reynolds, area principal of Pam Golding Properties in Durban, Durban North, La Lucia, Umhlanga and Umdloti, is, after location, to investigate the body corporate and financials of the complex. ‘Well-run blocks are sought-after and achieve far better rental returns than badly managed complexes.’ She says to always look at acquisition cost versus return, then decide whether your investment choice is based strictly on returns, or whether you’re seeking both capital appreciation and solid returns. ‘For great returns only, sectional-title units close to the R1-million mark make the best investments in terms of ROI, but if you’re seeking capital growth as well, then more expensive properties in better areas will achieve growth as well as fairly good returns.’ Myles Wakefield, CEO of Wakefields Real Estate, counsels new investors to take a conservative approach, and be cash positive from day one. ‘If you’ve bought a R700 000 apartment on Durban’s Berea, and put down a 10 per cent deposit, you’ve invested R70 000. Based on current rentals and annual increases, the tenant’s rent should cover your levy, rates and bond.

Conservatively, if the cash flow is positive, the capital growth received on your investment will be the ‘‘gravy’’. Ideally, the tenant pays off your bond. ‘If you have to feed the bond/levy/rates, it’s not a good investment. If the interest rate rises, you’ll find yourself in stressful circumstances, and in a worst-case scenario, be forced to sell at the wrong time for less.’ ‘Investors need to do their sums carefully when calculating returns,’ says Dexter Leite, rentals manager for Pam Golding Properties in the Western Cape Metro Region. ‘Gather intelligence on all the factors from reputable area rental specialists, and ask them to view the premises before you invest.’ Critical to the investment is the rental achievable. Luthuli says that while a buy-to-rent property can be lucrative, she warns landlords not to overcharge tenants. ‘They can be price sensitive and you don’t want your investment to sit empty because you’ve priced it out of the market.’ On the flipside is the primary issue raised as a reason not to enter this market – concern over

quality tenants. Although there’s no foolproof vetting system, rental professionals have a very stringent pre-tenancy check – with advanced assessment tools – and, of course, a list of prospective tenants who’ve already been vetted. That’s why, increasingly, investors approach realestate rental divisions for their tenants. Bottom line, set a market-related rental. Be absolutely realistic when you’re doing your sums. Ensure you have the financial elasticity to cope if the bond rate increases, a special levy pops up, or you’re left tenant-less for a month. ‘The long-term investment value in property is well established universally,’ says Laurie Wener, MD of Pam Golding Properties in the Western Cape Metro. ‘The rental and capital yield is relatively stable and even short-term speculation can have excellent yields for those with an appetite for risk. ‘Property remains a valuable investment asset for private individuals and institutions. Longterm reduces the risk level and as property transactions tend to be relatively slow (not quick to liquidate optimally) and expensive, it’s essentially a long-term investment for most.’ Mike van Alphen, national manager of the Rawson Property Group’s bond origination division, Rawson Finance, says, ‘Any investor not putting 25 to 30 per cent of his capital into property at this stage in our economic cycle is making a mistake – where else can one acquire income-earning assets at such low borrowing rates?’

ree-lined streets, a peaceful village atmosphere and a plethora of chic cafés and delis are just the start of Newlands’ irresistible charm. Protected from Cape Town’s notorious southeaster by the forested slopes of Table Mountain, and with plenty of winter rainfall to encourage tall trees and lush gardens, it’s as close to nature as you can get in the city and yet it’s very central. Residents love having Newlands forest so close; it’s the place to walk dogs every morning, run mountain trails, cycle with the kids, go foraging for mushrooms or take toddlers for wild adventures clambering around and over mountain streams, rocks and tree stumps. And the forest and its access to mountain trails is only a few steps from the M3, which conveniently keeps traffic away from the suburb and yet allows residents to nip into town or out to the airport in only 15 minutes. Historically, Newlands grew up around several large estates and breweries taking advantage

A wide variety of housing styles characterised the vibrant community as it developed over the last two centuries, from large houses and villas to workers’ cottages and terraced houses, and today’s Newlands reflects this heritage. ‘Newlands has a very representative community of all age groups, from young couples to retirees,’ says Pam Sorel, an independent estate agent who has lived in Newlands for many years. ‘There’s a real mix of property sizes, including apartments, starter homes, small cottages and large family houses, as well as security developments.’ With so many good schools in the area, it’s particularly sought-after by families, with SACS, Westerford and Sans Souci all in walking distance. Little Kildare pre-primary school has its own nature reserve on the banks of Newlands stream, with story time and environmental activities held on the banks each week. Other well-known schools in adjoining suburbs are Rondebosch Boys’ High School, Bishops, Herschel Girls’ School and Rustenburg High School for Girls. However, you have to be quick off the mark to buy the perfect family home in Newlands. ‘The

townhouses built on the site of an old house that has been demolished or on a subdivision,’ says Pam Sorel, adding that an average townhouse currently sells for around R6 million. With such an attractive lifestyle on offer, it’s not surprising that residents are predominantly owner-occupiers and rental property is at a premium, being snapped up as soon as it comes onto the market. To experience the essence of Newlands’ charm, stroll through the shady streets to the bottom of Kildare Road where a busy hub of stylish cafés attracts the coffee and lunch crowds. Melissa’s is a longstanding favourite, now joined by Cassis with its legendary macarons and patisserie, and Gogos for artisan biltong. After school, kids and moms head to Dean Street where it’s a toss-up between frozen yoghurt with toppings at Wakaberry, decadently rich ice cream at The Creamery, or healthy juices and smoothies at Rootbar. And Montebello Design Centre is another regular meeting place, with various art studios and craft workshops producing cutting-edge design and gorgeous hand-made pieces. WITHHOLDING CAPITAL GAINS TAX FOR NON-RESIDENTS Section 35A of our Income Tax Act applies in all cases where a property seller is a non-resident. It obliges the property purchaser to withhold a percentage of the purchase price in order to cover the potential tax liability of the seller. The tax due by such a seller to the South African tax authorities (SARS) could be, for example, income tax on rental income (if the property was let out before it was sold) or capital gains tax (CGT) on disposal of a nonresident’s immovable property. The purpose of s 35A is to assist SARS to collect taxes due by non-resident sellers, the section

presupposing that it may be difficult to convince non-residents to pay tax to SARS once the investor departs from the country on the sale of his property. HOW IT WORKS To withhold payments due to a seller means that the purchaser (through the conveyancer) must retain a certain percentage of the purchase price and must not pay this to the seller, who would under normal circumstances have been entitled thereto. Instead, this money is paid to SARS, who will apply it towards payment of any taxes due by the seller and will refund the balance to the seller, if any money is left.

GOING IT ALONE Should you sell your property privately?

state agents perform a vital role in most property transactions. And, as the experts in the field, they have the know-how and experience to get the best deal for both parties. There are, of course, always people who have the time and knowledge to do it themselves. If you do opt to sell your property privately, however, there are some important considerations that must be taken into account. The first is putting the property on the market at the correct price. Estate agents have access to tools to help them to value a property and to judge what will be suitable for the area, but there are also free property reports available to help a private seller. It’s crucial to get this right because if the price is set too high, the property may not sell, and if it’s too low, you could lose out. If you’re selling a home you’ve lived in for many years, you may be blind to its faults. This might not only lead you to over-value it, but may deter potential buyers if what they’re seeing doesn’t match what you’re telling them. It may therefore be worth having an independent contractor in to have a look around the house to identify any obvious defects, and to quote on what it may cost to fix them so that this can be factored into the sales price. Don’t, however, make the mistake of doing too much renovating before putting the property up for sale. While there are obvious benefits to fixing major problems, don’t overcapitalise because you may not recover the expense.

It’s also vital to bear in mind that when selling a property you’re not just negotiating a price, but also the terms and conditions. The best approach is to have a conveyancing attorney help you through the selling process, drawing up an offer-topurchase agreement and any other documentation required. Make sure that any known defects are disclosed to protect both you and the buyer. Estate agents also have an advantage when it comes to marketing a property. They not only have budgets for advertising, but also databases of people looking in specific areas for properties within certain price ranges. The private seller, on the other hand, has to rely on websites or classified ads. In addition, when selling privately, you have to be available to show potential buyers around the property, and as this has to be done at times that best suit those potential buyers, you need to be flexible. When agreeing on a sale, don’t neglect to find out where the money is coming from. Does the buyer need to sell another property first or obtain a bond? This may delay the transaction and possibly derail it if it doesn’t work out as planned. Make sure that any agreements include timelines so that you’re not bound to wait indefinitely for the buyer to come up with the money. Finally, remember that you haven’t really ‘sold’ your property until the change of ownership is lodged at the local deeds office. Your attorney will be in the best position to do this, and to help you get the necessary clearance certificates from the municipality.

COVER YOURSELF If you’re renovating, don’t neglect your insurance

R

enovating your existing home is often more appealing than looking for a new one: you don’t have to leave your neighbourhood, family and friends, and you don’t have to take on the costs and disruption of buying, selling and moving. Something that many people neglect to take into consideration, however, is the effect that home renovations may have on their insurance policies. The risks are that your current policy will either not cover any damage caused by the work crew or will simply fall away. You must inform your insurer of your intention to renovate from the outset. Check that your policy will remain in force for the duration of the work. This is particularly important if you’ve chosen to move out of your house for the duration, as most insurance policies stipulate that someone must be staying on the property to reduce the risk of burglary. If you wish to leave the house unoccupied, make sure to clear your decision with your insurer. Extensive renovations might even require a reclassification of your policy. For example, if an exterior wall is being replaced, or some of the roof taken down, then your home might have to be considered a ‘building under construction’ rather than a ‘family dwelling’ during the process. It’s vital to make sure that any renovations are pre-approved by the necessary authorities, as your insurer could deny your claim further down the line if it’s found that the alterations do not conform with legal and building standards. Use a reputable and licensed contractor – it may even be worthwhile speaking to your insurer’s claims department for recommendations. Homeowners may place themselves at risk of having a claim turned down if the work is not

carried out by a licensed builder and it later deteriorates or collapses. Check that the contractors you choose are properly insured. They should carry enough cover to fix any damage they cause or even for the total loss of the house arising from their negligence. Put this agreement in writing to back you up in the case of potential liability. Ensure that the company has insurance for its workers, too, so that you don’t risk being held liable for any injuries they sustain while on your property – and even if it does have such cover in place, it may be worth reviewing the amount of liability cover you have, just to be safe. It’s also a legal requirement for the building owner to compile a Health and Safety file that contains information about any risks on the property that need to be managed. Finally, once the renovations are complete, don’t forget to review the amount of cover you’re carrying. If you’ve made significant changes to the home or added more expensive interiors, such as marble countertops or a new stove in the kitchen, then you must inform your insurance company of these upgrades. It might even be worth having the insurer conduct a new valuation of the property and adjusting your premiums so that you’re always fully covered.
