I

n a typical scenario, when you finance the construction of your home, you will need to complete a loan application and get pre-approved for the mortgage through a commitment letter. Afterwards, a second approval from the interim lender or bank is required for the funds used to construct the home. Finally, as the construction completes, the permanent lender will request a new loan approval for the permanent mortgage loan which pays the remaining balance of the interim construction loan and becomes the homebuyer’s permanent home loan.

The downside to the typical loan process described above is that, because it is a second loan, the permanent financing has to be approved, and matters can get complicated if your financial situation has changed negatively during the period between your interim and your permanent loan application. Changes in interest rates in the time between the two loans can also be a negative factor. When you add to this the fact that with the traditional two-loan process you will have to pay two sets of closing costs and invest more of your time, it becomes obvious why the One-Time Construction Loan is an ideal option.

So, what is a One-Time Close Construction Loan? itle insurance is a form of protection coverage called “indemnity insurance” that is issued by a Title company and protects lenders and homebuyers from financial loss sustained from defects in the title to a property. If the condition of a property title is not what you understood when you purchased your home, a title insurance policy protects you against any and all losses that may occur as a result. What is the cost of title insurance? Here in Texas, title insurance fees are regulated by the state, so you won’t need to get different quotes for prices; however, you do need to choose a title company with an established reputation in the community to make sure that they obtain all the pertinent documentation regarding the property from sellers, real estate agents, lenders, etc.—a title company that knows what to do and with whom to communicate to get everything done. AVOID EASEMENT WOES Perhaps you share a driveway or access road with your neighbor, or you have a section of land that you share with others, or you have heard the words “utility easement.” Do you know your rights when an easement issue on your property rears its ugly head and, for example, the cable company wants to dig on what you thought was your private property? Let’s explore what easements are, the situations that could result in conflict, and how to deal with them.

WHAT IS AN EASEMENT? An easement is a part of a property in which there is shared access. An easement dictates what rights you have and what entity owns the right of way. Easements are generally created when a subdivision is developed and its plat is recorded with the County Clerk’s office. The easements provide access for gas, power lines, telephone lines, water and sewer pipes, cable TV, and other public utility needs. There are three primary kinds of easements: RIGHT-OF-WAY THROUGH PROPERTY: In this case, you would either grant or be granted permission to cross through someone’s property to gain access to your own property (or allow someone to cross through yours to get to theirs). This could include long private roads through which someone might have to drive to access a property at the back. Issues in this case could stem from an owner not maintaining the access. RIGHT-OF-WAY GRANT: This would refer to shared properties such as driveways or walkways. The issues in this case could include who is responsible for maintaining it (i.e. shoveling debris or fixing cracked concrete). UTILITY EASEMENTS: Here’s one that trips up many homeowners. In this case, the actual utility (gas, electric, telephone, cable) access for one property is on another property. It could be wires, poles, boxes, etc. This is where the situation can get thorny in two ways. First, fences and barricades must allow access for maintenance or repair crews to enter the area. Homeowners often fail to understand this before they install barriers such as fences, or, worst-case scenarios: outbuildings or a swimming pool. This can lead to fines or the costly need to tear down those fences or buildings, or remove the pool. Second, if digging is required on one property to access a line connected to a neighboring property, there is often the question of who pays to fix the mess created. Do you as the homeowner or does the city or utility company? Understanding your rights in these cases is important. 14

HOW TO HANDLE EASEMENT ISSUES? So what do you do when you’re faced with a conflict arising from an easement issue?

When you purchase your home, ask if there are any easement-related issues about which you should know and rights and obligations you have. Make sure you check the survey to see if there are easement lines on your property. If you are building your home, the builder should have the survey and building plans with any easement restrictions attached. Make sure to ask your builder to give you a copy, and then keep it in a safe place for as long as you own the home. You never know when you may need it!

If you already own your home, you may still wish to check with the County Clerk’s office to confirm what is required of you, especially before beginning any new construction projects, or even building a fence if your property line is on an easement. Your local Planning and Zoning office should have the information you need.

The biggest lesson: Don’t get caught with an easement barrier that ends up costing you big! Always consult with the County Clerk’s office before building or remodeling if you don’t know what your easement requirements are. You can also call your utility company for clarification of the easement areas on your property.

A Rater models the home using its floor plans and elevations to predict the energy efficiency of that home even before it is built. He/she also reviews the Manual J heat calculations for the home to make sure the HVAC system is sized correctly for the dimensions of the home to ensure lower utility bills, better comfort, and to avoid moisture issues that can occur with an improperly-sized system. So why doesn’t every builder use a Rater to perform these duties? One reason is obvious. Some builders think this will cost more money and the inspections will cause delays in construction. But the biggest reason, sadly, is that homebuyers don’t ask about third-party inspections. Builders have the option of having their homes certified as high-performance homes in such programs as BUILT TO SAVE™ or ENERGY STAR®. With these certifications, you, the homebuyer can rest assured that the home

you are buying was inspected and tested by a third-party independent home energy Rater who is not affiliated with the builder. The rewards for homeowners are huge: lower utility bills, tighter quality construction, and a more comfortable home with better indoor air, and peace of mind to name a few. But what’s in it for the builder? Many understand the value of getting a good reputation for building a quality highperformance home. Those that do, have already discovered that there are financial incentives from local utility companies for doing just that. The cash rebates they receive from the utility companies can easily offset the cost of hiring a certified RESNET Rater for third-party inspections, testing, and verification. Magic Valley Cooperative (MVEC) pays cash incentives, available on a first-come basis, to builders who certify homes in the BUILT TO SAVE™ program in MVEC communities. The more energy efficient the home is, the higher the incentive. To qualify in the BUILT TO SAVE™ program, a home must meet the construction requirements of the program and have an energy rating that is as little as 5% over that required by minimum code. The AEP Texas HighPerformance Home Program also offers a rebate program for builders constructing homes in AEP’s territory. Their rebates, available on a first-come basis, reward builders who install 15 SEER or 16 SEER air units. The incentive structure is designed to measure kWh savings achieved above a Texas Baseline Reference Home and exceed its minimum by 5%. The homes must also meet other elective criteria and be inspected and tested by a certified RESNET Rater. Rebates are available to all Rio Grande Valley residents on a first-come basis. The Blower Door Test and the Duct Blaster Test are used to calculate a home’s Energy Rating Index (ERI—also referred to as the HERS score). The Rio Grande Valley Builders Association’s (RGVBA) annual Parade of Homes is committed KS RE to the safety and health of its AS members and the public who attend this yearly fundraising event for the non-profit organization. TH U A N K YO We urge everyone to follow the Parade Visitor Guidelines outlined below that will be enforced by Parade builders at their Parade homes for the health and safety of everyone participating in this event. Let’s do our best to avoid the spread of the Coronavirus by following both the RGVBA and CDC recommendations for face-to-face interactions, including the wearing of face coverings and practicing social distancing as we tour the homes in this year’s 2020 Parade. REAL ESTATE NEWS The Best Building Code in a Decade: 2021 IECC Coming Soon The International Energy Conservation Code (IECC) is preparing to release the new model code that will establish the minimum energy efficiency standards for commercial and residential construction in the nation. And it promises to be the most efficient building code to date, projected to result in an estimated 10% or more energy efficiency improvement in residential and commercial buildings. The 2021 IECC will reduce both energy use and carbon emissions in homes and buildings which, today, is about 40%. What does this mean to the consumer? Well, the good news is that the new code is designed to deliver lower utility bills, more home comfort, higher productivity, lower utility bills, lower carbon emissions, and an increase in the value of new construction. The International Code Council, a membership association, developed and manages the IECC, which was formed in 1998 and is the most widely adopted energy code model by states and municipalities in the United States and other areas. The IECC code is updated every 3 years through an extensive process that involves a forum of energy professionals, partners, and code officials to discuss proposed changes which are approved by votes from eligible voters, local governments, and related agencies. Voting on the proposed 2021 code changes set a record high—4 to 5 times more votes cast than in previous code cycles—thanks in part to an online voting option implemented by the ICC. The 2021 code will be a compliant path where 56

improvements in building components such as windows, doors, and R-values in insulation are prescribed, but it will continue to offer builders the flexibility of performance paths which leave it up to the builders on how they can build, as long as they meet the required minimum energy efficiency requirements. Note that the IECC is set to minimum standards. High Performance Home Programs such as BUILT TO SAVE™ and ENERGY STAR® are designed to go above and beyond these minimum code requirements for enhanced energy efficiency and quality construction. Keep in mind that building to the minimum required code is just that—the bare minimum standard. With the new 2021 IECC, in the Rio Grande Valley— located in U.S. Climate Zone 2 that is one of the hottest regions in the country—we will see increases in ceiling R-values, and a requirement for better insulated windows with higher U-factors. Overall, the proposed changes cover a wide variety of measures designed to improve energy efficiency and carbon emissions. The new code also includes two new appendices that provide ways for states and cities


to move in the direction of zero energy performance requirements, with a goal of building homes and buildings that, within one year, would produce as much energy as they consume by using renewable energy like solar panels. The new 2021 code will be available for adoption by state and municipalities in the fall of 2020. While it can and should be adopted by all cities and states, it is important to note that adopting the code and enforcing it are two different things. Any city can adopt a code, but if it is not enforced so that builders have to comply with it, the energy savings and reduced carbon emissions of the new code will not be realized. As a homebuyer, you should be aware that today, all new homes built and sold in Texas, for example, must be compliant with the state’s mandated 2015 IECC, the current code. Yet, sadly, many cities in the Rio Grande Valley and across the state who may have adopted the code, do not enforce it. Worse still, some cities may be enforcing codes older than 2015 and not compliant with Texas law. Builders should also realize that they, and not the city code officials, are ultimately

responsible for building homes according to code law. A good takeaway message for homebuyers (and builders) is that if your home is certified as BUILT TO SAVE™ or ENERGY STAR®, there is absolutely no question that your home is in compliance with the current code. These high-performance home certifications go above and beyond what is required—no matter what version of the code the city is enforcing.
