When can OSHA enforce chocking on CMV trailers?

Most employers know that OSHA requires chocking or securing trailers during loading and unloading, but many ask about an exemption for commercial motor vehicles (CMVs). However, that exemption is so narrow that it may not have much impact.

The OSHA regulations in 1910.26(d), 1910.178(k)(1), and 1910.178(m)(7) all require employers to use chocks or similar measures (such as dock locks) during loading or unloading operations.

Federal OSHA created an agreement with the Federal Motor Carrier Safety Administration (FMCSA) for the FMCSA to retain jurisdiction

enforce chocking requirements on CMVs.

There is a catch to OSHA’s enforcement limitation, however. In fact, there are several issues that employers should know.

Enforcement limits and exceptions

First, many states run their own OSHA programs (state-plan states). Since the FMSCA jurisdiction agreement is with federal OSHA, states not subject to the agreement could enforce chocking requirements for CMVs.

Second, OSHA expects employers to enforce chocking even on CMVs if the employer’s workers (such as forklift drivers) are doing the loading or unloading. OSHA stated that the FMCSA regulations (and jurisdiction issues) apply only to motor carrier employers that fall under FMCSA authority, not to other employers whose workers load or unload CMVs.

OSHA addressed these issues in a letter of interpretation dated March 7, 2011, outlining the history of the agency’s agreement with the FMCSA. Here’s the key portion:

...because the FMCSA parking brake regulations do not apply to companies which do not own, operate, or lease CMVs, OSHA is not pre-empted from enforcing standards requiring such companies to take precautions to protect their workers, such as forklift operators, from the movement of trailers.

In other words, if a manufacturing or retail employer is not subject to FMCSA regulations, but that employer has forklift operators unloading trailers, OSHA expects that employer to “take precautions to protect their workers ... from the movement of trailers.”

Who is responsible?

The above letter also asked who is responsible for confirming that no employees are injured when the truck driver attempts to move the trailer. OSHA responded:

If the FMCSA’s regulations do not cover a working condition, e.g., a manufacturing company that has employees exposed to this condition, then an employer must comply with OSHA’s standards to ensure that forklift operators are not in the trailer or hostler when the driver attempts to remove the trailer from the loading dock. ... Thus, a PIT operator must be trained that he or she is not to operate a PIT on a trailer that has been backed to a company’s dock, unless the trailer is properly secured or restricted from movement prior to boarding.

The bottom line is that even though OSHA cannot enforce wheel chocking requirements on CMVs, that limitation applies only to CMVs operated by a company under FMSCA

jurisdiction. Other employers (like warehouses and manufacturing facilities) not under FMCSA jurisdiction must still protect workers from unexpected trailer movement.

Automation in Healthcare: The Robotics Revolution

When it comes to automation in healthcare, the word “robotics” typically brings to mind images of robot-assisted surgery. But why should the operating room (OR) get all the glory? Hospitals are deploying robots in many other ways, from drones delivering blood products to humanoids greeting patients.

The bounds of automation are endless inside and around the hospital. With widespread labor shortages, continued supply chain disruptions, and growing patient desire for a more consumer-like healthcare experience, here are some ways robots and automation in healthcare are coming to the rescue.'

Last Mile Fulfillment

As consumers of retail goods, we have come to expect products to land in our hands within days, if not hours. Take for instance driverless cars for food delivery on college campuses. While on-demand pizza at 3 a.m. may feel like a lifesaver to a hungry student, in healthcare, immediate delivery of blood products or critical medicines to a patient is a true life-and-death scenario.

Zipline, an instant logistics and delivery provider that began transporting blood products via drone to patients in remote areas of Rwanda in 2016, is now partnering with Intermountain Healthcare for drone delivery of prescriptions and medical products to patients’ yards in the Salt Lake Valley area.

Logistics company DHL also plays in the healthcare last mile fulfillment space. One of its first pilot programs was delivering medications via drone from mainland Germany to the remote island of Juist in the North Sea. Before, the island’s residents had to wait for a ferry or airplane to make a scheduled delivery, whereas now, drones can bring critical medicines 24/7.

Another successful example of automation in healthcare is drone delivery use by Raleigh-based hospital WakeMed, which has partnered with UPS Flight Forward (UPSFF) and drone manufacturer Matternet to transport blood and urine daily between the hospital and a primary testing lab.

In the United States, the Federal Aviation Administration (FAA) has stringent laws around drone operator certification and line of sight, which has slowed progress in drone delivery across many industries. But successful drone usage by health systems such as Intermountain and WakeMed shows these hurdles can be overcome if safety requirements are met.

Support Services

Even with surgical robots like da Vinci, a human is behind the scenes controlling the actions. While we aren’t likely to see a robotic OR team autonomously performing procedures anytime soon (but never say “never”), robots can automate manual, labor-intensive tasks on the perimeters of care delivery, freeing up clinicians to focus on their primary responsibility – the patient.

For example, Mobile Industrial Robots (MiR), headquartered in Denmark, offers robots that deliver patient meals from a hospital’s kitchen to patient rooms (and return empty trays) and collect dirty linens throughout a healthcare facility for laundering.

Other robots are designed for situational interactions with humans in the hospital environment. Humber River Hospital in Toronto has employed RobotLAB’s Pepper hospitality robot to greet pediatric patients and their families upon arrival and comfort them at the bedside during treatment. The child-sized, humanoid robot is programmed to answer kids’ common questions about surgery and can even be customized to educate individual patients about their specific surgical procedures.

Medical/surgical supply management is a huge burden on clinicians today that could likely be performed by robots in the future. Instead of a nurse having to walk to a storage area and retrieve supplies, a robot containing high-use items could travel patient care floors or even tag along behind caregivers to offer up supplies on demand.

One challenge that arises when hospitals implement different robots for different functions in patient areas is how to coordinate their movements, so they don’t get in the way of care delivery. For example, a robot programmed to travel throughout the nursing units to perform a task, let’s say mopping floors, could conceivably tie up an elevator at a time when a patient needs transport to the intensive care unit (ICU). Hospital stakeholders must consider issues like this as robots and automation in healthcare become more pervasive.

Warehouse Automation

In the wake of pandemic-related supply chain disruptions, more health systems are taking greater control over their supply chains through the establishment of consolidated service centers (CSC) where they can house direct bulk buys from manufacturers. Looking at the success of retail in leveraging warehouse automation for decades, healthcare is turning to robots to help manage supplies in their CSCs.

For both retail customers and patients, there is no one-size-fits-all approach to fulfillment. The staff in a retail warehouse must pick/pack the specific products contained in a customer’s e-commerce order, while those in a health system’s CSC must pick the items a clinician ordered for an individual patient. Massachusetts-based Locus Robotics offers autonomous mobile robots (AMR) that work alongside warehouse staff members, visually guiding them to the right pick locations to boost productivity, efficiency, and accuracy.

With healthcare in its early days of warehouse automation, and costs a constant concern, Locus Robotics offers a scalable, cost-effective way for health systems to begin deploying robots in their supply chain operations. Through the company’s Robots-as-a-Service (RaaS) model, a healthcare organization can add AMRs to their CSC as they

need them and scale their robot workforce up or down as needs change.

Maintaining adequate inventory is important to the success of any organization, but the implication of shortages is far more critical in healthcare versus other industries. In retail, running out of a popular t-shirt might cause some grumbling among consumers. In healthcare, clinicians not having access to a cancer drug could mean a patient goes without life-saving treatment.

Ware, a San Francisco provider of automated inventory control solutions, has developed cycle counting drones that fly around a warehouse following preprogrammed flight paths taking pictures of inventory. When the drone returns to its charging “nest,” it uploads data to Ware’s cloud-based software, which leverages AI to extract barcodes and identify inventory anomalies.

The implications of this automation technology in healthcare are staggering from a supply management perspective, especially when it comes to highly regulated products like narcotics. Drug products like these are typically stored in a locked cage within the CSC where only authorized staff members can access them, and all movement of drugs in and out of the storage is closely tracked.

Imagine a drone that could fly up over and into the cage to perform an automated cycle count, versus a human having to do it manually. Eliminating the human factor would certainly reduce the risk of drug diversion and at the same time, boost the efficiency and accuracy of inventory management workflows.

Speaking of efficiency, what if these drones were paired with RFID technology? Within minutes, they could fly through a warehouse capturing information from RFID-tagged supplies. In theory, drones could offer healthcare supply chain leaders not only real-time inventory levels but also critical information such as products nearing expiry and those that have been recalled and must be pulled to avoid patient harm.

Conclusion

Healthcare has just begun to dip a toe into process automation, and it is proving to be not only beneficial but achievable. Two decades ago,

maybe even 10 years ago, if someone told a health system CEO that drones would be flying around their campuses transporting items, or robots moving supplies around in their warehouse or delivering meals to patients, they’d likely see it as science fiction.

But here we are on the cusp of 2023 with automation in healthcare rising and robots as our reality helping to alleviate many of the challenges faced today and opening the door to countless other applications in and around patient care settings.

Avoid the digital disconnect: Keep the supply chain flowing

truly end-to-end integrated digitization, right down to the packaging and labeling

A recent survey of manufacturing leaders found up to 90% of manufacturers struggle with integration challenges, so when disruption happens, they are unable to cope quickly or effectively – causing a ripple effect right through the supply chain. As businesses of all sizes continue to ramp up their digital transformation efforts, end-to-end digital integration must be at the heart of these projects – and that, argues Arjun Khanna, Chief Technology & Innovation Officer at Kallik, means right down to the artwork and label processes that are essential to the smooth flow of the supply chain. He discusses the extensive operational challenges faced by businesses using disparate systems and siloed data, and how many of these issues can be overcome with careful integration of core solutions.

Siloed operations keep businesses vulnerable to disruption. Acquired a small competitor in a different region? New regulation enacted that requires changes to existing product labeling? Rolling out a new factory process at the very end of the value chain? Any of these could require a significant response to avoid major disruption. Disparate, disconnected systems leave businesses poorly placed to respond to deal with any disruption or shake-up in typical day-to-day operations.

Legacy systems – very little control, disparate data

Despite such threats to business continuity, many firms continue to operate a patchwork of core systems with little to no integration with each other. They are often developed piecemeal with in-house fixes or manual workarounds. While this may help maintain the status quo of day-to-day operations, it is highly vulnerable to disruption and far from agile compared to more digitally mature competitors.

Thankfully, the latest wave of digital transformation has placed an increased focus on cloud-based solutions and customizable implementations for core platforms such as ERP systems. However, other, more legacy systems or manual processes are equally critical to operational success – yet often neglected in the grand scheme of ‘digital transformation’ projects. This lack of integration is especially noticeable among businesses operating in highly-regulated industries such as pharma, medical devices, or chemicals, despite these being prime candidates for shortnotice impactful disruption.

Artwork, labeling, and packaging must not be an integration ‘blind spot’

The disconnect is particularly noticeable in siloed product assets, such as labels, artwork, and symbols. This essential part of the business process is often subject to minimal version control or global insight, and where integration with print requests and data flows from the ERP system, for example, is yet to be embraced significantly.

But these label and artwork management systems play an increasingly critical role in ensuring product consistency, consumer safety, and regulatory compliance. As a result, having these operations and assets siloed is becoming nonnegotiable. Integration with other platforms such as regulatory systems is a must.

The knock-on effects could be catastrophic

Take a label for a simple medical device intended for the EU market. This must pass through extensive review and approval processes to ensure medical, marketing and regulatory information – including various symbols and markings – are all present, correct, and consistent. To be sold broadly throughout the EU, this device label would in theory need to be translated into 24 different languages.

This upstream process is therefore very delicate and susceptible to disruption or human error. If an incorrect version of a regulatory symbol is used, or some medical information is changed in one language and then not updated across all other language versions, this could introduce a major error – potentially even threatening the health of the end-user and triggering a costly product recall.

If the systems involved in this workflow are not fully integrated into other critical business systems, processes, and databases, the risk of recalls can rise significantly.

Find a complementary digital artwork and labeling system

Consolidation and integration are key when it comes to rationalizing and standardizing systems and processes as part of a company’s digital maturity project. That means finding proven, feature-rich solutions that can be deployed across all necessary departments and locations worldwide, with full integration capability to ensure seamless operation with other core systems.

Rental industry pioneer Bill Butler dies

William “Bill” Butler, one of the pioneers of the rental industry in Southern California, died on January 10th at the age of 83. William “Bill” Butler, one of the pioneers of the rental industry in Southern California, died this week at the age of 83. Butler started Able Equipment Rental in 1961 at the age of 22, starting with a “handshake” and a Quonset hut in Santa Fe Springs, Calif. (just east of downtown Los Angeles), according to his daughterin-law Pamela Butler. Butler is survived by his wife Lois, and three children – Jeffrey (wife Pamela), daughter Pamela (married to Richard McKenney}, and daughter Patricia (married to Douglas Cook.) Butler is also survived by nine grandchildren and six great-grandchildren.

MHI expects all participants to help ensure a positive experience for everyone. Unacceptable behavior will not be tolerated during any portion of the ProMat event. All participants including, but not limited to, attendees, exhibitors, support staff, speakers, presenters, facilitators, MHI staff members, board members past and present, service providers and all others are expected to abide by this Code of Conduct.

This Policy applies to all aspects of the ProMat event, including exhibits, special events, and sessions.

Registration

All attendees must register to attend the ProMat. Qualified Attendee Registration is offered at no cost. All exhibitors must register their booth staff.

Discrimination and Harassment

MHI has zero-tolerance for any form of discrimination or harassment, including but not limited to gender, sexual orientation, disability, race, ethnicity, religion, national origin or any other protected class. If you experience harassment or hear of any incidents of unacceptable behavior, MHI asks that you report it via e-mail at customerservice@promatshow.com so that we can take the appropriate action.

Interference with Competitors

No person may interfere with the activities of an exhibitor at ProMat, including exhibit booths, product demonstrations, educational sessions and meetings. Behavior, in particular, that is insulting, rude, distracting or disruptive is forbidden.

Suitcasing

Solicitation or promotion of products and services to attendees or exhibitors from non-exhibitors is strictly prohibited.

Other Unacceptable Behavior

In addition to the above, Unacceptable Behavior is further defined as:

 Intimidating, harassing, abusive, discriminatory, derogatory or demeaning speech or actions of any kind.

 Verbal abuse of any exhibitor, attendee or other participant or MHI team member. Examples of verbal abuse include, but are not limited to, verbal comments related to gender, sexual orientation, disability, physical appearance, body size, age, race,

 Harmful or prejudicial verbal or written comments or visual images related to gender, sexual orientation, age, race, religion, disability or other personal characteristics, including those protected by law.

 Unwelcome attention or deliberate stalking or intimidation of any participant.

 Real or implied threat of physical, professional or financial damage or harm.

 Inappropriate disruption of an exhibit, product demonstrations, educational or networking sessions, meetings or sessions or other events organized by MHI throughout the event. All participants must comply with the instructions of the moderator and any MHI staff member.

 Photographing, video or audio recording of exhibits, product demonstrations, sessions, slides, oral or poster presentations without presenter/author’s permission.

 Presentations, postings and messages should not contain promotional materials, special offers, job offers or solicitation for services unless you are the session host or supplier. MHI reserves the right to remove such messages and potentially ban sources of those solicitations.

 Failure to stop unacceptable behavior when requested by a fellow participant or MHI staff member.

 Sharing your ProMat credentials with other individuals.

 Derogatory social media or app posts against a competitor

Right to Take Action

MHI reserves the right to take any action deemed necessary and appropriate, including immediate removal from the event without warning or refund, in response to any incident of unacceptable behavior, and MHI reserves the right to prohibit attendance at any future meeting or trade show, digitally or in

person. Inappropriate action could also result in future restrictions on attendance at MHI events or possible termination of MHI membership or positions on boards/committees.

Confidentiality

Confidential product information may be shared in exhibitor booths, product demonstrations and in meetings. Participants agree not to use or disclose at any time any confidential information of any exhibitor or their affiliated groups, unless expressly authorized in writing and/or required by law. Taking photos, videos or capturing images of any product or booth display without consent of the exhibitors is forbidden.

Personal Responsibility

By attending ProMat 2023, you agree to abide by and engage in conduct that is beneficial to the health and safety of the event and all persons attending. I will take necessary precautions while at the event including, but not limited to, adhering to all state and local regulations and following the guidance of the CDC. I agree to not attend any ProMat event if I feel ill, had recent exposure to a COVID-19 case or have tested positive for COVID-19 within the last 14 days.
