CCCANZ Board has been working hard behind the scenes to provide our members with value for your membership fees. We are working with both IRHACE and RLNZ for the betterment of our industry and there are several initiatives that have been released in 2022-2023 that will benefit your company and take away your administration, improve governance and to allow staff involved in the HVAC&R industry an ability to earn CPD points.

CCCANZ has developed subcontracts and supply agreements for their members through their legal team at Heimsath Alexander and these have been through a full update in 2022 at a cost to CCCANZ. These have previously been an additional cost to CCCANZ Members, but as from 1st January 2023, CCCANZ Board has decided to provide these as part of your membership.

In 2023, we see a return of the CCCANZ Business Awards and we encourage all our members to enter the Business Innovation and/or Excellence in Business Awards.

A CCCANZ Member Company is the Company/Organisation that has registered for membership with CCCANZ.

CCCANZ Membership only applies to the registered and approved Company/Organisation. Any other entity should apply separately to receive the same member benefits. Benefits shown in the Member Benefit Kit are not transferrable between Companies.

TECHNICAL PAPERS & ARTICLES Member Technical papers and articles are available from the CCCANZ website.

SCHOLARSHIP Member AMCA Diploma of Project Management; “Managing for Profit”

CCCANZ established an annual scholarship to assist up to two employee/s (from different CCCANZ member companies) of a financial member/s of the CCCANZ, to undertake an industry supported study programme.

This programme provides intensive in-depth training in the fundamental of managing for profit in the HVAC&R industry.

Only CCCANZ Member companies are eligible, and you must be a member for a minimum of one year prior to applying.

In addition to the advertising, CCCANZ is also working with IRHACE and RLNZ on the technical education platform. This includes the recent launch of the CPD Programme which CCCANZ is a huge supporter.

IRHACE is offering each CCCANZ Member the opportunity for webinars to be included in their Online Library which attracts CPD points. Webinars can either be Live or pre-recorded. This is a great opportunity for you to promote your company and products.

CPD PROGRAMME

CPD POINTS Member IRHACE released the HVAC&R industry CPD programme in early 2022 specifically to provide a level of technical education - a first in our industry.

CCCANZ are in full support of this initiative, and we are pleased to be working with IRHACE to promote this through our network. We are encouraging our network of 100+ companies to contribute webinars to this platform for the betterment of the HVAC&R industry.

CCCANZ Board have agreed that each CCCANZ member company (excludes Affiliates) are eligible to sign-up for five (5) IRHACE Affiliate members. Additional staff are able to sign up at the industry price.

Contracts and Agreements

SUBCONTRACTS

This note seeks to provide general guidance to Members regarding the use of the Association’s Short Form Subcontract terms and conditions prepared as part of a suite of Standard Form contracts. The other form of subcontract is the Project Subcontract forms. Those documents are lengthier and require dedicated resources to set out the scope of works, assess value, risk and compile the agreement and associated documentation.

Details

1 It is intended that for lower value, lower risk engagements Members will utilise the Short Form to enable responsive Subcontractor engagement. Subcontractors engaged for subcontracts of this nature are likely to be less sophisticated when compared with Subcontractors who have the resources and capability to be engaged on high value works packages. A simpler form of Subcontract, where appropriately used, should assist straightforward contract engagement.

2 The length of the Short Form Subcontract has been minimised and the terms standardised to assist Members with engaging Subcontractors at the outset of subcontract engagements

3 While there are no ‘hard and fast’ rules regarding when the Short-Form should be used in preference to the long form, as a general guideline, the Association recommends that Members use the Short-Form only where:

a. The expected value of subcontract supplies is no greater than $100,000 (exclusive of GST and disbursements); and

b. The expected scope of the subcontracted works does not represent a significant risk to the Contractor, e.g. in terms of the Member’s performance under the relevant head contract.

4 4(a) and 4(b) are inter-related, in general terms, as the value of subcontracted works increases, there is a likely to be a corresponding increase in complexity and risk in the works to be subcontracted and the reliance placed upon the Subcontractor.

SUPPLY AGREEMENTS

The CCCANZ Board provides their members with useful and professional initiatives relevant to the changing nature of our industry. Supply agreement and associated forms are provided with short form standardized terms and conditions for contracting for the supply of goods and services.

Details

A The agreement is in a standardized template form. The relevant commercial details need to be added by the Member completing the Agreement particulars and the schedules (purchase order form and additional terms schedule covering continuing supply situations) to tailor this appropriately to the supply.

These documents will be provided in an editable PDF format allowing for insertion of only:

• Company Name

• Company contacts

• Company logo

• Completion of the Agreement particulars and purchase order and additional terms schedules.

B It is not possible to edit the general terms of the Agreement.

This ensures that the terms and conditions for goods and services procurements by Members are standardized and there is uniformity across CCCANZ’s supply procurement practices.

Where given the nature of the supply circumstances there is a requirement to vary these terms, this should be dealt with in the Special Conditions section of the Purchase Order Form. This has the added benefit of ensuring that variations apply to only that supply.
