PROFESSIONAL Chapter 7, often called “fresh start bankruptcy,” wipes out most unsecured debt, like payday loans, credit cards and medical bills. Under Chapter 11, debtors make a monthly payment to a trustee who pays off collectors. In either case, the focus is on making sure clients understand their options and helping them determine the best course of action, Berberick said. Many bankruptcy claims involve small businesses, but because owners front much of the financial burden themselves, those cases easily can become personal. In some cases, bankruptcy isn’t the right move. “You have people who are in a bad financial situation,” he said. “They feel guilty and bad about the whole thing.
