by RIKI MARKOWITZ Contributing Writer It’s difficult to say what season homeowners in Travis County worry the most. Is it the end of January when their tax bill is due? Or maybe mid-April when notices of appraised value are sent out? After homeowners receive an assessment that’s higher than usual (extremely common these days in the Austin metro area), they then have 30 days to formally file a protest to the Travis County Appraisal District (TCAD). It might sound like a sufficient amount of time, but when your clients have jobs and kids and soccer practice and dentist appointments — four weeks goes by in a snap. And then, after protests have been filed, it can take several months for TCAD to schedule and then hold the client’s informal hearing.” Those months feel like a lifetime as stressed homeowners wait to present evidence for why the body overvalued their home or condo. And what if your client doesn’t get the results they want: a lower tax bill? That’s a very realistic outcome. There’s just one other option, which is to go to the Appraisal Review Board (ARB). It’s an independent office that works to resolve disputes between TCAD and taxpayers. If an owner’s protest is successful, they might breathe a sigh of relief. But even that small amount of comfort may not last long. Tax rates for the current year are soon set in August and September; in October, property tax bills hit mailboxes and the whole cycle starts anew when payments are due at the end of January. Last year, according to the Austin Bulldog, the chief appraiser with TCAD, Marya Crigler, said the body received nearly 150,000 protests. Now it’s about mid-May in 2022 and it’s been close to four weeks since your clients saw last year’s property tax assessment. What it said about previous years in Austin basically came down to, “If you thought the twenty-teens were rough, hold my beer.” To say that homeowners had “sticker shock” is the understatement of the decade. Austin-Round Rock owners are used to seeing their appraised tax values go up year after year.

With the demand for housing continually outpacing supply, it is time for local jurisdictions to approve meaningful policy changes that reduce regulator barriers to housing and allow for greater housing capacity. REALTOR® Advocacy in D.C. When I say that REALTORS® are working hard to increase our housing inventory and improve access to homeownership, I genuinely mean it. At NAR’s 2022 Legislative Meetings, nearly 8,000 REALTORS® traveled to our nation’s Capital to advocate for Congress to take steps to address our housing shortage. I was there and personally participated in a meeting with Representative Michael McCaul’s Office. In addition, many other REALTORS® had meetings with Congressional Offices asking their elected officials to support important housing initiatives, including: •

the bipartisan Housing Supply and Affordability Act to create a Local Housing Policy Grant program for cities, states, tribes, and regional associations that enact pro-housing policies at the local level.

the bipartisan Neighborhood Homes Investment Act (NHIA) to offer tax credits to attract private investment for building and rehabilitating owner-occupied homes, estimated to incentivize the building and rehabilitation of 500,000 homes over the next decade.

the GREATER Revitalization of Shopping Centers Act to create a grant to incentivize public and private investment in abandoned and underutilized shopping malls to repurpose them for a range of uses, including the development of affordable housing.

the Revitalizing Downtowns Act to create a Qualified Office Conversion Tax Credit to convert unused office buildings into residential, commercial, and mixed-use properties.

At the same time, we are working to ensure fair housing for all. That’s why REALTORS® across the country are asking Members of Congress to support the Housing Fairness Act, which would reauthorize and increase funding for HUD fair housing testing and enforcement programs.

After all, Central Texas is one of the hottest housing markets in the country. According to Austin Business Journal, “For 2019, the median taxable home value in Travis County rose 7.4 percent.” Once owners filed their homestead exemption, that rate came down to 6.2 percent. The increase from the previous year was just over 10 percent. This year was different. The average property tax assessment went upwards of 50 percent. And the headlines blaring from every corner of the media — from newspapers to Facebook — were borderline hysterical. Homeowners in Round Rock were warned early that they would see property increases over 50%, “far higher than the previous record of percentage increase of 18% set last year,” wrote KVUE. Axios, which is a national publication but has local coverage in cities across the country, didn’t pull any punches. Their headline said “​​The Austin housing crisis is landing on the doorstep of every Travis County property owner.” The reporter, Asher Price, wrote “Before tearing open the envelope [by TCAD]: Fix yourself a drink.” To find out what clients reacted and what they’re doing about the 2021 property tax assessments, Realty Line contacted local brokers to get first-hand POVs. Susan Horton is Austin Board of REALTORS (ABoR) immediate past president, she’s been a licensed broker since 2009, and has more than three decades’ experience in the field. You can say when it comes to real estate in Central Texas, Horton has seen it all. Regarding homeowners’ reactions to TCAD assessments she said that clients are “absolutely” distressed. It’s almost like someone yelled fire in a theater. Ryan Rodenbeck, broker and owner of Spyglass Realty has been a real estate investor since 2001, a REALTOR for almost two decades, and a Platinum Top 50 executive, said that understandably homeowners are freaking out. “What they need to understand, though, is that this is a very hot market and very fast paced.” However, he implores agents to use this as an opportunity to add value to their business and their clients. That’s really good advice because for the past month, “agents have been getting bombarded with calls from homeowners asking

Once you give your client the CMA, you can put it in a program like HomeBot where brokers and clients have access to regular updates.

He also tells his agents at SpyGlass that they don’t have to wait for a year like this one to reach out to their client base. You should do this every year.

Crigler also has some suggestions for agents, including telling clients to file for their homestead exemption. That alone will prevent their taxes from going up more than 10 percent. As a real estate investor, Rodenbeck knows that clients who lease may be feeling pretty good about opting-out of the Austin market the past few years. But that’s something he and Horton vehemently disagree with. “Now is the time to consider buying,” says Rodenbeck. “Right now, your mortgage on a condo could be less than the house you’re renting,” he tells clients. And rents are going to go up because owners of rental properties get a tax assessment, not just homeowners. And rental units don’t qualify for exemptions. So real estate professionals have to discuss with lesees who are hesitant to get into the Ausin real estate market to look at what their rent is now and where it’s going to be. “Usually it makes sense to buy because rents will go up but their mortgage will stay relatively the same.” Rodenbeck

adds, “I don’t know any renter who has done well waiting out this particular market.” But back to those high assessments, what can homeowners do to get a few points knocked off their tax bill? Horton says there are third-party agencies that can help people prepare their protest paperwork. For example, you’ll want to take photos that demonstrate your home’s value is not the same as newer builds in your neighborhood and those that were recently remodeled. “If you did have work on your home in the past, even within five years, kitchens, bathrooms and flooring change.” They lose value over time. The goal at the client’s hearing is to show that not all the homes on one street or in one neighborhood are equal in value. Rodenbeck agrees. “You need to try to protest your taxes.” While about 20 percent of homeowners appeal their property tax assessment each year, according to Realty Austin, many Austin brokerages believe that a majority of Austinites should protest. Even if your assessment doesn’t budge, the protest helps keep TCAD from overestimating property taxes, especially in areas where a percentage of neighborhoods experienced growth and improvement. Also, if you just rely on your homestead exemption from raising your taxes more than 10 percent, that won’t stop your bill from going up 10 percent each year. Considering the corporations opening offices in Austin, from Tesla to Amazon, Tik Tok and Apple, it would be extremely shortsighted to assume we’re at the peak when it comes to property tax assessments. There is one person who is confident that more homeowners will take the advice to protest their taxes. Chief appraiser Crigler told the Austin Bulldog, “We expect this to be the busiest protest season we have ever had.”
