Change of plan for accidental landlords With the ‘credit crunch’ phenomenon of ‘accidental landlords’ on the wane, there is more evidence that the sales and lettings sectors are returning to a position of health. Your Move researched the current market and sought advice at the recent Merseyside Landlords Expo, for more information. Accident prone Accidental landlords came to prominence towards the end of last year as concerned sellers sought an immediate income on their property in a depressed housing market. The influx of accidental or reluctant landlords into the market was by no means a new trend, but their numbers swelled as prices reached their nadir. They predominantly consisted of those who had lived in, or inherited a house, and were unable to achieve a desirable sale for their property amidst tumbling prices. As ever there were also those who needed to move, due to divorce, career relocation or otherwise, and were usually faced with the prospect of accepting lower offers or waiting out the market slump while securing a rental income. All told the flood of accidental landlords boosted the number of rental properties on the 36 Your Move

market, with significant increases in the number of houses and family homes. Rules and regulations Perhaps inevitably it hasn’t all been plain sailing for the accidental landlords, with demand not always forthcoming for certain types of properties in certain areas. Many landlords of course were also not au fait with the responsibilities of a landlord and the rules and responsibilities they are required to comply with. As a result of a lack of planning and foresight, tenants were also left under threat of eviction if struggling accidental landlords were no longer able to pay their mortgage. All change Since the market started to stabilise in the summer, accidental landlords have been selling up in great numbers, illustrating the continuing strength of the sales market. The disappearance of accidental landlords has, in turn, strengthened the rental market, as supply has tightened. This state of affairs was highlighted by property expert Sarah Walker, who recently gave a seminar on “How to make more money from your property portfolio in the current market” at the inaugural Merseyside Landlords Expo in New Brighton. The sentiment was echoed by a spokesman for the Royal Institution of Chartered Surveyors, who commented: “The number of properties coming on to the rental market has slowed as the sales market has begun to stabilise. This is good news for landlords, who were coming under pressure to reduce rents as a result of oversupply. The need to respond in this way is easing and, providing the housing market holds firm, the outlook for the rental market should continue to improve.” Professionals return The main beneficiaries of the current market conditions appear to be buy-to-let investors, who have been able to capitalise on a steady demand for a diminished supply. Carrol Corran, city centre lettings manager for Sutton

Kersh, commented: “We have seen a decline in the number of “accidental” Landlords coming to the market. As people’s faith in the property market is beginning to be restored and sales are picking up, those who considered renting as a last resort to selling are now tailing off. On the flip side the increase in sales, particularly in the city, has lead to an increase in the number of “professional” landlords coming to the market. Those who were fortunate enough to pick up a bargain over the past twelve months are seeing an excellent return from renting.” Waiting game Sue Taylor, head of Keppie Massie Residential, believes landlords, be they reluctant or otherwise, should always adopt a long-term approach to the letting if they are to benefit. She commented: “Certainly, we had many investor owners, who were forced into the rental market as the market started to decline. But we have noticed that they are now appreciating the investment value of their properties, some of which are now offering returns of between six and eight per cent. The property market should always be treated as a

long term investment and not as a quick profit maker.” Sue added: “Using a good rental agent can increase the value of an investment portfolio and minimise void periods. Keppie Massie is currently offering investment portfolio’s in the city centre, complete with corporate tenants offering amazing yields.”

Future direction The sharp decline in the number of accidental landlords is a good indicator that the housing market has stabilised, but inevitably they are always likely to have a presence in the marketplace. Alan Bevan, from Victoria Street-based City Residential, does not believe we have seen the last of accidental landlords. He commented: “There is no doubt there has been a decline in numbers as increased sales activity has “relieved” some landlords of their properties. We do not expect this decline to necessarily continue however, as a tighter selling market and stronger lettings market may well encourage some new “accidental” landlords. Obviously the future direction of interest rates may well have a more defining effect as well.”

Q. I have worked out of the UK for several years as an overseas contractor, and have always claimed non-residence and made sure I was in the UK for less than 90 days each tax year. Lots of my colleagues do the same, but one of them is now being investigated by the Revenue who are saying that he has been resident in the UK all along. What is the position? A. There have been a number of recent changes in the way that HMRC will assess someone’s residence. The long standing practice of many people like yourself and your colleagues to rely on the ‘90 day’ rule is now under severe threat. Firstly for 2007/8 onwards HMRC changed the rules for daycounting, so that days of arrival and departure in the UK which had previously been ignored in counting towards your UK days, were brought in. This makes a real difference for people who make frequent short trips to the UK. Secondly and much more importantly on 6 April 2009 HMRC withdrew their old IR 20 Booklet and replaced it with more detailed guidance including HMRC 6, a new (as yet draft) manual. Buoyed up by victory in a couple of recent high profile cases, this new booklet provides a flavour of how an Inspector will tackle a residence enquiry.

Certainly it is no longer enough to just ‘count days’, as lifestyle and family choices can jeopardize residency status. Q&A With Julia Ford, Head of Conveyancing

Q I have just viewed a property which I am told is “shared ownership”. What does this mean and what are the implications of ownership?

The Company Director Sue Weir, director at Amazon Management Services Ltd, worked in property before launching the family-run lettings and management company. Sue now oversees all aspects of the business, offering a smooth and reliable process for landlords and tenants.

How did you get into property? My husband had been buying properties, refurbishing them and selling them on. He was doing very well, and eventually began keeping some properties to let and I began doing the accounts for those properties as I was ATT qualified. I had been working for a landscaping company but after it went into liquidation I continued with the accounts for my husband. As things were going so well we decided to set up Amazon Management Services. From the word ‘go’, landlords began approaching us just via word of mouth asking if we could deal with their properties.

How has your career progressed? Things have taken off with the business really quickly! A year ago I was dealing with 30 or so properties and now it’s over 150. The company has also grown. Initially it was just myself but now we have more staff and are hoping things will expand even more. It’s very rewarding when people are appreciative of the work we do, and there’s a real sense of loyalty from our clients.

What would be your dream pet? At the moment I have my hands full as I have a parrot called Bobby. I sometimes bring him into the office as he hates to be left alone. I would choose another outlandish animal such as a peacock as their tails are so beautiful and they’re such quirky animals.

A Shared ownership is simply part buying and part renting a home. The Shared Ownership Lease will grant you the percentage share of the property you have bought from the Landlord, for example 50%. For the remaining share you don’t own, i.e. The other 50% you will have to pay a monthly rent to the Landlord, and this agreement will be contained in the Lease. You will pay rent until you have bought the full 100% of the property. The Lease will also contain provisions to enable you to buy any remaining shares in the property after a certain amount of time (if you wish until full ownership is achieved); this is known as staircasing. A valuation will be carried out on the property and the price of the share you wish to buy will be apportioned accordingly. As with any Lease, it is usual that you will pay a yearly ground rent to the Landlord and in addition to this, a service charge for maintenance of the communal areas, eg. Structure of the building, lifts, cleaning, lighting, heating and management. You will pay a proportion depending on your share of the building i.e. Either the number of apartments in the block, or based on square footage of the apartment. Movers What do you make of your new home? The house came with blinds and was fully carpeted which saved a massive expense, so we didn’t have to do much at all. We used to live in one of the old Victorian terraces in the area, which was a lovely old house with great big ceilings. Unfortunately it cost a fortune to heat and maintain. Having a new build is just totally different. In the old house the boiler was falling to bits but here you only have to have the heating on for two minutes for the house to heat up. Tell us about the layout... We have three bedrooms upstairs, a bathroom, a lovely modern kitchen, a large living room and a downstairs toilet. There’s a gated driveway on the front and also a back garden. What’s the garden like? It’s great, just a nice size for us. There’s a little bit of a patio and a nice bit of grass. We’ve never really had a garden before so I’m not sure where to start, but I’ll be looking forward to getting stuck in!

What’s your favourite part of the house? I like the kitchen. It’s nice and modern and came fully fitted. It’s nice to eat once a day as a family. If nothing else we can grab half an hour a day with each other. I think it’s important. And finally, what would be your dream buy? If it was up to me I’d like to have a plasma TV in the living room.

What have you done with the living room? We bought a three piece black leather suite from CSL and there’s a big black mirror and a couple of pictures on the walls. We have two display cabinets, red and blue, which feature all of our designer glass ornaments.

Take us upstairs... We bought a German bedroom suite from London Road for the master bedroom and there are two double wardrobes and a bed unit on one wall. Charlotte is in the other room and my son is in the box room, which is a decent size. We had to get rid of the gaming chair he had so we bought him a bed with a remote control. He also has a plasma screen TV on the wall, a chest of drawers, bookcase and a wardrobe were he keeps all of his X-Box games.

Tim Smit Interview //// TALENT IN THE CITY

Having become disillusioned with the music industry, successful writer and producer Tim Smit escaped to a quiet corner of Cornwall, where he uncovered and restored The Lost Gardens of Heligan, one of the most popular botanical gardens in the UK. Later, on the site of an old china clay pit, he created The Eden Project, a stunning attraction of artificial biomes dubbed the eighth wonder of the world. Tim spoke to Your Move before giving a Liverpool University lecture at the Philharmonic Hall.

Avant Garden You studied archaeology at university. How did you end up in the music business? When I was at uni’ I was completely skint so I formed a band with my mate Charlie Skarbeck and ended up getting loads of gigs. We went down to London thinking we were God’s gift to music, but immediately ended up on the dole. We realised that on any particular week in London there were 10,000 musicians better than us. Fortunately we made friends with a guy who was a sound engineer at Abbey Road. He allowed us to use the studio when it wasn’t booked and we got five or six record deals back to back. What was your greatest success? We had a monster hit with a lady called Louise Tucker who had actually been babysitting for me at the time. The day after she had been babysitting for me, the artist who was supposed to turn up to the studio didn’t arrive. I phoned Louise up on spec and said it would be nice to work with her. We sold a million copies of 52 Your Move

the album and the rest was history. We went to number one in 14 or 15 countries and did a few albums with her which were very big. Why did you start to move away from the business? We got very arrogant and decided we were God’s gift to music all over again and that we had much better taste than everybody else. We decided to build a studio to work with other artists, but we blew all our money on it and didn’t have any hits. It was a great lesson in life. I’m really glad it happened because it taught me to be grateful for every good thing as opposed to being arrogant. Over the next few years Charlie and I produced and wrote for a whole load of acts like Twiggy, the Nolan Sisters and Barry Manilow but I fell out of love with the music business and decided to move to Cornwall. How did the Lost Gardens of Heligan come about? I was going to build a recording studio so I could produce film music without

having to deal with artists. While I was doing that I met a guy building a nearby farmhouse. When we talked and he heard that I was an archaeologist he asked if I’d like to see the estate that he’d just inherited next door because nobody had been in there since 1915. So the following day I joined him with a machete and we walked into this big estate and cut our way through and it was just unbelievable - like a secret garden – completely overgrown. I fell in love with it and decided within 45 minutes I was going to change my career and restore this garden. What inspired the Eden Project? I’d long had the idea of something very spectacular and I guess there was a moment when I was driving along the A30 and saw the sun setting on Goonbarrow Clay Quarry, in a way that made it look like a ziggurat. I started dreaming about Arthur Conan Doyle’s lost worlds, lost civilisations in craters of volcanoes. I thought how could

you create a metaphor for a civilisation that was a distillation for all that’s best in our world; to draw attention to how we could work better with a growing nature. Have you been surprised by its success? We’ve had 11million visitors since we opened in 2001 and put over a billion pounds back into the Cornish economy, which is more than double the entire European budget for the whole of the south west in the same time. I guess the reason it works is because it’s a global must-see – bigger than a tourist destination. Do you still have a day-today involvement? I do but I’m moving away from the tea and toilets because I believe that the stage is now right for us to do something as big as Eden all over again. What are your hopes for the future? When I look at most of the environmentalists who talk about climate change they bore the pants off me. Most of them seem to have bad breath and dandruff. They want to tell you the world is going to go to hell in a handcart with charade science, which in most cases is cod science. Most of the environmentalists I know don’t actually understand the science but they’re quoting from others who say they do. We actually need a vision of what those sunny uplands might look like – a story of why it’s great to be alive today and why maybe we’re at the dawning of a renaissance.

I would also have a look at smaller furniture stores as in today’s market you may find some real savings and deals. An eclectic mix of old and new furniture can be really exciting, and will make your new flat look fantastic.

It’s a bug’s life Construct a garden habitat where an array of diverse insects can hibernate over the winter months, first by taking four pieces of wood of equal size. Drill holes of various dimensions to allow access to a multitude of creatures, leaving the top side to prevent rain leaking in. Glue or nail the planks to create an open-ended box and pack with twigs, straw and bamboo canes to create little hiding places for your garden friends. Finally, position your insect house in a dry, sheltered spot where it won’t be disturbed.

Food waste can be converted into energy, and Liverpool city council is about to trial kitchen caddies which, if successful, will see a scheme devised for residents in our area. In the meantime, however, and if you have some outside space with your property, get into the habit of collecting food waste. Place compostable items, such as banana and potato peelings, in a sealed container and empty every day onto your compost heap. However, don’t deposit meat or bones to avoid attracting rats to your garden. A food waste processor for your outdoor space is another solution, converting all your leftovers (including meat and bones) into water and carbon dioxide. Table Talk //// LUCY OLIVER INTERVIEWS MARK PHILIP COOPER AT SAVINA

Zest Lets’ quirky radio advert has become a favourite with Juice FM listeners and landlords looking for a ‘fresh approach’ in lettings, as has the unmistakable zebraprint Smart car on the city’s streets. Managing director, Mark Philip Cooper, is as enthusiastic in the flesh as you’d expect from Zest – and Savina, the Mexican restaurant on Duke Street makes a tantalising venue for our lunch meeting. Mark’s experience in property is substantial for his young years, and his current role heading up the relatively new brand sees him explore his passion for the industry. “I’ve been in property since I was 16, working as a site manager for a local property developer. It was a great experience – it really opened me up to the opportunities in this sector. I decided that I wanted to work in lettings and sales, and took on a position at The Waterford development in the Georgian Quarter.” This experience in managing properties proved invaluable when he was offered the position at Zest Lets, Mark tells me, as we enjoy wine and soda with nachos, salsa, guacamole and sour cream. He’s fully equipped to offer landlords support by managing properties, advising on where to invest, and a full range of services. “I’ve been working really hard since I took on the business, and it’s been challenging, but I’ve always had my own ambitions and I want to make this a success while I’m still young. I’m prepared to put the time in for that, and this afternoon is fully

booked up with viewings.” The first birthday celebrations for Zest Lets are set to take place on 8 October at Palm Sugar, and will also form the launch of Zest Res, the estate agency side to the business. The themed event will operate a dress code, seeing guests pay homage to the colours of the pink and zebra-patterned logo and branding. “I’m really excited about the launch, as it’s going to be a real celebration of everything that’s different about the Zest brand. We provide a professional service, but we’re not obviously corporate and formal – we relate to people on their level and earn their trust. That’s how I like to do business.” Savina’s friendly service, fronted by Antonio, is complemented by a wide range of Mexican-themed meals. Mark chooses the Cajun chicken fajitas with mixed peppers and rice, while I opt for the pan-fried snapper. Mark’s plate sizzles as

my fish dish arrives with small cut roast potatoes, and served on a bed of green beans and sweet corns. The restaurant is also launching a new takeaway service, which is set to prove a favourite with city centre dwellers and other patrons. For Mark too, new business in the city looms as he looks to take on more city centre-based landlords and manage properties across south Liverpool and the suburbs, including properties for students and graduates. The recent Merseyside Landlords Expo also proved successful, generating new business and contacts. “My aims are to grow the company, and I’ve been busy networking to reach more landlords and tell them about our competitive rates and what we can offer. I want to leave my mark.” Somehow, I don’t think that that’s going to be a problem – this brand is one that’s sure to make an impression.
