Dream House Tax nightmare Sometimes a tax case comes along which underlines the importance of taking good tax advice. This applies also when doing something to your main home, where there is a common assumption that a sale is always tax free. Mr Gibson, bought a property for £715,000 and lived in it. He then decided to demolish the original house and build his 'dream house'. He had worked out that demolishing and rebuilding would be more cost effective than renovating the existing structure. The new house was built on new foundations out of different materials. Mr Gibson then ran into relationship and financial difficulties and decided to sell the new house for £1.5 million. He assumed that the substantial gain would be tax free, as he believed that Principal Private Residence relief would apply and so he completed his tax return on this basis. HMRC disagreed.

The key failure here was that Mr Gibson did not 'properly' live in the new house before he sold it. The complete demolition of the old house, meant that the new house had to be considered separately, they were judged to be different 'dwelling houses' so Mr Gibson's occupation of the first house became irrelevant and his occupation of the second house became critically important.

Although Mr Gibson said he had camped at the new property while it was being built, this was not enough to convince the tax tribunal. Mr Gibson's intention to live in the new house was not enough, neither was camping at the property while it was under construction. He failed to show a period of quality residence in the new house which would have led to it being treated as his home. However unfair this may seem, if only a couple of circumstances had been different about this case then the outcome could have been quite different. Although it is a generous and widely applied relief, PPR can be lost quite easily and sometimes for notquite logical reasons, this is not always appreciated. Mr Gibson not only ended up having to pay capital gains tax on the gain but he also got landed with an onerous 50% penalty for negligence in completing his tax return. Expensive mistake, which could have been avoided. If you are planning anything similar I would recommend that you get good tax advice - so your dream house does not become a tax nightmare.

2017 has started off relatively strongly across most of the residential sectors we deal with and is currently slightly ahead of last year on a like for like basis. The city continues to grow its leisure, culture and retail offerings, thereby attracting an increasing number of potential future buyers. We would therefore expect the market to continue to perform well, although there must be an element of caution given the potential political issues that may lie ahead such as Brexit, European elections, Trump economics and subsequent volatile currency swings. On the flip side, many of these political headwinds could well result in unexpected positive effects on the market such as a continual fall in sterling making Liverpool (and indeed all UK property) more financially attractive than pre Brexit.

We expect 2017 will see the focus on home ownership continue following the recent government announcements on a range of housing initiatives. People’s changing households, working patterns and a growing older generation all mean house hunters are increasingly looking at different types of property and tenure. Home ownership is certainly on the social housing agenda. The sector is awaiting news of a further regional pilot of the Voluntary Right to Buy for housing association tenants, as announced in the Chancellor’s Autumn Statement. I think that buy-to-let landlords are in for a bumpy ride this year. The stamp duty changes last April, much tougher affordability checks by lenders and withdrawal of wear and tear relief and mortgage interest relief will have a significant dampening effect on the market and we are already starting to see highly geared landlords, whose portfolios may well become cash negative, start to look for an exit route. This could be an opportunity for well capitalised landlords to pick up bargains. Overall though, demand for property continues to exceed supply so I think we will continue to see increases in residential property values overall, albeit not at particularly exciting rates of growth.

HOW DID YOU GET STARTED IN ACTING? I was about 10 years old when my mum and dad bought me a digital camera. It was just a basic one but you could record video and then edit it on the computer. My sister and I started filming little videos - comedy sketches and dramas based on what was happening in our family. We had all sorts of characters in the family at the time like my auntie who enjoyed a drink and my uncle who was nuts and we would try and imitate them. We would take the finished product into the living room to show my mum and dad. The positive reaction we would get made us proud and spurred us on to keep doing it. From there I did drama at primary school but it was my drama teacher at secondary school, Nicola Ousey, who really started paying attention to me and putting on my reports that I could be something special.

YOU’VE SAID SEEING DANIEL DAY-LEWIS’S PERFORMANCE IN JIM SHERIDAN’S ‘IN THE NAME OF THE FATHER’ WAS A TURNING POINT IN YOUR CAREER WHY? At first a lot of the stuff I was doing was comedy based - trying to make people laugh all the time. Then when I was 15 I was sitting with my uncle and he described the whole film from start to finish and I just couldn't stop listening. Afterwards I got a copy and it changed my perspective on everything. That’s when I knew what I wanted to do with my life – I wanted to have the same effect on people that Daniel Day-Lewis had on me when I saw that film.

WHAT WAS IT IN PARTICULAR ABOUT HIS PERFORMANCE THAT HAS SUCH A PROFOUND EFFECT ON YOU? I’d always been used to seeing the male lead in most films being very masculine but there was a certain vulnerability about his performance which stood out and was something I could see in myself. I’m quite a sensitive person; I think that's why I’m an actor. I used to do mixed martial arts and while I did enjoy competing, when it comes down to it I’m not a very aggressive person - what aggression I do have comes out through my acting now. I think it’s that mix of both aggression and sensitivity that makes a character human. YOU STAR ALONGSIDE STEPHEN GRAHAM IN THE SOON-TO-BE RELEASED SHORT FILM ‘BEING KEEGAN’ CAN YOU TELL US MORE ABOUT THE STORY? Myself, Stephen and young actor Adam Perryman all play a character called Jay at different stages of his life. When Jay was younger he saw his friend killed by a train and develops post-traumatic stress disorder (PTSD) as a result. I play the 18-year-old version of Jay who is struggling with the PTSD. In an attempt to deal with it he’s turned to drugs; he’s taking it out on his family and has completely gone off the rails. The film puts a lens on a real life traumatic situation and sees the after-effects and looks at how a kid can start out with the dream of being the next Kevin Keegan but one thing happens in his life and it all gets turned upside down. DO YOU LOOK UP TO PEOPLE LIKE STEPHEN? WOULD YOU LIKE TO EMULATE HIS SUCCESS? As a kid from Liverpool, what Stephen did for me was spark an idea of a possibility of what could be. I hadn’t seen many Scousers on the television and when I did the way they were portrayed didn't appeal to me. So when I saw Stephen in ‘This Is England’ I said to myself ‘that’s a real, living, breathing character’. It’s one of the most real performances in British cinema I have ever seen. I’ve taken inspiration from people like Stephen, Daniel Day-Lewis, Paddy Considine and Gary Oldman - who I’ve just finished a film with - but I haven’t set out to intentionally emulate anyone.

CAN YOU TELL US MORE ABOUT THE UPCOMING ACTION THRILLER ‘HUNTER KILLER’? It will be my first feature-length film and the first which will have a worldwide cinema release. It’s what I’ve been working towards for a few years and although it’s not the end goal, it’s what I’ve envisaged for myself for a while. My agent sent me for an audition and I saw on the brief that Gerard Butler and Gary Oldman were in the lead roles and I thought ‘I really want to get this’. Hopefully being in this film will start to open some more doors for me and I will get seen for things that I wouldn't have before. I’m not saying it's a massive lead role but it's a significant part in the film and I’m in a good few scenes, including some with Gerard Butler. The plot revolves around Gerard’s character, who’s in charge of a submarine which is sent on a mission to rescue the Russian president by Gary Oldman’s character. There is a mini-submarine attached to the main vessel and that's where I come in. My character ‘Nichols’ is on this mini-sub with his partner and it’s their job to go in and rescue the president who has been kidnapped by a rogue general. All the submarine scenes were shot at Pinewood Studios in Shepperton - we were drilled into this submarine which was built up from real parts but just looks like a cardboard box on the outside. Some of the scenes were really hectic - it’s quite difficult to stay focused and remember your lines when water is being shot at you from all over the place! HOW WOULD YOU LIKE TO SEE YOUR CAREER DEVELOP IN THE FUTURE? I want to keep developing myself as an actor and continue to play characters that are intense, sensitive and real people who you can relate to. I’m in a position now as a 22-year-old lad where I haven’t made it yet, but I want to get to a point where I’m taking lead roles in feature films. I want to leave behind a nice body of work and hopefully inspire people in the same way that people like Daniel Day-Lewis and Stephen Graham have inspired me.

Usually quality and quantity are mutually exclusive – by having one, you’d expect to sacrifice the other. Interestingly though, this isn’t the case at Hanover Street’s latest underground venue which prides itself on its 24-hour brined and buttermilk-coated chicken, made succulent by a secret mix of herbs and spices. The thematic venue provided a welcomed break from the hustle and bustle on a crisp winter night. As we entered, my dining partner and I were pleasantly surprised with the restaurant’s strippedback décor which combined splashes of colour and exposed brickwork to blend authentic dining with flashes of an industrial environment. Attentive staff offered us a choice of seating and so to fit in with the restaurant’s theme we decided to sit in a booth modelled on a chicken coop. After being guided through an extensive menu we began with drinks. I ordered the Oreo milkshake (£4.50) made with vanilla ice cream, cookies and cream, and my dining partner chose the Big Wave Golden Ale (£5.50) which together with other signature house brews, is on tap. The first dish to arrive

was a labelled selection of sauces (50p) and highlights included the Smokin’ Aces (Horseradish and Scotch Bonnet chilli hot sauce), Buffalo (the original New York hot wing sauce imported from the USA) and Korean (soy sauce, coriander, tomato and honey) options. I also selected the Fill It Burger (£9) served with lettuce, tomato, mayonnaise and chips and topped with a dill pickle which pierced the brioche bun struggling to hold a full buttermilk fried chicken breast. My dining partner ordered the Parma Bird (£12), combining a full buttermilk fried chicken breast wrapped in Parma ham with cooling Mamma Mia sauce – an Italian-style tomato and basil accompaniment – parmesan cheese, rocket, tomato and mayonnaise in a brioche bun, again topped with dill pickle and served with chips. Each dish leapt onto the table with fresh vigour as if to form a colourful mosaic. We combined our mains with a selection of side dishes and ordered chips garnished with Monterey Jack cheese (£3.50), Yard &

Coop’s creamy house slaw (£3) to combat the searing heat of the Buffalo sauce, Chorizo Thins (£3.50) in crispy tempura batter and Cowboy Beans (£3) - a mix of beans and chicken and bacon bits in spicy tomato sauce. However, whilst I understand the restaurant targets a wide demographic and is time constrained, the meal would have been improved with fresh, handcut chips instead of what appeared to be the frozen alternative. Overall, it was clear nothing here was a limp attempt to replicate another restaurant. Instead, the product was a bold reimagining of convention, delivering classic flavours and original combinations to subtly pay homage to its deep roots. Suitably impressed with its offering, we agreed to return. With plans to expand further, it’s clear Yard & Coop can go from strength to strength, especially with its £5 lunch specials and home delivery service. However, I do warn you that its portion sizes are not for the faint hearted!

Liverpool’s Chinatown sprung up from the seeds sown and stones laid by Europe’s earliest Chinese settlers and is now home to a vibrant and diverse community. The city is celebrating its links to the Far East with an extended programme of events for the rooster-themed Chinese New Year 2017, starting on Friday 27 January and concluding on Sunday 29 January. The streets around Chinatown will explode with colour when a parade marches into town on the final day, backed by street performances, family workshops and market stalls - but these traditional festivities will be accompanied by a spectacular light show this year. Created by digital experts Illuminos, the lumiere installation will light up Chinatown’s most famous landmarks - the Chinese Arch, the Black-E and the former Scandinavian Hotel building. Playing on an hour-long loop, the projections will tell the story of ‘Jingwei and the Ocean’, an ancient Chinese myth about an Emperor’s daughter who perishes at sea, returns to life as a bird and attempts to fill the ocean with debris to prevent others from suffering the same watery fate. Across the weekend, visitors can also take part in an augmented reality trail which will take them on a virtual tour of the city’s Chinese cultural history via their smartphones. This year’s celebrations have been organised by members of the local Chinese community in conjunction with Liverpool City Council, which 48 Your Move

is helping to manage the three-day event. Speaking to Your Move, Councillor Wendy Simon, assistant mayor and cabinet member for culture, tourism and events, sheds light on why Liverpool’s Chinese New Year celebrations have been expanded for 2017. “We’re in constant dialogue with the Chinese community about ways to improve the celebrations and we feel like the light show was the right way to enhance them this year,” she explains. “Extending the festivities by an extra day enables us to fit in everything people were calling for. “Because of our huge developing relationship with China and the increase of Chinese students at our universities, we felt like it was the right time to expand the New Year celebrations but Liverpool’s Chinese community was always pushing for a bigger festival.” The Year of the Rooster’s bumper programme is as much about paying homage to Liverpool’s long-standing Chinese community - deemed vital to the city’s heritage and cultural offering as it is ringing in a new calendar year in a distant time zone. From Oriental cuisine to martial arts, Chinese culture has been embraced in Merseyside since an influx of Asian immigrants arrived on these shores in the late 1850s, and there are a number of community groups, arts organisations and individuals striving to keep these traditions alive. Pagoda Arts is a multi-faceted group which promotes Chinese culture in the city, from dance to Tai Chi and music via its acclaimed Pagoda

Youth Orchestra. The organisation is heavily involved in the Year of the Rooster celebrations and will deliver live street performances during the main event. “The expansion of the celebrations means we can showcase the community to a wider audience,” Pagoda Arts director, Zi Lan Liao, tells us. “This year we are not just holding a community celebration, but a cross-Atlantic project. Having the chance to collaborate with Illuminos, musician Jah Wobble and Miami-born rapper MC Jin on the soundtrack is amazing. “This commission by the council has yet again consolidated the presence of the Chinese community in Liverpool.” Working towards that same goal, the Wah Sing centre has taught Mandarin and Cantonese to Chinese children in Liverpool for more than 50 years, while community figure Kwong Ngan known locally as Kenny Tam - has earned a British Citizen Award for introducing Tai Chi to the city, among other accomplishments. “Liverpool’s Chinese community is extremely important to the city’s cultural offer, creative scene and historically to our maritime development,” Cllr Simon says. “We’ve got so many cultural activities which take place around Chinese traditions, from dance groups to music and martial arts. There’s also a massive business community linked to the city’s Chinese demographic.” John Campbell and Moira Kenny - known collectively as local artist duo The Sound Agents - work closely with the Chinese community on projects promoting its value and heritage. They believe events like Chinese New Year are vital to promote the role of Oriental culture in Liverpool. “Traditionally Chinese people do not speak out or showcase their work,” John and Moira tell Your Move. “Individuals, organisations and community groups in Liverpool's Chinatown work mainly behind the scenes of the cultural scene. “Chinese New Year is an opportunity for the public to see the performances, find out about opportunities and get involved with activities all year round. Culture, philosophy and sport are high on the agenda in Chinatown - they are part of everyday life; not just for Chinese New Year.” The Sound Agents are preparing a planning application for a pop-up museum in Chinatown after securing a £2,500 grant from The Mayor’s Fund to support the venture. The project, which has been pencilled in for a May launch, aims to highlight the need for a dedicated community space in the area and preserve the heritage of the oldest Chinese community in Europe.

As the Sound Agents make plans to celebrate Liverpool’s Chinese community past and present, developer North Point Global is looking to the future with its £200 million New Chinatown scheme. The transformative project, which is already underway, will eventually deliver hundreds of new homes alongside brand new retail and commercial units and a hotel to the Chinatown area. John and Moira believe the expansion of Chinatown’s borders will help the Oriental influence radiate across the city, pointing out that Chinese communities are already springing up in other parts of the city centre and are making their presence felt. “The New Chinatown development promises to create a thriving business centre in the heart of town with opportunities for small business from China and Hong Kong working alongside families and professionals,” they added.
