The firm recently negotiated a groundbreaking $115 million settlement in a class action lawsuit over the massive 2015 data breach of Anthem, Inc., one of the nation’s largest for-profit managed health care companies. The settlement was achieved after more than two years of intense litigation during which the firm led the taking and defense of more than 200 depositions and pored over roughly 3.8 million pages of documents. If approved, the $115 million package will be the largest data breach settlement in history, providing class members with a minimum of two years of triple credit bureau monitoring and fraud resolution services, and requiring Anthem to make specific commitments to protect class member data and improve information security. Some of the firm’s other recent successes include a $60 million settlement in a nationwide class action against technology security provider Symantec and its e-commerce vendor, Digital River, Inc. over the marketing of Symantec’s “download insurance” for its popular Norton anti-virus software; and a

$36 million pending settlement with Lumber Liquidators Inc. to resolve all claims related to the formaldehyde multidistrict litigation brought on behalf of purchasers of Chinesemanufactured laminate flooring. Andrew N. Friedman, Co-Chair of the firm’s Consumer Protection practice group, was recently appointed to the steering committee for the consumer plaintiffs in In re: Equifax Inc. Consumer Data Security Breach Litigation, the multidistrict litigation stemming from the massive Equifax data breach which came to light late last year. Mr. Friedman served in a similar capacity in In re: The Home Depot Inc. Customer Data Security Breach Litigation, which resulted in a $25 million settlement on behalf of financial institutions in September 2017; and is currently serving on the plaintiffs’ steering committee in In re: Vizio Inc. Consumer Privacy Litigation, a closely watched class action in which plaintiffs allege that Vizio secretly collected data through software surreptitiously installed on their Smart TVs and subsequently shared it with advertisers and other interested parties.
