Veterans, county clash over fire station site By Hemananthani Sivanandam

Veterans are questioning why Contra Costa County failed to look for an alternative area to house a new downtown fire station as the site identified raises concerns for veterans, residents, and businesses. The veterans’ organization of Brentwood also questioned if the county had conducted an impact or emergency response assessment prior to designing plans for the new fire station at 739 First St., which will replace the former Fire Station 54 that was demolished last October after permanently closing in 2014 following 57 years of service.

The county is moving forward with the construction of a new fire station, estimated to cost $10 million. This station aims to ac-

commodate larger fire engines and enhance fire and medical response times in Brentwood and throughout East County to serve the needs

of the expanding community. Among the concerns raised by veterans regarding the project include:

• taking away land dedicated to veterans and paid for by taxpayers • impact on parking spaces on First Street. • taking away the option of closing streets for community events such as Hometown Halloween, parades, and car shows. • disruption of alleyway and loading zones for local businesses and increased presence of fire engines maneuvering through narrow streets and turn radius pose a safety concern for pedestrians and motorists downtown. The Oaks residents complain Medical pot delivery about security, maintenance one step closer Two residents selected for housing panel By Jeff Weisinger Staff Writer

The Oakley City Council appointed two Oaks apartment residents to fill two of the three vacancies on the city’s affordable housing ad hoc committee during Tuesday night’s City Council meeting. Oaks residents Doug Gamble and Barbara Bautista were both selected by Mayor Aaron Meadows to be on the committee after the council had four people interview in person for the three open spots. Two of the open-

ings were to be filled with current residents with one member of the Oaks management team to fill the other. Oke Johnson, the executive vice president of Winn Residential, which provides the property management and maintenance services for The Oaks, was unable to attend because he was traveling. All four Oaks residents were asked the same questions regarding their time living in the apartment complex in Oakley, and all four gave their insight into their experience living at the Oaks, most of which was negative. From overdue maintenance to security issues throughout the complex, the four candidates who spoke on Tuesday night were not afraid to remind the council about the ongoing maintenance issues that have yet to be resolved in the

Changes to Brentwood’s municipal code that would allow for the delivery of medical cannabis to residents blazed ahead on Oct. 10 following a 5-0 vote by City Council. The changes are intended to bring the city into compliance with a new state law and were previously approved by the Planning Commission. Senate Bill 1186 was passed by Gov. Gavin Newsom in 2022 and asserts that “it is the policy of the state and the intent of the Legislature to ensure that Californians throughout the state have timely and convenient access to safe, effective, and affordable medicinal cannabis,” according to the agenda packet for the Sept. 19 Planning Commission meeting during which the topic was originally

Gamble mentioned that he’s lived in The Oaks for “almost a year and a half.” “I’ve seen things around the properties go downhill. The biggest problem I’ve seen has been security issues. Each of the buildings have a dumpster in it that’s secured by a security door. And those security doors have no locks on them. So people can get into the buildings at night with no problems. I have people trying to get into my apartment on a regular basis late at night, to the point where I’ve had to call the police two or three times a month to

The city would leave in place existing prohibitions on cannabis cultivation, cannabis dispensaries, and non-medicinal cannabis deliveries within Brentwood. “The delivery and transport of non-medicinal cannabis with the city’s jurisdiction will remain restricted,” Senior Analyst Abraham Salinas told the council. Salinas provided the City Council with a similar presentation to the one given to the Planning Commission that outlined the importance of the change, the previous action taken by the commissioners and what the next steps would be in the process. Brentwood oil drilling decision delayed State petroleum group against the ordinance By Jake Menez Staff Writer

An independent petroleum group has come out against Brentwood’s plan to ban oil and gas drilling within city limits. This comes as the city of Brentwood is still finetuning a new ordinance that would determine whether oil and gas drilling could take place within city limits following a letter from California Independent Petroleum Association. “The Ordinance is not supported by substantial or sufficient evidence, and therefore is arbitrary and capricious,” the nine-page letter signed by the organization’s CEO Rock Zierman reads in part. It characterizes the ordinance as an “unconstitutional” seizure of private property, citing court cases in which the rulings stated that regulation of private property that “goes too far” is synonymous with taking that property. The council received the letter on the afternoon of Oct. 1 – the same day as the council meeting in which drilling was set to be discussed. As a result, the city had not had a chance to “thoroughly analyze” it before the meeting, according to Assistant City Attorney Katherine Wisinski. Staff will determine whether concerns cited in the letter require additional changes to the ordinance before sending it back to the Planning Commission for approval. A decision by the city was originally scheduled for the Aug. 8 meeting of the City Council, but a state Supreme Court ruling on Aug. 3 caused plans to change, with staff requesting the item be moved to the Sept. 12

At the Sept. 12 meeting, Director of Community Development Alexis Morris requested additional time to analyze the court decision. The California Supreme Court ruling, Chevron U.S.A. Inc., et. al. versus the County of Monterey, overturned a local ordinance in Monterey that had attempted

to “ban the drilling of new oil and gas wells throughout the County’s unincorporated areas,” according to the ruling. Morris explained to the council at the Oct. 10 meeting that the ruling prohibits jurisdictions from regulating the methods and practices of oil production, but they can regulate where it takes place. see Drilling page 15

Ron Nunn Elementary now $40,000 richer Fundraisers contribute to improve opportunities for its students By Juan Cebreiros Correspondent

After various fundraisers throughout the 2022-23 school year, the Ron Nunn Parents Club handed over a check of $40,815 to the elementary school named after Nunn. “The impressive donation promises to uplift educational opportunities and resources for students,” Ron Nunn Principal Nick Casey said. According to Casey, the money will be used to directly improve students’ educational experiences such as technology in classrooms as well as with social and emo-

tional learning activities. The donation is also geared to go towards helping improve campus supervision in an effort to make the area better overall. “The mission of Ron Nunn Parents Club is clear, they look to better the experiences of all students at our school and we are deeply grateful to their hard work,” Casey said. This school year, the Ron Nunn Parents Club has a fundraising goal of $89,000, which they look to use towards many different aspects of the school, including learning programs and other educational activities. The money will also go towards different educational programs at the school to help both students and staff. This includes learning activities such as RAZ Kids and AR Renaissance Learning while also looking to fund field trips and other larger activities for the school. “We are deeply grateful to their hard work and our school community as a whole for providing these opportunities for all our students,” Casey said.

City Council to limit Zoom at future meetings By Jake Menez Staff Writer

The Brentwood City Council voted 5-0 during their Oct. 10 meeting to implement some changes to the way residents can participate in meetings via Zoom. The move comes in response to anti–Semitic rhetoric on Zoom at the previous meeting. “The law rarely keeps up with technology,” City Attorney Damien Brower told the council as they brainstormed different ways to curb unwanted comments. “The First Amendment gives tremendous protections to people speaking, including speech that the vast majority of society may find really objectionable. But the people have the right to say that … during the general public comment portion of the agenda.” Councilmember Pa’tanisha Pierson, also an attorney, expressed concern that limiting public comments could raise concerns about free speech if not done carefully while also acknowledging the need to shield the public from being subjected to hate speech. Vice Mayor Susannah Meyer suggested that the public comment portion of the meeting, which takes place at the start, be limited to those present in the chamber, while the public comments that are specific to items on the meeting agenda may still include Zoom participants. “I think that might be possible,” Brower

said. “There is no Constitutional right to have a Zoom participation, and there’s nothing in the Brown Act that says you have to allow Zoom. So if you say this is a courtesy and we choose not to exercise that courtesy during the general public comment portion, perhaps. I know that’s a ‘lawyer answer’ and I’m not giving you a definitive ‘yes’ or ‘no’, but we’re talking about free speech rights and so I’m trying to be extra careful.” The reason for the distinction between allowing Zoom in agendized public comments but not general public comments comes from a concern Brower explained at the Sept. 26 meeting following the hate speech. Comments not considered on topic when discussing an agenda item may be cut short by the mayor, Brower said, while comments during the general public comments at the start of the meeting are more protected as free speech. Residents were split on the issue, with several speakers expressing both concern and understanding. “You can have the doors open all day long,” resident Danny Dohrman said while gesturing toward the entrance to the council chamber. Dohrman said that limiting Zoom participation would effectively cut off the elderly, those with disabilities and busy from having their voices heard. “This is ridiculous and, as I said, I never threatened. I warned

Brentwood stands with the Jewish community The Brentwood City Council issued a proclamation during the Oct. 10 meeting “reaffirming Diversity, Equity, Inclusion, and Belonging in Brentwood” and presented it to Rabbi Peretz Goldshmid of Chabad of the Delta in response to the anti-Semitic comments at the Sept. 26 council meeting. “Positivity is the best weapon against antisemitism,” Godshmid wrote via email. “Every individual, and especially those with a platform, should make a clear statement that we do not accept such behavior and that, on the contrary, we stand with the Jewish community and all that stands for good.” While the Chabad of the Delta does not have an exact count on the number of Jewish residents in East Contra Costa, their mailing list includes over 3,000 households, according to Mashie Goldshmid. The city and Chabad will host a joint event in City Park at 2 p.m. on Oct. 15 to celebrate diversity.

Armed robbery and vehicle pursuit leads to arrest in Brentwood An unidentified man was arrested and booked into the county jail last Friday after police allege that he stole ‘a large amount of cellular items’ from a cellular store and was caught a short time later. Friday morning at 10:15, Brentwood officers responded to a cellular store in the 3100 block of Balfour Road to investigate an armed robbery. Employees reported a lone suspect armed with a handgun left the store with the unspecified items. A short time later, Brentwood officers located the suspect in a vehicle in Oakley. The suspect immediately fled from officers at a high-speed car chase, which continued through Oakley and Antioch, before the suspect’s vehicle became disabled and crashed on eastbound Highway 4 near Highway 160. Immediately following the crash, the suspect fled on foot before being quickly apprehended. The suspect, an unidentified 25-year-old male from Fremont/Oakland was transported to an area hospital for minor injuries related to the crash. No other vehicles were involved and no officers were injured, police said. Property associated with the robbery and a firearm was recovered. Employees at the cellular store were not physically harmed and no customers were present during the robbery, police said. When the suspect is released from the hospital, he will be booked at the county jail on multiple felony charges. This investigation is ongoing and no additional information is being released now, police said.

National Pedestrian Safety Month goal: Keep streets safe

October is National Pedestrian Safety Month, and it’s a reminder of the importance of safe streets for everyone. In 2021, there was a pedestrian fatality every 71 minutes and an injury every 9 minutes in traffic-related crashes, according to federal statistics. That’s why the Contra Costa County Vision Zero team wants to change these numbers. The message is clear: “Slow Down for Our Families. Get there Safely!”

733-2767) The Red Cross experienced a significant blood and platelet donation shortfall in August, contributing to the current blood and platelet shortage. To ensure the blood supply recovers, the Red Cross must collect 10,000 additional blood products each week over the next month to meet hospital and patient needs.

“When blood and platelet supplies drop to critical levels, it makes hospitals and the patients they are treating vulnerable – especially if there is a major accident or emergency medical procedure that requires large quantities of blood during a disaster,” said Dr. Baia Lasky, medical director for the Red Cross. “A single-car accident victim can use as

Details are available at RedCrossBlood. org/Together. Unique challenges to blood supply In late summer, the Red Cross national blood supply dropped by about 25% on the heels of one of the busiest travel seasons and the beginning of back-to-school activities. As people settle back into fall school and work routines, a unique challenge to the blood supply remains – many employees continue to work from home or in a hybrid capacity, reducing the number of opportunities to give blood at businesssponsored blood drives. In fact, before the COVID-19 pandemic, more than 800,000 blood donations were made at blood drives hosted by businesses. Last year, the Red Cross saw only about 500,000 blood donations at these locations – a nearly 40% drop from prepandemic levels, the agencey said. This, coupled with an active disaster season, is creating a perfect “storm” and challenging the organization’s ability to collect a sufficient amount of blood products to meet the needs of hospitals across the country. The Red Cross provides community blood drives and donation centers across the Northern California; the closest office in East County is in Antioch. Those who may have previously given at a local business blood drive are encouraged to book a time to give at one of these locations by downloading the Red Cross Blood Donor App, visiting RedCrossBlood.org or calling 1-800-RED CROSS (1-800-7332767).

He said that it was important to allow residents the ability to speak even when attending virtually but that the loophole in the process that allowed anonymous callers to spread hate speech needed to be addressed. “I suggest removal of virtual comments during the open comment period because there are no safeguards in place to stop virtual speakers during the open comments without violating the right to free speech. However, I do ask the council to not throw the baby out with the bathwater.”

DOES A WILL AVOID PROBATE? go to the Probate Court and view your Will. Another potential drawback with Probate is that if you own real property (e.g., land, houses, condos, timeshares, etc.) in more than one state, the family may have to go through probate in each state where real property is located. The bottom line is that a Will does nothing to protect you from Probate. The good news is that you can avoid Probate by setting up a living trust. One of the most important benefits of setting up a living trust is that all assets transferred to a living trust completely avoid the probate process. The council ultimately voted unanimously to amend the city’s meeting rules to allow only comments in person for the general public comment period of the meeting while also allowing virtual public comments on agendized items at meetings going forward. The change applies to all city agencies, such as the Planning Commission, rather than just for City Council meetings, at the suggestion of Brower who said it would be simpler to have just one set of rules. “It’s a very thin line of what we have to walk and what we’re comfortable with,” Mayor Joel Bryant said. “In my personal opinion, I cannot shut up the opportunity and stop the opportunity for our residents to speak on agendized items. By Todd W. Moeller, Moeller Estate Law Many people mistakenly believe that if they have a Will their estate will not go through probate. However, if a Will is to be given any legal effect, the Will must be submitted to Probate. The word “probate’ comes from the Latin meaning “to prove the will.” Most of us would rather avoid Probate if at all possible because Probate can be expensive. The costs involved in Probate may include (but are not limited to): Attorney’s Fees, Executor/Administrator Fees, Accounting Fees, Publication and Bond Fees, Appraiser Fees, and Court Filing Fees. In addition to being expensive, probate is a time consuming process. By law, formal probate must take several months, more often than not, the probate process will take much longer. During this probate process, it may be difficult or impossible to access certain property. Probate is also a public process. If you die and your Will is filed in probate court a great deal of your personal information may be available for anyone who is interested enough to

New fire stations will make Brentwood safer The past three years have brought massive improvements to fire protection services in East County. As your District III County Supervisor and Contra Costa County Fire Protection District Board Member, I want uest to share with comment you the progress made up to now and information about two new Brentwood fire stations set for construction in 2024. Two major changes in recent years have increased our firefighting capacity: Voters passed Measure X, a halfcent sales tax to improve public safety and other county services in 2020, and East Contra Costa Fire Protection District was consolidated into Contra Costa County Fire Protection District (ConFire) on July 1, 2022. With the increase in financial resources and the efficiency gains

G

of joining a larger agency, we have opened one new Oakley fire station, added two new fire crews for faster responses, and upgraded our crews to provide paramedic-level care so they can carry out more complicated medical tasks than EMTs. The next improvements coming are a new Brentwood station on Empire Road and the return of a fire station in its downtown Brentwood location on 1st Street. Fire Station 54 downtown served Brentwood for 57 years before the East Contra Costa Fire Protection District’s budget problems forced it to close in 2014. Thankfully, ConFire has the resources to build a new modern fire station that is capable of housing 21st-century fire engines, which are larger than any engine the original fire house designers could have expected in the 1950s. The requirement for larger garages, modern earthquake standards

and other firefighting necessities means that the new Station 94 will need a larger footprint. The county, which owns the parcels on either side of the station, has pledged about 3,500 square feet of undeveloped land to ConFire to make room for this lifesaving resource. Most of that land would come from the south side of the station, but 1,212 square feet would come from land on the north side next to the Brentwood Veterans Memorial Building. Some Brentwood veterans have expressed concerns about the new construction, but the fire station would be built on a part of the county-owned land currently used as an unpermitted gravel parking lot and temporary storage units. Neither of the two permanent structures that the Brentwood Veterans Memorial Building uses would be impacted. Contra Costa County has invested more than

$100,000 improving those structures in recent years, and the county is pursuing nearly $200,000 in future funds to improve the building’s fire alarm systems, air conditioning, exterior siding and more. In the coming months, ConFire will hire design-build teams for the new fire stations, and the projects will go through the city of Brentwood’s planning and permitting process, complete with California Environmental Quality Act (CEQA) compliance and public hearings. If designs are approved in a timely manner, construction of both new stations will break ground in 2024. When they open, Brentwood and the rest of East County will have the highest level of professional fire protection in our history, and our entire community will be safer for it. Diane Burgis Contra Costa County Supervisor

Letters to the Editor Meals on Wheels chief reflects on anniversary of fire

Editor: It is hard to believe, but it has been a year since Meals on Wheels Diablo Region was displaced by a fire at our headquarters on Civic Drive in Walnut Creek. We had hoped to be back by now, but we still do not know what the future holds. We are fortunate that BPM, LLC stepped forward and offered us office space to lease during this time of transition. As we mark the one-year anniversary of the fire, it’s important to acknowledge the incredible flexibility, inventiveness, and resiliency of our staff and volunteers. For two months last year, they worked from parking lots, coffee shops, coworking

spaces, and from home without any notice. The fire occurred on a Saturday night. On Monday morning, every client was delivered a meal and did not experience any disruption. Our ability to carry on without a suspension in deliveries and services is a testament to our incredible staff and volunteers. I want to thank our Board who continues to guide us through this process, the community who has been so supportive, our hard-working volunteers, and our generous donors. The fire resulted in many unanticipated costs. And without the support of our donors we would not have been able to continue our deliveries and services while we continue to develop new programs that meet the needs of a

rapidly growing senior population. We are stronger together. The main positive outcome is proving that we all support the mission of ensuring our older neighbors are able to remain nourished, safe, and independent for as long as possible. Caitlin Sly Executive Director, Meals on Wheels Diablo Region

Editor: I have a different experience than a letter writer from Oct. 6 about our little town of Brentwood. I see a town that is growing and thriving. New restaurants are coming to town, a new park is being built, and other parks are

being improved. The Brentwood City Park and the downtown are wonderful. There are always fun things going on. We have an amazing Farmers Market. Our population is becoming more diverse. The schools are excellent and people here value education. The City Council and downtown business owners are working hard, and good things are happening. Is there some crime and homelessness? Yes, just like everywhere else, and in every other time in history. I’ve lived here 17 years, and I’m going to keep living here. That writer says they are considering leaving. I say good luck finding a place as good as Brentwood. Kevin R. Allen Brentwood

Freedom prepares for home stretch Heritage

healthy vs. Deer Valley

By Jeff Weisinger Staff Writer

It’s been six years since Kevin Hartwig took over the sideline at Freedom High football games. The last time he was leading the program was on Dec. 2, 2017 in the NCS Championship game loss against Liberty. A week before that, he won his 100th career game in the NCS semifinal against Antioch. With Zach Sims now removed from the program, Hartwig’s focus in his return to the sidelines Friday in the Falcons’ home game against Pittsburg (Oct. 13, 7 p.m.) isn’t necessarily on winning or pushing Freedom to a playoff spot. His focus is on the players. “It’s not about me. It’s about the team,” he said after Monday’s practice, his first with the team. Hartwig is taking over the team for the final four games of the season after Zach Sims was placed on administrative leave from the program last Monday. “It’s about the kids. Freedom football, just the history of it, and what’s expected of a Falcon.” Hartwig brings plenty of experience with him onto the coaching staff for the rest of the season. His co-head coach, Scott Sbranti, will share head coaching duties with him. Joining the staff are Don Birk, Bill Pierce, Frank Beede, Larry Rodriguez, and Stephen Rodriguez. Returning as well are Jeromy Smith, Martell Montgomery, Marcus Hyer, Brenden Rearick, and Fred DeVito. “All these guys coached here before. That’s kind of the cool thing,” Hartwig said.

“Winning the week” has been the mantra for the Lions all season long, and Cable wants to emphasize this as these late season games become much more crucial. “You gotta win that week, not looking past any opponent or any given day or any drill,” Cable said.

The Heritage High Patriots football team achieved a few things during last week’s bye week, the most important of which is they got healthy, according to head coach Dave Fogelstrom. They also watched the film from their last-second loss against Antioch, and they went back to their fundamentals, Fogelstrom said. The ‘getting healthy’ part may be the most crucial for Heritage entering Friday night’s matchup in Antioch against a resurgent Deer Valley team that, like Heritage, is also looking for their first playoff berth in several years. “I think this is the healthiest we’ve been since the Vintage game,” Fogelstrom said. “Deer Valley is a good team this year. (Head coach Matthew Mills) is doing a good job coaching those guys up, so we got to be prepared.” The biggest return the Patriots are getting is junior running back Mekhi Adanandus. Adanandus. He took over for Emanuel Rankins, who’s out for the year, has run for 334 yards on 53 carries with three touchdowns in five games with Heritage so far this season. He took over the spot in relief of Rankins last month in the team’s win at Vintage in Napa, and in his two starts this season, he’s rushed for over 100 yards. Fogelstrom also says that Heritage will also have junior running back and defensive end Giovanni Cardena back from injury as well, and adds that sophomore running back Ilias Muhammad is still two weeks away from returning and that he aims to have him back in time for the Patriots’ Senior Night against Freedom on Oct. 27. “(Getting Adanandus back) is huge,” Fogelstrom said. “(Senior Nike Zovich) did a great job against Antioch, but he’s not a perimeter runner. But losing Mekhi, we lost our edge and our speed outside.” “Mekhi has almost 300 yards in seven quarters of football before he got hurt, so we’re excited to see him down the stretch. He feels good. The bye week was huge to get him healthy again.” Zovich ran 25 times for 139 yards in the Patriots’ loss to the Panthers two weeks ago, his first start of the season. Much like Heritage (2-4, 0-1 BVAL), Deer Valley (3-3, 0-1 BVAL) enters Friday’s game coming off of a 58-0 loss against Pittsburg last week, their worst

Co-Head Coach Kevin Hartwig works with one of the Freedom football players during his first practice with the team on Monday Junior quarterback Myles Hunt was surprised by the coaching change as the team goes on with its first full week with the new staff. “It was kind of a shocker for everybody,” Hunt said. “We just got to get used to the new coaches. We have to keep moving forward.” Part of the change that Hunt described sees him going under center a lot more, compared to the common spread-style offense that he ran under Sims that saw him in the shotgun more frequently. “We didn’t do a whole lot of that before,” Hunt said. “We just got into it the last couple of weeks, so I’m kind of caught up on it now. I feel more comfortable.” For practices, Hartwig is introducing a faster-paced tempo in practice with players running in between drills. “We want to get in and get out and

condition during practice so we don’t have to sit around and blow the whistle and run ‘40s,’ right?” Hartwig explained. “That’s a lot of wasted time. So we’re just trying to pick up the tempo and make it fun and finish the season for the kids. “We can just try and coach hard, and get them in the best position possible for the next four weeks.” Freedom’s first two games coming off of their fall break bye week are against the 6-0 Pittsburg Pirates and the 5-1 Antioch Panthers, two of their toughest tests in their final four games. Hartwig says that the goal for the team is to “just get better.” However, Hunt says that the team still has high expectations for themselves. “Our expectations are still to push for the playoffs,” he said. “Beat the teams we need to beat to make the playoffs and just improve as a team and get some momentum for next season.”

Lions gear up for key game vs. Antioch By Juan Cebreiros Correspondent

“This is going to be a playoff-type game,” Liberty Lions head football coach Mike Cable said after Tuesday’s practice for the Lions’ clash with Antioch on Friday. Both teams are coming fresh off of bye weeks, but each team went into their bye weeks on different notes. The Lions are coming off a 41-0 victory against the rival Freedom Falcons where for the seventh year in a row they won the “Bell Game.” Antioch is coming off a dramatic 18-17 comeback win against the Heritage Patriots where Yusef Jenkins scored the last second touchdown for the Panthers. The bye week came at a fortunate time for the Lions as several players are nursing injuries, including starting safety Kyle Cook who is battling an

ankle injury. Cable anticipates the game against Antioch will be similar to a playoff game as the Lions and Panthers are battling for playoff spots with just four games to go in the season. “Antioch’s had a great season so far, they’re a very physical football team and we’re prepared for a playofflike atmosphere,” Cable said.

Patriots hold on against Deer Valley Correspondent

The Heritage Patriots volleyball team had to erase a 10-point deficit to come from behind in Set 4 to defeat the Deer Valley Wolverines 3-1 (21-25, 25-16, 25-20 and 27-25). Entering the fourth set the Patriots had all momentum on their side after coming off wins in Sets 2 and 3 by scores of 25-16 and 25-20. However, Heritage fell into a 6-0 hole to start Set 4, which prompted head coach Janet Hannigan to use a timeout to try to loosen up her team after the rocky start. “I just told the girls we need to go out there and we need to have fun,” Hannigan said. She added that over the past few weeks the team has looked super tight and she’s trying to figure out different ways to get her team to loosen up. “Just trying to play looser in their skills and find a different mindset that’s a

back breaking for Deer Valley. The Patriots’ victory keeps them tied with Freedom and Liberty high at the top of the Bay Valley Athletic League while Deer Valley needed the win to tie the Patriots in the standings. Hannigan noted that this match against Deer Valley was one that felt like a playoff game. Hartman agreed, adding tonight was the first time it set in to the players on the court. “We have a huge target on our back as 3-peat league champions. We want it so bad; we want that title. It’s not necessarily pressure but more intensity,” Hartman said. Heritage faces Freedom and Liberty in their last two matches of the season, and those two games will play big roles in which of the three schools come away with a BVAL championship. Each team controls their own destiny by simply winning the rest of their games as the three schools are deadlocked atop the BVAL standings with just three league games remaining in the season.

early in the season, but a slight scheme change to the setting approach by Hannigan has helped open up the team’s offense. However, Hannigan still sees parts in the team’s offense that could improve these last few matches of the season. “We could be running a lot faster tempo. We could be pushing the ball farther out, we could be running more decoys,” Hannigan said. The victory was key for Heritage but

little more fun,” Hannigan said. The Patriots dropped the opening set 25-21, but Hannigan gives credit to senior Ellie Hartman and junior Hope Hess for staying despite facing the pressure of being down 1-0 in the series. “Ellie and Hope set the tone for the match by being calm in their passing, and having them be more calm and positive was good,” Hannigan said. The Patriots offensive attack struggled

Liberty from page 11 The Lions have command of their fate for a playoff spot. It’s simple for them – if they keep winning they’ll be in the playoffs. “We control our destiny and that’s a good place to be, when you have the power to control that narrative,” Cable said. The Lions this season are in the same spot they were in last year – a 4-2 record with losses to Los Ga-

tos and San Ramon Valley before entering league play. At this point last season, the Lions got hot, winning their last four games to qualify for the North Coast Section playoffs. Despite both their losses coming against schools that are top 10 in power rankings, Cable still has confidence in his team to go toe to toe with the best schools, including league rival Pittsburg High. “San Ramon that game was a fluke, and then Los

Gatos we came out on fire in that first half and kind of let things slip away from us in the second half,” Cable said. This matchup could have major playoff implications come season’s end, depending on how seeding and the rest of the league plays out for both these schools. “It’s very possible that the loser of this game is on the outside looking in as far as playoffs,” Cable said.

Freedom fights back to sweep Pittsburg By Jeff Weisinger Staff Writer

Freedom has learned how to fight back, and that fight could push them all the way to the playoffs – but they’re not worried about that part yet. The Falcons battled back in all three sets in their 3-0 win (25-20, 25-21, 25-21) Tuesday at Pittsburg. “At this point, we’ve learned how to fight back and not give up regardless of where we’re at,” Freedom head coach Elizabeth Rivas said. “Don’t look at the score, one point at a time.” In the third and final set, after opening with an 8-3 run, Freedom went cold with Pittsburg taking advantage of the Falcons and rallying back with an 11-0 run to take an 14-8 lead, forcing Rivas to call a timeout. “At that point we needed to regroup,” she explained. “We were playing a bit chaotic, so we needed to settle down and reset and that is what helped us through the game.” Rivas admitted that the third set started to remind her of the team’s fiveset loss at Liberty last Thursday. “I was a little scared,” she said. “But I put those emotions aside and believed

Freedom High’s Madison Perry celebrates with her team during Freedom’s 3-0 win at Pittsburg Tuesday night. in my girls.” Senior outside hitter Kyla Powell had a team-high 13 kills and nine digs on the night and junior Madison Perry had seven kills with seven digs. Both played huge roles in sparking Freedom’s comeback late in the third set. “It was really nerve wracking at first, but we all kind of gelled together and realized we had to get this back,” Perry said. “We all worked together and just let our

mistakes not get the best of us.” Powell’s kill sparked the rally for Freedom after the timeout, ending Pittsburg’s 11-0 run. “We just have to make the game a little more entertaining,” Powell joked after the win. “Honestly, we just had to win.” “When we slow it down, we get our momentum back and we can take the momentum away from the other team.” The win for Freedom puts them in po-

season, and with both in NCS Division II, Friday night’s game could include playoff implications for both teams. Deer Valley has a slight edge over Heritage at the moment due to having one more win in their overall record.

sition to make the NCS playoffs. They’re third in the Bay Valley Athletic League standings at 5-2 behind Heritage and Liberty, teams who not only also grabbed wins on Tuesday night, but also recently defeated Freedom at their home matches. The win also gave them some distance from Pittsburg who drops to 3-5 in league play. However, even with the team on pace for the playoffs with just three matches left, Rivas isn’t worried about the playoffs just yet. “I don’t want to think about that,” she said. “At the moment, I think we want to think that we want to play one match at a time and without realizing everything else. Now we’re in the mindset that we’re gonna come in, regardless of who our opponent is, and we’re gonna play our hardest.” Although Rivas isn’t worried about a berth in the NCS playoffs just yet, Perry and Powell still have the playoffs in their mind. “It’s one team at a time,” Perry said. “But at the end of the day, we all want to make it to the NCS, so we have to play our hardest every game.” “The mindset is ‘We got to win,’” Powell added. “It’s either win or go home. That’s the mindset.”

“This is huge,” Fogelstrom said. “We’re still in the D-II playoff hunt. If we can get this win, that bumps us up and puts us on a nice path for the last few games.” “It’s going to be a competitive game.”

Drilling from page 2 The newest draft of the ordinance focuses on banning oil and gas production in specific locations, particularly those known as “sensitive receptor” areas. A sensitive receptor area is defined by the Environmental Protection Agency as an area whose occupants are more susceptible to harm from pollutants, such as hospitals and schools. The new language in the ordinance would require a 3,200-foot distance from sensitive receptor areas for all new wells, storage tanks and production facilities, according to Morris. The next step for the ordinance after factoring in potential concerns raised by Zierman’s letter as well as one the council received from a nonprofit, the Native Oil Producers and Employees of California, is for it to go back before the Planning Commission, Morris said at the Oct. 10 meeting. The Planning Commission needs to approve any ordinance before it comes back to City Council because changes that have been made to it are “significant enough” to require new approval since the Planning Commission had been the initial

governing body to consider the ordinances. An interim moratorium on drilling will remain in place until March 27, 2024. Bob Nunn, the president of local drilling company Sunset Exploration Inc., characterized the ordinance as “a waste of city resources” in an email to The Press since only one well has been drilled in the city in the past 25 years. Nunn has previously stated that he does not oppose the legislature since his company has no plans for drilling in Brentwood. Those who spoke in favor of the ordinance during the public comment period of the Oct. 10 meeting were largely local high schoolers, as with previous meetings in which the topic was discussed. “I will just express my tremendous appreciation for your concern about our community and the future,” Mayor Joel Bryant said, addressing the students who had spoken. Jokingly, he added, “You may now go back to your video games because I know you’re not going to bed during [school] break.” The full meeting can be watched at https://bit.ly/3QbKyRD

Speed, inattentiveness cause fatal crash in Antioch One person died in a four-vehicle crash in Antioch last weekend. On Oct. 5, at 2:08 p.m., a motorcyclist was stopped at a red light at the intersection of Deer Valley Road and Prewett Ranch Drive when he was struck from behind by a vehicle traveling at a high rate of speed. That caused the motorcyclist to be ejected, police said in a press release. The force of the crash caused both vehicles to crash into two other vehicles in the intersection. Paramedics and Antioch police were nearby on an unrelated matter and immediately began rendering first aid to all involved. The driver of the motorcycle, a 63-year-old male from Bay Point, was

transported to a local hospital where he died of his injuries, police said. The driver of the vehicle that caused the collision remained on scene and is cooperating with Antioch Police Traffic investigators. Speed and inattention appear to be the cause of this incident, police said. The names of the parties involved are not being released due to family notifications. No other information will be released. Anyone with information is asked to call the Antioch Police Department non-emergency line at 925-778-2441 or Traffic Collision Investigator Blumberg at fblumberg@antiochca.gov. You may also text-a-tip to 274637 (CRIMES) using the key word ANTIOCH.

n Saturday, Sept. 16, 2023, Rita and Richard Nahm celebrated their 60th wedding anniversary at the Brentwood Community Center surrounded by 130 guests, including their three sons, grandchildren, daughter-in-law and other family members. Those in attendance included special friends and extended family of many years. The highlights of the occasion included a renewal of their vows and a blessing officiated by Fr. Jerry Brown, retired Pastor of IHM and Deacon Leland De Fretas, personal toasts by their family and friends, along with a beautiful three-tier cake created by their friend of 48 years, Linda Pearson. Richard sang three special songs to his bride of 60 years, finishing with her favorite song, Sabor a Mi. Richard and Rita both thank the venue staff, caterer, photographer and videographer and the DJ for their assistance. Lastly, this celebration was made complete by all those special friends who joined them. God-willing, they will celebrate many more anniversaries together.

CA 94561-5087 The undersigned Trustee disclaims any liability for any incorrectness of the street address and other common designation, if any, shown herein. Said sale will be held, but without covenant or warranty, express or implied, regarding title, possession, condition, or encumbrances, including fees, charges and expenses of the Trustee and of the trusts created by said Deed of Trust, to pay the remaining principal sums of the note(s) secured by said Deed of Trust. The total amount of the unpaid balance of the obligation secured by the property to be sold and reasonable estimated costs, expenses and advances at the time of the initial publication of the Notice of Sale is: $574,493.70 If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Trustee, and the successful bidder shall have no further recourse. The beneficiary under said Deed of Trust heretofore executed and delivered to the undersigned a written Declaration of Default and Demand for Sale, and a written Notice of Default and Election to Sell. The undersigned or its predecessor caused said Notice of Default and Election to Sell to be recorded in the county where the real property is located. NOTICE TO POTENTIAL BIDDERS: If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call (844) 477-7869 or visit this Internet Web site WWW.STOXPOSTING.COM, using the file number assigned to this case 112851CA. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Web site. The best way to verify postponement information is to attend the scheduled sale. NOTICE TO TENANT: Effective January 1, 2021, you may have a right to purchase this property after the trustee auction pursuant to Section 2924m of the California Civil Code. If you are an “eligible tenant buyer,” you can purchase the property if you match the last and highest bid placed at the trustee auction. If you are an “eligible bidder,” you may be able to purchase the property if you exceed the last and highest bid placed at the trustee auction. There are three steps to exercising this right of purchase. First, 48 hours after the date of the trustee sale, you can call (855) 313-3319, or visit this internet website www.clearreconcorp.com, using the file number assigned to this case 112851-CA to find the date on which the trustee’s sale was held, the amount of the last and highest bid, and the address of the trustee. Second, you must send a written notice of intent to place a bid so that the trustee receives it no more than 15 days after the trustee’s sale. Third, you must submit a bid so that the trustee receives it no more than 45 days after the trustee’s sale. If you think you may qualify as an “eligible tenant buyer” or “eligible bidder,” you should consider contacting an attorney or appropriate real estate professional immediately for advice regarding this potential right to purchase. GAMES & PUZZLES

Here’s How It Works:

Sudoku puzzles are formatted as a 9x9 grid, broken down into nine 3x3 boxes. To solve a sudoku, the numbers 1 through 9 must fill each row, column and box. Each number can appear only once in each row, column and box. You can figure out the order in which the numbers will appear by using the numeric clues already provided in the boxes. The more numbers you name, the easier it gets to solve the puzzle!

secured by said Deed of Trust, with interest thereon, as provided in said note(s), advances, under the terms of said Deed of Trust, fees, charges and expenses of the Trustee and of the trusts created by said Deed of Trust. The total amount of the unpaid balance of the obligation secured by the property to be sold and reasonable estimated costs, expenses and advances at the time of the initial publication of the Notice of Sale is $ 141,714.95. The beneficiary under said Deed of Trust has deposited all documents evidencing the obligations secured by the Deed of Trust and has declared all sums secured thereby immediately due and payable, and has caused a written Notice of Default and Election to Sell to be executed. The undersigned caused said Notice of Default and Election to Sell to be recorded in the County where the real property is located. If you wish to learn whether your sale date has been postponed, and if applicable, the rescheduled time and date for the sale of this property, you may call (916)939-0772 or visit this internet website http://search.nationwideposting.com/propertySearchTerms.aspx, using the file number assigned to this case CA2300288737 Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Website. The best way to verify postponement information is to attend the scheduled sale. NOTICE TO TENANT: You may have a right to purchase this property after the trustee auction if conducted after January 1, 2021, pursuant to Section 2924m of the California Civil Code. First, 48 hours after the date of the trustee sale, you can call (916)939-0772, or visit this internet website http://search.nationwideposting.com/propertySearchTerms.aspx, using the file number assigned to this case CA2300288737 to find the date on which the trustee’s sale was held, the amount of the last and highest bid, and the address of the trustee. Second, you must send a written notice of intent to place a bid so that the trustee receives it no more than 15 days after the trustee’s sale. Third, you must submit a bid, by remitting the funds and affidavit described in Section 2924m(c) of the Civil Code, so that the trustee receives it no more than 45 days after the trustee’s sale. If you think you may qualify as an “eligible tenant buyer” or “eligible bidder,” you should consider contacting an attorney or appropriate real estate professional immediately for advice regarding this potential right to purchase. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. Veterans from page 1 night, Oct 10, Veterans of Foreign Wars Post 10789 Commander Bill Weber said the County had designed the fire station before conducting a survey and subsequently, the lot line was shifted to accommodate the size of the design created because it exceeds the capacity of the existing space previously occupied by the old fire station. “The county decided to take about seven percent more (6.8 percent) land from veterans to make a larger design possible. That is why we are losing our parking and storage containers area.” “The county also created an additional easement that was taken from this Brentwood Veterans Memorial Building and gave it to the Contra Costa Fire Protection District so they can control the disabled access ramp. “It seems silly. Why would you take it from us and give us an easement to use it,” said Weber. He said California passed a law in 1921 allowing counties to impose a special tax for veterans’ meeting spaces and in the following year, Contra Costa County voted to impose tax and set up a special fund. In 1923, the County had purchased the parcel for the veterans memorial hall and the building was completed in 1925. In 1937, the County built a fire station on the portion of the parcel that was purchased for the memorial hall, and it was replaced in 1957 by the now-demolished station. However, Weber said there are no records to show the fire department had subleased the property from the American Legion and from the portion of the parcel that was purchased for the veteran’s memorial hall. “We only have a newspaper article saying there is a sublease from the veterans to create the fire station,” he added. Weber said the county owns the proper-

ty, and the veterans, through the Brentwood Veterans Memorial Building, lease the property. He added that the county cannot remove land dedicated to veterans as stipulated under the California Veterans and Military Code 1266. “We have no beef with firefighters, this is not a veteran-versus-firefighters issue,” said Weber. Marine Corps League Commandant Donald Hester said the veterans are willing to work with the county but are worried that the county will keep expanding its footprint and take away the space dedicated to them. “If we don’t protect our future, we won’t know if there will be a memorial hall in the future. “Our concern is they (county will) bulldozed us and say ‘it’s our property and we can do anything’,” said Hester. Meeting participant Vivian Treff, owner of the Boondoggies restaurant and on the Board of Directors of the Downtown Brentwood Coalition, said she was concerned as the fire station could have an impact on her business if road closures downtown for events were no longer allowed due to the operations of the fire station. The veterans said they had sent several letters to the county to state their concerns

Security from page 1 have them come out and chase people out of the building, or at least look for the people who have recently left the building. Doors just subsequently go on unchecked in the buildings that are supposed to be secure. The buildings that we’re paying to be secure, aren’t secure.” Camila Johnson, a public commenter who spoke before the candidates interviewed, mentioned that even though rent continued to go up annually – now at $2,200 as of October for her three- bedroom apartment – that repairs

Cannabis from page 1 ment is expected to be given a second reading by the council during their Oct. 24 meeting, Salinas said. It will then be implemented ahead of the Jan. 1, 2024 deadline. “A decision not to modify the Brentwood municipal code to allow for the delivery of medicinal cannabis to qualified patients would expose the city to legal challenge by any of a host of individuals who have been authorized to seek legal recourse by SB 1186,” Salinas said to the commissioners during his presentation in September. He reiterated this point to the council on Oct. 10, saying legal challenges could come from the Attorney General and patients in the city who desire delivery of medicinal cannabis as well as medicinal cannabis businesses trying to sell their product in Brentwood. According to Salinas’ presentation, the

but said that county Supervisor Diane Burgis had deferred her authority to Eric Angstadt, the county representative for discussion but have not heard back from them. Weber also said an invitation to Tuesday night’s meeting was sent out but no representative from the county was present. Burgis said her office did not receive an invitation to participate until last Friday afternoon and could not rearrange their schedules. “However, my office, Con Fire leadership, and County leadership continue to be in conversation with the leadership of the Brentwood Veterans Memorial Building to address their concerns. “We have repeatedly asked them to designate a committee to engage with us, and they have not yet told us who they want representing them in the discussion,” said Burgis in an email to The Press. “Both new stations will require approval by the City of Brentwood’s Planning Commission and City Council, and that process will include community input and a full California Environmental Quality Act (CEQA) review,” Burgis said. When asked about assertions that the county is unable to eliminate land designated for veterans, as outlined in the California Veterans and Military Code 1266, Burgis said she is confident that the county and Con Fire “are proceeding correctly and in the

that she’s requested are still yet to be completed. She’s lived in The Oaks for the last three years. “When I first got there, (rent) was only like $1,750,” she said. “I kept having repairs not being done. The rent kept going up every year, but the repairs never got done. It’s still not done.” Bautista, who was also selected to the committee, mentioned that while she’s never really had any problems with maintenance at The Oaks, mainly because she just fixes things herself because she can, that she’s also noticed the

amendment to the municipal code would still include some limits on delivery: • Deliveries would have to be made to a “fixed address” and may not occur at locations such as daycare centers, schools, youth centers, public parks and other open spaces. A fixed address is defined in the amendment as “a permanent and unchanging location where an individual, business or organization can be contacted or located.” • Out-of-city cannabis retailers would also be required to obtain a city business license prior to being able to deliver to customers within city limits. Commissioner Dirk Zeigler noted at the Sept. 19 meeting that Brentwood has no cannabis sales, so all local retailers would be delivering from outside the city. • All medicinal cannabis or medicinal cannabis products would have to be securely packaged and labeled according to State regu-

spirit of bringing better fire services to East Contra Costa County.” Con Fire Deputy Chief Aaron McAlister said the Contra Costa fire serves 13 cities and has many fire stations in the downtown environment. Hence, they are used to dealing with traffic in high-density areas. He said the fire service serves downtown Brentwood and navigates through public events, parades, and other things that impact their responses but such events go through permitting processes. “It makes things better for the downtown community to have the fire engine and advanced life support services available downtown,” McAlister told The Press. He also said the fire service does not anticipate any impact from the loading zones in the alley as the previous fire station had access to the alleyways. McAlister said the previous fire station was four bays wide while the new fire station has just two, thus requiring a smaller ramp space. He also anticipates that the City could actually gain some parking space directly in front of the fire station where there is no ramp. “A portion of the proposed building is just offices and that doesn’t have a ramp so potentially there is going to be parking spaces but that is up to the City,” he said, adding that Con Fire is working with the City in its planning process and the public will have an opportunity to weigh in on it. McAlister was asked if Con Fire had conducted an impact assessment or considered other locations for the station, he said there wasn’t any as there has always been a fire station in the area. “So no, we did not consider any other alternatives because this was the location selected and it was already owned by the fire district,” he said. decline in the complex. “The lawns were looking pretty shoddy,” she said. “I think where management is missing some things, I also think that it’s a two-way street. Some of the tenants also need to be part of the solution.” Gamble and Bautista were named to the committee on a 4-1 decision from the council with the lone ‘no’ note from Oakley Vice Mayor Anissa Williams. Johnson was also approved to be a part of the committee unanimously by the City Council.

lations, ensuring that they are not accessible to minors during transit. • Delivery vehicles would be required to adhere to safety and security standards, which include GPS tracking, alarms, and secure storage. • The delivery of cannabis accessories, branded merchandise of the licensee, or promotional materials is prohibited, except for any equipment, products or materials necessary to enable a qualified patient to ingest, inhale, or otherwise introduce cannabis or cannabis products into the human body These new regulations will be enforced by a combination of law enforcement and the Community Enrichment Program, Salinas said. Other topics discussed at the City Council meeting included: • Changes to the way Zoom is used in fu-

ture city meetings following anti-Semitic comments at the Sept. 26 meeting. See page 4 for the full story. • An update on the oil and gas drilling ban the city has been working on since 2022. It is expected to go in front of the Planning Commission soon. See page 2 for the full story. • Suggested changes to Contra Costa Animal Services’ code related to domestic animals and livestock being kept outside in extreme weather. CCAS Director Beth Ward attended the meeting to hear the council’s feedback • A request by Councilmember Jovita Mendoza that council discuss at a future meeting the possibility of department heads reporting to the City Council directly instead of the city manager The full meeting can be watched at https://bit.ly/3QbKyRD
