Methodology

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. The only plaintiffs’ employment litigator in Pittsburgh ever to be named to the Top 100 Pennsylvania Super Lawyers list, Cordes was called the “archangel of employment rights in Western Pennsylvania,” by the Pittsburgh Tribune Review. A Cutting Edge Approach to Plaintiffs’ Litigation

A

Caroselli Beachler McTiernan & Conboy on Handling Some of the State’s Most High-Profile Cases

firm of trailblazers, Caroselli Beachler McTiernan & Conboy LLC (CBMC) has been on the forefront of plaintiffs’ personal injury litigation since its inception in 1972. “We have handled a number of pioneering matters over the years that many lawyers initially shied away from, but which are now part of the everyday practice of law,” says founding partner William Caroselli. Indeed, Caroselli was the attorney for the plaintiff in the first cigarette-related lung cancer trial in the country. “I learned a lot about lung cancer from that case,” he says, “and it became a real foundation for the asbestos work we did later on.” CBMC was one of the first law firms in the state to handle an asbestos disease claim; it was also among the first to represent cancer victims against nuclear and industrial polluters. “We’re not afraid to stand up and fight to advance the interests of our clients,” says partner David Senoff. “This is one of the few practices pushing the envelope on a statewide basis.” Recently, CBMC has been involved in some of Pennsylvania’s most notable cases, including the internationally-recognized “Kids-for-Cash” case, where members of the Luzerne County bench were accused of accepting $2.6 million in kickbacks from the builder of a pair of juvenile detention centers. “This was one of the biggest legal scandals in state history,” Caroselli says. “These judges incarcerated thousands of juveniles for minor infractions, and it has been very satisfying to obtain some justice for them.” CBMC was the first firm to file a civil case in the matter, and it recently secured a $17.75 million settlement against the builder of the detention centers; the case against the nonsettling defendants is ongoing. “These kids and their parents have been waiting years for redress,” Senoff says. “So we could not be more pleased with this settlement.” In another high-profile case, the firm filed a lawsuit against Gov. Tom Corbett of Pennsylvania after he eliminated adultBasic, a health insurance program for the working poor. “The adultBasic program was subsidized by money from the state’s settlement with major cigarette manufacturers,” Senoff says. “And by redirecting that money into the general fund for the budget, the governor violated a 2001 state law requiring the payments from the tobacco companies to be used in maintaining adultBasic.” CBMC filed a class action lawsuit arguing that redirecting the funds was unconstitutional. In 2012, the Pennsylvania Commonwealth Court dismissed most of the preliminary objections to the lawsuit, and the case is ongoing. “We will continue to argue this case going forward, with the ultimate goal of restoring funding for the program,” Caroselli says. The firm also brought a lawsuit against Highmark Inc., one of the country’s largest not-for-profit health insurers, alleging that the company violated the state’s nonprofit laws by accumulating

excessive profits. “The plaintiffs in this case are seeking court-ordered remedies to the issue of Highmark not using its extra profits to benefit its customers, despite the fact that the company is a not-for-profit,” Senoff says. The plaintiffs in the case sustained significant injuries when an exterior metal stairway at a Consol building collapsed, and Conboy notes: “We were able to demonstrate through expert testimony that Consol should have known of the defect in the metal steps.” He adds, “It would have cost Consol less than $25 to repair the defect, but the company claimed it was not cost-effective to inspect and repair the steps, even though it had recently spent over a billion dollars to acquire another company.” As part of the verdict, Conboy attained a $900,000 loss of consortium award—one of the largest loss of consortium awards in Allegheny County for a personal injury claim.
