METHODOLOGY
T
his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives
fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. T
hree years after the unprecedented Deepwater Horizon oil rig explosion and subsequent spill into the Gulf of Mexico—which ultimately sent some 206 million gallons of oil spewing into the sea and its sensitive habitats over the course of nearly three months—the first phase of what is shaping up to be one of the largest environmental civil trials in United States history is unfolding in New Orleans. With billions of dollars at stake for countless private-sector plaintiffs throughout the Gulf Coast region, to say there’s a lot on the line for the fishermen, shrimpers, restaurant owners and hoteliers affected by the disaster would be a gross understatement. But standing beside them since the early days of the disaster (and still to this day in New Orleans federal court) have been Herman, Herman & Katz partners Stephen Herman, Jim Klick and Soren Gisleson, who have helped shepherd Gulf residents and businesses through the dizzying maze of legal proceedings—and it’s far from over. “I think we are going to see some intensive litigation through the end of this year and next, and even if major issues get resolved, there are still going to be a few years of tying up loose ends,” says Stephen Herman, who, as co-lead of the Plaintiffs’ Steering Committee, previously helped broker an $8.5 billion settlement with BP that, along with the trial, is currently being administered. “There’s almost nobody in this area who has not been affected, either directly or indirectly, so it feels good to be able to help friends and neighbors in some way. For the people of Louisiana and across the Gulf, their way of life was and is at stake, and it’s hard to put a price tag on it.” For Herman and his colleagues at the 70-year-old firm—six of whom have been named Best Lawyers this year—working on highprofile, high-stakes cases is nothing new. The plaintiffs’ firm, which is as skilled at assisting individuals as it is in handling large groups of defendants, is a class action and MDL powerhouse, and there aren’t many national actions in which the firm hasn’t been involved. In 1994, HHK was a lead firm in the tobacco litigation, resulting in a landmark
jury verdict mandating a court-supervised cessation program, as well as billions in settlements for the States. A federal judge recently issued an order approving five class-action settlements (worth more than $1 billion) in the firm’s ongoing litigation involving Chinese drywall, along with the firm’s work in pelvic mesh implants, Granuflo litigation, and Tylenol litigation, after recovering billions for plaintiffs in national Vioxx litigation. “We’re successful in part because we try to foster an environment that lets attorneys develop their talents,” says Herman. “It helps us to put together the best teams and give people who are willing and able to step up to the plate the chance to do it.” Herman himself is the embodiment of this very tenet; he says he has been very fortunate in his career to be able to work with and learn from some of the best lawyers in the country. Consider this: the complex construction disputes he mediates can often bring between 10-15 parties (all with competing interests) to the table, but Shreves can help negotiate a solution that everyone is satisfied with in a couple of days or less. Medical malpractice defense attorney Peter Sperling says a respect bordering on reverence for the medical field—born from growing up with a surgeon father—is what helped originally propel him toward the practice. But decades spent going to battle every day to defend doctors, nurses and other medical professionals against malpractice claims is what has really driven home his passion for the work. It is also what has helped him become one of the top regional attorneys in his field. “I saw how much commitment my father put into the practice of medicine, and it instilled a similar work ethic in me,” says Sperling, a founding member of Frilot, LLC and the head of its medical malpractice group. “It’s an incredibly rewarding practice and it has been since day one.” But it has been challenging as well, says Sperling, who, amongst his other remarkable work, has spent years defending members of the medical community against claims brought in the devastating aftermath of Hurricane Katrina. His biggest hurdle? Overcoming the “sympathy factor.” “In the vast majority of cases, the plaintiff did nothing wrong,” says Sperling, a fellow of the American College of Trial Lawyers. “The challenge then becomes explaining the medicine to a lay jury in a format that they can understand. But I can’t appear condescending either.” It’s a balance that Sperling has spent his entire career learning to strike in an area of the law that has few winners, regardless of trial outcomes. “What is often overlooked is the devastating affect these claims can have on the defending doctor,” he says. “In a sense you become not just a lawyer but also a spiritual advisor.” n

en Saunders began his railroad practice in 1974 as a plaintiff’s attorney when he tried his first FELA case for a railroad worker with a brain injury in federal court in New Orleans. Since 1975, he has concentrated almost entirely in the FELA field of practice. He has obtained half million to multi-million dollar results on cases he has handled in Louisiana, Mississippi, Alabama, Georgia, Florida, South Carolina, North Carolina, Texas, Virginia, and Washington D.C. Over the last ten years, he has taught FELA Law at AAJ seminars. He has spoken on the New Orleans Bar Association television program, It’s the Law and wrote the often quoted “Truth Wins Lawsuits” article for a NOBA Legal Seminar. He has testified as an expert in FELA at Lloyds’s of London in England and served as Chairman of the Designated Legal Counsel for the Brotherhood of Locomotive Engineers (BLE) from 19992002. While serving as Chairman of the Designated Legal Counsel for the BLE, he published the Rules of Conduct for its Designated Legal Counsel Program. He has also served as Chairman of ATLA’s railroad law section and as President of the American Rail Labor Attorneys (ARLA) from 1999-2000. He is a member of the Past President’s Advisory Committee and its Legislative Committee.

When the founding attorneys of Sher Garner Cahill Richter Klein & Hilbert, L.L.C. broke off from a much larger firm 14 years ago to strike out on their own, there was one certainty: they were lawyers who wanted their new endeavor to be nothing like a typical law firm. “We wanted to take the ego-centric characteristics out of the equation and focus on building a team approach where we could mix and match people from all areas of the firm depending on the needs of the client,” says firm co-managing member James Garner. “The single biggest impetus in forming our firm was that we wanted to focus on the ‘we’ and not the ‘I.’ It gives us an advantage and helps us serve our clients more effectively.” Garner says about half the firm’s attorneys are litigators and half are business lawyers who focus in various industries— adding up to a firm that can handle almost any legal matter. “We could be handling mortgage litigation and need a business lawyer on the litigation team,” says Garner. “Being able to put together teams of the best suited attorneys allows us to provide services of superior quality. We avoid building walls that would convert us into a confederacy of small firms.” Garner notes that the firm’s real estate attorneys routinely handle high-value transactions—and is one of the southern United States’ most experienced firms handling issues relating
to commercial real estate and transactional maritime financing law. Then there is the work it is doing in the tech sector and the leadership position it has in title and commercial litigation. “We are also representing major claimants in the BP oil spill litigation,” says Garner. “We’re always trying to find out what the next issue is. Currently, we believe that to be energy and oil and gas law, which we plan to further develop in our firm.” But regardless of where the firm’s business takes it, Sher Garner is at its heart a firm that has its roots planted firmly in New Orleans. Post-Katrina, it was heavily involved in helping the city get back on its feet, helping craft real estate deals and working with businesses and not-for-profit institutions with respect to issues related to FEMA and their insurers in the storm’s aftermath. “We are at the forefront of rebuilding a city,” says Garner, adding that the firm recently helped reform the city’s taxicab industry. “There’s a great deal of fulfillment knowing we have a part in it.”
