isa Curtis, when asked, admits it sounds hokey, but it’s true: helping patients severely damaged or killed because of medical negligence makes her feel like she is doing something good in the world to make medical care safer. “This is one of the best jobs in the world,” said Curtis—an attorney for almost 20 years, fighting for the rights of patients, and others hurt or killed by the wrongful conduct of others. “The people my firm represents are so damaged, they can’t heal or grieve from the wrongful death of their loved one unless we hold people accountable for what’s happened,” Curtis said. This is true too for the victims of childhood sexual abuse, that she and her firm represent. “I have an extraordinarily committed team that has been working with me for many, many years. This is what we do to make the world a better place.” Curtis knew from an early age she wanted to be a lawyer and feels blessed to be recognized by her peers in the law as one of the “Best Lawyers®.” While her firm provides a strong, seasoned voice for the victims of bad medical practices inside the courtroom, Curtis herself works for all of New Mexico’s residents in a much larger capacity outside of the legal arena. In late 2011, Governor Susana Martinez appointed Curtis to fill a vacated State Senate seat. Curtis assumed the District 21 seat previously held by Senator Kent Cravens, who resigned last year. Curtis is serving the remainder of Cravens’ term, which expires at the end of 2012. She’s seeking the backing of the state’s voters this November in a bid to retain her current Senate post. METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America®, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers® lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. Civil rights attorney John Bienvenu was perhaps predestined for his profession. Born the son of a litigator, the Stanford Law alumnus said there was “this expectation” he would follow in his father’s noble footsteps—which he did, of course. But not right away. “After graduating from college, I started my family and worked other jobs,” Bienvenu explained. “I did construction, wrote for the newspaper, worked as a park ranger, made documentary films. But in time, I started to get involved in certain legal matters” and before long, “law school was a natural progression.” Today, Bienvenu—who is also the father of an attorney— is a partner at Rothstein, Donatelli, Hughes, Dahlstrom, Schoenburg & Bienvenu, using his more than 20 years of court experience fighting for the rights of employees. “I’m a civil rights attorney and the workplace is a key area for enforcement of rights, from equality and-non discrimination to First Amendment freedoms of speech,” Bienvenu said. His clients include whistleblowers and other workers who’ve been retaliatory terminated for bringing unsafe work practices to the attention of management. He also works with those who’ve been sexually harassed on the job and handles class actions, consumer law cases and business torts. Bienvenu—who has been a partner at the firm the last eight years—said that since legal battles against employers can be quite costly, many victims fail to take action. “There are just certain cases that cry out for legal redress based on the egregious violations of individual rights,” Bienvenu said. “There are things that go on in workplaces that are unfair, and to which it’s impossible not be sympathetic.” A family man, Bienvenu spends much of his time outside of the office with his sons. Plaintiffs’ personal injury attorney Jim Branch has had a career that’s literally taken him around the world. There was his stint in Micronesia, where he defended criminal cases from the Marianas Islands to the Marshall Islands, to a teaching fellowship— interspersed with law firm work—in Brazil. Then there were the years he spent teaching law school at the University of Denver, not to mention his active duty tour in Vietnam while he was still earning his J.D. at the University of New Mexico School of Law. It works.” And though Branch, a faculty member of the National Institute of Trial Advocacy (NITA) for 25 years, has the record to prove it, he isn’t one to tout major verdicts or settlements. “It’s not my style,” he says. You only need to talk to family lawyer Gretchen Walther—of the namesake Walther Family Law that she runs with her father, David—for a short few minutes to understand why she champions divorce choices: Collaborative, Interest Based Settlement Facilitation, or litigation, depending on a family’s particular needs. Walther, who went to New York University as an art history undergrad before turning to law, sees her practice as the ultimate exercise in negotiation. So it’s definitely no surprise to learn why this daughter of 1960s civil rights activists is actually a pioneer in collaborative divorce in New Mexico. In 2001, Walther formed the New Mexico Collaborative Practice Group, a 501C-3 organization made up of lawyers, financial and mental health professionals who promote the process. “What’s great about is that professionals are finally acknowledging that unless we manage the emotional overlay of this traumatic time, people aren’t going to be making good legal decisions,” says Walther, who became interested in social justice issues as early as elementary school, when she was bussed out of her predominantly white, middle-class neighborhood to go to school in a poor, mainly African-American area. “Our job is to make sure they make good decisions. It brings a whole other level of understanding to the conflict that traditional methods can’t.” But that’s not to say Walther encourages alternative approaches in every case—and she is prepared to go to trial if necessary. “I fundamentally believe that what I’m doing helps families,” she says. “My satisfaction comes with helping clients remember their long-term goals.” n
