METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or email ballots; the other half is polled by phone. 4 | NEW ENGLAND’ S Best Lawyers®

Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. Bill Barrett of Esdaile, Barrett, Jacobs & Mone Fighting for the Injured Through the Worst of Circumstances

S

he was a 12-year-old girl on a camping trip as a member of a well-known youth organization, taking part in a project that involved making stoves out of soda cans. The fuel? Denatured alcohol, a compound with an explosive tendency and a flame that’s not easily visible during daylight conditions. Her mother, who was on the trip with her, had never used a soda-can stove before, and was not properly briefed on the potential dangers of denatured alcohol, asked to borrow her daughter’s stove, which she mistakenly believed to be out of fuel. What happened next is the stuff of nightmares. “She didn’t realize that the soda-can stove she thought had run out of fuel was still burning,” says Esdaile, Barrett, Jacobs & Mone partner Bill Barrett, who represented the young girl in the 2008 incident. “As my client’s mother tried to pour more of this highly explosive material into the already lit soda-can stove, the contents of the gallon container were ignited, creating what amounted to a flame thrower in the mother’s hands.” Unfortunately, Barrett’s client sustained life-altering third-degree burns over nearly 30 percent of her body. Witnesses to the explosion stated that they did not realize that the nearly invisible burning denatured alcohol was burning her clothes and hair until they saw smoke rising from her head. “I promised my client and her family that this case would not only be about compensation, but that I would make sure this activity was never done again,” he says. So Barrett, with the full force of the firm’s resources behind him, set up a sophisticated reenactment of the incident at a fire lab. “When the gallon container of denatured alcohol ignited, there was this huge whoosh,” Barrett says. “The contents in the container shot against a cotton shirt that was Bill Barrett affixed to a wall and you couldn’t tell that it was burning until the fabric itself started smoking.” No wonder the defendant settled in mediation. “We ended up prevailing against the defendant, and it has ensured that my client will never have to worry about having enough money for medical treatments or that her injuries will hold her back from having a productive life,” Barrett says. “That’s what we

wanted from the beginning and we worked incredibly hard to make it happen. It’s what this job is all about.” Barrett’s victory shows the impact that the use of powerful and creative demonstrative evidence can have, and it’s just one example of many. The firm has used sophisticated computer animation to recreate incidents such as how improperly handled scaffolding on a Boston building collapsed, crushing a car and its occupant on the street below. But it also shows how the firm spares no expense in preparing cases for gravely injured clients. “We do whatever we need to when it comes to uncovering the details as to how a client was injured and making a compelling presentation to a jury,” Barrett says. “It’s an investment that will bring the best possible results for our clients and often leads to helping bring about changes that increase safety for many others.” Indeed, the defendant in the denatured fuel case, as well as the Boy Scouts of America, have both stopped using the soda-can stove project in their organizations. Tim Kelleher of Cooley Manion Jones Discusses What It Means to Be a Trial Lawyer

C

ooley Manion Jones (CMJ) partner Tim Kelleher has vivid memories of tagging along to work with his father, an Irish immigrant who labored as a meat cutter in a butchery under Faneuil Hall to support his wife and four children. The sounds, the smells, watching the butchers work—all of these have left an indelible mark on Kelleher, a trial lawyer at the firm since 1990. “He just tried to instill in me the value of hard work,” says Kelleher. “And that if you believe in something, you can be impactful.” It’s a tenet that Kelleher abides by every day in his practice, where he serves clients who are facing catastrophic injuries as a result of lifechanging incidents. So it was a bit like coming full circle when Kelleher stood in the historic Faneuil Hall for the very picture that accompanies this piece. For Kelleher, it felt like the past and the present colliding, the skinny kid who stood wide-eyed in the marketplace returning to the location where he learned the value of a hard day’s work. But Kelleher will be the first to tell you that the work he does isn’t all about him—it’s about his clients and doing everything he can to make them whole again. Take for example a recent case involving a worker seriously injured in a propane explosion. Kelleher and his colleagues at CMJ were able to craft a $7.5 million settlement in mediation (one of the largest of 2012), but he also knows it was far from a singular effort. “Our firm Tim Kelleher worked with two other firms that represented two other people who were in the explosion,” Kelleher says. “This was really about attorneys working together to bring about the best results for a group of plaintiffs.” The total settlement exceeded $22 million. Recovery aside, that’s not quite where the story begins and ends. In some ways, it’s also about the good work of the Massachusetts Academy of Trial Attorneys. Kelleher, the President of MATA this year, says the lawyers who came together on the propane case—which is likely to bring about change in the propane industry’s safety standards—are all members and knew each other

through the organization. MATA’s members work tirelessly to have defective and unsafe products removed from the market and to enact broad-based safety changes, Kelleher says, as well as work with state legislators to ensure that proposed bills don’t chip away at the rights of individuals and their families. “That part has been very rewarding,” says Kelleher, who has been the Legislation Committee Chair for the past seven years and has testified at the State House about issues impacting consumers on many occasions. It is the national End Distracted Driving campaign (started by Joel Feldman, a Pennsylvania-based attorney who lost his daughter due to distracted driving) MATA is currently participating in that will likely end up being the defining program of Kelleher’s presidency. The attorneys—all volunteers—visit high schools around the state to give a presentation on the dangers of distracted driving. “I knew that this was a program we had to be doing in Massachusetts,” says Kelleher. “So I talked to Joel about bringing it here. It’s great to see our members out there helping educate kids about the real dangers of distracted driving. These kinds of programs are what the spirit of MATA is all about.” For the service-oriented Kelleher, getting out and making a difference with his peers in the name of safety is simply an extension of what he does at CMJ—and is illustrative of the firm’s culture as well. “Pat Jones, who is my partner and the person who taught me how to be a lawyer, is always out there in the community, and I try to take my lead from him and the other attorneys at the firm who give freely of their time outside of the office. It’s self-motivating,” he says. “And not only is it good for our community, but it helps give the public a sense of who we are.” Indeed, Kelleher says that at the end of the day it’s about not only talking the talk, but walking the walk as well—the very epitome of what being a trial lawyer is all about. “I couldn’t be more proud to be in this noble profession,” he says. “We try to do everything we can to truly make a difference.” n For more information go to www.bestlawyers.com | 1 1

The Powerhouse Firm on Rebuilding Lives and Improving the Practice of Medicine

O

n September 7, 2002, a baby was born via c-section at a Massachusetts hospital: an occurrence that happens at virtually every major medical center across the country on a daily basis. But the birth of this baby did not go as planned. The mother had labored for three consecutive days before the infant was finally delivered by cesarean section. Two days after birth, the baby started to experience seizures and was transferred to a neonatal intensive care unit at a nearby hospital. At the NICU, the infant was treated with Phenobarbital, which proved ineffective at controlling his seizures, so the infant’s doctor ordered a dose of a different anti-seizure medication, Dilantin. But rather than injecting the medication intramuscularly as was ordered, the NICU nurse injected the medication intravenously to the infant—an egregious error with devastating neurological consequences for the infant. Enter plaintiffs’ attorneys Andrew C. Meyer, Jr., and William J. Thompson of the medical malpractice powerhouse firm Lubin & Meyer PC. A month before the 2010 trial was set to begin in this case, Meyer and Thompson were able to prove that the baby’s injuries resulted from the improper administration of Dilantin and the parties settled for $6 million. “Those moments of the doctors’ and nurses’ neglect resulted in a lifetime of consequences for this family that needed to be addressed,” says Meyer, a founding member of the firm. “This settlement meant that Andrew C. Meyer, Jr. there could be some degree of normalcy for this family. This family would be able to access the resources and support services they would need over the course of the child’s life.” For Meyer and his colleagues—all recognized by their peers as amongst the best in the business—every claim the firm brings is about seeking accountability. But Lubin & Meyer takes it a step further. “We want to improve the medical system so that others aren’t harmed under similar circumstances,” Meyer says. “In some ways, our firm is essentially a patient watchdog organization making sure these medical errors aren’t swept under the rug.” The systemic improvements the firm has forced over the years have been significant. In just one example, after a Lubin & Meyer suit uncovered a flaw in a major Boston hospital’s computer system that allowed medical professionals to overdose a patient

resulting in her death, the hospital changed its protocols and put a backup system in place to safeguard against a similar tragedy. Indeed, it has been proven that malpractice suits improve patient safety. An August 2012 study conducted by a professor at UCLA Law found that the suits are an important source of information about medical error—and that the data uncovered during litigation is useful in patient safety efforts. “The sad reality of the medical profession’s culture is that there’s little proactivity in addressing the risks that patients are exposed to,” says Meyer. “In many cases the only way that necessary and lifesaving changes will be made is through the efforts of a firm like ours.” Lubin & Meyer’s record of success is truly amazing and consistently higher than that of other firms. Through the first five months of 2013, the firm has already achieved four verdicts totaling approximately $5M in a practice area where the defense wins approximately 9 out of 10 jury trials nationally. Thornton & Naumes partner Edwin Wallace’s first jury trial some 30 years ago ended in a favorable verdict and a recovery of $11,000 for his client, a young girl injured in a bicycle accident with a trash pick-up truck. Not even a decade later, Wallace obtained the largest verdict in New England in an asbestos case—$2.9 million—a record that still stands. Since then, Wallace has racked up an impressive record of million-dollar verdicts and settlements, cementing his reputation as one of the region’s top trial lawyers. But seeing the pain and suffering his clients go through is as difficult today as it was when Wallace first started out. It’s especially true for clients dealing with mesothelioma, a devastating asbestos-related illness that typically doesn’t manifest until 25-30 years after exposure. “It’s truly the most difficult part, because I’ve been in so many rooms where people are dying. As an avid outdoorsman and lover of the natural world—hiking, rock climbing and skiing are favorite activities—it’s no wonder that Barry Needleman chose to pursue environmental law upon his exit from law school.
