Building a Better Family Law Firm: Michael Berger on the Evolution of Berger Schatz From the outset of his legal career, Michael Berger’s goal was to build a law firm. Berger, together with his fellow founding partners, established a practice that has become Berger Schatz, one of the largest divorce firms in the country. “I realized long ago that having a firm would be much more advantageous for clients,” Berger says. Along with the efficiencies of scale, Berger recognized that a larger law firm can provide intellectual and tactical resources for its clients. “It allows for the exchange of ideas,” Berger explains, “And as a practical matter, you can only be in one place at a time, so having a large group of talented attorneys can be very helpful if an emergency arises.” With 36 lawyers, Berger Schatz is able to act as a comprehensive litigation resource in the family law field. The firm’s attorneys provide the full range of matrimonial law services, handling divorces but also prenuptial and postnuptial agreements, marital settlements and parenting agreements, child custody and support matters, and adoption and assisted reproduction-related legal counseling. “It’s very gratifying to see the firm’s growth over the last 25 years,” Berger says. “We continue to be very successful in cases that are on the cutting edge of the law, and that’s not something I take lightly.” As a pioneer among firms specializing exclusively in matrimonial-related issues, Berger Schatz remains responsive to the ever changing nature of family law. In the past year, the firm established a family building practice to guide clients through the processes of adoption and assisted reproduction. “Issues relating to fertility and adoption law are growing exponentially in Illinois and throughout the United States, so you need to have lawyers who can concentrate specifically on these complex matters,” Berger explains. “And given our size, we’re able to provide that.” The firm has also enhanced its resources in the areas of mediation and collaborative law, with several partners practicing in those fields. Berger, meanwhile, has developed a reputation for his knowledge of the financial and business aspects of family law proceedings. Over an almost 40-year career, Berger has acquired significant experience in cases requiring business valuations, segregation of personal and enterprise goodwill interests, and protection of non-marital assets from a spouse’s marital claim. Indeed, Berger and his partners have devised new and unique theories in cases involving complicated corporate and financial issues—arguments that have been well received by the courts. “I’ve spent many years learning these issues and keeping abreast of changes in the law as it relates to those matters,” he says. “And not just in divorce cases, but in other aspects of the law as well, because those issues fundamentally touch on different practice areas, such as corporate, real estate, and tax law.” Berger Schatz’s all-encompassing approach has proved beneficial to its clientele, which is comprised of accomplished

professionals and high-net-worth individuals. “As your practice grows there becomes a need to know instead of just relying on outside experts,” Berger observes. “There are many situations where we bring ideas to the outside experts that they accept and incorporate into their own opinions; I certainly couldn’t do that if I had not learned on my own the many facets of business valuation.” Berger recognizes that his personality is well suited for assisting clients in such a personal area of the law: “It really wasn’t my goal as a young lawyer to become a matrimonial attorney, but I started handling some divorce cases early on, and I found that I enjoyed helping people who were experiencing an emotional upheaval in their lives—it was very rewarding to help them effect a transition.” Every attorney at Berger Schatz shares that fundamental goal, Berger notes proudly. Methodology

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. hen Dean Dussias formed his matrimonial law practice in 2001, he had already concentrated in the area for a decade and had served as a partner at one of Chicago’s most well-respected divorce firms. Hagler has assisted his clients in the recovery of abducted children, represented clients from Poland, Argentina, and Mexico, and advised highranking Department of State officials on international abduction cases. Ty Laurie’s practice may be based in Chicago but the construction attorney’s complex work has him negotiating contracts and litigating, arbitrating and mediating various construction disputes from coast to coast. “We do work all over the country because our clients work all around the country,” says Laurie, a long-suffering Chicago Cubs fan who graduated from the University of Michigan Law School. “Our practice is a national practice.” Laurie’s practice—which he cofounded nearly three years ago with his good friend and longtime partner, Daniel Brennan—boasts a dozen litigators and a handful of paralegals and support staff. The firm counts as clients contractors, owners, sub-contractors and design professionals, involved in the creation of luxury hotels and major hospitals to high-profile sports complexes, says Laurie, an attorney for 26 years. “I was initially attracted to construction law in large part because of the people I was working with,” recalls Laurie, an avid golfer and skiing enthusiast. “I did some construction law cases early on, and I tended to enjoy them more than general commercial litigation,” Laurie continues. “There are also the people that I get to work with in the construction industry.
