On August 24th, 2023, the Lytle Lake Water Control & Improvement District (the “District”) adopted revised Rules and Regulations for the Use of Lytle Lake and District Property (the “Rules”), pursuant to Water Code §51.122 and §51.127. The Rules govern the use of Lytle Lake (the “Lake”) for recreational and irrigation purposes and outline the individuals who are authorized to use the Lake or access certain property owned by the District, including boat ramps, boat parking, and park facilities. The Rules also establish construction and appearance standards for certain improvements made on or near the Lake by owners of waterfront property (such as docks, private moorings/markings, seawalls, and revetments), require annual inspections, and require permits before construction or major modification of same.
The Rules differ from the previous version adopted on September 1st, 2022 in five ways. First, the Rules more specifically state that a District member may not have more than one on-water facility. Second, the Rules nullify any previously grandfathered moorings. Third, the Rules provide new provisions for correction of on-water facility violations. Fourth, the Rules specify a new General Penalty provision which allows the District’s Board to revoke access to District property when a District member violates the Rules. Fifth, the Rules state that updates to the Policies, Rules, and Regulations take place within 5 days of publication.
The Rules establish that any violation of the Rules may subject the violator to prosecution for a Class C misdemeanor punishable by a fine of up to $500.00. In a suit against a person violating these Rules, the District may recover a civil penalty from the person in an amount of $1000 per day that the violation continues. The Rules allow the District to restrict access to District property when a District member violates the Rules. A full copy of the Rules may be obtained from the District’s website at www.llwcid.org.
