As Foreclosures Inch Back Up, Advocates Tout Assistance Fund

Hope Seen to Avoid ‘Traumatic Process’ for Homeowners

In the years after COVID-19 arrived, foreclosures in New Hampshire dropped.

That was intentional: The federal government imposed a moratorium preventing lenders from carrying out foreclosures on federally backed mortgages, and offered forbearances to allow homeowners to pause their existing payments.

Those programs ended last year. And now, the rate of foreclosures across the country is ticking up.

In New Hampshire, the rate of foreclosure filings on properties has risen 149.72 percent from mid-year 2021 to mid-year 2023, according to a July 13 report from ATTOM, a property data firm that analyzes filings across the country. Most of that increase has happened in the last year.

Housing experts say the uptick is not surprising. Because many home loans in the United States are connected to a government program, whether through Fannie Mae, Freddie Mac, the U.S. Department of Agriculture, the Federal Housing Administration, or the U.S. Department of Veterans Affairs, the lifting of the moratorium last year affected many borrowers, said Stephanie Bray, an attorney for New Hampshire Legal Assistance and the director of the organization’s Foreclosure Relief Project.

“The knowledge was always there that the

piper would have to be paid eventually,” Bray said, speaking on the end of the governmentled freeze.

And while evictions increased more quickly after rental assistance aid ran out in 2022, foreclosures tend to have slower processing times, meaning the effects of the end of the aid are continuing to emerge.

But the foreclosures are not inevitable, advocates have stressed. New Hampshire is continuing to accept applications to its New Hampshire Homeowners Assistance Fund, which allows qualifying homeowners to apply

for up to thousands of dollars in assistance to help with mortgage payments, property taxes, utilities, and other expenses.

Aid workers are hoping more families will apply.

“We help people apply,” Bray said. “We kind of keep the wolf from the door long enough for the application process to do its thing.”  Increase Seems Unavoidable

Even with that aid, experts say an increase in foreclosures is likely in the coming years.

How to Read The Real Estate Records

The information appearing in this newspaper is taken from deed and mortgage documents filed at each of the ten registries of deeds in the state. All property transfers with a sales price of at least $100 and all term-mortgage documents are collected.

Whenever possible, we combine the separate deed and mortgage documents so that we can present one complete record of the street address, purchase price, lender and mortgage amount. When we cannot link a deed with a mortgage (and vice versa) each transaction appears individually.

Real estate records are organized alphabetically by registry, then town, then by street name.

The amount appearing on the same line as the street address is the purchase price from the deed. We print “No Amt Given” when the amount did not appear on the document we review. “No Street Given” appears in place of the street address when it was not available. The volume, page of the deed and filing date appear for all sales.

The mortgage lender and the amount of the mortgage used to purchase the property are shown. Any second mortgage (Mtg2) filed at the same time as the deed will also appear here.

In communities where we have a file of all properties from the assessor’s office, we provide additional property details when available. This is done by exactly matching the address and seller name from the new sales record with the address and owner name found in the property file. No descriptive data appears whenever there is any doubt that the two records are the same property.

The “Use” is based on the code the assessor assigns to each building on a parcel. Whenever there is more than one use code or more than one building on a parcel, we flag these as “Multi-use” and “Multi-bldg” respectively.

These deeds transfer title to the lender after the mortgage is foreclosed (unless there is a higher bidder at the auction.) The amount in these transactions is usually the amount of the outstanding mortgage that was foreclosed.

Shopping for Mortgages Can Save Your Buyers Money

It’s Not Just for First-Time Buyers, Anymore

ears ago, my oldest son (by five minutes) was in the middle of buying his first house when the state announced a program that offered belowmarket mortgage rates for first-timers who met certain qualifications.

When I mentioned I thought this was something worth looking into, he rejected the idea, saying he already had his financing lined up. But I insisted, arguing that he might be able to significantly cut his monthly payment – an important point for any young family buying their first house.

He ended up securing the lower-cost loan and saving $100 a month. And since he lived in the place for 10 years, he pocketed $12,000 overall.

I tell this story because, according to a new report from the Consumer Financial Protection Bureau, all buyers, not just rookies, can save a significant amount of money if they shop for the best deal on their mortgage.

How much can they save? Around $100 a month, said the report.

YThe study found that rates differ between lenders by as much as 50 basis points. In lender parlance, it’s called “price dispersion,” and it exists for practically every type of mortgage, from governmentbacked loans to those in the private market.

Based on the 2021 loans it looked at, the CFPB said that a $300,000 mortgage at a fixed rate of 3 percent for a 30-year loan would cost $1,265 per month. (That’s for principal and interest alone, not taxes and insurance.) But if the rate bumped up to 3.5 percent, the payment rose to $1,347 – a difference of $82, or a 6.5 percent higher payment.

“The math remains similar” using today’s higher rates, wrote the report’s authors, Alexei Alexandrov and Elizabeth Saunders, and the results can have an even bigger effect. At today’s rates, for example, a half-percent difference on the loan described above would result in a $100 higher payment – $1,896 at 6.5 percent vs. $1,996 at 7 percent.

“In a higher interest-rate environment, with monthly payments being much higher overall, this $100 a month difference might matter even more as borrowers potentially are more stretched to make ends meet,” Alexandrov and Saunders said.

The CFPB report confirms what LendingTree and others have been saying for

ages: that buyers who take the time and effort to price-hunt could cut their monthly outlays by quite a bit.

Last summer, LendingTree reported that borrowers who shopped around could save an average of $63,151 over their loans’ 30year terms, which breaks down to about $175 a month. The reason: price dispersion. Across the 50 metro regions the company studied, the average spread between the highest and lowest rates offered to borrowers was 82 basis points, or almost a full percentage point.

Why such a wide range? Each lender has its own set of criteria concerning the risks it is willing to take. The greater the risk it assumes by lending to you, the higher the interest rate. And since one lender might find you riskier than another does, it pays to shop around.

Many People Still Don’t Shop

Unfortunately, homebuyers shop far less for a mortgage than car buyers do for their favorite makes and models. Fannie Mae, the government-sponsored enterprise that buys loan on the secondary market, said more than a third of consumers receive just one quote before picking a lender.

But Zillow said the number is much higher. In its own 2022 study, the listing portal found that almost three-quarters of prospective buyers had not shopped for a

loan and had no plans to do so. By comparison, 28 percent said they spent “at least a month” researching their vehicle purchases, and 23 percent spent that long before booking a vacation.

The reasons people don’t shop around for a mortgage? Thirty percent told Zillow they feared it would hurt their credit, 24 percent were happy with the first lender they contacted, and 19 percent didn’t want to spend the extra time.

To be clear, shopping for a mortgage can potentially affect your credit, but in a limited way: “Buyers can shop and submit multiple applications over 45 days with only one hit to their credit score,” said the Zillow report.

Apartment Industry Pushes Back on Biden ‘Junk Fee’ Crackdown

The Biden administration recently launched a series of initiatives to make sure apartment renters were able to see all so-called “junk fees” charged by landlords. The announcement, alongside ones for new corporate merger guidelines and a crackdown on price-gouging in the food industry, were discussed as part of President Joe Biden’s meeting with the White House Competition Council, a group of officials established under a 2021 executive order.

The council has focused on creating more transparency for consumers and finding approaches to limit the concentration of industries in ways that the Biden administration says lead to higher prices and hurt the ability of start-ups and small businesses to grow. Republican lawmakers and some business group critics counter that the Democratic president’s effort will lead to greater regulatory costs that leave the economy worse off.

“Bidenomics is about increasing competition, not stifling competition,” the president said before the meeting. “When companies have to compete, it means lower prices, fair wages and more innovation.”

Separately, the government is working with the companies Zillow, Apartments.com and AffordableHousing.com to create a new website that reveals to renters all of the fees they could be charged when signing a lease.

The effort comes from concerns that many renters find themselves surprised by what the administration calls hidden junk fees for

background credit checks, paying their rent online or trash collection. The administration’s goal is for renters to know how much they’re being charged so that they can make better choices.

Bob Pinnegar, CEO of the National Apartment Association, said in response that rental housing is a “narrow-margin industry.” While transparency is a positive, he said, policymakers “must recognize operational realities and the role that fees play” in providing housing services.

And Jay Parsons, a prominent rental market economist and head economist at multifamily proptech firm RealPage criticized the White House’s approach as largely ineffective. In a series of posts on Twitter, Parsons

“Fee transparency is important and renters deserve that. (That’s the core of the White House plan — fee disclosure, not elimination.) But the reality is most property mgrs already disclose fees on their own websites AND in the lease application process. It’s totally fair to be upset if you sign a lease only to find out later you’re getting charged $200/mo for some “admin fee” that you derive no value from. And it’s fair to crack down on the small number of bad actors who do such things,” he said. “Most fees are for reasonable things, BUT there’s some pushback that renters shouldn’t pay separate fees for parking, WiFi, smart home tech, valet trash, etc. That’s fair, but they’re still real costs. If you took away those fees, those costs just get rolled into the base rent. So that means that in most properties (bad actors aside), you’re unlikely to derive meaningful savings for renters.”

New Hampshire Gov. Chris Sununu announced that he will not seek reelection to a fifth term in 2024, an unexpected move for the popular Republican that gives Democrats real hope of reclaiming the battleground state’s top elected office during a presidential election year.

Sununu, who took office the same year Donald Trump entered the White House, said in an interview that the nation’s toxic political climate had no impact on his decision. But he decried Trump’s impact on the GOP and vowed to use his political capital to help Trump’s Republican rivals in the state’s firstin-the-nation presidential primary over the coming weeks and months.

“They call it ‘public service,’ not ‘public career,’” said Sununu, who has also decided against runs for president and the U.S. Senate in recent months. Turning to the 2024 presidential primary, he said, “I’m gonna be an aggressive proponent of everybody else (besides Trump) and a proponent of the Republican Party. Donald Trump does not represent the Republican Party. He might be our nominee, but he doesn’t represent the future. He’s yesterday’s news.”

While Sununu, 48, intends to play an outsized role in state and national politics through the 2024 election, his decision gives Democrats reason to be optimistic about winning the governorship for the first time Sununu took office in 2017.

“Before Sununu, the Democrats had a lock on the governor office for a dozen years. Sununu changed all that,” said University of New Hampshire political science professor Dante Scala. “He would have been the significant favorite had he decided to run for a fifth term. For the first time since 2016, we will be more likely to see a competitive race for governor. Democrats will have their best shot in a while.”

Already, several high-profile Republicans have signaled interest in succeeding Sununu.

Chuck Morse, former Republican president of the New Hampshire Senate and a former U.S. Senate candidate, announced his campaign for governor shortly after Sununu announced his decision in an email to supporters. Morse said in a statement that he’s proud to have worked with Sununu “to put together a conservative, pro-jobs, pro-growth, family first economic agenda that has made New Hampshire the envy of New England and the nation.”

Former Republican U.S. Sen. Kelly Ayotte has also joined the field of candidates.

“We are one election away from becoming Massachusetts in New Hampshire, and I’m not going to let that happen,” she said in an appearance on “Fox & Friends” on July 24. “We have something very special in New Hampshire – no income [tax], no sales tax, education freedom is so important in our state.”

At least two Democrats have already launched bids for governor, Executive Councilor Cinde Warmington and Manchester Mayor Joyce Craig.

Sununu, whose father was governor from 1983 to 1989 and later served as White House chief of staff under President George H.W. Bush, was the youngest top executive in the country when he took office in 2017 at age 42. During his tenure, the easy-going politician known for folky manners was praised for his pro-business policies, efforts to combat inflation and his leadership during the COVID-19 pandemic.

Republican Governors Association Chair and Iowa Gov. Kim Reynolds issued a statement praising Sununu after his announcement, saying he “never backed down from a challenge.”

“He made it a priority to deliver balanced budgets, lower taxes, improve education, and address substance use disorders for New Hampshire citizens,” she said. “And, thanks to Governor Sununu’s leadership, New Hampshire now ranks number one in the nation for personal freedom.”

For Ben Frost, deputy executive officer at New Hampshire Housing, the state’s housing agency, the increases in the Granite State are not yet worrisome. New Hampshire still has only the 40th highest foreclosure rate in the country, according to the ATTOM data. And while the number of foreclosure notices at the midpoint of 2023 – 646 – is higher than the same time last year – 494 – it is still not as high as the midpoint of 2019, a year before the pandemic. That point had 741 foreclosure notices.  “If you look at the numbers, they have increased, yes,” Frost said. “But it’s not an alarming increase.”

Still, Frost said, any instance of a family losing their home through foreclosure can be devastating. With a tight rental market and an expensive housing market, finding another home is even harder, he noted.

Selling a house – a common, last-ditch tactic to avoid foreclosure and move elsewhere on a more intentional timeline – is difficult to do in this climate for the same reasons.

“It’s always concerning, because it’s a person’s home, it’s their principal asset, and it’s a place of safety and security,” he said. “So foreclosure is always a really traumatic thing for a family to go through.”

And even though the foreclosure process has traditionally been slow, it is speeding up, Bray says. More private investors are purchasing homes at foreclosure than did after the Great Recession, and those buyers are more likely to seek to evict the former owners to make a quick turnaround sale than banks, Bray said.

New Tool Holds Promise

Bray says that reality is why legal advocates at NHLA are working to help connect families with the existing aid before the foreclosure process can be completed.

The organization has experience helping residents stay in their homes; in 2012 and 2013, its staff worked to fight the wave of foreclosures following the Great Recession. Back then, the primary strategy was to encourage families to apply for loan modifications to help them keep their homes while they rebuilt their finances.

Today, loan modification is still a proven technique, but NHLA has a new tool: the Homeowners Assistance Fund and the thousands of dollars it can provide. Because the foreclosure process is more deliberate, struggling homeowners now have more opportunities to slow things down by securing assistance before a court gets involved.

“Sometimes it’s just getting the money from the program, and your clock is restarted, you’re current again, and away you go,” she said.

“We are like the air support that keeps the title in the name of the homeowner and the

foreclosure from happening until that process is complete,” she added.

In order to qualify for funding from the Homeowner Assistance Fund, residents must show that they have been “affected in any way” financially by the COVID-19 pandemic. Bray says that requirement can sometimes deter people who aren’t sure they qualify. But more people meet that bar than might realize, she said, and she encouraged people to apply anyway.

“Sometimes people had a spouse die as a result of the pandemic,” she said. “And particularly if they were an older couple and getting Social Security, that’s half your income that you lose.”

Others may be unable to work as they did before COVID-19, or their profession may have been drastically changed by the pandemic, or their budget has been severely affected by pandemic-driven inflation. Those situations would all qualify them for assistance.

Frost also urged people to apply, even if they are unsure.

“People should not self-select themselves out of eligibility. If they have a problem, they should apply, and if they’re not eligible they’ll get denied. At least they should make the effort to seek this funding.”
