A: When a seller signs a listing agreement, she agrees to pay the agent a prescribed commission if the home is sold. In Lafayette, the average commission on residential sales is 6%. If the buyer is working with an agent too, it is typical for both agents to split the commission between them. Unless there are some extenuating circumstances, the agent appears to have earned her commission. If the seller is smart, she’ll allow the deal to go forward and for the closing to proceed as planned. If she still can’t resolve her disagreement with her agent which is more than likely over the agent’s commission, they can battle it out after the closing. The contract you signed should be a valid contract for the purchase of the home, regardless of the seller’s problems with her agent. Of course, if the seller’s agent has committed fraud or something along those lines, there is a possibility that your agreement with her may be able to be unwound.

In any case, the seller should voice her complaints to the managing broker of the real estate company her agent works for. Smoothing things over and resolving problems when sellers, buyers and agents aren’t getting along is one of the managing broker’s primary responsibilities. And, if the seller can’t resolve the problem with the managing broker, she can take her complaint to the Louisiana Real Estate Commission. You should talk to a real estate attorney who can help you resolve the situation from your end should the seller try to delay your closing or back out of the deal all together. And, since you said you are represented by an agent, you and your agent and your agent’s managing broker should sit down with the seller’s managing broker and try to figure out how to make this deal close. If the deal doesn’t close, depending on the language of your purchase agreement, you may have legal options, including specific performance, meaning you can sue the seller to force her to sell you the house. Your real estate attorney will be able to discuss these with your further. Good luck.
