Unlocking New Possibilities: How California’s AB 1033 Transforms ADUs into Profitable Investments

The New Frontier in Housing: Assembly Bill 1033

In January 2024, California introduced Assembly Bill 1033, often hailed as a transformative piece of legislation for homeowners and potential buyers. Commonly referred to as ADUs or “granny flats,” Accessory Dwelling Units have traditionally only been permitted as rentals within California. However, AB 1033 ushers in an era where these units can now be bought and sold independently from the primary residence as condominiums.

What is an Accessory Dwelling Unit (ADU)?

An ADU is additional housing units on the same plot as a primary residence. San Diego County allows up to three housing units on a single lot. In addition to the primary home, you can add a junior ADU up to 500 square feet that is attached to the primary home, and a detached ADU up to 1,200 square feet. These units can vary widely in form and are designed to be fully functional living spaces, complete with their own entrances and amenities, allowing them to operate independently from the main residence.

Expansion of Ownership Opportunities

Prior to AB 1033, ADUs in California could only be rented. This restriction limited the potential for homeowners to fully capitalize on the value of their property. With the new law signed into effect, homeowners in participating cities and counties can now construct ADUs on their properties and sell them as separate entities, like condominiums. This change not only increases property utility but also enhances the opportunity for homeownership.

Local Government and Condominium Conversion

For the condominium model to be applicable to ADUs, local governments must opt into this approach. This requirement ensures that the development of ADUs aligns with local housing strategies and community plans. Homeowners wishing to pursue this route must adhere to specific regulations like those for new condominium developments, such as separate utilities, forming a homeowner’s association, and managing separate property taxes for the home and the ADU. As of April 2024, there are no San Diego County municipalities who have opted in, but many are considering implementation.

FROM YOUR AGENTS

Potential Impact and Benefits

The implications of AB 1033 are far-reaching. For retirees, this can mean an opportunity to generate supplemental income by selling off an ADU while maintaining ownership of their primary residence. For young families, this presents a more affordable entry into homeownership. The flexibility offered by AB 1033 could transform many Californians’ approach to housing, particularly in highdemand areas.

Navigating the New Landscape

For homeowners interested in exploring the possibilities of AB 1033, it’s important to stay informed about the specific requirements and opportunities in our area. Consult with our team to be connected with a contractor

who specializes in construction of ADUs, and we’ll provide valuable insights and guidance through the complexities of ADU development under this new law.

In conclusion, AB 1033 offers Californians a promising new avenue for property development and investment. Whether you are looking to expand your living space, or explore new income opportunities, ADUs now offer a more flexible and potentially lucrative option. We’re always here to chat about any topics that spark your interest. Keeping you up to date on state and local changes in the housing market is our pleasure, ensuring you are fully equipped with the knowledge and insights you need to stay well-informed.

Memory Lane The “Scary House”

In last month’s edition of “Where is this Located in Jamul,” we featured a striking image of a tennis court seemingly swallowed by the wilderness. Situated in western Jamul, just beyond Steele Canyon Estates, this court, and the surrounding chain-link fence, are integral components of a once-thriving family compound. Known by various monikers—from the “scary house” to the McGinty Mansion or the Martin House— this estate holds a storied past.

Constructed in 1967 by Bernard Martin, the compound expanded over three decades to encompass multiple guest residences, a full-size tennis court, an inground pool, and livestock pens. However, by 1997, the Martins had relinquished ownership, and the property changed hands several times before its total abandonment, circa 2007.

In the last decade, social media has transformed this secluded locale into a known trail for mountain biking and hiking enthusiasts. With increased attention came a wave of vandalism, beginning with the pilfering of salvageable materials and escalating to extensive graffiti. Today, what was once a legal driveway is accessible only by foot or bicycle, requiring a meandering two-mile journey uphill to reach the former Martin Family Compound. As you make the journey up the path, you pass an old chimney on the south side of the trail, which still enjoys the stone footings of a cabin long-gone.

Having personally traversed this path numerous times, I’ve witnessed firsthand the gradual decay of the structures. Despite a destructive fire that hastened their demise in 2023, remnants such as the original tennis court and inground pool, along with a solitary cottage, still stand—a testament to the estate’s former grandeur.

Contemplating these dilapidated remnants, one can’t help but envision their potential restoration—a return to their original purpose as a multi-generational retreat from urban life. Indeed, nestled in its own valley, this property, once a remote homestead, represented a beacon of local prosperity, tucked away just below the switchbacks on the northern side of McGinty mountain.

As a 32 year Jamul resident situated in a modern home with sweeping views over Jamul Highlands RD, I’m grateful for the convenience afforded by contemporary living. Nonetheless, it’s fascinating to reflect on an era when rolling ranch hills dotted with grazing livestock defined western Jamul—a poignant reminder of the community’s enduring heritage.

Bob and Nancy Parker - 4 Year Jamul Residents

Community Cornerstone

This special feature is all about celebrating the wonderful people who make our community unique. In each edition, we’ll be getting up close and personal, diving into the stories of our neighbors, and learning more about the journeys that have brought them here.

Can you share the story of how you came to settle in Jamul? What were the key factors or events that led you to this community?

Bob played golf at Steele Canyon Golf Course and liked the homes around the course. We had lived in Mira Mesa for 48 years in a two-story home and wanted a one story. The following day there was an ad in the newspaper for an open house for a single-story home in Steele Canyon Estates. The home had everything and more we were looking for, so we bought it.

What are some of the most significant changes you have witnessed in the community since you’ve been in Jamul? Some communities are always in transition, but Jamul seems to be stable. In the four years we have lived here, we have seen a couple of stores close and a feed store, tractor supply store and gas station open. We have made numerous friends and enjoy country living.

If someone was visiting the area for the first time, what’s one place you would recommend they went?

We enjoy taking our guests for a beautiful drive in the backcountry, especially in the spring when the hills are green and the wildflowers are in bloom.

What aspects of the community do you value the most, and how have they impacted your life?

The friendships we have made at Jamul Community Church helped us to adjust to a new area and to feel very welcome. Bob joined the Steele Canyon Golf Club and Nancy joined a local bridge group. We have also enjoyed trivia night at Brody’s and exploring local restaurants in the area.

“...there

was an ad in the newspaper for an open house for a single-story home in Steele Canyon Estates. The home had everything and more we were looking for, so we bought it.”

If you were to describe the spirit or character of Jamul to someone who’s never visited, how would you describe it? Laid back country living. A community united to fight the unwanted sand mine. Neighbors helping neighbors.

On a personal note, we both volunteer at a local food distribution program sponsored by Jamul Community Church. Each week we provide about 300-350 local families with fresh produce and dry goods. It is nice to know that no one needs to go hungry in Jamul. Bob has been volunteering for 16 years in the restoration department of the San Diego Air and Space Museum since retiring. I was looking for a home for my daughter, son-in-law and our precious grandson, that would be close to both sets of grandparents. I spotted the dream home (or as our then 10 year old grandson said “Poppa this will be my forever home”). How do you say No to that? We called Zachary and Rochelle Svelling, and they went to bat for us. Not only did they procure our kids’ dream home, but they were able to sell another piece of property for us, so we could make the deal. I just want to say to these two young, energetic souls....”The adoption papers are ready to sign”. They build Dreams, and make them come true, but the biggest thing my wife and I received in the deal, was a lifelong relationship with hard working, caring dream makers. There is a jewel out there waiting for you, and the Svellings will find it.

The Svelling Group was a great help when we made a major move across the country. They were extremely supportive and listened to all our concerns. They recommended several amazing companies to help us during escrow when we wanted referrals. They are tremendously caring and generous and gave us a monetary gift towards our closing costs as a thank you for being a first responder family. We are very grateful to have worked with them.

The Svelling Group helped us tremendously when we were selling one investment property and buying another. They answered all our questions and were instrumental to the entire process altogether. We will definitely be using them in the future.

Best real estate agents around! These two are definitely a team that you want on your side when selling or buying a house. They go above and beyond to meet your needs! They marketed so well, they did mailers, phone calls, multiple open houses. Their photography team was top notch. Their escrow team was so easy to work with! I am so glad that my family chose them to represent us!

Zachary and Rochelle are a five-star team. I have known Zachary for over a decade. He is by far the most knowledgeable real estate agent I have ever met. Zachary helped me with my VA offer and the inspections. He Also helped me understand all the electronic paperwork, so I knew what to expect. Everything he did was positive and made the entire process a memorable one.

WHY OVERPRICING YOUR HOUSE CAN COST YOU

If you’re trying to sell your house, you may be looking at this summer season as the sweet spot – and you’re not wrong. We’re still in a seller’s market because there are so few homes for sale right now. And historically, this is the time of year when more buyers move, and competition ticks up. That makes this an exciting time to put up that for sale sign.

But while conditions are great for sellers like you, you’ll still want to be strategic when it comes time to set your asking price. That’s because pricing your house too high may actually cost you in the long run.

The Downside of Overpricing Your House

The asking price for your house sends a message to potential buyers. From the moment they see your listing, the price and the photos are what’s going to make the biggest first impression. And, if it’s priced too high, you may turn people away. As an article from U.S. News Real Estate says:

“Even in a hot market where there are more buyers than houses available for sale, buyers aren’t going to pay attention to a home with an inflated asking price.”

That’s because no homebuyer wants to pay more than they have to, especially not today. Many are already feeling the pinch on their budget due to ongoing home price appreciation and today’s mortgage rates. And if they think your house is overpriced, they may write it off without even stepping foot in the front door, or simply won’t make an offer if they think it’s priced too high.

If that happens, it’s going to take longer to sell. And ideally you don’t want to have to think about doing a price drop to try to reignite interest in your house. Why? Some buyers will see the price cut as a red flag and wonder

why the price was reduced, or they’ll think something is wrong with the house the longer it sits. As an article from Forbes explains:

“It’s not only the price of an overpriced home that turns buyers off. There’s also another negative component that kicks in... if your listing just sits there and accumulates days on the market, it will not be a good look... buyers won’t necessarily ask anyone what’s wrong with the home. They’ll just assume that something is indeed wrong, and will skip over the property and view more recent listings.”

Your Agent’s Role in Setting the Right Price

Instead, pricing it at or just below current market value from the start is a much better strategy. So how do you find that ideal asking price? You lean on the pros. Only an agent has the expertise needed to research and figure out the current market value for your home.

They’ll factor in the condition of your house, any upgrades you’ve made, and what other houses like yours are selling for in your area. And they’ll use all of that information to find that target number. The right price will bring in more buyers and make it more likely you’ll see multiple offers too. Plus, when homes are priced right, they still tend to sell quickly.

Bottom Line

Even though you want to bring in top dollar when you sell, setting the asking price too high may deter buyers and slow down the sales process. Considering a move? Let’s connect to find the right price for your house, so we can maximize your profit and still draw in eager buyers willing to make competitive offers.
