VETERANS AFFAIRS PENDING PAYMENT COMPLIANCE

Note: A covered individual is any individual who is entitled to educational assistance under chapter 31, Vocational Rehabilitation and Employment, or chapter 33, Post9/11 GI Bill benefits. In accordance with Title 38 US Code 3679 subsection (e), Lebanon Valley College adopts the following additional provisions for any covered individual while payment to the institution is pending from the VA. LVC will not: • Prevent nor delay the student’s enrollment; • Assess a late penalty fee to the student; • Require the student to secure alternative or additional funding; • Deny the student access to any resources available to other students who have satisfied their tuition and fee bills to the institution, or other institutional facilities.

However, to qualify for this provision, such students may be required to: • Produce the Certificate of Eligibility by the first day of class; • Provide additional information needed to properly certify the enrollment as described in other institutional policies. • Pay any costs that are not covered by the VA by the established due dates or a penalty may be incurred. LVC permits any covered individual to attend or participate in the course of education during the period beginning on the date on which the individual provides to LVC a Certificate of Eligibility or entitlement to educational assistance under chapter 31 or 33 and ending on the earlier of the following dates: The date on which payment from the VA is made to LVC. 90 days after the date LVC certified tuition and fees following the receipt of the Certificate of Eligibility. Note: If the pending VA payment generates a refund, no refunds will be processed until the VA funds have been received and a refund has been requested.

The Family Educational Rights and Privacy Act of 1974 (FERPA), also known as the Buckley Amendment, helps protect the privacy of student records. The Act provides for the right to inspect and review educational records, to seek to amend those records, and to limit disclosure of information from the records. The Act applies to all institutions that are the recipients of federal funding. Annually, Lebanon Valley College informs students of the Family Educational Rights and Privacy Act of 1974, as amended. This Act, with which the institution intends
