Terms: Terms of the sale are cash or good check to be paid immediately following the sale and before any merchandise is released be it live cattle or genetic lots. The seller has the right to require a certified check before the release of cattle or merchandise. Risk: Once an animal is declared “sold” by the auctioneer, the animal becomes the property of the buyer and assumes all risk.

Bidding: Any and all discrepancies will be settled by the auctioneer. The auctioneer’s decision is final. Announcements: All announcements from the block take precedence

over those printed in the catalog. The seller reserves the right to remove any sale lot before the auction begins.

Health: All animals sell with the proper health certificates for interstate travel. Please check the regulations regarding your particular state before you purchase to determine if your state has special regulations. Registration Papers: All animals selling carry ACA registration papers. These papers will be transferred to the new owner at the seller’s expense and mailed to the purchaser.

Shipping: All attempts will be made to aid the purchaser in shipping their newly purchased animals but no responsibility will be assumed by the seller or sale manager. All expenses incurred in the shipping of the animals is the responsibility of the purchaser. We suggest the purchaser obtain insurance on the animals purchased.

Breeding Guarantee: Females - represented as being “safe in calf” will have been examined and declared safe. These females are considered breeders without further guarantee. Cows with calves at side shall be considered breeders also without further guarantee. Females represented as “bred” or “exposed” are not guaranteed as “safe in calf”, however, they and the open heifers selling as individual lots are guaranteed to be breeders. NO guarantee will apply to suckling calves and NO guarantee is given that bred females will deliver a live calf. Course of action for non-breeders: Any female that appears to be a nonbreeder within 6 months after the sale date must be made known to the seller via written letter or e-mail. If the female is in healthy condition, she may be returned to the seller at the purchaser’s expense. The seller will have the right to prove her to be a breeder for a 6 month period. If the female does prove to be a breeder she will be returned to the purchaser at the purchaser’s expense. Should the animal fail to prove to be a breeder, the seller, at his discretion, may either return the purchase price to the buyer or replace the animal with another of equal value in full settlement and satisfaction of all claims. In no event shall the seller be responsible for more than the purchase price. In the case that the animal in question should develop to be a problem breeder due to negligence or improper management by the purchaser, the sellers guarantee does not apply. If the animal is subjected to any hormonal or surgical reproduction techniques after the sale, this guarantee shall be null and void. Any complaints regarding breeding difficulties must be reported in writing by the buyer to the seller within the time limited above, and animals returned must be free from disease and in good condition.

Bulls – All bulls are guaranteed to be breeders. It will be the responsibility of the buyer to have the bull semen tested before he is turned out with cows or before 15 months of age, whichever comes first. If this is not done, the seller is not responsible. Any bull that has not proven himself to be a breeder, the matter must be reported in writing to the seller within six (6) months following the purchase or six (6) months after the bull has reached 15 months of age. The seller will then have the right of six (6) months to prove the bull a breeder. Any bull that has proven himself to not be a breeder that is in good condition may be returned to the seller at the buyers expense. The seller reserves the right to prove the bull a breeder. If proven to be a breeder the bull will be returned to the buyer at his/her own expense. If the bull should fail to prove to be a breeder, the seller at his option can return the purchase price to the buyer or replace the animal with another of equal value in full settlement and satisfaction of all claims. In no event shall the seller be responsible for more than the purchase price. If the bull becomes a nonbreeder by reason of injury, negligence or mismanagement, the sellers guarantee shall be void. This breeding guarantee will only apply to natural breeding. No guarantee is given to artificial collection, preparation or storage of semen. In cases where the animal is subjected to any hormonal or surgical techniques after the sale, the guarantee shall be null and void. All complaints regarding breeding difficulties must be reported in writing by the buyer to the seller within the time limits specified above and animals returned must be free from disease and in good condition. This guarantee ceases when the bull is disposed of by the buyer.

Accidents: All persons who attend the sale do so at their own risk. Seller, sale management, auctioneer or property owner assume to liability, legal or otherwise. The above mentioned are not responsible for lost or stolen property.

Liabilities: The sale manager assumes no liability for loss of or injury to livestock due to theft, mysterious disappearance, sickness, improper handling or act of god. The sale manager acts only as a medium between the buyer and seller. The sale manager is not responsible in any way for the failure of the buyer or seller to live up to their obligations or for the enforcement of any warranties.
