Farm Expo returns for it’s fifth year

The South East’s largest agricultural and machinery show, Farm Expo, returns for its fifth year at Kent Showground, Detling, near Maidstone on 6 March 2024. The event showcases the best of farm machinery, goods and services from national and international suppliers.

Launched in 2019, Farm Expo aims to connect merchants and buyers, providing a convenient opportunity for visitors to shop for all their farming needs. With more than 100 exhibitors in attendance bringing the latest in innovative equipment and technology from all sectors of farming, land management and related businesses, this is a prime opportunity to ‘try before you buy’ and discover the latest releases from favourite brands.

There will also be many opportunities to see live demonstrations, view equipment and machinery up close and network with industry-leading professionals.

NEW for 2024, the Demo Zone gives exhibitors the chance to show off their newest kit, offer test drives and demonstrate new features to a highly engaged audience, bringing an interactive element to the day. Bookings for slots in the new Demo Zone are filling up fast, so make sure to stop by during your visit.

calendar of events for organisers the Kent County Agricultural Society (KCAS), Farm Expo brings together farmers, farm workers, land managers, students and agri-businesses from all corners of the agricultural industry.

Julian Barnes, KCAS Chairman, said: “Farmers have never before faced as many challenges as they do now. With today’s society ever changing, new barriers are being thrown up continually, whether it be sustainability, an economic crisis or the challenges to food security. Farmers are having to constantly diversify and evolve.

“It is more important than ever that Farm Expo brings farmers the knowledge and innovation needed to help their businesses not just survive but thrive. With the range of exhibitors, networking opportunities and other resources on offer, Farm Expo is an important date in the calendar on which farmers can meet their peers and see developments in the industry.”

BECOME A MEMBER

The Kent County Agricultural Society became a registered charity in 1990, but has been around a lot longer than that.

It was in 1923 that the society was first formed. Throughout its history its mission has been embedded in endorsing agriculture, supporting improvements in breeding and rearing

livestock and encouraging the invention and development of agricultural implements and machinery.

As well as holding the annual Kent County Show, the society holds five other events, The Kent Farming Conference, Farm Expo, the Heritage Transport Show, Living Land and Biddenden Tractorfest.

The society’s Kent Rural Scholarship Scheme, introduced in 2015, has sponsored over 20 students of landbased degrees at a cost of over £60,000, and makes charitable donations each year to support the Kent Federation of Young Farmers’ Clubs, providing essential funding for materials and services. Membership of the society contributes towards the continuation of the Kent County Show and helps the society continue to achieve its charitable objectives each year.

Members receive tickets to society events and other benefits such as entry to exclusive show areas and access to other offers and discounts. They also receive a quarterly newsletter with information on the society’s latest news

and events, while helping to preserve the rich agricultural heritage of the county for generations to come.

THE KENT RURAL SCHOLARSHIP

The Kent County Agricultural Society continues to support nine students per year through the Kent Rural Scholarship scheme. Now in its 9th year and having so far supported 23 students, this scheme awards £1,000 per year for up to three years to students who wish to pursue a career in agriculture, horticulture, forestry, equine, veterinary and animal management.

Applicants must be a resident of Kent at the time of application and aged between 18 and 25. They should be studying in the UK in one of the fields listed, on a full-time college or university degree-based course.

Applications for the 2024 new entrants to the Kent Rural Scholarship will open soon.

Chairman’s welcome

Welcome to Farm Expo 2024, a free event run by The Kent County Agricultural Society at the Kent Event Centre.

Having gathered pace over the previous shows, Farm Expo aims to bring together a wide range of machinery, equipment, services, and knowledge from across the South East and beyond in a relaxed and accessible way. There is no better time to get together and build our businesses, shout about new products, and meet new customers.

In our current climate, where people are actively trying to find new approaches, there are always opportunities to discover. The ongoing protests taking place across Europe serve as a stark reminder of the challenges that we, as a farming community, face and of the need for us to stand together and put up a united front across the agricultural industry and related sectors.

Over the last 12 months, the reality of our constant discussions around so many of our input costs at local

and national level have come to the foreground. Insufficient returns for finished goods, how have they managed to be concealed for so long? How can such damaging practices not be taken more seriously throughout the supply chain? How do we engage and educate a consumer to be our ambassadors for the very countryside and products they not only need for their security and health, but which form such a large part of their leisure time.

With these challenges and so many more facing the farming way of life, I hope that events such as Farm Expo and the Kent Farming Conference, which took place earlier this year, can continue to present an opportunity for us all to come together and discuss the vital topics at hand. To gain new ideas and inspiration, make new connections and discover new opportunities.

In 2024, Farm Expo is taking an exciting new direction with the launch of our brand-new Demo Zone, which can be found on the hard-standing in front of the Astor Ring. Allowing visitors to see the newest equipment from their local machinery dealers in action, this Demo Zone introduces a more interactive element to what has become a key date in Kent’s farming calendar.

I would like to take the opportunity to thank our Trade Stand holders. We do not underestimate the time, effort and cost of getting such a wide range of equipment delivered and set up for this day. Huge thanks also go to our Sponsors, whose support is so important in delivering

an event that in turn allows the society to fulfil its charitable objectives of which a key part is supporting and educating the next generation.

Kent Rural Scholars

The Kent County Agricultural Society is so proud to continue to support nine students per year with the Kent Rural Scholarship scheme. “Moving to the UK from Ireland was a huge challenge as I had to start fresh. I worked on a number of farms in Ireland, and this gave me the ambition to become a vet. A display of over 1,000 vintage vehicles including classic cars, motorcycles, tractors, steam and stationary engines, joined by hundreds of buses from across the South East and beyond.

Living Land

A free event teaching primary school children in years 3 and 4 about farming, food production and the countryside. Over 47,600 children have taken part in this event since it was started 18 years ago.

Kent County Show

Five steps to ready your business for 2024

With a new year upon us, now is the time for rural business owners to take stock of their current standing and ensure they have solid foundations on which they can build business success in 2024 while taking care of the future, too. A new year brings new opportunities as well as challenges, and it is crucial to understand how to navigate the legal landscape effectively to ensure business growth and longevity. Sarah Gaines, Partner and Head of Rural and Agricultural, brings you her top legal tips to help you get set for all 2024 has to offer.

STEP 1: ENSURE YOUR BUSINESS PASSES THE STRESS TEST

Many agricultural businesses will have faced tough challenges in 2023. To start the new year on the best footing, we recommend undertaking a thorough review of your current commercial practices:

• Is now the time to rationalise processes? Are some areas of the business under or over-performing? Consider if action needs to be taken to mitigate risk, capitalise on opportunities for growth or to improve efficiencies. As a law firm with expertise in both agriculture and renewable energy, we are increasingly speaking to landowners who are considering allocating land to green energy projects, particularly solar power. There are various options, but commonly, the operator will apply for planning permission

for a new generation site on your land, and if successful, will take up a long-term lease of the land. This can be a reliable revenue stream to help fortify your other farming activities.

• Have you got commercial contracts in place? Are they up to date and watertight in light of the unpredictable economic challenges the sector continues to face? Take some time to review the contracts you have and put in place the ones you don’t. If you are renewing a contract, a commercial lawyer will be able to give it the ‘fine toothcomb treatment’ to ensure it protects your position and appropriately allocates risk.

STEP 2: REVIEW YOUR PROPERTY CONSIDERATIONS

As a rural business owner, there are various considerations to be aware of about your property and land. With various laws in this area set to change in the near future, it’s important to keep an ear to the ground:

• Do you privately rent out residential property? If so, look out for updates on the Renters (Reform) Bill which is currently passing through parliament. The Bill is set to call time on ‘no-fault’ evictions, meaning it may take more time (and money) to gain vacant possession of your property. Landlords will also have to consider tenants’ requests to keep a pet. If you’re apprehensive about the impact of the new renting laws, talking through your options with a property lawyer can help you to stay ahead of the changes.

• If you are providing accommodation for workers, do you understand their occupation rights? These will differ based on the type of tenancy you have in place. Having written

agreements in place will protect you and your workers.

• If you are considering changing the use of a building on your farmland, do check the current law on permitted development rights (PDRs). These are rights that permit, in certain circumstances, the development of land or property without requiring you to obtain planning permission. Not only can the law on PDRs change but there can also be certain circumstances where the rights do not apply – for example, if the local planning authority has removed or restricted PDRs through what’s known as an ‘Article 4 direction’. Additionally, the Government has recently consulted on several proposed changes to PDRs, including those aimed at assisting agricultural

diversification and the development of agricultural units. Check your local council’s website and consider consulting a planning lawyer prior to pressing ahead with your development project.

• Do others have rights of way over your land, or does anyone else occupy your land? If yes, do you have these arrangements formalised >> in written documentation? If not, it’s important to do so, to ensure you and others have certainty in relation to these arrangements.

• Are your title deeds registered and up to date? Registering deeds at HM Land Registry means you’ll benefit from proof that you own the land, which makes it easier to sell your property. You’ll also have peace of mind, not having to worry about paper deeds going missing. However, the application process can be complex and should be carried out by a qualified legal professional. Land Registry fees are payable whenever land is registered and bear in mind that Land Registry is currently experiencing long delays in some instances. However, you can sign up for a property alert to be kept informed about any action on the title you are registering.

STEP 3: COMPLY WITH YOUR OBLIGATIONS AS AN EMPLOYER

After a period of (relative) stability in the employment law landscape, 2024 will see some significant changes being introduced to employment law and employers should be alert to their obligations as and when these changes come into force.

Key areas to be aware of include:

• The Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023 are due to come into force on 1 January 2024 (although they will not have an immediate practical effect). These regulations make various changes to the Working Time Regulations, including introducing “rolled up” holiday pay and a new method of annual leave accrual for workers with irregular hours and those who work part of the year. The Regulations will also introduce into UK law various aspects of EU case law, including in relation to the carryover of annual leave when workers have been unable to take this due to sickness or statutory leave.

• Changes to consultation requirements under TUPE are also introduced by the Amendment Regulations. Very broadly, TUPE applies to protect employee’s rights where a business or part of a business moves from one employer to another (a business transfer) or to a service provision change, where contracts are taken over. The “micro business” exemption (which allows employers with fewer than 10 employees to consult directly with those employees regarding TUPE transfers where there is no existing representatives or recognised union) is being extended. Small businesses (with fewer than 50 employees) and businesses who are undertaking a transfer of fewer than 10 employees, will now be able to consult directly with employees, if there are no existing employee representatives in place.

• Flexible working is set to become a “day one” right from 6 April 2024, to replace the current 26 weeks’ continuous service requirement.

Other changes being made to the flexible working regime include entitling employees to make two requests (rather than one) in any 12-month period and reducing the timeframe for employers to respond to a request from three to two months.

• Finally, workers and agency workers with working patterns that lack certainty of hours or times of work will have the right to request more predictable terms and conditions of work under the Workers (Predictable Terms and Conditions) Act 2023. This will also apply to those on fixed-term contracts of 12 months or less. Employers will have the ability to reject requests on grounds set out in statute, but must complete the process

within a month. The Act will also entitle agency workers in certain circumstances and who meet the statutory requirements, to request to become an employee of the hirer. It is expected that this will come into force in September 2024.

With further changes also being considered, employers and businesses are advised to keep up to date with developments to ensure responsibilities are met.

<< A well-run farming business will strive to protect their workers, members of the public and others affected by their operations. This is the right thing to do but it also makes good financial sense. There are many business benefits to ensuring compliance with H&S laws, including minimising ill health, preventing accidents or incidents which might lead to criminal penalties and avoiding costly investigations by the HSE.

Of course, all employers must ensure, so far as it is reasonably practicable, the health, safety and welfare of employers and any others who may be affected by what they do.

• Do you have an up-to-date health and safety policy and appropriate risk assessments in place? This is a requirement under health and safety legislation and failure to comply can lead to prosecution by the Health and Safety Executive (HSE).

• Have pressurised or lifting equipment regularly inspected. This is a legal requirement under the Pressure Systems Safety Regulations (2000) and Lifting Operations and Lifting Equipment Regulations (1998).

• Do other regulations apply to work undertaken as part of your business? The HSE provides useful guidance on its website regarding the obligations that rural business owners need to understand and comply with.

• If you’ve diversified your land for new uses that are open to the public, don’t forget to check that your insurance covers you for any new risks and liabilities.

• If there are any public rights of way that cross your land, you must keep the route visible and not obstruct or endanger users. Checking the route regularly will ensure you’re compliant. Additionally, have you considered your responsibilities towards members of the public using footpaths which cross your land? Farmers have occasionally been prosecuted after their cattle have attacked footpath users.

STEP 5: PROTECT YOUR FAMILY AND ASSETS FOR THE FUTURE

The new year is the perfect time to get a comprehensive succession plan in place. It will provide peace of mind knowing that your wishes will be met, your loved ones are looked after, and the future of your rural business is protected.

• If several family members or others have a stake in the business, have you got a written Partnership Agreement in place? These define the rights and responsibilities of each party and can reduce the chance of future disputes.

• You may also wish to consider setting up a Family Investment Company, which enables you to pass on wealth to future generations in a tax efficient way. It is a corporate structure, controlled by a board of directors, which operates in a similar way to a discretionary trust. Profits are extracted via dividend payments. A good solicitor can advise on whether an FIC is suitable for you.

• You may have specific wishes for certain aspects of your business, or for the distribution and division of

land once you’ve passed. We advise you update your Will every five years or after any major life event to make sure it’s still up-to-date.

• Registering a lasting power of attorney (LPA) for property and financial affairs enables your attorneys to act on your behalf. This means that, in the event that you lose mental capacity, they will be able to make decisions for you in a number of transactions such as signing documents, negotiating commercial contracts, making investments and transferring land. Making an LPA will mitigate against any problems that might otherwise arise without one.

• If you’re getting married in 2024 (or if you’re already married) consider

the benefits of a pre- or post-nuptial agreement as a way of setting out the division of assets should the relationship break down. This can be particularly important if you have children from a previous relationship who you want to provide for, or if you have specific plans for the succession of your business.

Fruit and vine specialists celebrate 50 years

This year marks NP Seymour’s 50th anniversary and 40 years since the fruit and vine machinery dealership started supplying UK growers with Fendt’s range of specialist tractors.

On its stand at Farm Expo, NP Seymour will be displaying a front-mounted tool carrier frame designed and constructed by NP Seymour’s expert team of engineers at the company’s Avon Works facility in Cranbrook, Kent.

The tool carrier frame, which will be mounted on the front of a new Gen 3 Fendt, can accommodate a variety of mechanical weeding tools from renowned manufacturers such as Braun and Clemens.

The Braun Vine Trunk Cleaner and Clemens MultiClean heads offer growers an environmentally friendly, chemical-free way to bud rub and control weeds effectively in the undertrunk area without interfering with the soil structure. Handy for the end of winter and early spring season, these strimmer-like heads can also clear prunings in preparation for mulching.

Each tool carrier frame is custom-built to the exact specifications of growers, who can choose the desired width, whether it is hydraulically or manually adjustable and whether it is singlesided or double-sided.

SFI actions to look out for

With DEFRA recently announcing further details on the Environmental Land Management scheme (ELMS), crop production specialist Hutchinsons is sharing advice on the options to look out for.

From summer 2024, farmers will benefit from a combined environmental land management offer comprising Sustainable Farming Incentive (SFI) actions with increased payments, plus over 50 new actions. Countryside Stewardship and SFI payment rates have increased and will apply to existing and new schemes, with an overall average increase of 10%.

Farmers could claim up to £27/ha for variable rate nutrient management, which is part of the ‘precision agriculture’ action. Farmers can use TerraMap digital soil mapping and

Omnia’s leading mapping tools for variable rate N, P and K maps to support their application.

There is up to £73/ha available for the ‘no-till farming’ action.

There will be a new suite of 21 ‘premium payments’ which will offer payment for high priority actions such as agroforestry maintenance, 3D buffer strips and managing features for flood and drought resilience.

A separate capital grant scheme will also open to support the creation of grassland habitats and there will be better support for the management of existing habitats.

Managing inheritance tax risk for farmers

When discussing inheritance tax risk with local farmers, some frequently occurring issues that arise are as follows:

FARMHOUSES

You may be able to secure agricultural property relief (APR) on the farmhouse if you actively manage and work on the farm. If the person running the farm also occupies the farmhouse, it maximises the chance of APR. Be aware that if the landowners occupy the farmhouse, but others carry out the daily management of the farm, APR is likely to be denied.

‘ESTATE’ CONCEPT

If you have rental properties on your land, consider establishing the ‘estate

concept’. If it can be argued that your rental properties are part of your ‘whole’ or ‘country’ estate, and farming is the main activity, it will increase the possibility of obtaining APR or business property relief (BPR) on all the properties. If you are not farming actively day to day, consider making use of farm business tenancies to secure 100% APR with tight lines drawn around the farmhouse to ensure the maximum relief is obtained on the land and farm buildings.

DEFRA introduces new solar grant

Farmers in England who wish to install solar panels can now apply for financial support under round two of the Improving Farm Productivity grant.

Farmers and horticulturalists will be able to apply for the grant in early 2024. It will allow all farming businesses to apply for support to cover 25% of a solar PV system; the minimum amount of funding is £15,000 and the maximum is £100,000.

The funding can be used for roofmounted or irrigation reservoirmounted solar arrays providing that the power is mainly used to run the farming operation. The funding cannot be used for ground-mounted

solar systems, north-facing roofs or systems in heavily shaded areas.

Eligible items include solar PV panels (plus associated equipment such as the mounting system and inverters) and batteries, as well as certain grid connection costs and power diverters (systems which redirect excess solar energy to power storage such as heat stores, for example).

Items which are not eligible include ground-mounted solar arrays, replacement or reinforcement of roofs, construction of farm buildings or upgrading of existing solar panels.
