Striding into 2010 with Fanfare 2009 is a fruitful year for Gamania, our self-produced game, Lucent Heart successfully brought in nearly USD 10 million in revenue while Bright Shadow made its debut appearance in the U.S. Moreover, Gamania was awarded “Taiwan Superior Brand”. In the midst of global economic downturn with average global economic growth rate at -1.1%, Gamania took it in stride and created a remarkable 40% average growth rate as a group, spreading the footprint of Gamania worldwide. 2010 is just around the corner, in this special edition of G!Voice, we collected the Best 100 of this year to share with all Gamanians. The IPR War is on! We have entered an era of knowledge economy, with knowledge being incorporated into the scope of legal protection, we couldn’t emphasize enough on the importance of Intellectual Property Rights(IPR). So what does IPR has anything to do with Gamania? How do we fight this war? In this edition of G!Voice, we will tell you all about it.

If you haven’t heard of IP, then you’re outdated! When it comes to “property,” people usually associate it with tangible items such as movables (a.k.a. personal property, i.e. cash, jewelry or stock), and immovables (a.k.a. real property, i.e. land, buildings). However, in the course of civilization development, intangible property has drawn more and more attention. The “intangible property” we are referring here means creations of the mind, i.e. music (songs , lyrics), literary (novels, thesis), paintings (oil painting, comics), website designs (Yahoo FrontPage), computer software (Microsoft Office XP), invention patents, trademarks (IBM, Microsoft) etc. The corresponding fields of law that protects people’ s intellectual creation and grants the exclusive rights to the creators is known as Intellectual Property Rights. (IPR) IPR includes trademark rights, patent right, copyright and trade secret rights. Most people tend respect tangible property more than intellectual property right which causes the market to be flooded with copied or bogus merchandises, books or software. Another common example is confusion on similar trademarks. There are quite a few examples of others using trademarks that are similar to Gamania’s, for example, game forum, “T.G.G”; internet café “GameMonkey” and convenience store, “Tangerine King” (who not only copied the logo but tempered with the original design) etc. These are all considered violation of IPR and Gamania reserves the right to file for legal action.

IPR and Gamania are closely knitted The above mentioned perpetrators violated trademark right and plagiarized Gamania’ s most notable symbol because Gamania is a highly recognizable and well perceived brand. Apart from trademark right, all products from Gamania are all relevant to IPR. Let’s discuss this from different aspects: Gamania’s self-produced “Bright Shadow” and “Lucent Heart” belong to software development and therefore fall under the scope of copyright; Gamania’s online entertainment such as animation, “Hero: 108” is also protected under copyright; PKI, a special technology designed to protect account safety falls under patent right; the secret methods used for plug-in block cannot be revealed to the public therefore it falls under trade secret right. In brief, we can almost presume that digital industry is IPR industry. If we could use IPR to the best of our advantage, it will put Gamania in an advantageous position and bring forth immeasurable benefits. On the contrary, if we ’re not fast enough, it may cause us a great fortune. The following are three good examples:

GameFlier’s Communication Lock and its Patent Disposition Gamania originally planned to collaborate with Chunghwa Telecom to launch a new service, “Cellphone Communication Lock,” however, during the course of discussion, Gamania found out that GameFlier had applied for patent right but still pending for approval. Under the guarantee of our collaboration made by Chunghwa Telecom, Gamania proceeded with a series of disposition. During the last phase of contract signing, Chunghwa Telecom halted the collaboration for its concern on the potential violation of the law. The amount of time, man power (drafting of programs) and money (server and equipment purchase) all went down the drain. As a result, to this day, we still haven’t been able to provide players with Communication Lock service.

China’s 9you Contended for DNF Trademark Gamania acquired the agent right of renowned Korean online game, “Dungeon & Fighter” (DNF) in Taiwan, Hong Kong and Macau in May 2009. This game has swept across Asia since 2005, accumulated over 100 million members. However, China’s 9you company registered the trademark of DNF in Taiwan prior to Gamania’s acquirement of agent right. Gamania can’t use partial Chinese title to name the game (neither Dungeon nor Fighter) and finally settled in its English title, “Dungeon & Fighter” to advertise to players. Due to the fact that the target players of this game are predominately middle and elementary school students, it was hard to spread the English name and subsequently affecting the publicity and popularity of the game.

Taiwan Mobile Infringed Taiwan Index Corporation Ltd.’s Patent Right on Methods and System of Broadcasting Commercials during Incoming Calls Taiwan Index Corporation Ltd. (TIC) applied for patent on Methods and System of Broadcasting Commercials during Incoming Calls in 2005. If the

users choose to adopt the system where game commercials to be played as connecting tone for incoming calls, they can enjoy cash-back. However, Taiwan Mobile collaborated with Ohyeh Multimedia Co. on the same line of business which may be infringing the patent right owned by TIC. Currently, TIC is negotiating with both companies. Either it results to settlement or litigation, TIC is mostly likely to benefit from it. Other well-known companies such as IBM enjoy benefit from patent authorization every year as much as USD 1 billion, which makes up the company’s 1/9 of annual Profit Before Tax. Sum up the above cases, we ’ ve learned that one patent right can put you years ahead of your competitors. Currently leading enterprises of various fields in Taiwan have drafted IPR policy, pertinent SOP and management mechanism. Gamania has always aimed for becoming leading brand in international digital entertainment, therefore we can’t afford to be absent from this battlefield. To implement a comprehensive IPR policy can not only lower our operational cost and risk but increase our benefit and make us one step closer to positioning ourselves as a leading brand in the industry.


War against Plagiarism To implement IPR policy and protect Gamania ’ s intellectual property rights, Gamania will engage in internal promotion to raise awareness on various IPR guidelines announced by the group. Group Gamania has also set up IPR exchange platform to teach Gamanians to recognize, comply with and properly use IPR to reduce operational risk. This platform is open to oversea Gamania branches so the information and resource can be shared to reduce group’s legal cost. In addition, to enhance the R&D and quality of creativity group wide and position ourselves as the leading brand in the industry, Gamania will implement Guidelines on IPR Reward System which provides high stake price as incentive to encourage all Gamanians to apply for patents. Let’s help Gamanian to win the battle on IPR.

Gamania’s IPR Reward Guideline:

Approval. If your proposal passes the review done by your unit head, then it can be brought on to special project meeting for second review. Whether your proposal is apt for patent application, at this phase you may collect your proposal reward of USD 100. If your proposal is apt for patent application and you successfully complete the application process, you will be rewarded with patent application reward of USD500. Lastly, if your proposal is approved, announced and registered by competent authorities of your respective region, you may collect your patent approval reward. The amount for patent approval reward is to be discussed and determined by MDs and country heads. Judging by the profitability and the contribution your proposal may bring for the company, the reward is classified into three ranks. A:USD15,000~20,000 B:USD8,000~10,000 C:USD1,000~5,000

Dolls, clothes, accessories, second hand books are just among the things commonly seen in charity bazaar but Gamania is known for creativity, of course we have come up a lot more than that. This year’s Gamania Charity Bazaar, we had wish fulfiller service, beauty salon services, date bidding and other services. In brief, Ganaians had all the love and creativity for all to see.

Novemeber 11th 2009 was Gamania’s 14th birthday and was also one of the most important day for Gamania—the Gamania Festival. In the past, Gamania Taiwan would celebrate it with Cosplay competition or festivity. This year Gamania Taiwan decided to host a Charity Bazaar competition to help stray dogs. There were 5 teams registered and participated in this event. Among these 5 teams, “Chic Brand Circus” gained the most attention on your creativity. Their unit head, Ahbin was nominated to be auctioned off for a One-Day date event. Their services featured stress-relief massage, beauty care and hair cut. Their creativity was well-received and highlypraised. Other notable campaigns include: Dao and Bazzi, main characters from Kart Rider providing services to the highest bidder and lucky draw hosted by Maid Shop from Gama To Your Liking. (Grand Price: HP Printer) These exciting and topic provoking themes and creativity prompted the number of visitors in the charity bazaar and subsequently increased the sales revenue.

The Importance of the Integration of

ACG

ACG is said to be the most important subculture of this generation. Many take ACG seriously and study it as a discipline. As an online game company, Gamania has even closer relationship with ACG. G!Voice invited a special guest, Jo-Jo, convener of Shuffle Alliance, Taiwan to talk about the origin and the importance of ACG.

Jo-Jo has been an ACG fan for more than 35 years and has profound study on Otaku community. She dedicates herself to promoting Otaku spirit, as the leader of Shuffle Alliance, she helped launching books such as Animation Comic Game, Japanese Animation Case Studies and Animation Comics 2000.

Originally there was only AC, A stands for Animation and C stands for Comics. Back in the day in Taiwan, people used to call it CC-Cartoon and Comics until Shuffle Alliance published a book called, “Animation Comics 2000 ” , the phrase AC started to gain its popularity. Earlier in 1995, our member AIplus came up with an insightful classification. He proposed that three industries: Animation, Comics, Game should be studied and observed integrally and thus coined the term, “ACG.” In recent decade, ACG has gradually become the trend and the universal buzz word in countries like Japan. Note: the order of ACG, in AIplus’ own explanation, wasn’t determined by the popularity or superiority of these three categories. It ’ s because under the computer search method, the arrangement of ACG will actually make it appears on top of the search result. Even though ACG is just an acronym of three nouns, but over the decade, with the rise of its popularity we may assume that users or fans of these three categories do present linked or correlating behaviors such as fondness, promotion and consumption. In other words, if you like one category out of the three, you ’ re much likely to enjoy the other two. The business trend surely proved that point, Japan is the best example of how these three industries

have merged and integrated into one. The overall industrial value for ACG has grown substantially over the years and is still growing continuously which is a proof that these three do help buoy one another. Because the three industries have inevitably emerged into one, whenever a new comic book comes out, readers will be expecting the book to be animationized and saving money for the game software that will be flooding the store in the future. This kind of expectation and anticipation has become the universal experience for ACG fans alike and the rule of thumb for the market. We may even go so far as to say that these three industries cannot fight on their own, strategic alliance and cross media collaboration are bound to become the inevitable trend. In this sense, ACG means more than just three words binding together. It exists because we think from the most basic and fundamental point of view of our consumers: what are their behavioral modes and what do they really crave? And through this collaboration and alliance, we satisfy their demands and desire. It is only when we bear that in mind and put it into our R&D process can we bring the full potential of these three into full play. And later when we propose projects, campaigns and promotions, we could use that tremendous force to achieve 1+1 >3.
