CHAMBER CALL HOUSE ON ISO BINGO BOX CHALLENGE December saw the return of the ISO Quality Services Bingo Box Challenge, helping to feed families this Christmas.

CHAMBER AMONGST 50 EMPLOYERS TO RECEIVE MINISTRY OF DEFENCE AWARD The Herefordshire & Worcestershire Chamber of Commerce, along with fifty other employers from the West Midlands region, received their Ministry of Defence Employer Recognition Scheme (ERS) Silver Award from West Midland Reserve Forces & Cadets Association (West Midland RFCA).

The Bingo Box challenge aims to spread the word on the crisis the Foodbank is facing and encourages organisations and individuals to donate items to their local Foodbanks. The task was simple, a bingo style challenge where each member of staff were given the responsibility of donating one item off the bingo box sheet. This year the Chamber have chosen to donate the items to Hereford Food Bank. All staff have contributed to this effort and they even have duplicates of most items so had to increase the size of the box! In the past five years, the need for foodbanks in the Trussell Trust’s UK network has increased by 128% and last year, they distributed a record breaking 2.5 million emergency food parcels to people

in crisis, a 33% increase on the previous year. Nearly 1 million of these went to children. It was fantastic to see not only the Chamber, but a number of businesses across the region taking part in the challenge and donating much needed items to foodbanks across the two counties.

The ERS was launched in 2014 to recognise employer support for the wider principles of the Armed Forces Covenant. The scheme encompasses bronze, silver and gold awards for employers that pledge, demonstrate or advocate support to Defence and the Armed Forces community. Sharon Smith, CEO at the Herefordshire & Worcestershire Chamber of Commerce, commented: “We are delighted to have achieved the Silver Award through the Employers Recognition Scheme in recognition of our support for the Armed Forces community. “We are proud to support the fantastic talent that the forces bring to the business world and it’s a great honour for us to not only participate in the scheme ourselves, but to promote it to the whole of the two Counties business community.” The lunch time event was held in Aspects at the iconic National Memorial Arboretum, a fitting place for such awards to be presented. Guests were welcomed to the event by Watchman, a Staffordshire Bull Terrier, who is a military mascot for the now disbanded Staffordshire Regiment, but continues his duties as part of the Staffordshire Regimental Association. BLUE PRINT GET TOP MARKS THANKS TO CHAMBER IOSH TRAINING The Chamber of Commerce have helped local direct mail service Blue Print Direct Mail gain accreditations for a number of their staff. Blue Print recently sent a number of their workers on the Chamber’s IOSH Working Safely training course with all members passing the course. On their staff passing the course, Blue Print Direct Mail, said: “Massive congratulations to our staff at Blue Print for gaining their IOSH Certifications. IOSH is a Working Safely course, provided by Herefordshire & Worcestershire Chamber of Commerce. Many thanks to H&W Chamber for delivering this course to our employees, it is great to improve our

Health and Safety within the workplace with an internationally recognised certification.” Working safely is for people at any level, in any sector, needing a grounding in the essentials of health and safety. Working safely meets the government’s guidelines for introductory health and safety training and is a 100 per cent match to the Health and Safety Executive’s ‘passport’ syllabus. UK TRADESHOW PROGRAMME TO SUPPORT EXHIBITING BUSINESSES The UK Tradeshow Programme offers government support to help UK businesses successfully attend or exhibit at overseas trade shows.

UK businesses exporting, or thinking about exporting, can apply for support to: exhibit at, or attend, approved overseas trade shows and conferences potentially receive grants to offset some costs Applications to exhibit at overseas trade shows open from 29 November 2021. Applications to attend overseas trade shows (without exhibiting) open from January 2022. The maximum number of successful applications available to individual organisations is limited to one for the lifetime of the UK Tradeshow Programme. Eligible businesses must be a small to medium-sized enterprise based in the UK and either:

OVER 80 HR PROFESSIONALS DISCUSS THE WORLD OF WORK Last month saw the return of the successful HR Conference, where over 80 HR representatives gathered at Sixways Stadium for an update on the latest hot topics within the industry. The Conference was held in partnership between Hewett Recruitment and Herefordshire & Worcestershire Chamber of Commerce. The Chamber delivers a number of conferences per year with each conference providing thought-provoking speakers on a range of topics. Attendees had the chance to hear from a number of topical key speakers who provided useful and insightful information on the world of work almost 2 years on from the beginning of the pandemic.

Birmingham’s Community Healthcare NHS Trust (BCHC) has invested in a full suite of cyber security services to keep its patients’ data and personal details safe from any would-be cyber attacks, criminals and hackers. HOW TO GET YOUR BUSINESS CYBER SECURE IN 3 STEPS You may be hearing a lot about cyber security at the moment with the steep rise in cyber crime in recent years. Businesses are looking for the best ways to protect themselves against the ever-increasing threat from hackers as cyber crime methods become more and more sophisticated, in line with rapid advances in technology. The statistics are alarming, with the number of UK businesses suffering cyber attacks doubling over the last 5 years according to a cyber security report by internet provider, Beaming. There are three main ways you can ensure that you are doing the best to secure your vital data, systems and infrastructure from cyber attacks. These are protection, testing and training.

PROTECT There are a variety of cyber security solutions available which will increase your organisation’s defences against cyber attacks. Firewalls: Hackers have developed ways to get into even the best protected computer security systems. They can enter your network without leaving any signs and can remain there undetected for as long as 18 months which can mean huge financial losses or implications to your business’ reputation. Firewall hardware or software is a security device that helps protect your network by filtering the traffic that enters it, stopping unauthorised users from accessing the confidential data stored on your computer. It can also stop malicious software from infiltrating your computer. Multi-factor authentication: Multi-factor authentication is designed to protect your user accounts from cyber attackers trying to steal credentials or exploit weak credentials.

It is a two (or more) step verification process which requires users to enter a username and password or pin but also to approve authentication requests via an a smartphone app or another device. This acts as protection against phishing, social engineering and password attacks. Anti-virus: Another key element in keeping your systems safe is anti-virus software. Anti-viruses work by detecting a virus, identifying which type of virus it is then working to remove it from your computer or quarantine it so that it cannot cause any further damage. Anti-viruses can also act as a preventative measure, performing system scans to monitor your device and system files searching for possible threats and using real-time threat detection to guard your computer system against potential risks as they arise. In order to combat highly developed malware viruses, it is important to have the latest in anti-virus protection.

TEST Testing your systems is an excellent way to see if your they are currently cyber safe or if you need to put further security measures in place to avoid security risks. Penetration testing involves putting your network through a simulated cyber attack to see how it would hold up in the event of a real attack.

AA SALT INVESTS SIX-FIGURE SUM AS FLEET INCREASES Respected winter maintenance and snow clearance company AA Salt has recently completed a £190,000 investment into its growing fleet of vehicles. The Himbleton-based firm, which was shortlisted in the Excellence in Sustainability category in our 2021 Business Awards, has added to its fleet throughout the past 12 months with the six-figure injection seeing the introduction of five further gritting vehicles, two lorries, six new snow ploughs and a forklift truck. Sales and Operations Director Ben Tanner says it has been a vital investment as the company works round the clock to keep car parks, paths and access roads clear for hundreds of its customers. Ben said: “As we had forecasted back in the autumn, it has been a really

freezing winter with dangerous sub-zero temperatures across all parts of Herefordshire and Worcestershire. “Our investment into the fleet was an important part of our planning and to make sure we were winter-ready to support our customers. We have really seen the benefits from that planning and our decision to increase the size and quality of our vehicles and the huge amount of equipment we need. “There’s no doubt it has taken our capacity to a whole new level this winter and helped hundreds of our customers provide

a safe environment for their own staff, guests and visitors - including retail parks, sports stadiums, hospitals, offices and our private customers.” An investment into stocking thousands of tonnes of environmentally-friendly marine rock salt has also been a vital part of AA Salt’s planning this winter as it has ensured its supplies have stayed high despite many local authorities struggling to cope with demand. QUARTERLY ECONOMIC SURVEY REVEALS CAUTIOUS OPTIMISM Over a 3 week period in November, over 400 organisations across Herefordshire and Worcestershire completed the latest Quarterly Economic Survey (QES). This survey conducted across the Chamber network, for over 20 years now, reveals a snapshot of opinion and evidence from many areas of business. It’s true that with this latest report some aspects of business show caution while optimism is displayed in other areas. In addition to the frequently asked questions, this report was sponsored by The Low Carbon Opportunities Programme, part of Worcestershire County Council’s Clean Growth Programme and presented some useful information on the sustainability plans and challenges of businesses. Economic factors provide the headlines of every QES. In this latest survey, 46% of businesses experienced increased sales in the last three months. This compared with 49% in the previous quarter. 35% of businesses saw that their sales remained the same, compared to 32% in the last report. This was further reflected in an analysis of advanced sales and orders. In the last survey 46% of businesses were experiencing an increase in orders, with just 26% seeing their advanced orders remaining the same. This survey reveals that now 39% of those surveyed were dealing with increased orders, while 37% had remained the same. There is a possibility here that demand, and supply, previously being outweighed by extraordinary demand is beginning to find a balance. Additionally it could be that businesses are using stocks they have built up when concerned about supply shortages. People are the most important resource in any business. Often specialised, always a changing market place, and now in certain sectors in short supply. The Quarterly Economic Survey covers this area asking businesses questions regarding staffing levels, recruitment and training. 31% of businesses increased their workforce over the last three months. This was compared with 34% in the last quarter and with 60% of organisations showing no change it shows a period of consolidation, or in fact difficulty to recruit.

This is because 38% of businesses expected to increase their staffing in the next three months. The majority of these roles were full time, and encouragingly, apprenticeship recruitment was increasing. Finding the right candidates proved difficult to the majority of those surveyed, and a strategy to improve this situation might be displayed in fact that 29% of businesses were revising upwards their training plans, compared to 24% last quarter. The Quarterly Economic Survey looks to the future and allows us to plan accordingly. 67% of businesses anticipated their turnover would improve in the next quarter, slightly down from the previous quarter. More alarming perhaps was that just over half (65% previously) anticipated their profitability to improve. This was due to some real concerns being expressed by business in terms of Interest Rates, Business Rates, Inflation, Competition, and the greatest change of all, Energy Prices which were highlighted by 49% of businesses, up from 16% in quarter 3.

The Queen’s Anniversary Prize also recognised that 95 per cent of full-time students at the college successfully made it to their first-choice destination after leaving and in 2020, the college broke national records for end-point assessment pass rates for its land-based engineering apprentices.

The prestigious award recognises WCG for how it has developed future engineers through innovation and partnership over the last quarter of a century. Angela Joyce, CEO of WCG, represented the College at a Prize Winners Reception held at St James Palace where the 2020-2022 Winners were announced. WCG delivers engineering courses at three of its colleges, Warwick Trident College, Rugby College and Evesham College. The college has established itself as a leading provider of engineering apprenticeships in the Midlands and across the UK. It was a pioneer of employer-centric educational provision, which is now being widely adopted by other institutions under the Government’s new skills strategy.

Business and divorce – can your business survive?

Divorce is difficult at any time– but if your business is affected it can lead to even more disruption. Deciding who gets what in a settlement is often a contentious process. Our experienced team of Family lawyers handle cases of any size – from the simplest to the most complex. With businesses now a prominent feature in a number of divorce cases, particularly where a business was set up prior to marriage, it’s important to know what to do to protect your position if your relationship ends.

There are several ways ‘divorce-proofing’ your business can be achieved. The first and most effective is to sign a pre- or post-nuptial agreement. Both parties sign an agreement laying out what happens in the case of divorce and how assets are divided. Pre-nuptial agreements must be agreed prior to marriage, whilst post-nuptial agreements can be entered into at any time after marriage. A well drafted pre-nuptial agreement can be persuasive to the divorce court later on, subject to the agreement being seen as fair. A post-nuptial agreement is often seen as a useful tool for legacy planning and requires full disclosure and to have been executed voluntarily and without coercion – the same as a pre-nuptial agreement. These agreements must also be fair. Simply stating that the spouse won’t receive anything in the event of divorce will not pass the ‘reasonableness’ test the court will apply. Phantom agreements – an agreement between a company and a business owner or someone working in the business – produce phantom shares, which can increase and decrease in value, but without actually granting any shares. These can be created to give a spouse financial interest in the business. Both sides would have to consider and clarify the tax position of these shares.

Articles of association are a further way of ensuring your business is protected when it comes to divorce. These key documents can require shares previously transferred to a spouse to be ‘bought back’ by the company in the event of divorce. Paying yourself a competitive salary instead of reinvesting profits back into the business can also assist here. An exspouse may consider their entitlement to be larger than originally thought if they feel they did not derive any benefit due to funds being re-invested. Difficulties can also arise if you involve your spouse in your business as this may place them in a stronger position when the court are deciding their entitlements in respect of the business.

There are several ways ‘divorceproofing’ your business can be achieved.

It is also important to consider matrimonial and non-matrimonial property. Non-matrimonial property –acquired from outside the marriage – is far less likely to be shared upon divorce, whereas matrimonial property –acquired or built up during marriage, is usually shared equally. In most cases, non-matrimonial property can only be ‘invaded’ when assets acquired during marriage aren’t enough to meet the needs of both parties. Whilst there is no entitlement to share non-matrimonial property, it can be susceptible to a claim based solely on needs. Therefore, it’s extremely important to try to keep these two types of assets separate. In 2019 the United Kingdom became the first major economy in the world to pass laws to end its contribution to global warming by 2050. The target will require the UK to bring all greenhouse gas emissions to net zero by 2050. Greenhouse gas emissions are directly related to energy use, particularly energy use from fossil fuels. The data for greenhouse gas emissions (GHG) in the UK is provided up to the year 2019, before the coronavirus (COVID-19) pandemic. The total GHG emissions for 2019 were over 550 million tonnes of carbon dioxide equivalent (Mt Co2e) (residence basis). Households and the energy, manufacturing and transport sectors were the top four contributors to greenhouse gas emissions in 2019. These accounted for over 72% of the total emissions for the UK.

Households remain the highest contributors to overall greenhouse gas emissions. Biomass heating can be one of the keys to support the government plans for 2050. When heating with wood, only as much carbon dioxide is released, when the wood fuel is burned as the tree absorbs while it is growing. Trees convert the CO2 from the atmosphere into carbon (C) for growth and oxygen (O2) for release into the air. All in all, wood burning is climate-neutral when the guidelines are observed.

John Legge, owner of JPL IT Training Limited, delivers Microsoft Excel training on behalf of the Chamber. Like many, the Chamber had to implement new ways to deliver training since face-to-face was not an option, the switch to online training courses allowed the Chamber to deliver their portfolio of courses to a whole new virtual world. When the pandemic first hit the country and the training delivered at the Chamber, they had to work with their external trainers and think on their feet quickly! As a business owner straight away, John investigated and quickly implemented virtual training using Webex video conference software. John says: “Webex is a simple tool which allows me to train Chamber members in

the various levels of Excel training which starts at Basic and goes up to Master Class Bronze. All that is required is a laptop with a webcam, set of speakers which can be built in and a good microphone. “Our courses are generally limited to 4 people to optimise the experience of the customer. I share my screen showing the Excel worksheet and topic we are focusing on and the trainee can if desired ask to share their screen also. “Many customers have engaged from their home office, living room or kitchen! It works so well as often the relaxed atmosphere of their own environment puts them at east plus my own relaxed informal style lends itself rally well to this type of training. If/when they go back into the office place, delegates can be trained from their own office just as well. The Chamber simulate team-based working by using breakout rooms where teams of two work together to affect a solution to an Excel problem. John added: “We have found that with Excel being such a popular course that many clients go through the levels with us on their learning journey, so they start with

ARRANGEMY TRAVEL HEADS IN BRIGHT NEW DIRECTION The past 18 months haven’t been an easy journey for business travel experts arrangeMY. But now there’s a lot of bright lights on the horizon, and one just happens to be AMBER. Karen Southern finds out more.

However, Nick’s natural ebullience shines through. “It’s a bit of a sucker punch,” he concedes, “but we’ll carry on regardless because everything that made us a great company in 2019 still applies today. “The four core pillars of our business are travel, accommodation, venue sourcing and our in-house IT provision which is unique to our industry. I believe we offer the best service in the industry backed up the best in the industry.

MD Nick Scott saw 95 per cent of business at his Worcester-based travel firm disappear at the start of the pandemic. Turnover was about to reach £35 million, “and then it was like someone turned the tap off.”

“Perhaps I didn’t appreciate the strength of our business before. You think that things are normal --- until they’re not! We’ve learned a lot of hard lessons along the way, but I think we are going to bounce out of this in quite a good place.”

All the hopes and dreams built up over 30 years of independent family trading looked set to be dashed. Thankfully, business confidence is picking up again, although there are lingering concerns over the latest COVID variant.

This rebound in confidence is partly down to the huge success of their flagship user management system, AMBER. This is turn came hot on the heels of a major contract win with the Construction Industry Training Board (CITB) to handle all the travel and training needs for its apprentices around the country. Nick explains: “CITB wanted a centralised database to co-ordinate all aspects of training and accommodation bookings for their 1500 students.

“AMBER basically revolutionised how they look after their apprentices, managing hundreds of courses across 30 colleges. In fact, it has saved so much in time and money that CITB have been able to streamline their whole administration process, and they have a new scheme called ‘Travel to Train’ that they want us to facilitate.”

Alex Ganderton is the in-house mastermind behind the new technology. He had just joined the IT team when he was tasked with helping to create AMBER. “An external company had built a platform that wasn’t quite right for our client needs so we basically rebuilt it from the ground up. “The system is easy to duplicate and flexible so that each client has a tailormade profile matching their specific travel, accommodation and training needs. We have over 1,000 business clients and having these efficient admin workflows mean our staff can focus on other productive tasks.” Nick is full of praise for the progress made by his young software and development manager in just three short years, saying “It’s pure luck we got him when his original university placement fell through. However, Alex responds with, “Credit where credit’s due. Some of my friends were shoved in a corner and given Excel data entries to do for nine months. “Here, I always had people to turn to for help. I also went out on the road with our business development manager, speaking to clients and building relationships with them. I did project management with the software team and learned new skills. “It was a good match for us both. arrangeMY wanted my knowledge and

they gave me a really good flexible working environment where I could try stuff out. “It’s great to be able to learn and improve myself and the company at the same time!” This caring, sharing attitude was integral to the family values laid down by Nick’s dad Simon, when he founded arrangeMY in 1990. These values are just as strong today, as Nick explains: “I’m really proud of our family roots. We have great people working with us who are aligned to our core values of caring, teamwork, respect, integrity and quality. “As a company, we had dark days during the pandemic, but we chose to protect jobs, and our staff know that we care about them, not just the bottom line. “Our business was decimated by COVID but there have been lots of positives. We genuinely care for our clients and they genuinely appreciate our work, even more than before. We’re a trusted partner, as our service levels show, and our clients know that we will help them in the best way we can.”

Caring was also apparent in the manner in which arrangeMY recently took over three other companies. Nick points out, “They weren’t hostile takeovers. We had acquaintances in the industry who approached us and said, for example, ‘Look I’m about to retire, you’re a good bunch, we’d like you to take on our business’.” The newcomers have proved to be a natural blend to our core business, so it’s been very beneficial all round!” And what about the future? Nick concludes, “Our business accommodation is actually now ahead of where we were in 2019, and things are slowly improving for travel and events. We’re looking to roll out AMBER in a similar vein for event sourcing and management, so if a client needs a bespoke booking platform or a check-in inventory system, we can look at that alongside our more standard booking solutions. PROTECT YOUR BUSINESS AND CUSTOMERS WITH CYBER ESSENTIALS Size really doesn’t matter when it comes to cybercrime. Whether you’re a sole trader or a multi-million-pound business, you should take basic steps to protect your money and reputation, as Matthew Parsons of Surf Tech IT, explains.

Cybercrime sounds like something out of a sci-fi movie, so many companies think it will never happen to them. In fact, the threat is very real – and growing – particularly for law firms committed to legal excellence, or other key sectors like finance and healthcare with access to sensitive client data. The UK’s legal sector alone is worth around £60bn per year, making it a very attractive target for cybercriminals. The most common security breaches involve phishing, hacking into business emails and systems, and ransomware. Some attacks target the firms, others directly target the clients during transactions. But simple steps can make all the difference, as Matthew, from award-winning IT services and solutions provider Surf Tech IT, points out. “It’s best practice for firms handling personal information or delivering certain IT products and services to have their information and security policy

in-line with Cyber Essentials. In fact, we have this accreditation ourselves! It’s a government-led scheme using five key technical controls (Boundary Firewalls, Secure Configuration, Access Control, Malware Protection and Patch Management) to reduce 80% of common cyber threats. “An online questionnaire helps pinpoint any weaknesses in your policies; for instance, you might need to use more complex passwords, choose different passwords for different processes, or update your IT systems. It’s bread and butter stuff really, but there is still a lot of complacency around.” All Lexcel accredited law firms are expected to achieve Cyber Essentials. Firms with the next level up, Cyber Essentials Plus (which is verified by an external body), are also recognised by the SRA as more likely to have good policies in place, and to have taken effective steps to protect themselves – and their clients – from costly breaches.

Matthew added: “Surf Tech IT is definitely not in the business of scaremongering, or pushing the hard sell, but businesses should be aware that cybercrime is on the rise, particularly now during the pandemic. In fact, businesses faced a 20% rise in cyber security threats in 2020 when compared to 2019. Even if your operating systems are only down for a day, it could

still cost thousands of pounds in revenue and reputation. “Just imagine getting a message saying your data is encrypted and demanding a Bitcoin ransom. Even if you pay up, there’s no guarantee you will get the decryption key. Or internal staff could be sent an email spoof pretending to be the MD or finance director, pushing for immediate payment of an invoice. “We see our role as educating business owners about the risks, and advising them on the best solutions for their needs. For example, any firm would fail Cyber Essentials instantly if they are still running Windows 7, or have old phone handsets which are no longer supported by the provider. We also set up tests to help staff spot fake communications.” Surf Tech IT, based in Stourport, has grown exponentially since launch in 2014, and recently won Micro Business of the Year at the Chamber Business Awards. PROTEUS INSTRUMENTS SCOOPS WORLD-FIRST FOR WATER INDUSTRY Small in size but big on innovation, the Proteus sensor has proved a game changer for the global water industry… and it all began in Bromsgrove. Academia’s loss was industry’s gain when Rob Stevens abandoned his PhD studies back in 1994. And he shows exceptional modesty by saying he “struck lucky” from then on. “I always had an affinity with water and rivers, but after doing my undergrad degree, I realised that job prospects in a recession didn’t look good, even with a PhD. So I went straight into industry,” Rob explained. Today, the RS Hydro group has a £5m turnover, a world-first under its belt, and several exciting new products in the pipeline. The world-first is of course the Proteus – the first (and only) water quality instrument on the market to accurately measure organic and microbial (bacterial) pollution in real time. And just as the Greek God Proteus protected waters in ancient times, his modern namesake is keeping track of water safety standards around the world today. Rob continued: “Usually water samples have to be taken for lab tests to see if they’re suitable for drinking, bathing and other environmental purposes, and this can take days. The Proteus measures data on the spot. “There isn’t a country in the world where this technology doesn’t apply, and the feedback has been truly amazing. Plus, overall costs, energy usage and general maintenance are much lower than analyser-based systems, and Proteus can be installed in almost any aquatic environment.

trials with water companies can be lengthy and repetitive. So we undertook several scientific papers to speed up the acceptance process which proves that Proteus can successfully classify 90% of samples into the correct bathing category in real-time. The papers include more evidence and science than we could have possibly achieved through trials.”

The story began in 2013, with a two-year knowledge transfer partnership between RS Hydro and the University of Birmingham. Proteus Instruments Ltd was formed in 2018 and production started the same year.

Now Proteus has a global network of distributors from New Zealand to India, with worldwide patents filed. Extensive trials have also been carried out with water companies around the world; in particular the company has worked closely with Severn Trent Water who now use the technology – a partnership that Rob is particularly proud of.

Rob pointed out: “We’re a small company with limited resources and time for marketing, so it took a while to build awareness. We knew there would be scepticism in the industry at first, and

Imagine taking that technology anywhere in the world to protect water wells in developed and developing economies. While many businesses have now re-opened their offices, a large number are adopting a hybrid way of working, where employees’ time is split between the office and remote working. Technology will therefore continue to play a huge role in day-to-day working. So which pandemic-driven trends are here to stay over the next 12 months and beyond? GOING GREEN – HAS THE GOVERNMENT USED TAX TO DRIVE THE RIGHT BEHAVIOURS, OR IS THIS A ‘COP’ OUT? If we are serious about combating climate change, then should taxation of business be evolved to encourage efforts to reduce carbon footprint and perhaps penalise those who do not – but is this currently the case? ELECTRIFICATION OF VEHICLE FLEETS Significant tax breaks are available for electric company cars, with extremely low benefit-in-kind rates and favourable corporation tax savings. They also carry no road fund license cost and electricity is not treated as fuel for benefit-in-kind purposes.

ENERGY EFFICIENCY OF BUILDINGS Capital allowances can be claimed on insulating existing buildings, but insulation of new builds is expected as standard, so no tax relief is given. Solar panels are

considered ‘special rate’ assets for capital allowances, so they do generally receive 100% allowances in a year, but don’t qualify for the 130% super-deduction currently available on P&M.

ENERGY EFFICIENCY OF PROCESSES If a scientific or technological advance is required which saves energy, improves yield, or reduces waste, then the project may qualify for generous Research & Development tax savings. However, simple changes which don’t involve an advance will not result in any savings.

CARBON OFFSETTING A popular option for businesses is to offset carbon – investing in schemes which reduce carbon dioxide in the atmosphere, for example tree planting. HMRC have not specifically allowed costs incurred for carbon offsetting, and generally anything that is not completely for the purpose of trade would not receive a tax deduction. In future it would hopefully be possible to argue that offsetting emissions is for the

benefit of the trade as it would allow the business to promote itself to its customers and employees.

£27 MILLION FOR FARMERS TO BOOST PRODUCTIVITY technology, with the potential to transform business performance. This strand will focus initially on water management with grants available to improve water use on farms for things like crops irrigation and constructing on-farm reservoirs. Farmers will benefit from a £27 million pot to adopt innovative new technology and invest in productivity-boosting equipment as the Farming Investment Fund opened on Tuesday 16 November. Farmers, foresters and growers from across England are urged to apply for grants to buy new equipment and infrastructure to help to improve efficiency and help us build back greener. This could include solar powered electric fences, water treatment systems that use ultraviolet light rather than chemicals and cameras for monitoring livestock. The fund will be split across two strands. Firstly, the Farming Equipment and Technology Fund will focus on smaller grants for equipment from a set list including electronic seeders and chemical-free disinfection systems. Secondly, the Farming Transformation Fund will cover more substantial

Eligible applicants involved in the production or processing of agricultural, horticultural or forestry products, who are based in England, can apply for a grant. Applicants are urged to make note of the differing deadlines for both strands of the fund. The deadline for Farming Equipment and Technology Fund is the 7 January 2022 at midday. The application portal, which includes the eligibility checker, for the Farming Transformation Fund will open from today until the 12 January 2022, with the deadline to complete full applications by 30 June 2022.

As we head towards the end of 2021, just as we all thought we would be heading into a new year with Covid all under control, the emergence of the new covid variant Omnicron, saw many countries closing their borders and the UK reactivating the red lists. With Christmas just around the corner, most of us just want to be able to enjoy this season without worrying about further restrictions from shopping to international travel. The Bank of England’s previous announcement that rates would be held at 0.1% sent quite a shock across the markets, and saw Sterling lose ground quite considerably. Was this a real shock or just a pricing correction based on the fact that markets had already priced in a rate hike, so when this did not materialise, they were left with no choice but to make the adjustment. The Bank of England Governor Andrew Bailey had made every effort to avoid hinting about the timing of the next interest rate mover. He told the Sunday Times that he never said there would be a rate hike in November. He then told the House of Lords that he was inclined to scrap forward guidance. Investors were left none the wiser and the rate outlook became muckier still following the news of the new covid variant! With inflation at a 10 year high of 4.2%, it is looking to remain persistently high for the

foreseeable future, an Interest rate hike was always likely. Meanwhile across the pond, the annual inflation rate in the US surged to 6.2% in October of 2021, the highest since November of 1990 and above forecasts of 5.8%. US interest rates remain at 0.25%. US Fed officials have signalled a possibility of a rate rise in 2022. The EU inflation rate also moved considerably to 2.43%, up from the previous year of 0.68%. The European Central Bank (ECB) will be one of the last major central banks to raise interest rates after the COVID-19 pandemic, according to a Reuters poll of economists, who still say the risk is a rate rise comes sooner than their current prediction of 2024. Interest rates remain at 0.0%, while deposits remain at -0.5%. While the ECB has said the recent inflation surge will be transitory and has clearly indicated no policy tightening until it averages around its 2% target, financial markets are pricing in a hike later next year. So what does this mean for the currency markets? Throughout 2021, we have seen Sterling move 10 cents against both the USD and the EUR. GBP/EUR has moved from 1.0920 to 1.1931, and GBP/USD has moved from $1.3227 to $1.4226. For a business importing $1m over the last year, Sterling has moved £53,090, a massive swing which can have a huge knock on effect if foreign exchange is not managed effectively.

Whilst the ranges are huge between the highs and the lows, and are only forecasts, the point here is banks cannot agree of where Sterling may or may not be throughout the year, but the risk to businesses continues. Managing your FX is a key factor, and if there is one thing that businesses do not want at the moment, is any more uncertainty, especially as far as costs are concerned. Locking in costs, securing margin and profits is one area that business can do very easily. LOOKING AHEAD AT THE CHANGES FOR IMPORT PROCEDURES COMING INTO PLAY IN JANUARY 2022 Declaration Import (SDI) submitted by the 4th working day of the month following the month in which the goods were imported. In addition, a Final Supplementary Declaration (FSD) will need to be submitted to HMRC, this is a message confirming the number of SDI submissions that month. Customs entries made into declarants’ records (EIDR) will also cease in the present import easement form, unless approved to use EIDR within a CFSP authorisation. So, from January 1, the procedure for imports, where declarations are made into declarants’ commercial records, will need to be supported by the appropriate HMRC authorisation. The authorisation applications will incur HMRC processing time. If your business has received imported goods without the evidence of an import declaration, it is crucial that your business investigates and takes appropriate action.

UK businesses involved in international trade have had to manage a lot of change over the last year. For those expressly involved with moving goods between the EU and the UK, this change continues to evolve, and businesses will need to keep pace and be compliant. The latest Border Operating Model (HMRC published data on the functioning of the UK EU border) was published by HMRC on 18th November 2021. This release is likely to be the final amendment for 2021, so it will be important to find time to keep up to date with on-going releases of HMRC border related guidance published on the UK Government website, into the new year, and beyond. For businesses and those involved with the planning and physical movement of the goods need certainty so, further evolving changes to processes may prove challenging to manage in daily working practice. The biggest impact will be on UK imports, where import easements (or staged import controls) in place now, will cease and full UK import controls come into force on January 1 2022. So as an importer, what changes might affect you and your business in the new year?

What is vital to understand in the first instance is: Import declarations will be required when goods physically arrive into GB from EU member states 1st January 2022. The import easements that have been in place for 2021 that permitted import declarations to be made later (within 175 days of physical arrival) will stop. Arrivals into GB from the Republic of Ireland and Northern Ireland will continue under the present easement conditions into the new year until HMRC advise further. The EU UK Trade Cooperation Agreement will not negate the requirement for customs measures at the border. Goods Vehicle Movement Service - Go Live GB-EU, EU-GB January 2022.

IMPORT EASEMENTS Businesses that have been using the delayed declaration easement at import, where top level data is submitted to HMRC at import, with 175 days to make the Supplementary Declaration Import (SDI), will need to consider reverting to the non-easement process. Only companies specifically approved to use the Simplified Customs Declaration Procedures (SCDP), also known as CFSP, will be able to bring goods into GB without a full customs declaration. A Simplified Frontier Declaration (SFD) will be needed at arrival with the supporting Supplementary

VAT needed to be calculated at the time of the arrival of the goods and declared within the VAT return relating to the date of that import. This has proven challenging for businesses using the easements unless appropriate VAT import measures have been implemented within its financial business process. If import VAT has not been provisioned at import within 2021 or declared on the VAT return for the period covering the imported goods receipt into the UK, the business should investigate and seek appropriate guidance. Traders involved in the supply and import of Products of Animal Origin, Phytosanitary, and Sanitary goods will need to keep abreast of the revised import timetable and any updates that are expected to be announced as measures progress. SERIOUS HMRC DELAYS IN PROCESSING VAT GROUP APPLICATIONS There are serious delays at HM Revenue & Customs (HMRC) in processing VAT group applications and amendments, and it shows no signs of easing. The lead time is now around 6 months, based on Bishop Fleming’s experience and the feedback around the industry when contacting HMRC for an update. The message from HMRC is that it is working on a large backlog of applications and is currently only at applications received in May 2021. The rules say that where a valid VAT group application is made and received by HMRC on or before the requested date, unless HMRC reject it for revenue protection or VAT avoidance purposes, the VAT grouping should take effect from the requested date. However, this often doesn’t provide sufficient certainty for taxpayers, particularly in particular circumstances. Unfortunately, there doesn’t appear to be a means to expedite the process, such as an emergency contact at HMRC etc, and calls are met with the same response about the backlog. Tax specialists Bishop Fleming are suggesting to consider alternative solutions such as transfer of a business as a going concern (TOGCs), single online VAT registrations (although these can take a while as well), and to discuss with them practical steps to manage risk on a case-by-case basis. NEW CYBER CENTRE SECURES TWO COVETED CONSTRUCTION AWARDS The new Cyber Quarter – Midlands Centre for Cyber Security building based in Herefordshire has secured two coveted top prizes at the Constructing Excellence West Midlands Awards 2021. The centre is a joint venture between the University of Wolverhampton and Herefordshire Council and part-funded by the Government’s Local Growth Fund, via the Marches Local Enterprise Partnership (LEP) and the European Regional Development Fund (ERDF). The project scooped the Building Project of the Year Award as well as being announced joint winners for the Integration & Collaborative Working Award at the

ceremony held in Edgbaston recently. The centre, which secured £2.82m of funding via the Marches LEP’s Growth Deal with government in 2017, is part of the new Cyber Quarter at Skylon Park, already home to numerous defence and security sector businesses. POSTCARDS FROM LIFE – ST MICHAEL’S HOSPICE

St Michael’s Hospice is in the frame to receive almost £9,000 following an online art auction. More than 250 mini masterpieces went under the hammer during Postcards from Life, an annual fundraiser for the Bartestree-based Hospice. Each year, some of the region’s best artists produce postcard-sized art which is auctioned off through Leominster-based Brightwells’ website. They do this completely free of charge, donating their time and effort in producing these one-off works of art to support of St Michael’s. Almost 2,800 bids were placed during the latest auction, with the most successful lot being Valerie Whittaker’s entry which sold for £305. The mixed media on cotton paper was called ‘They took some honey’, which was inspired by the famous Edward Lear poem ‘The Owl and the Pussy-Cat’. “We’d like to thank everyone who took the time to bid on the wonderful array of art during this year’s Postcards from Life,” said the Hospice’s Chief Executive, Mike Keel. “Those successful bidders have secured themselves artwork which will brighten any room. “At the same time, their generosity is helping families in our community who are living with a terminal illness. “We hope that every time our supporters glance up at their artwork, they’ll be reminded of how much they’ve helped their Hospice. “As always we’re incredibly grateful to the artists for producing such fabulous work, and to Brightwells for their support in hosting the online bidding platform.” www.st-michaels-hospice.org.uk Artist Michael Dent

BROMSGROVE LAW FIRM ANNOUNCES LINK UP WITH LOCAL HOSPICE A Bromsgrove law firm is set to support a local hospice for the next 12 months as part of a new charity partnership. Staff at mfg Solicitors have voted for Primrose Hospice to be its local charity for the next year with a variety of events planned to support fundraising for people living with life-limiting illnesses and their families and loved ones. The new link-up kicked off with a fun ‘Primrose Day’ event at the firm’s High Street office which saw staff raising £230 by selling homemade cupcakes and hosting a raffle – all based on a Primrose Hospice yellow theme. Abi Coulson, Corporate Fundraiser from Primrose Hospice, said: “We really were delighted when we heard we had been chosen by mfg’s staff in Bromsgrove. “The team at mfg are already working hard to help us raise much-needed funds and I was also pleased to attend the recent Primrose Day to give a little more insight into what we do and how

fundraising money is spent. We can’t thank everyone at the firm enough and look forward to getting involved in all the fantastic ideas they have planned.” Throughout the year staff at mfg Solicitors will be hosting a wide range of events including dress down days, a netball tournament, regular raffles and book sales to raise money. A variety of Christmas events were also planned during the festive season, which included donations of chocolate selection boxes. The charity relies heavily on voluntary donations. It offers day therapy, occupational therapy and physiotherapy, alongside its Family Support Centre which provides bereavement and counselling support to families, loved ones and children in the local community. www.primrosehospice.org

WHY DOING GOOD MAKES GOOD BUSINESS SENSE The Little Princess Trust is a charity based in the centre of Hereford that provides real hair wigs for children and younger people undergoing cancer treatment where they are experiencing the devastating effects of losing their hair. As a result they have now supplied over 8,000 wigs and have invested around £5m into ground breaking childhood cancer research. The charity is based at the recently launched Hannah Tarplee building in Hereford City Centre. When they were designing the Hannah Tarplee building they wanted to make sure that the power they use is renewable and reduces their impact on the environment. Phil Brace, the CEO at Little Princess Trust approached Caplor Energy for advice and support in installing a suitable solar PV system that would not only meet their climate concerns, but also provide the necessary financial benefits for the charity.

MS DYNAMICS 365 HAS TIGHT INTEGRATION WITH OFFICE 365

CAN THE PROPERTY INDUSTRY ‘GO GREENER’? Following COP26, and recent reporting from the UK Green Building Council that the built environment sector is contributing around 40% of the UK’s total carbon footprint, unsurprisingly those involved in the property industry are wondering how can we go greener. The tide is changing on the perception of ‘green leases’ and whilst there is no industry standard, the property industry is experiencing an increase in negotiating commercial lease terms to align with businesses running in a more environmentally friendly and sustainable way. The prevailing message is ‘collaboration is key’ to promote sustainability. Working together means that we can come up with fresh ideas for a greener property future. Laura Moore, Commercial Property Solicitor at mfg Solicitors, suggests If you’re about to negotiate a new lease, ‘green’ provisions should form part of the negotiations. Some existing leases may already include ‘green’ provisions and as every lease is different the terms should be reviewed carefully. If in doubt expert legal advice should be sought. The Teams app is also part of Office 365, and became invaluable to us all during the pandemic. Any data transmitted via the app, e.g. documents, will be security protected under the MS Dynamics 365 hub too, so you are protected from Malware and other risks factors that affect email. Using MS Dynamics 365 and Office 365 in the cloud-based environment takes advantage of the tight integration that they have, and enables hybrid working, as you can work from anywhere, and across all media devices. If you have a legacy CRM platform or use a sector specific web platform, these can invariably be integrated with MS Dynamics 365 too, so Dynamics acts as a hub. CYBER ESSENTIALS: HOW BUSINESSES CAN PROTECT THEMSELVES AGAINST CYBER CRIME

CYBER SECURITY RISKS Cyber crime is at an all-time high due to the huge increase in uptake of different technologies during the pandemic. Businesses across all sectors are increasing their spend on tech and modernising their IT infrastructure, whether they are late adopters trying to ensure they keep up with the competition or innovators making waves in the technology arena. With this, though, comes a much increased level of threat in terms of cyber security. Organisations should ensure that all of their systems are fully protected so that hackers, phishers and cyber attacks cannot access and compromise their vital data. Simple viruses such as malware can attack a business’ entire IT network, something which can occur as easily as by something as simple as a network user clicking on a dodgy link or opening a suspect email.

WHAT IS CYBER ESSENTIALS? Cyber Essentials is an excellent first step for businesses who wish to become certified as cyber secure. It is a government-recognised accreditation which proves that Cyber Essentials certified businesses have a good base level of cyber security. The self-certification process which requires the business to fill out a questionnaire on their current cyber security provisions. It is necessary for businesses to provide any supporting

documents to prove that the measures they have in place satisfy the criteria of the accreditation. Therefore, it is important that organisations ensure that their practices are up to the correct standard before taking the questionnaire in order to pass straight away. Some companies may need to carry out a bit of a security overhaul in order to ensure that they are Cyber Essentials accreditation-ready. Once an organisation has achieved Cyber Essentials certification, they can apply for Cyber Essentials Plus, which is a more advanced level of accreditation, involving a comprehensive assessment of their cyber security by an external certifying body. This provides businesses with an extra level of assurance through the external testing of your cyber security provision.
