By Rhonda Van Pelt City Council members and Manitou Springs Urban Renewal Authority board members gathered Tuesday, Aug. 23, to clarify the future of the URA, an entity formed 16 years ago to improve Manitou Avenue properties between the U.S. Highway 24 overpass and the eastern city limit. After nearly two hours of presentations and discussion, City Council voted 4-3 to stop the flow of sales tax revenue to the URA from its area, an estimated $1.7 million annually. Councilors said they need the funds to address the city’s many capital needs. The action does not affect property tax revenue, a far smaller amount, also going to the URA. It also does not take away any funds already in the URA’s account. The evening’s first focus was plans for the La Fun motel property at 123 Manitou Ave. The city pulled the owner’s business license after it was troublesome, to say the least, for the Manitou Springs Police Department.

As URA Executive Director Jim Rees explained, the developer first would have to mitigate an unknown amount of asbestos in the building before demolition can start, likely in April 2023. Construction — of a mix of retail, restaurants or something else — could then take two years.

“The URA does not have any obligations regarding construction and the new facilities, so it’s probably a $5 million investment on the part of the developer,” Rees said.

The URA board was poised to close a deal with a developer on Friday, Aug. 26. However, City Councilors expressed concerns that the developer doesn’t have detailed, firm plans for the site. This is part of a larger concern that councilors have been grappling with: What happens to Manitou’s sales tax revenues if Colorado Springs voters approve recreational marijuana during the November election?

“I don’t see that the URA has much leverage on this project,” Graham said.

Rees affirmed that interpretation was correct.

Councilor Judith Chandler said that, after reviewing the contract and watching the video of the URA’s meeting when it approved the deal, “I do believe this is a sweetheart of a deal for the developer.”“Thisis a plan in search of a plan. If the developer had come with a more definitive plan, I might be a little bit more reassured,” she said.

Councilor Julie Wolfe asked what would happen when the URA sunsets in nine years.

URA board president Debra Sagen explained that the board isn’t willing to spend money it doesn’t have, and has carefully redevelopmentconsideredactivities.“Weknowwe’llsunset in nine years with this current district configuration. We want to end with a zero balance, frankly. So the way to do that is to redevelop appropriately under the Colorado state statute” that governs URAs, Sagen said.

Fortuin also applauded the URA board’s efforts

“I just think it’s premature to make any decisions right now,” Fortuin said in agreement.

After participants discussed estimates of the potential sales tax revenues from retail businesses on the site, Councilor Nancy Fortuin expressed her appreciation for the worst-case scenarios.

The former Manitou mayor continued: “Our mission is not to make investments that have a positive rate of return, or any kind of real return other than to accomplish our stated mission, which is to foster redevelopment to expand the tax base of the city. And that’s really what I believe this project is a perfect example of. … There is no downside for the city.”

“And when the Urban Renewal Authority expires, all of that tax revenue will go to the city or the county or the property-taxing authority. So the URA is perfectly content not to get paid back.”

The second goal: “To create and foster and encourage and support redevelopment of the URA into enterprises and projects that will have a long-term benefit to the city of Manitou Springs.”

“I think the potential here is much more likely that the city will benefit greatly, that this could be another catalyst for further development.”

City Council and URA board members discussed the pros and cons of using the property as a parking lot, then circled back to potential falling revenues from decreased recreational marijuana sales.Shada pointed out that the URA receives a “pretty big chunk” of tax revenue but encompasses only about 2.5 percent of the city’s total acreage.

Mayor John Graham summarized the La Fun purchase details as follows:

“I think there are better ways in our community that we can spend this money, OK?” he said.

The URA board has spent approximately one year studying plans and proposals to demolish the derelict structure and replace it with something that would generate sales tax for the city.

Snyder remarked that the east end of Manitou Avenue has been neglected for decades. Despite their urging, City Council voted to cut off future sales tax revenues going to the URA’s account, at least indefinitely. It will still honor any pending obligations and contracts.

“What happens with the rest of the money that is owed to the URA, assuming it’s not completely paid back by then? Does it revert to the city or does the developer not have to reimburse it?” she asked.

“But I would suggest that investment, by definition, is a risk on both sides. And we have lived without much development in that corridor for many, many years. If we do lose marijuana money, we need alternative sources of tax revenue,” she said.

Graham asked if the developer could delay building on the site, leaving it an empty lot for years.

Mayor Pro Tem John Shada questioned the board’s authority over what the developer proposes. Neville replied that, although the board reviews plans, ultimately, the city reviews and approves them. “So if the developer submitted some drawing on the back of a napkin, that would be for your review. If you didn’t like it, what could you do?” Shada asked. Rees reiterated that the city has ultimate authori ty over plans and the URA board does not.

“With the full retail development, it could possibly generate up to $3 million over the rest of the URA lifetime (of nine more years) in sales tax and property tax,” Rees said, adding that the developer would have to attract tenants. One option would be a grocery store, which could take up the entire 2.2-acre property, or 17,000 square feet of retail and 8,000 square feet of restaurant space, he said.

Neville pointed out that being paid back is not the URA’s mission or the project goal.

“It’s to get the La Fun motel off the site, fully remediated, and a new commercial development installed. And so from there you have tax reve nue-generating development,” the attorney said.

Councilors Wolfe, Shada, Graham and Chandler favored the action, and Johnson, Fortuin and Michelle Whetherhult opposed it. City Council will not meet next week, since it’s the fifth Tuesday of the month.

According to a document dated June 30, 2022, which council members saw, the URA has assets of $2,841,132. Those funds are intended to support development and improvements, such as bridges and public art, in the URA area.

“I feel like this conversation that we’re having today should have happened either six months ago, or in January of next year. I think that we have not figured out our budget for next year,” she said.

“The developer is not interested in holding a vacant lot; they’re interested in getting it built. But they’re cautious and wary about market conditions,” said the URA’s attorney, David Neville. Rees explained that he’s researched a couple of scenarios drawing from the developer’s proposal.

“I believe the La Fun is the most blighted property within our URA right now. So I think we accomplished that with this project,” he said.

It is anticipated that preliminary plans and a project estimate will be ready for the URA Board to include funding of improvements in its 2023 budget.

The URA has been working on several projects to increase pedestrian safety and connectivity. A study is underway to evaluate the Manitou Avenue/ Highway 24 interchange to make a safe pedestrian connection from where the Westside Avenue Action Plan work stopped, through the intersec tion, to facilitate a safe sidewalk connecting to Schryver Park.

Additional improvements could include un der-grounding of overhead power lines, landscaping and formalization of on-street parking.

Another streetscape improvement is being considered for the south side of El Paso Boulevard along the School District 14 property. Improvements could include a sidewalk to connect the Beckers Lane intersection to the gravel path that runs along the east side of the ball fields and connects to the Midland Trail/Creek Path.

Energy-efficiency rebates available for Manitou Springs homes

In partnership with the Housing Advisory Board, the city’s Planning Department is providing $10,000 in funding toward the Energy Efficiency Rebate Program, which will give rebates to homeowners or residents via their water bills. The funds can pay for insulation, air sealing, heat pumps, water heaters, high-effi ciency toilets and irrigation equipment. This program will continue through the end of 2022, or until the budgeted amount runs out.

The Manitou Springs Urban Renewal Authority (URA) oversees an area generally located north of Highway 24 on both sides of Manitou Avenue from the east gateway arch to the U.S. Highway 24 interchange. City Council created it in 2006 with goals of removing blight and encouraging development and redevelopment. By realizing these goals, the city’s tax base will increase, benefitting all residents. Although substantial work has been done along Manitou Avenue through the URA, more work needs to be done.

Currently, pedestrians can access the trail along Fountain Creek at Adams Crossing, Beckers Lane and Schryver Park. Acquisition of easements for a bridge connection west of Adams Mountain Café is underway, and the bridge can be installed once engineering design is completed.Asecond bridge location near the former car wash, on the north side of the 100 block of Manitou Avenue, is also envisioned in conjunction with redeveloping the car wash site.

A recent Creative District survey has indicated a strong preference for additional art in the corridor and beautification of Manitou Avenue through the URA. Look for two new sculptures within the URA area in the coming months. This year, Jodie Bliss’ “Spirit of Manitou” sculpture will be relocated from near the Lulu’s entrance, in the 100 block of Manitou Avenue, to a more visible site at the Holiday Inn. A pilot project will put an artist-created vinyl wrap on a utility box in the corridor, adding color and interest. The Marcy Morrison Bridge on Beckers Lane will be decorated with glass panels selected through community review and engagement. The panels will be installed in spring 2023 after fabrication.TheURA has funded a Pike Ride station that will help promote mobility alternatives, a City Council priority. A new location near Lulu’s will soon be in place. Two other potential Pike Ride stations are being investigated, to be located near the two proposed bridges linking Manitou Avenue to the Midland Trail/Creek Path. The URA board has entered into an agreement with a developer who will be required to remove the La Fun motel at 123 Manitou Ave. Demolition of the motel will prepare the site for development of a tax-producing enterprise; removal of this blighted structure has been a city and URA priority.Take a walk through the URA and look for these changes in the coming months! Potential applicants must apply for a property improvement permit and have receipts of purchased equipment. Residents can retroactively apply for a rebate, as long as they follow the above rules and the fixture was purchased and installed on or after Jan. 1, 2022.

Now, though, the URA board won’t have more funds to help entice such businesses, which is why a middle-ground strategy would have made more sense.Instead, some on City Council thought a better use of the La Fun property would be as a parking lot to benefit downtown, the Cog and the Manitou Incline. Nobody seemed to realize how many months such a lot would sit empty — unused, unproductive and unappealing.

Whereas retail businesses would operate year-round for the benefit of Manitou residents. It was as if someone had enacted a moratorium on common sense judgment. As one URA board member said after the Tuesday vote, “It was like watching a train wreck and knowing there was absolutely nothing logical or reasonable that might sway them. It was stunning.”

Never mind that the URA board includes some of Manitou’s most influ ential, qualified people of the past generation, including two former mayors and the owner of a prominent local small business: Marcy Morrison, state Rep. Marc Snyder, Farley McDonough (Adam’s Mountain Café), Ann Nichols, Barb Winter, Debra Sagen, John Maynard, Alan Gregory and Alan Delwiche. Should such a decision have waited until November, when Colorado Springs votes whether to legalize recreational marijuana sales? Yes. Should City Council have decided, now or in the upcoming 2023 budget process, to consider reworking its terms with the URA? Yes. Should the majority of councilors have given more thought to the ramifications of severely undercutting their own URA? Yes. Is there anything that Manitou Springs residents can do about it? Not now.

The best solution seemed obvious: City Council and the URA board could work out a new agreement, giving a larger share of sales tax revenue to the city but still allowing the URA to pursue its mission. Instead, four City Councilors wanted to take all URA sales tax funding. Until the city attorney recently advised otherwise, those councilors seemed hellbent on eliminating the URA altogether. That didn’t happen, but council’s 4-3 vote did chop off the URA’s legs. And the timing couldn’t be worse, just as the URA is finalizing a deal — in the works for almost a year — with a developer to buy the dilapidated La Fun motel property and revitalize it for business purposes.

Pikes Peak Bulletin 5August 25, 2022 If you ever need a textbook example of how small-town local government should NOT work, look no further than August 2022 right here in ManitouTuesdaySprings.night at Memorial Hall, the Manitou Springs City Council put the final touch on this chaotic month, voting to cut off sales tax funding to the Manitou Springs Urban Renewal Authority. The 4-3 decision, so clearly pre-orchestrated, did not have to happen so quickly and so vindictive ly. There was no immediate deadline looming, no reason to schedule a special meeting with nothing else on the agenda. Just a few weeks ago, a group of determined councilors thought they would have to go through a November ballot issue to achieve their desired outcome. After learning differently, they changed their plan to a surgical strike and pulled it off in a combined council-URA meeting that started out as an executive session and then was made public, allowing for immediate action. This is a difficult subject to tackle in print, because so many people know so little about the Urban Renewal Authority. Let’s try for a quick explanation. In simple terms, a URA is created to focus on economic development and revitalization in a specific, often blighted, area of a city. URAs are funded by sales tax revenue within that area, as has been the case since 2006 for Manitou’s URA, located between the eastern gateway arch and the U.S. Highway 24 interchange. Certainly, the URA hit the jackpot when recreational marijuana sales won approval in Manitou, with El Paso County’s only stores located within the URA’s boundaries. Suddenly, that tax revenue became a bonanza, now bringing about $1.7 million a year to the URA. Anyone can see how that money has largely been spent, from the new Beckers Lane Bridge to helping fund the county-led project to improve Manitou Avenue/Colorado Avenue. Residents and visitors also have noticed and appreciated the holiday lights, public art and other enhancements. But then some on City Council became frustrated — understandably so — because they faced such a hefty list of capital needs with insufficient funds (about $2.6 million currently) while the URA built a comparable amount in its own bank account.

Fearing it might be abolished and existing funds taken away, the URA board hastily signed that agreement for the La Fun, with closing set for next week. If all goes well, it could lead to some kind of grocery (Natural Grocers or similar) and restaurants, all of which would provide fresh sources of tax revenue at a time when most marijuana taxes might be going away.

At this time, they’re likely to forage for human food, trash and fruit trees in urban areas. Their instinct to eat can overcome any fear of humans.

All comments received will be available on the PPACG website after the public comment period. Staff and the PPACG Board of Directors will use the comments during the approval process.

They can sniff out potential food sources as much as five miles away. Barbeque grills, unsecured trash and pet food can lure them into cities. They have been able to open car doors when searching for food. Manitou Springs has a strict policy about wildlife-resistant trash receptacles and their use.

Be smart about bears — they’re hunting for food

El Paso County still ranks fourth among Colorado’s most populous counties, with 243 deaths per 100,000 people. The Pikes Peak Area Council of Governments has developed a draft study to assess existing electric vehicle charging assets within its Metropolitan Planning Organization and Council of Governments boundaries and provide resources for local entities that may pursue EV charging projects in the future. This effort is intended to assist those member jurisdictions or local entities that voluntarily decide to seek EV grants.

El Paso County has experienced 202,632 total cases, 8,321 hospitalizations and 1,773 deaths between March 1, 2020, and Tuesday, Aug. 23, 2022, according to the El Paso County Public Health Department.Inthetwo weeks leading up to Tuesday, we’ve seen 1,535 cases, 29 hospitalizations and one death.

Manitou Springs is one of the PPACG member municipalities and has several charging stations.

The county’s coronavirus cases hit an all-time high on Jan. 14, 2022, with 2,789 cases; they have steadily declined since then, other than a surge to 350 cases on June 9 of this year.

Bears are about to get very active in Colorado, prompting the state Parks and Wildlife Department to warn the public that bears are entering hyperphagia. That’s when they’ll spend about 20 hours per day searching for food, so they can consume up to 20,000 calories to prepare for hibernating this winter.

The annual celebration of original fine art and contemporary crafts will take place in Manitou Springs Memorial Park for its 48th year. This family-friendly juried art festival features something for everyone: great art shopping, tasty food, original music, art-related activities for kids and more. Hours are 10 a.m.-5 p.m. Sept. 3, 4 and 5; Memorial Park is in the 500 block of Manitou Avenue. Admission is always free. Many favorite artists from past years are returning, as well as some exciting new artists. Sculptors, jewelers, potters, photographers, glass artists, painters and more are coming from all over Colorado and neighboring states to share their creations with art-appreciating visitors. Art lovers can meet the artists and talk to them about their work before taking home something unique — or find the perfect holiday gift. Kids can watch balloon creatures appear with a few twists or create giant bubbles at the Millibo Art Theatre booth. Those are numbers, for both players, that should improve this season. A non-league slate of games that includes Rye, Valley, Rocky Ford and Prospect Ridge Academy gives Manitou a good chance of heading into league play with a winningWhatrecord.hasreally helped the team is understanding how Jeck operates as a coach, which has helped the players feel like they have progressed much further in the early practices of the season than they had at the same point a year ago.

The Mustangs start the season hosting Dolores Huerta in a non-league game on Thursday, Aug. 25, and then head to Gunnison on Saturday.

What helps in figuring that out is that Evan Yount is a year older and will embrace more of a leadership role this season. He was second on the team last year, with seven goals scored, and led the Mustangs with eight assists. Mack will certainly lean on him when games begin this week, but Yount also knows that he will play an important role in the Mustangs success this season. And he knows that his teammates will have to take on bigger roles than they were used to a year ago. “We have guys that need to step into key roles,” Yount said. “I think they’re fully capable of it and we’re looking at playing at a high level this Theyear.”Mustangs missed out on the postseason last year, a year after winning their first Tri-Peaks championship. Luke Donegan will take on the role of a senior leader this season and Deric French will provide a new face at goalie for the season. This team has a mix of experience from a large junior class and youth, considering the roster has just one senior. Reaching the postseason is the ultimate goal and, with the group Mack has in front of him, it will be fun to coach them up and push them to reach that goal.

The Mustangs bring a lot of positive attributes into the season, including experience, organization and motivation. If they can put it all together, Jeck and the players hope this season can serve as a launching point for a resurgence of Manitou Springs football.

The Mustangs are a junior-heavy team coming into the 2022 fall season, but Mack and the players still have high expectations for what they can “Theaccomplish.goalis always the playoffs,” Mack said. “If we can make the playoffs, that would be great. That’s the goal every year.

“I like challenges, period,” Mack said. “Some years are more challenging than others, but I love having a young team. You get the chance to work with them. You have players coming in knowing that they’re going to make up the core for two or three years, which is nice.”

“They’re a lot higher this year with more people having experience on varsity,” Gentzel said. “We’re expecting a lot more mature and stronger players that want to get better.”

Perhaps one of the biggest signs that the team is heading in the right direction is the number of participants the team has this year — specifically, the number of underclass men coming out to play.

“I’m very pleased with our underclassmen numbers,” Jeck said. ‘Our two biggest classes are our sophomores and freshmen. “That says a couple things. It says that football is growing in Manitou and the kids want to be a part of something that is great and also it’s there to build your future.”

“With last season being his first as head coach, I just feel like we weren’t as organized as we are now,” Maloney said. “We’re more organized as a team, during practice and everything. We know where everyone is and what everyone is doing.”

Challenges ahead for young Manitou boys soccer team

The prospect of development is nice to see, but there is certainly work to be done this season. The Mustangs have a lot of skilled players coming back, especially on the offensive side.

“I know we have some tough teams. Atlas is tough, James Irwin is tough. We’d love to win a conference championship, that’s a goal as well. We’re still trying to figure out how realistic some of those goals are.”

Senior Kai Thomas shot 101, sophomore Landon Foster shot a 113 and sophomore Jameson Cunning ham rounded out the Manitou effort with a 126.

The Manitou Springs boys golfers got that chance on Aug. 22, when they played at the Sand Creek Invite at Val ley Hi Golf Course. Junior Jack Clifford put together the Mustangs’ best round, shooting a 14-over-par 86 to tie for 36th. He had rough moments, for sure, playing his first five holes at eight over par, but was able to settle in and end his day on an encouraging note. He made birdie on the par-five 17th and then consecutive pars on six and seven to close out his day (he started on No.“I’d8).say that’s a really good start,” Clifford said. “I did not think that I was going to break 90 today. My drives were really good. They went far and straight. My chipping was OK.”

Law firm offers scholarships for high school seniors

The Manitou Springs volleyball is season is off to a rough start after Fowler swept the Mustangs in the season opener on Tuesday, Aug. 23. Ayla Flett led the offensive attack with six kills, but there wasn’t enough offense overall to hang with the Grizzlies. The Mustangs lost 25-16, 25-17, 25-11. Grace Allen led the Mustangs with 14 digs, Flett added 13 and Lily Glass added 11. The Mustangs will look to build on those numbers this week as they hope to prevent two straight losses to start the season. They’re hosting Pueblo Central on Thursday, Aug. 25, then Pueblo East on Tuesday, Aug. 30, before hitting the road to face Lutheran on Sept. 1.

“We need to put a lot of emphasis on chipping and putting and not just going down to the range and hitting balls,” coach Ken Vecchio said. “We don’t have a lot of time this week, but after (playing in two more tournaments) we have a whole week before we play again so we can try and work on some of those shortcomings.”

Volunteers are needed to help artists set up and take down their booths and to help throughout the festival in its waste-wise efforts. Aug. 15 At 0700 hours, found property was turned in at the Manitou Springs Police Station. In the 100 block of Manitou Avenue, MSPD officers located a man wanted on 13 warrants, including felonies, in El Paso County. He was arrested and transported to the El Paso County Criminal Justice Center; he also was in possession of a stolen vehicle.

Aug. 16 Officers stopped a suspicious vehicle in the 500 block of El Paso Boulevard. They observed drug paraphernalia inside it and detained the driver. While searching the vehicle, the officers located a felony quantity of amphetamines and booked the driver into CJC. At 0833 hours, MSPD contacted a transient person trespassing in the 3100 block of West Colorado Avenue and took the suspect into custody for a local misdemeanor warrant. A man approached officers patrolling the 3100 block of West Colorado Avenue and was arrested for interfering with them. People talking about and using illicit narcotics were reported in the 500 block of El Paso Boulevard. One caller also mentioned a possible firearm. The suspects were located in a nearby park and were observed using methamphetamine. They were identified, cited and released. No firearm was located.

Aug. 17 MSPD determined that a suspect had provided false information to multiple officers during contacts regarding criminal matters in the 100 block of Manitou Avenue. Officers took a case report about a cold criminal trespass (auto) in the 300 block of Beckers Lane. No suspect information is available. At 1455 hours, MSPD contacted a person illegally camping in Soda Springs Park, 1000 block of Manitou Avenue. The suspect was found to have an out-of-county felony warrant; she was taken into custody and booked into CJC. An assault in progress on Park Avenue was reported, and officers found two men fighting. After investigating, they arrested one for assault and property damage. Officers stopped a vehicle in the 300 block of Manitou Avenue. The driver was found to be under the influence of alcohol and was cited for DUI. Aug. 18 MSPD received reports of a burglary at the city’s Water Treatment Plant. Officers investigated the incident and cleared it. Aug. 19 At 1933 hours, someone turned in a cell phone found in the 600 block of Ruxton Avenue. It has been placed in safekeeping. Officers were dispatched to a motel in the 00 block of Manitou Avenue at 2350 hours; a possible domestic violence incident had been reported. After speaking to witnesses, the officers determined that it was a verbal argument only. Aug. 20 Manitou officers responded to a traffic accident with injury at westbound U.S. Highway 24 and Cliff Road. When they arrived on scene, they investigated and took a report.

Matthew Barton, another former MSHS teacher accused of sexual assault on a student, is scheduled to appear at a hearing on Friday, Sept. 16. A pre-trial readiness conference is scheduled for Tuesday, Oct. 4, and his jury trial is set to start Monday, Oct. 10.

Crews from the Manitou Springs and Colorado Springs fire departments responded to Cave of the Winds, north of Manitou Springs, on Friday, Aug. 19, after receiving reports that woman was injured inside of the cave.

The 20-year-old woman fell around 100 yards into a cave tour, and suffered a possible head injury. Crews safely evacuated the woman and she was able to walk out with assistance. No further informa tion about her condition is available.

Council prioritizes planning, zoning goals By Jack Elder City Finance Director Mike Leslie reported to City Council at Tuesday’s work session that there was approximately $32,000 available for implementing changes in the zoning code and related public processes for 2005. The recommendations submitted by consultant HB&A were itemized and came with the cost of each item included. HB&A will be contracted to perform the work of revising the code and establishing revised processes so the recommendations also served as a de facto bid on each item even though the firm’s involvement to date eliminates the requirement for a new bidding process. The 12 items on the HB&A list total nearly $91,000. HB&A also indicated several, mostly procedural changes, that can contribute to more efficient and less contentious process that can be implemented in-house at no cost. Operating within the $32,000 available this year, council identified the creation of approval criteria for each zoning category, including downtown, projected to cost $20,000; revising and updating the public process, projected to cost $9,100; reevaluating the setback requirements in the general residential zone, which consumes as much as one-third of planning staff’s time, projected to cost $5,000 and adopting and implementing the National Fire Prevention Association’s standard 299 at projected cost of $3,600. The NFPA standard would provide clear-cut guidelines, especially for construction on upslopes, where none exist now and thereby eliminate considerable negotiation, reports, hearings and general misunderstanding and arguments.Representatives of HB&A, City Council and members of city staff will now meet to finalize costs. At press time, it was not anticipated that further formalize action would be necessary to start the zoning and planning revision process as outlined Tuesday.
