Photos and brief by Larry Ferguson About 30 members of American Legion Eber Duclo Post 39 of Manitou Springs, its auxiliary and volunteers gathered at the city’s Crystal Valley Cemetery on Saturday, May 28, to place American flags on the graves of U.S. military veterans. Post Vice Commander Alex Thornberry conducted the annual Memorial Day Weekend event, during which the group placed nearly 200 flags on veterans’ graves. “May the ceremony today deepen our reverence for our departed friends and comrades,” Thornberry told the gathering. “Let us renew our pledge of loyalty to our country and its flag. Let us resolve by word and deed to emphasize the privilege of duty and patriotism.” Post Adjutant Sharon O’Donnell offered a prayer, asking that the group remember the valor and devotion of military veterans, “not only those whose bodies consecrate our country’s soil but also those who sleep beyond the seas and others whose resting places will not be known until that last day when the deep will have given up its dead.” Post 39 was chartered Aug. 1, 1920, one year after Congress chartered and incorporated the American Legion. It was named for Duclo, Manitou’s first resident to die in World War I; he’s buried in Crystal Valley Cemetery.

I finished editing that page and it was laid out a few days before the horrific crimes in Uvalde, Texas. I had to then turn my focus to the other 31 pages in that issue. Parking reservations program launched at Hiawatha Gardens

Visitors can now reserve prime parking in Manitou Springs as part of the city’s Parking Reservations Pilot Program. Eight spaces are available 6 a.m.-6 p.m. for reservations at Hiawatha Gardens, 10 Old Man’s Trail. Reservations can be made a few minutes before arriving — if spaces are available — or up to three months in advance. No oversized vehicles will be allowed and no carpool discounts are applicable. Visitors must check in with the on-site attendant. Rates are: • Three hours for $16; • Five hours for $25; and • All day for $50. Got fallen trees? Here’s what to do with them

To help Manitou Springs residents clear out fallen trees and branches on their property, the city is hosting a Chipper Day on Saturday, June 4. The gate will be open 8 a.m.-2 p.m. at the Public Works facility, 101 Banks Place. Tree limbs can be any length but must be less than 4 inches in diameter. Shrubs are allowed if the root ball has been removed. No construction materials, bags of leaves, grass clippings or other waste are allowed.

Along with the colleagues scheduled to work that day and the ones who came in on their day off and cut short their vacations, I had to focus on the work at hand. We put our emotions aside; we were journalists first and feeling, caring, grieving people second. I didn’t cry until Sept. 14. Now, I’m allowing myself to cry about the beautiful little ones, and their teachers, who died on May 24. I’m hurting for the people who loved them. I’m hurting for this country.

Dates for free grocery distributions

Care and Share of Southern Colorado will continue distributing free groceries in Manitou Springs. The giveaways take place in the parking lot of the Manitou Pool & Fitness Center, 202 Manitou Ave. Shoppers are welcome to take as much or as little of the food as they want. Distributions will take place noon-1 p.m. Tuesdays. Upcoming dates are June 7 and 21.

Trail Ambassador Program

Pool Feasibility Study Survey is available online

The city has launched a feasibility study to determine the long-term vision for the Pool & Fitness Center. As part of this study, city leaders want to hear from you about what you want the Pool & Fitness Center to provide to our community. Please take 10 minutes to complete the Pool Feasibility Survey, so the city can better establish a long-term vision for Manitou Springs’ only recreation center. It’s available at bit.ly/MSPoolSurvey. The Trails and Open Space Coalition is managing this effort to enhance experiences in local parks by providing environmental education, promoting safety and acting as the “eyes and ears” about what happens there. In the Barton case, the previous administration was aware of the allegations, and Barton faced no consequences. In the Hilt case, students and at least one employee knew. The administration either knew, with Hilt facing no consequences, or wasn’t aware of what was happening in the school. Either case is damning. Quit romanticizing the district before the current administration. These two criminal investigations are indicative of a culture that had to change. That administration did not hold themselves or their employees accountable, which created an unsafe environment for the students. Change in any organization is difficult and painful under the best of circumstances and, in this situation, desperately needed. Now, step out of the way and let this administration create a safe learning environment for our children. Construction update The Manitou Avenue, Park Avenue to Serpentine (MAPS) project is nearing completion. Crews are finishing curbs and sidewalks on the west end of Manitou Avenue. The major capital improvement project has been upgrading and undergrounding utilities, installing a new storm-drain system, improving the roadway grades, installing a new 10-foot-wide multi-use trail, improving pedestrian safety and installing sidewalks and ramps that comply with the Americans with Disabilities Act. The $4 million project is 82 percent federally funded and 18 percent funded by Pikes Peak Rural Transportation Authority. Wildcat Construction is the primary contractor.

Nonprofits can apply for trust fund grants The advisory trustees of the William & Betty Osborne Trust Fund announce the availability of grant funds for 2022. For an organization to qualify for a grant, it must have a nonprofit status and be involved in charitable work that delivers services to deserving residents within the territorial boundaries the trust outlines. Manitou resident Don Goede is gathering decades of material in collaboration with Kenny Frost, a Native American consultant and an enrolled member of the Southern Ute tribe. Frost’s great-great-grandfather, Chief Nanice, appears in many of the images that will be displayed. Along with Chief Edwin Cloud and Chief Ouray, Chief Nanice camped in this sacred area and performed ceremonies in Garden of the Gods. (See box for more information.) It’s likely that other people will see their ancestors in the displays. Beckner and the project team know that, because they’re condensing so much history into small spaces, people might walk in and say, “Where’s my grandfather?” Beckner is prepared for that possibility. She’ll simply say, “I’m sorry. We didn’t know your grandpa.” As she said, how do you summarize so much history? All the volunteers can do is the best they can with what they have and can find.

The “Host Nations” portion of this exhibit is just a teaser for a larger, more detailed exhibit about the Utes planned for May 2023 at the MSHC. “We’re working on something much bigger and expansive. So really, this is going to be a drop in the bucket,” Goede said. Frost, who works to preserve Ute history and identify sacred sites, will share oral stories he learned from his grandmother. He is trained in museum studies and archaeology with federal and state entities, and gives lectures to museums on the proper handling of Indigenous remains and sacred objects.

Why are our teachers resigning from MSHS? By Charlie Morgan, junior

T

errence Batson, a nine-year Manitou Springs High School Spanish and German teacher, resigned from the school to pursue his love of working with children. He will move up the pass to Ute Pass Elementary School next school year. Batson first contemplated this move in the early COVID-19 days during lockdown. “What happened in schools across the country during COVID-19 impacted me immensely,” Batson said. “My priorities and values have shifted as a result, and I began to reflect on where I might be more comfortable and have impact next year, the year after and for the rest of my career.” His next chapter will be different from his MSHS job. “I will be a K-6 Spanish teacher and tech integration specialist at Ute Pass Elementary School here in MSSD. Go Mustangs!” Batson said. “I have taught primary Spanish before, and I loved it. Teachers during the pandemic learned a great deal about tech integration through remote and hybrid learning, and I have always utilized technology to teach.” Batson thought this was a good fit for him as he cherishes the future of our country and having a positive impact on the district’s children. “I really enjoy working with youth,” he said. “I like to think they keep me young in mind and spirit; but, the body, less so.” He is also invested in “whole child education,” a philosophy that MSSD14 elementary schools use. “I really love what this district has to offer students in the way of setting and approach: That is the whole child education,” Batson said. “When I heard about the posting at Ute Pass, I went for it. The days after I submitted my application, I increasingly felt it was the right move for me.” Batson has no regrets, but is feeling mixed emotions. “While I am leaving a fantastic school that I have come to know and love, filled with incredible students and staff and too many special memories to recount, I am also ecstatic about a new direction and environment I will be making at Ute Pass.” Batson first came to MSHS in 2013. As a veteran of the school, he has seen a lot of growth and has always credited his and others’ success to the relationships and teamwork. “Any success I experience is contingent upon building positive, authentic, and trusting relationships,” he said. Many of these relationships were developed outside the classroom. During his time at MSHS, Batson sponsored many clubs and supported many students. “I have a ton of wonderful memories from BreadHeadz to Muffin Topz, Spanish Club to International German Exchanges, to working with exchange students and helping to make World Language and Culture Night a thing,” he said. is hoping not to be gone entirely from MSHS. He hopes to continue to attend sports events and, of course, he will continue to be a big part of World Language and Culture Night. After hearing the news of Batson’s resignation, Ingrid Perez, an MSHS Spanish teacher, was torn between her excitement for him and her own reaction. “Well, at first, I was not happy,” Perez said. “I was being a little bit selfish because he has been my mentor during this whole year, and I will still need his guidance next year. “But, I know that he needed a change of scenery, so I’m delighted that he got that opportunity.” Batson left a lasting impression and impact on the World Language Department itself. “He has everything under control. He knows what to do, when to do it and how to do it,” Perez said. “We will miss everything from his not-so-funny jokes to his constant guidance and support.” In her teacher appreciation speech for National Honor Society, senior Weatherly Hall emphasized that not only do his colleagues recognize and appreciate Batson’s leadership, but so do the students. “Dear Profe,” Hall said. “You not only make the class effective and engaging, but enjoyable for all of us. It is hard to learn a new language, which is no secret; but you genuinely care about your students and their learning. That shows in the progress each of us make with you.” Batson was known for his impeccable teaching qualities and his drive to see each student succeed and grow. “I have never had a teacher that has shown so much care and compassion for each individual student and has wanted their students to strive and grow more than Mr. Batson,” Hall said. Batson will be missed at MSHS next year, but on the flip side, the impact of MSHS on Batson’s life will forever be a part of him. “It has been an absolute privilege and honor to serve the students at MSHS for the past nine years,” Batson said. “I have had an amazing and unforgettable run at MSHS. Thank you to anyone who has ever been there for me, mentored, supported me or been a friend.”

Archer’s talk launches Historical Speaker Series

The 2005 Historical Speaker Series will present Dr. Lewis Archer as its opening speaker Jan. 16 at 3 p.m. in the Community Congregational Church, 103 Pawnee. The subject of his talk will be “The Broken Hear t of William Bell.” Dr. Archer has been an historical speaker in past years and attributes his interest in Manitou Springs’ history to his relocation here 13 years ago. He is a retired English professor from Whitwor th College in Spokane, Wash. His lecture is free and open to the public. City Finance Director Mike Leslie reported to City Council at Tuesday’s work session that there was approximately $32,000 available for implementing changes in the zoning code and related public processes for 2005. The recommendations submitted by consultant HB&A were itemized and came with the cost of each item included. HB&A will be contracted to perform the work of revising the code and establishing revised processes so the recommendations also served as a de facto bid on each item even though the firm’s involvement to date eliminates the requirement for a new bidding process. The 12 items on the HB&A list total nearly $91,000. HB&A also indicated several, mostly procedural changes, that can contribute to a more efficient and less contentious process that can be implemented in-house at no cost. Operating within the $32,000 available this year, council identified the creation of approval criteria for each zoning category, including downtown, projected to cost $20,000; revising and updating the public process, projected to cost $9,100; reevaluating the setback requirements in the general residential zone, which consumes as much as one-third of planning staff’s time, projected to cost $5,000 and adopting and implementing the National Fire Prevention Association’s standard 299 at a projected cost of $3,600. The NFPA standard would provide clear-cut guidelines, especially for construction on upslopes, where none exist now and thereby eliminate considerable negotiation,

reports, hearings and general misunderstanding and arguments. Representatives of HB&A, City Council and members of city staff will now meet to finalize costs. At press time, it was not anticipated that further formalize action would be necessary to start the zoning and planning revision process as outlined Tuesday.

Council nears administrator choice

Following Monday’s open house with finalists for the City Administrator position and a closed executive session Tuesday to review the candidates and the interview process that took place Monday, City Council appears to be embarking on final discussions with one or more candidates. Details from council executive sessions are, by law, not made public The four finalists are Elizabeth Black, District Manager for the Copper Mountain Consolidated Metropolitan District in Colorado; David Blanchard, City Manager of Blackhawk, Colo., from 2000 to 2003; Catherine Green, Director of Planning for the City of Pueblo from 1992 to 2004; and, Rick Sonnenburg, Town Manager of Monument. Bentley Henderson, Assistant Town Manager of Carbondale, Colo., withdrew from the process Friday The candidates were interviewed Monday by a panel of Colorado city managers and by City Council. The four then met with members of the public and with members of city staff. No public timetable has been set for the final hiring.

arrested and transported to the El Paso County Criminal Justice Center. MSPD officers were patrolling near South 31st Street and U.S. Highway 24 to educate the transient population about trespassing. People were identified and one was found to have a misdemeanor warrant from the El Paso County Sheriff’s Office. The suspect was taken into custody and transported to CJC. MSPD also patrolled the area of 21st Street and Highway 24, and found a person with multiple local felony warrants. The suspect was taken into custody and booked into CJC.

May 24

In the 00 block of Manitou Avenue, officers recovered a vehicle that had been stolen in Colorado Springs. There is no suspect information. At 1330 hours, MSPD towed an abandoned vehicle near the intersection of Highway 24 and the Washington Bypass. It had previously been tagged for towing. Officers recovered a stolen vehicle in a hotel parking lot in the 00 block of Manitou Avenue at 2235 hours. MSPD has possible suspect information, which is being relayed to the agency for the jurisdiction where the vehicle was stolen.

May 25

A juvenile was investigated on suspicion of selling marijuana in the 400 block of El Monte Place. MSPD responded to a check-thewelfare request in the 00 block of Manitou Avenue, where a man had his belongings spread out over the sidewalk. During the contact, officers discovered the man had a local misdemeanor warrant. While taking him into custody, they discovered a small bag of a white crystal-like substance in his sock; he said it was methamphetamines. He was cited for possession of a controlled substance and booked into CJC for his warrant. Officers responded to the 100 block of Spencer Avenue regarding a missing 7-year-old girl. However, it is presumed she is with her mother.

A traffic accident in the 200 block of Manitou Avenue involved a vehicle and a bicycle. No one was injured, and the vehicle had minor damage. At 1145 hours, a lost credit card was turned in; it had been found in a parking kiosk on Cañon Avenue.

May 26

MSPD responded to a traffic accident in the 600 block of Manitou Avenue, and officers were told the presumably at-fault vehicle had only minor damage. They investigated and cleared the incident. Officers observed a vehicle with expired registration in the 300 block of Manitou Avenue. Dispatch researched the license plate and found it was stolen. MSPD stopped the vehicle and spoke with the driver. They learned the license plate was on the correct vehicle and the driver was the registered owner. A motor vehicle theft in progress was reported in the 400 block of Ruxton Avenue. MSPD located the vehicle and stopped it. After an investigation, officers discovered that the vehicle was not stolen, but had fictitious plates; the driver didn’t have a valid driver’s license or insurance. They couldn’t confirm the identity of the vehicle’s owner, so it was impounded. The driver was cited and released.

MSPD responded to a report that a vehicle in the 00 block of Mountain View Road had been broken into the previous night. After investigating, officers concluded that a bear had broken into the vehicle. A report was taken to document the vehicle damage. A minor non-injury traffic accident occurred in the 00 block of Ruxton Avenue. Officers investigated and documented the incident.

May 28

A person was reported to be sleeping in a vehicle near Manitou Place and Osage Avenue. Officers contacted the man and he was found to have a local misdemeanor warrant. He was arrested and taken to CJC. A theft was reported in the 100

block of Waltham Avenue, where a woman had removed a parking boot from her vehicle; the boot and the vehicle were nowhere to be found. Officers investigated the theft of government property. At 2045 hours, MSPD received a call from the Manitou Springs Fire Department. A firefighter had received a report regarding an unknown individual on Lover’s Lane. Officers checked the area and found a person, who was taken into custody on local misdemeanor warrants. Manitou officers were patrolling the 400 block of Ruxton Avenue when they encountered a person with a local misdemeanor warrant for traffic violations. The suspect was taken into custody and booked into CJC.

May 29

MSPD responded to a domestic violence in progress reported on Highway 24 near mile marker 297. One person was found to have multiple local misdemeanor warrants and was taken into custody to be booked into CJC. Officers stopped a vehicle at West Colorado Avenue and Columbia Road. The driver had a local misdemeanor warrant, and was served a personal recognizance bond and given a new court date. The vehicle also had fictitious registration; the driver was cited and given a summons. Manitou Springs officers were approached by people who said they had discovered human remains while hiking in unincorporated El Paso County. They had brought a skull to show the police. MSPD then assisted in a multi-agency effort to verify the skull’s authenticity, locate the area where it was found and search for evidence. The investigation was turned over to the El Paso County Sheriff’s Office, but MSPD will continue to support the effort. A check-the-welfare visit was requested in the 00 block of Deneta Drive. After speaking with the subject of the request, officers determined he was the victim of domestic violence. A summons was issued for the suspect and an arrest warrant will be sought.

COURT UPDATE The arraignment for former Manitou Springs High school teacher Timothy Hilt was postponed to Thursday, June 9, according to the Colorado Judicial Branch’s online docket. He is accused of sexually assaulting a student. Matthew Barton, another former MSHS teacher accused of sexual assault on a student, is scheduled for a motions hearing Tuesday, July 19. His jury trial is

set to start Monday, Oct. 10. Ashlynne Perez is due in court for a final hearing Friday, June 17. Her 4-year-old son accidentally shot himself in the head July 6, 2021, outside a Manitou business. Her husband, Carlos Perez, is scheduled for a pre-trial conference on Tuesday, June 7. William Weaver, who was convicted of killing his wife, Wendy Cupit, in June 2020, has been sentenced to life in prison.
