See COUNCIL/page 2 Colorado’s 4th Judicial District Attorney’s Office has completed its review of the April 11 officer-in volved shooting in downtown Manitou Springs. That day, the Manitou Springs Police Department received a report from a bartender at the Royal Tavern, 924 Manitou Ave., that an intoxicated person had brandished a firearm at her. The bartender said the man left the bar and walked east on Manitou Avenue. MSPD Officers Levi Hoover and Jeffrey Schuelke, the initial responding officers, located an older white male who matched the description in the 800 block of Manitou Avenue. He was later identified as Wilford Robert Deweese, 67, a Florida resident. He refused the officers’ requests to approach to discuss the matter, instead remaining partially concealed. Deweese indicated he had been in the Royal Tavern but continued to refuse the officers’ directions to approach them further to discuss the incident. Deweese would not keep his hands up, telling the officers that he was recording them with his phone while also moving his hands toward his waistband. The officers tried to move closer to Deweese, but retreated when he told them to stay away and began reaching into his pocket. After more than 10 minutes, units from the El Paso County Sheriff’s Office and the Colorado State Patrol arrived to help contain Deweese. The Parks and Recreation Advisory Board and the Climate Action Work Group received a consultant’s recommendations in November 2021 and May 2022. Initiatives including an ongoing tree inventory; zero net tree loss; Organic Land Management policy; right-of-way tree permits; a Heritage Tree program; and a tree committee formed the foundation of a proposed tree care ordinance that city staff presented to council in mid-June of this year.

Johnson emphasized that, since budget season is approaching, she brought it before council now in hopes that the DDA could be part of those discussions.Fortuin said she thought it was a “really great proposal” and suggested that someone familiar with the process in other municipalities study Manitou’s situation and make a proposal for how that DDA would work.

“It just seems unnecessarily complex since PARAB can do that anyway,” Fortuin said. “PARAB does have the authority to create subcommittees and you’ve already designated PARAB as the official tree advisory board,” she said.

Councilor Nancy Fortuin asked Beck whether a tree committee, to be designated a subcommittee of PARAB, is really necessary.

“The intention was for the tree committee to be a subcommittee under the umbrella of PARAB,” BeckCouncilsaid. members then discussed the necessity to protect trees during construction activity; Fortuin asked for specific language about that in the ordinance.Beckexplained plans for a Heritage Tree program, which would protect unique trees on public and private property that contribute to the city’s environment and character. Individuals or groups could nominate a tree or grove of trees on city or private property to be protected as a heritage tree.

Energy-efficiency rebates available for Manitou Springs homes In partnership with the Housing Advisory Board, the city’s Planning Department is providing $10,000 in funding toward the Energy Efficiency Rebate Program, which will give rebates to homeowners or residents via their water bills. The funds can pay for insulation, air sealing, heat pumps, water heaters, high-effi ciency toilets and irrigation equipment. This program will continue through the end of 2022, or until the budgeted amount runs out. Potential applicants must apply for a property improvement permit and have receipts of purchased equipment. Residents can retroactively apply for a rebate, as long as they follow the above rules and the fixture was purchased and installed on or after Jan. 1, 2022. Information: bit.ly/MSRebates.

Councilor Judith Chandler asked to clarify that property owners will have to consent to having their tree or trees protected. Beck said that he would revise the proposal to reflect council’s requests, and Mayor John Graham suggested the Sept. 6 meeting for first reading of the ordinance.Councilor Natalie Johnson then presented information about a possible Downtown Develop ment Authority. Her first point was that the Business Improvement District was formed in 2004 as a self-taxing entity to cover basic repairs, landscaping and snow removal, but she’s concerned that it wouldn’t have enough to respond to an unforeseen eventWithdowntown.theManitou Springs Urban Renewal Authority ending in nine years, she’s concerned that the area east of the U.S. Highway 24 overpass and the Manitou Avenue from Park Avenue to Serpentine Drive (MAPS) area will need support to maintain infrastructure.“Inthepast, we’ve had organizations like the Manitou Springs Development Co. that supported some of these efforts, but they disbanded several years ago. And so, we’re sort of in this limbo,” Johnson said. She proposed a “gateway to gateway” Downtown Development Authority and said that many local entities could benefit from it. “Developing a DDA takes about two years. There’s a whole process, obviously, involving community engagement,” Johnson said, that could take about $30,000. “I believe that if council was willing to contribute $10,000 to $15,000, the rest could be raised through the other partners.”

Chandler suggested that it be put on hold briefly until other issues council is facing are clarified. Graham added that council might not want to commit money for developing a DDA until Colorado Springs votes on allowing recreational marijuana sales, which is on November’s ballot. Fortuin mentioned that the city’s finance staff is working on two budgets for next year, depending on whether the marijuana measure passes. Graham then introduced the topic of the Urban Renewal Authority, which is funded through property and sales taxes. “This is kind of a complicated animal,” he said. The mayor expressed hope that any question of dissolving the URA could be included on the November ballot to avoid the expense of a special election.“City Council can pass an ordinance, basically abolishing the URA, without a vote. Another way to do it is to initiate an ordinance that abolishes the URA,” Parker explained.Graham said that, if council “turns off the faucet” to the URA, the authority could use its savings to still meet its obligations for a while.

Parker advised council about several advantages about retaining the URA in some way because there are “ramifications about forming them“Weagain.”arenot in crisis mode,” said Fortuin, council’s liaison to the URA. “If we get into crisis mode, I’m perfectly prepared to talk about diverting funding from the URA.” Fortuin suggested that City Council meet with the URA board. Graham replied with a list of the city’s current unexpected, urgent expenses. “Every time we turn around, there’s another major expense lurking,” he said. Johnson said she does feel like the city is in a crisis situation, but that she’s uncomfortable about making major decisions about the URA out of fear.

This was the second year that the city of Manitou Springs used a survey to gauge the community’s satisfaction with its quality of service, among other key indicators of residents’ feelings, opinions and ideas. In 2021, 431 residents responded, but this year’s respondents dropped to 346. Public Information Officer Alex Trefry still considers that a “great turnout for a community survey.” That approximately 7 percent response rate is one that other municipalities can only dream of receiving for a survey without a randomized sample pool, he said. “I was especially pleased by the number of responses we got. This gives the survey credibility. The majority of responses were positive, so citizens are recognizing the city’s efforts,” Mayor John Graham said. “Also, some of the comments that were critical targeted specific issues that the city is working on, so we are generally on the right track.”

The survey went live April 26 and ended May 10. Trefry compiled the questions, drawing ideas from other municipalities’ surveys. “The way in which survey questions are worded is an art, and the slightest word change can make major impacts toward how people answer the question,” Trefry said. The city mailed 2,052 informa tional postcards to local residences on the utilities mailing list; of those, 108 were returned for invalid addresses. The survey was online, but paper copies were available in City Hall. The opportunity to give feedback was announced several times on the city’s social media outlets and website, and in the Bulletin. This year, the first question asked if the respondent is a Manitou resident; nine people answered no, so their answers were not factored into the analysis.“Theintent of the survey was not for decision-making, but due to trends and significant findings, some of the data may prove beneficial to help city officials with policy-making or

Municipal government and infrastructure featured in other answers, with 16 and 15 percent, respectively.Peoplewho wanted to change the municipal government mentioned that the city focuses too much on businesses, rather than its residents. Of the 56 people who wanted to change the government, 17 said they were concerned about City Council and five specified city staff/departments. The survey also asked if respondents would like for someone in City Hall to follow up on questions and concerns, and 46 people said yes. Trefry said those questions ranged from water/sewer fees to tree maintenance, and included recom mendations for new parks. Department directors followed up with those residents; for instance, questions about the Manitou Springs Police Department went to Chief Bill TrefryOtto. said the city will continue the annual survey, although some questions or how it’s conducted may change. After a few years’ worth of surveys, the city can compare results year-to-year and find trends to monitor. “Community surveys are extremely important to do for a few reasons: It gives us true data to look at when gauging the performance of ourselves, but also how people feel about living here. In addition, it gives our residents a very quick and easy way to get involved with the city,” he said. — John Graham

The following comments and opinions are those of the author only. They do not represent an official position for the city of Manitou Springs or City Council. Given the city’s many needs and uncertain financial future, should we continue to restrict public funds that could be used elsewhere in the city? Many Manitou Springs residents may be unaware of the city’s Urban Renewal Authority, the role it plays and the financial policies that underpin it. The URA controls significant funds that can be used only under limited circumstances.TheURAwas formed in 2006 to overcome urban blight and revitalize eastern Manitou Avenue. Its boundaries include properties on either side of Manitou Avenue from the eastern arch to the U.S. Highway 24 overpass. It was designed to channel tax revenue back into properties in that area. The property and sales taxes amounts collected in 2006 within the area were set as the basis for future comparisons. Any tax exceeding that baseline goes directly to the URA, not to the city’s general fund. This was before Manitou legalized recreational marijuana in 2014 and limited sales to two locations, both in the URA. Marijuana sales have been a gold mine for the URA, with a smaller percentage going to the city. According to the URA’s budget, it will get approximately $1,733,000 in sales tax and $115,000 in property tax in 2022. In comparison, the city as a whole expects to get $8.5 million in sales tax and $865,850 in property tax. Weigh the URA revenue against that for the entire city, you will see that the URA prospers handsomely. This is a lopsided arrangement — shouldn’t the windfall benefit everyone? The URA’s retained funds from last year are $2,295,169. With this year’s income, that will total more than $4 million. Again, this is lopsided — shouldn’t the windfall be spread more evenly for the benefit of all? In comparison, on July 19, City Council earmarked $2,646,000 for eight major projects. These will benefit the city at large and protect our quality of life. These allocations were not as generous as Council might have liked. They came with a strong sense of fiscal caution. Taxes from recreational marijuana sales are substantial. If Colorado Springs voters legalize it in November, the city budget will see severe shortfalls.

The URA’s anticipated capital expenditures for this year include: • Two sculptures for Manitou Avenue: $110,000; • Restroom renovations at Fields Park: $65,000; • Property acquisition: $1,250,000;•Streetscape enhancements: $1,500,000;•Street tree program: $25,000; • Pedestrian bridge over Fountain Creek: $250,000; and • Holiday lighting: $35,000. These expenditures would total $3,235,000. Some of the URA projects are less than essential, such as wrapping a dozen utility boxes with artwork at a cost of $5,000-$8,000 apiece. That’s potentially almost $100,000. Two sculptures already occupy spots along Manitou Avenue where they are difficult to appreciate; three more are on the way at about $55,000 each. In addition, the URA will credit sales tax collections at the new Holiday Inn Express back to the hotel for construction incentives. Although the hotel’s owners had already committed to the project, the URA offered concessions, potentially to the tune of $2.1Supposemillion.the URA money was used elsewhere in the city.There has been a lot of deferred maintenance throughout Manitou, all begging for fixes. The cost of repairing deficiencies at City Hall, the fire station and the Pool & Aquatic Center come to a little less than $2 million, based on a report City Council received in April. A more recent surprise is that we need to create our own ambulance service. Legal limitations prevent spending URA funds outside its boundaries. Once the city remits money to the URA, it belongs to the URA, regardless of needs elsewhere in theTherecity.are several possible scenarios:1.Make no changes and let the URA keep its status quo; 2. Disband the URA; close it out and channel all future money to the city’s General Fund, reserving only enough funding to satisfy existing URA obligations. This would require voter approval; or 3. City Council could withhold all or a portion of the money that would otherwise go to the URA. The city could then use the money where needed. If Colorado Springs legalizes recreational marijuana, our tax base will be severely damaged. We need to make the most of our resources now. More money for capital projects would help with overdue improvements. A strong cash reserve will be helpful, especially when federal infrastruc ture programs take hold and perhaps ask for matching local money.

Deputies and officers immedi ately began lifesaving efforts on Deweese. Manitou Springs Fire Department personnel also assisted within minutes, but Deweese died. Crime scene investigation personnel recovered a 9mm pistol near Deweese with its slide locked back, indicating complete expenditure of ammunition. Shell casings were also recovered. A forensic examina tion of the firearms evidence conclusively identified that Deweese’s pistol fired the shot, killing Jinx.

Another responding deputy, Ronnie Hancock, displayed his K9 partner, Jinx, to Deweese to demonstrate the necessity of complying with officer commands. Hancock then took over communication responsibilities and additional commands were issued for Deweese to show his hands and walk toward the officers. The threat to public safety increased as people traveled down Manitou Avenue behind the police containment line and gathered in windows and balcony areas. For eight additional minutes, Hancock continuously repeated his commands, including multiple warnings that, unless Deweese complied, the K9 would be released. Deweese was speaking via phone with a relative and stated he was planning to shoot the dog. Finally, with no cooperation from Deweese’s, Hancock deployed Jinx and officers began a simultane ous coordinated movement to approach him. As the K9 ran toward the walkway where Deweese was located, he pulled a handgun from his pocket and fired at Jinx, fatally striking him in the head. Deweese then fired at officers as they moved down the walkway, and in response, Hoover, Schuelke, Hancock and LeBaron returned fire. Deweese was struck approximately 22 times, incapacitating him.

Vintage teams turn back the clock on baseball — Roger “Digger” Hadix Story and photos by Larry Ferguson The cranks were in the bleachers, the ballists on both clubs were ready, the strikers were warming up and hoping to provide the tallykeeper with plenty of aces, and the base tenders were taking their positions on the diamond.Forabout three hours on Saturday, Aug. 6, it was 1864 again at Roger Maestas Field in Manitou. The Star Base Ball Club of Colorado Territory was in town, taking on the Manitou Springers of the Manitou Springs Heritage Center. The contest was the latest in an outgoing rivalry the MSHC sponsors in conjunction with the Colorado Vintage Base Ball Association. The association is a nonprofit, formed in 1993, that is dedicated to preserving the history of 19th century baseball in Colorado. “This is a really nice field,” said Roger “Digger” Hadix, manager of the visiting Star team. “Generally, we play on fields that are pretty rough, a lot rougher than this.” Ferril “Mad Dog” Mason, who had come from Denver to serve as umpire for the game, agreed. His job was to be the judge of fair and unfair play, and to determine all disputes and differences that may occur during the game.TheSpringers captain, Mike Maio, was busy counting his players and had a resigned look on his face. With only eight, he was about to be pressed into service, probably as a hurler or maybe as a first hand. What followed turned out to be a surprisingly close contest as the visitors withstood Manitou’s ninth-inning, bases-loaded rally to post a 15-13 victory. It was surprising because the home team players were up against an experienced team that sees action several times every month and is thoroughly acquainted with the 1864 rules. But the Springers’ non-stop hustle almost salvaged the day for Manitou. Trailing for most of the game, the local contingent rallied for a combined six runs in the eighth and ninth innings to cut the losing margin to two runs. The CVBBA games are played by early-day rules, using original terminology and featuring a slew of quirky traditions such as runners ringing a bell on the scorekeeper’s table after they score by crossing “home base” (actually a round plate). Fans of the modern-day game can easily recognize most of the basic principles and strategies of the game because the rules have remained relatively unchanged. However, a few key differences set “base ball” apart from “baseball.” Perhaps the biggest game changer is a rule that allows the defense to record an out if a hit ball is either caught in the air or caught after it bounces one time. The ball, composed of rubber and yarn and covered with leather, is far livelier than today’s baseball. The lack of gloves, an innova tion that didn’t come until the 1870s, added to fielders’ difficulties. “Also, there’s no over-running first base, and sliding into a base is considered ungentlemanly,” said Hadix, who in addition to being a member of the vintage baseball organization for 28 years, wrote a book, “Baseball in Colorado Springs.”Theoriginal terminology includes cranks (fans), ballists (players), strikers (batters), aces (runs) tallykeepers (scorekeepers), base tenders and first, second and third hands (infielders). Officers responded to a hit-andrun traffic accident in the 100 block of Deer Path Avenue. A parked vehicle was struck at an unknown time; there is no suspect Someoneinformation.reportedbeing assaulted in the 400 block of Washington Avenue. The victim refused medical attention and a suspect was not located. The case is still being investigated. A shots fired report came in from the area of West Colorado Avenue and Columbia Road. However, MSPD found no evidence of a shooting. MSPD stopped a vehicle with a damaged/defective headlight in the 1200 block of Manitou Avenue. The officers observed an open alcohol container in the vehicle and investigated the driver for being under the influence. The suspect was arrested for DUI, cited and released.

Aug. 6 A cold theft was reported in the 700 block of Manitou Avenue; the suspect has not been found. At 2119 hours, a hit-and-run accident occurred in the 100 block of Manitou Avenue. There were no injuries, and the suspect vehicle has not been located.

Council prioritizes planning, zoning goals By Jack Elder City Finance Director Mike Leslie reported to City Council at Tuesday’s work session that there was approximately $32,000 available for implementing changes in the zoning code and related public processes for 2005. The recommendations submitted by consultant HB&A were itemized and came with the cost of each item included. HB&A will be contracted to perform the work of revising the code and establishing revised processes so the recommendations also served as a de facto bid on each item even though the firm’s involvement to date eliminates the requirement for a new bidding process. The 12 items on the HB&A list total nearly $91,000. HB&A also indicated several, mostly procedural changes, that can contribute to more efficient and less contentious process that can be implemented in-house at no cost. Operating within the $32,000 available this year, council identified the creation of approval criteria for each zoning category, including downtown, projected to cost $20,000; revising and updating the public process, projected to cost $9,100; reevaluating the setback requirements in the general residential zone, which consumes as much as one-third of planning staff’s time, projected to cost $5,000 and adopting and implementing the National Fire Prevention Association’s standard 299 at projected cost of $3,600. The NFPA standard would provide clear-cut guidelines, especially for construction on upslopes, where none exist now and thereby eliminate considerable negotiation, reports, hearings and general misunderstanding and arguments.Representatives of HB&A, City Council and members of city staff will now meet to finalize costs. Aug. 1 At 0812 hours, Manitou Springs Police officers contacted a transient in the 600 block of Manitou Avenue for illegally camping. The suspect was a wanted felon and was arrested and transported to the El Paso County Criminal Justice Center. Property was found and turned in at the police station; it was placed in safekeeping at 1143 hours. Officers stopped a vehicle with fictitious plates in the Beckers Lane/ El Paso Boulevard area. The driver was a habitual traffic offender and the vehicle was towed. A Samsung phone was turned in at the police station after being found in the Hiawatha Gardens parking lot. A wallet covered in green camouflage material was found in the MSPD lobby.

While patrolling for illegal camps near westbound U.S. Highway 24 and Ridge Road, MSPD contacted a man with a local misdemeanor warrant. He was taken into custody and booked into CJC. At 0724 hours, officers attempted to contact a wanted person in the 300 block of Ruxton Avenue. The suspect eluded MSPD, but eventually was captured and taken into custody on multiple charges. A license plate was reported stolen in the 100 block of Manitou Place. No suspect information is available, but the details were entered into crime databases as stolen. At 2033 hours, officers stopped a vehicle with fictitious license plates at the intersection of Highway 24 and West 31st Street. The driver was issued a summons and the vehicle was impounded.MSPDcited a man for theft after witnessing him rush out of a store in the 3200 block of West Colorado Avenue. Officers contacted the store and verified the items were stolen. He was arrested on charges of possessing amphetamines and narcotic equip ment, along with shoplifting.

Aug. 7 Officers stopped a vehicle in the 1900 block of West Colorado Avenue. The driver was found to have several local misdemeanor warrants, and was taken into custody and booked into CJC.At 0946 hours, MSPD responded to a hit-and-run accident in the 100 block of Manitou Avenue. Officers responded to a report of a suicide attempt in the 5600 block of Moosa Road in Chipita Park. An older woman intentionally consumed an excessive amount of sleeping pills and was transported to a hospital.

Former Manitou Springs High school teacher Timothy Hilt is scheduled to be sentenced on Thursday, Sept. 1, according to the Colorado Judicial Branch’s online docket. He has pleaded guilty to two counts of sexual assault on a child by a person in a position of trust. Matthew Barton, another former MSHS teacher accused of sexual assault on a student, appeared at a review hearing on Tuesday, Aug. 9. A pre-trial readiness conference is scheduled for Tuesday, Oct. 4, and his jury trial is set to start Monday, Oct. 10.

Manitou Springs,

A suspect with active warrants provided false identifying information to officers in the 3500 block of West Colorado Avenue. The investigation is ongoing.MSPD responded to a report of fraudulent checks in the 00 block of Cliff Road. Officers completed an initial report, but the investigation will be passed on to the local agency that has jurisdiction over where the checks were being deposited.

The Rotary Club of Colorado Springs picks up the letters twice a month from PPLD. The Rotarians read through the letters to ensure they are supportive and include no personal information. Two organizations, Ukrainians of Colorado and Ukrainian National Women’s League of America Inc., help translate and check the letters.

Three caring people, Steve Popovich, Keith Davis and Vince Murphy, implemented the program in partnership with relief organizations. Popovich reached out to Melody Alvarez, the PPLD’s director of Family & Children’s Services, to discuss the idea. The project took many months to start as the three men worked with relief organizations to find carriers that would transport the letters to refugee camps in Poland. In May, PPLD received the good news that two carriers would transport letters.The Frontier Horizon non-govern mental organization will deliver 1,000 letters to displaced Ukrainian orphans, age 6 to 17, who are temporarily sheltered outside of Warsaw, and possibly in Germany. Letters of Hope NGO has committed to taking batches of letters to refugees outside of Ukraine and those at the processing stations in Poland.

Pikes Peak Library District started the writing campaign in June during its Summer Adventure reading program and it will end Aug. 31. As of late July, PPLD had collected 339 letters. PPLD was the first library district to join the partnership as a pilot. The program now includes Security Public Library, Pueblo City-County Library and Aurora Central Library. Gov. Jared Polis has endorsed the program, as has the United Nations Refugee Agency.
