FULL STEAM AHEAD Six years after its conception, Yachting Malta is today a well-established entity that serves the local maritime industry and the sport. Peter Valentino speaks to John Huber on yachting and whether Malta can serve as a centre for maritime excellence.

John, you were first appointed as chairman of Yachting Malta in 2017. What prepared you for this, and how could you best describe your first years in office? It was a commissioned report that I wrote that eventually led to Yachting Malta’s chairmanship. I had the previous experience of setting up the yachting section at the Malta Chamber, so I was wellversed with the subject at a professional and personal level. From the onset, we delved deeply into what role Yachting Malta should have to serve better the country, the sport and the yachting industry. This was done by meeting up with the clubs, industry representatives and anyone who wanted to contribute. I relayed my findings to the government, and the role evolved from being an entity to just trying to attract events but much more than that. Moreover, we developed an excellent relationship with the regulator, Transport Malta, and continue to dialogue on an ongoing basis on ideas mainly focusing on the promotional side. We, therefore, widened our objective and assistance. So, to come back to your question, it has been a very intensive but rewarding three years. Solid groundwork has been laid, and we are now starting to see results. The maritime sector is exceptionally vast. It’s intricate and highly competitive. What help has Yachting Malta been to the maritime industry? In my first interview, I stated that I wished to see the maritime industry as one of the pillars of the Maltese economy; I still think so and hope so. We have five active yards within the Grand ›

As a country, we have had terrific success with our flagging and fiscal incentives. Still, we must continue to strive harder to make Malta a primary superyacht industry hub for repairs and maintenance. Most yards have gone through and continue to innovate with significant capital expenditure with the assistance of Malta Enterprise, which bodes well for the future. We have also seen some academies open, most notably Maritime MT, with state-of-the-art facilities. This continues to enhance our stance as a centre of excellence. How did COVID-19 affect the maritime industry? As happened to all other industries in Malta and throughout the world, Vivid-19 hit hard, and the yachting industry was no exception. Our ports were closed for quite some time, and this hit the industry very hard. On a positive note, Transport Malta, Yachting Malta and the Yachting Section at the Malta Chamber of Commerce, Enterprise and Industry got together. They saw the best possible and safest measures to alleviate the burdens of the industry and, in the light of circumstances, had a measure of success. These are the results we like to see that when heads put themselves around a table and work cohesively for the country’s benefit, positive results ensue. So, Yachting Malta’s interest in powerboats is two-faceted; the sport and the local manufacturing industry. Together with the Ciantar family, we are also considering the smaller powerboats called the Cyber 370 class, which are 13 feet and fully certified as very safe boats. These young racers are equipped with a maximum of 25hp engines. We are optimistic about the outcome, and based on its success, we will start working on an international academy in Malta for this type of boats. We are in a fortunate position to work with Aaron Ciantar, a world champion in his own right, and his expertise and knowledge of the sport are second to none. How well is Yachting Malta known on the international scene, and what plans do you have to ensure increased visibility? We are making our voice heard as much as we can, and I am pleased to state that we are making in-roads. We are bidding for some significant events, which is a first for Yachting Malta. Any new developments? From my experience, Transport Malta’s Merchant Shipping Directorate adopts a highly proactive approach. It is constantly fine-tuning its regulations following and depending on the feedback from customers, stakeholders and regulators. As of the 1st of January 2021, Malta issued a revised Commercial Yacht Code. I am gladly confident that this improved code will elevate Malta’s regulatory framework for commercial yachts whilst ensuring conformity with all international safety regulations. The Brexit scenario has triggered another very recent development. Maltese law has been amended to include citizens of the United Kingdom as eligible international owners. This is highly beneficial for both the UK citizens who already own a Maltese-flagged vessel and those who may be interested in obtaining a European-member state flag for their boat, always following the Brexit developments. VAT on yachts. How does Malta come into the equation? VAT implications are the main concern for potential buyers of both newly built or second-hand yachts. Unfortunately, space does not allow me to delve into the details of what Malta must offer in this respect. However, there are yacht leasing options with favourable VAT consequences that can be applied if the intention is for personal enjoyment. There are other options that owners can avail themselves to in Malta, such as the temporary importation of pleasure boats having a non-EU flag and non-EU ownership in EU waters and the importation in the EU of yachts intended for commercial use. Yachts would be able to circulate freely in EU waters, and for all options above, the yachts would need to be brought to Malta to undergo the relative VAT and customs procedures. What assistance can a yacht owner expect? Whether it’s a matter of registering a yacht under the Malta flag, transferring a vessel to another flag, securing a lender’s rights over a yacht by the registration of a priority mortgage over it, or obtaining VAT or tax advice on the purchase, use or sale of a yacht. Yacht owners and managers almost invariably seek support and guidance from specialised local practitioners in the maritime industry. Local professional operators have an excellent reputation in the maritime sector and are one added reason which underpins the success of the Malta flag registry.

Writing about discipline and what can lead to a hearing under the infamous Misconduct Rule is something I have been procrastinating. Still, the string of events that paved the way to a few hearings at one of our leading clubs and a brush with it at another two left me with no option, all in the interest of clarifying a few points or misconceptions, which may be the right place to write, hoping that the Malta Sailing Federation and all the clubs below that umbrella will get together and get things done in the right way. Let me start by saying that Rule 69, 'Misconduct', is probably the most complex of rules; it pivots around the character of the person, and any action concerning this may have very severe long term effects. Misconduct, and here I quote from the Rules Book, is 'conduct that is in breach of good manners, a violation of good sportsmanship, or unethical behaviour; or conduct that may bring the sport into disrepute. Interestingly, Rule 69 is not grounds for a protest, so a sailor during an event can't fill a protest form under RRS 69 and have the rights to proceed with the case's presenting. Many still think that they can, but no – Rule 69 has its provisions. Pre-2004, a Jury or Protest Committee were empowered to start a hearing even if the slightest allegation was brought forward. ‘Trigger happy' or, better still, pompous characters went down that line with imprudence, and this was an error, one that World Sailing ought to be embarrassed about. Certain officials used to take pride in this, and I know of at least one case here in Malta; because I was the target. It was an exciting episode where an official who couldn't stand the fact I was appointed as an International Judge lodged a protest against me for the use of what he considered to be a discourteous word. I wasn't even informed of his intention to 'protest', and I was whisked into a protest room to face him and three judges. I heard his story, and I was shocked because I knew he was lying, but I

Anyone with a passion for racing knows that the 13th of December marks the annual Round Malta Race; a 42-mile long event usually attracts much more than a handful of boats, especially compared to other local events. It has always been an excellent experience, at times with boats returning well after dusk in light airs to others when boats crossed the finishing line with ample time to go home, rest and venture out. It tends to attract anything from the absolute racing boats to the regular series produced family cruiser; who well know they won't have a chance of holding the prize up high. However, they do join because it's an excellent experience, and it's fun. Moreover, it's the last race of the year; it gets boats to venture by the west coast along the majestic Dingli Cliffs, where those racing can at least enjoy nature at its purest. Well, in brief, it's the race we all prepare for and look forward to. Well, the Round Malta this year got postponed 'sine die', just like a pending court case; and the reason for this was that it was too 'windy'. To a sailor, this is unacceptable. It's incomprehensible to the man in the street, not to mention what a sponsor may think. Before I open Pandora's box, I think it's best to clarify the rules chronologically and status wise. It falls under the Fundamental Rules found in part 1 of the Rules Book. Rule 4, titled 'Decision to Race' specifically and solely states, 'the responsibility for a boat's decision to participate in a race or continue racing is hers alone.' Rule 27.3 reads 'before the starting signal, the race committee may for any reason postpone or abandon the race'. This is what happened, but just as the rule dictates, there must be a 'reason' – in my terminology, a factual, sound and waterproof reason, taken after collecting facts and coming to a reasonable conclusion. However, I'll now go to Rule 32, giving some comfort to Race Officials. This rule talks about 'Shortening or abandoning after the start' whereby this rule details how a race can be shortened or abandoned and which reasons will be deemed valid. So, whilst Rule 32.1 (a) dictates explicitly what sound signals need to be sounded and what flags need to be displayed; it goes on to give the reasons, and the only ones applicable to this race are:→

Still, a few boats left the harbour, and in sailors' terminology, they went out 'for a blast'. They sailed well. They didn't push the boats because they weren't racing, they used the East Coast where the waves were moderate, but boats would have achieved the 'real blast' if these sailed the actual race and stormed down the West Coast. I drove there out of interest. Yes, it was bumpy but certainly not inclement.

What kind of training have you endured in the run-up to the event? After 25 years of water polo and another 10 years working as a personal trainer, that’s the last thing I was worried about. I knew it would be tough, rough, and a considerable challenge ahead; after all, I am 51 years old (with a brain of a 15-year-old, ha-ha). Even though I was fully prepared for this challenge, I suffered sunstroke and tremendous back pains on the third day, and it took me a week to recover fully; however, it was all worth it. What inspired you to go for such a challenge? Is this a first for you? I had done a few short beach clean-ups last year, which opened my eyes to the gravity of the situation. The sea is my passion, and I have always been surrounded by nature, whether during fishing, hunting, snorkelling, horse riding, off-roading with my jeep in Gozo, skiing on the alps or trekking. It’s all about respecting and embracing our natural environment. We need to live and enjoy nature, but nature is very vulnerable now; it is suffering a slow but steady death, and we have only us to blame.
