Strength in Numbers

W

e are almost through the first quarter of 2021 and AAOC’s upward trajectory in membership growth, member engagement, and member attendance for its online meetings and webinars continues at an impressive rate. Now, more than ever, rental housing providers must stay active, informed and focused on moving forward, while continuing to navigate the turbulent financial, social, and public policy waters that threaten our industry, including those stemming from the COVID-19 pandemic. AAOC has presented many excellent online education programs, briefings, and other webinars over the past year. Our members are clearly finding value, as indicated by the growth in online

attendance that the association is experiencing. For the AAOC staff, volunteers, and sponsors who work tirelessly to develop, deliver and support our online programming, your attendance is a meaningful acknowledgement of their efforts on your behalf. I was particularly impressed last month by the turnout for AAOC’s member briefing on SB 91, which has extended California’s statewide COVID19 eviction moratorium through June 30, 2021. Stephen Duringer and Ron Kingston presented a comprehensive, two-hour briefing for more than 700 AAOC members, the association’s highest attended online event, which is understandable given the law’s impact on our industry.

I am so appreciative for the time and energy that Steve and Ron put into not only developing such an excellent webinar and for answering so many member questions, but also for updating our operational forms to help our members remain in compliance with the law. We are truly fortunate to have these outstanding legal minds on our side. The Scales Appear Slightly Off Balance

W

hen the scales of justice are gazed upon, they are viewed as a symbol…that law is distributed fairly. Yet, when a landlord is placed on one side of the scale and tenants on the other, there is a tip so distinct, the sound of metal chains clanking, it moves so violently in favor… So, let’s look at legislation that leads us to conclude the scale of justice may not be conducive to ownership of residential rental property.

Impact: AB 1482 limits annual (12 months) gross rent increases to 5% plus CPI in the county of the property’s location; or to 10% — whichever is less. Plus, it set standards for “no-fault” and “at-fault” evictions.

On April 6, 2020, the Judicial Council’s Emergency Rule temporarily halted evictions; and on August 14, 2020, the Council voted to extend the protections through September 1, 2020. Then two-weeks later Governor Newsom signed into law Assembly Bill 3088. Impact: There is currently no declared end date regarding Newsom’s executive order. And the courts have severely limited evictions. Tenants claiming to be adversely affected by the

Assembly Bill 1482 was signed into law by Governor Newsom in June 2019; and it placed California under a statewide rental cap on residential rental units. Unfortunately for landlords, it became effective in January 2020, during the same time the country was placed on notice about what is now known as a worldwide pandemic. COVID-19. The word alone has proven worthy of constructing a full sentence.

Governor’s Executive Order

On March 4, 2020, Governor Newsom proclaimed a state of emergency in response to the COVID-19 pandemic.

pandemic can remain in possession and not pay rent for at least 15 months.

AB 3088

Assembly Bill 3088 created the “Tenant Relief Act of 2020,” which applied protections for tenants unable to pay rent as a result of complications related to COVID-19, and effective until February 2025. Impact: In order for a tenant to qualify for the protections under AB 3088, tenants are required to sign a declaration, under penalty of perjury, that the tenant is experiencing COVID19 related financial distress. Financial verification is not required, unless the tenant had a reported income that exceeded 130% of AMI prior to March 1, 2020. Even under this situation, the landlord must adhere to very strict guidelines; for if a landlord proceeds to request documentation in violation of AB 3088, the landlord is subject to heavy civil penalties. Arguably, when


the courts do open to evictions, tenants can sign the declaration form when in court which, as a result, may undermine the intent of the need and purpose of the declaration. AB 3088 also created a “Covered Period” from March 1, 2020 through January 31, 2021, during which the tenant protections apply. The three main protections apply: 1) to a further division of periods of time; 2) each period of time has a different set of rules to be followed regarding how landlord may collect COVID-19 Rental Debt; and 3) rental debt became a “consumer debt” not part of an unlawful detainer. AB 3088 also opened up the small claims court to the middle of this year (only to have the small claims court re-open at a later date due to another law the governor signed on January 29, 2021). The first subset of dates, referred to as the “Protected Period,” from March 1, 2020 through August 31, 2020, permitted a tenant to remain in possession of their rental unit while technically breaching contract by not paying rent for the exchanged possession, if the tenant alleges COVID-19 related financial distress. While it is true that a landlord may collect all of a tenant’s Rental Debt, in full, starting February 1, 2021, collection required that landlord send a specific notice to all tenants relating to this period of time within weeks of the bill becoming law. The second subset of dates, referred to as the “Transition Period,” from September 1, 2020 through January 31,

2021, permits a tenant to continue remaining in possession of their rental unit if that tenant alleges COVID-19 related financial distress and pays an amount that equals at least 25% of each rental payment that came due for each month during this period on or before January 31, 2021. During this “Transition Period,” as was the case during the “Protected Period,” the state compelled owners to rent the dwelling units and perform all legal obligations to maintain and offer the units for rent. And all the same restrictions apply to this period of time as the first subset. The language in AB 3088 also, notably for owners/managers, places all COVID-19 Rental Debt under the debt collection category of “consumer debt.”

SB 91

On January 29, 2021, Governor Newsom signed into law the offspring of AB 3088 — SB 91. In all, the 59-page bill was introduced on a Monday afternoon and was signed into law that same week on Friday morning. The measure provides additional tenant protections, an extended eviction moratorium, and further restrictions regarding an owners/manager’s ability to collect rent. Most notably, SB 91 creates a Rental Assistance Program that will be funded with $2.6 billion from the federal government and was allocated throughout the state in an effort to alleviate some financial hardships suffered by low and very low-income tenants. The state acts as an administrator of the federal pro-

gram. Without the federal government, our state and local governments would not have stepped in to provide rental assistance. SB 91 requires each tenant make a good faith effort to apply for rental assistance if they have accrued COVID19 Rental Debt from April 1, 2020 through March 31, 2021. SB 91 prevents owners/mangers from assigning or selling any COVID-19 Rental Debt to a debt collection company if a tenant paid no rent during the period of time between March 1, 2020 and June 30, 2021, or would have qualified for rental assistance funding during the same time period. SB 91 prevents an owner/manager from “retaliating” against any paying tenant who complains to an appropriate agency as to the tenantability of a rental unit. SB 91 prevents an owner/manager from charging tenants any fees associated with late rental payments and or reporting to a credit bureau about late payments or no payments that occurred from March 1, 2020 through June 30, 2021. The new law also bars property owners/managers from deducting rent from a tenant’s security deposit without the consent of the tenant. SB 91 requires landlords to send additional notices to tenants regarding the provisional language of AB 91 as it pertains to COVID-19 Rental Debt and the Rental Assistance Program.

Sacramento — continued from 7 SB 91 prevents owners/managers from initiating an unlawful detainer action relating to COVID-19 Rental Debt prior to July 1, 2021. However, a tenant shall not be guilty of an unlawful detainer if the tenant makes one or more payments that total 25% or more of each rental payment demanded from September 1, 2020 through June 30, 2021 on or before June 30, 2021. Pursuant to SB 91, eligible uses of funds made available under the Rental Assistance Program are as follows: (A) Rental arrears. (B) Prospective rent payments. (C) Utilities, including arrears and prospective payments for utilities. (D) Any other expenses related to housing as provided in Section 501(c)(2)(A) of Subtitle A of Title V of Division N of the federal Consolidated Appropriations Act,

Additionally, any assistance provided to a tenant from the Rental Assistance Program shall include a receipt that provides confirmation of payment made out to the landlord and the tenant. According to SB 91, if an owner/ manager agrees to accept payment through the Rental Assistance Program, the landlord must agree to the following terms: (A) Limiting unpaid rental debt to 80% of the total rent due from April 1, 2020 through March 31, 2021; (B) Agreeing to release any and all claims for unpaid rent owed from April 1, 2020 through March 31, 2021. Conversely, if an owner/manager does not agree to accept payment through the Rental Assistance Program then a tenant may apply for rental arrears assistance from the local government, which shall be limited to 25% of the tenant’s total COVID-19 Rental

SB 91 provides that if an owner/ manager initiates an unlawful detainer action and the tenant files a Declaration of COVID-19 Related Financial Distress, the case shall be dismissed. SB 91 permits a locality to apply for a Block Grant through the Rental Assistance Program. The provisions of AB 3088 and its offspring, SB 91, places a state stronghold on private landlords who are business owners by mandating the landlord perform by permitting a tenant possession of a rental unit, while at the same time permitting the tenant to breach his/her duty by not providing payment for the possession. Further, it is arguable that the provisions of these bills, the state is taking private property without just compensation, which could arguably be a violation of United States Constitution.

Issues to Consider:

This article has discussed just four actions of the Governor and California legislature that has changed interest in owning/managing existing and the development of new rental housing. Rental payments, judicial remedies for intentional contractual default, intentionally clogging the courts; barring owners to occupy their own properties, increasing owners/managers duties and responsibilities, increasing operating costs, and constitutional issues are issues owners/managers must consider in the not-too-distant future. Those that advocate “cancel rent” may have just killed the goose that lays the golden egg. Preparing for Action

E

ven though 2021 is not an election year, AAOC has been very active engaging with its local elected officials, keeping them apprised of the laws and evolving issues affecting its members and the rental-housing industry, and reinforcing the association’s availability as a resource to them in the communities that they serve.

Special Election for Orange County Supervisor

The special election to fill the vacant 2nd District seat on the Orange County Board of Supervisors is on Tuesday, March 9, 2021. The election will decide who will succeed Michelle Steel, who resigned the seat following her election to the U.S. House of Representatives, representing the 48th Congressional District. The Second Supervisorial District includes Costa Mesa, Buena Park, Stanton, Seal Beach, Rossmoor, Newport Beach, Los Alamitos, La Palma,

Huntington Beach, Fountain Valley and Cypress. The special election is an all “Vote-by-Mail” election, with approximately 144,000 voters in the district. The ballots were mailed to voters on February 8, with in-person Vote Centers opening on February 27. Additional Vote Centers will open on March 6, the Saturday before the election. AAOC’s Political Action Committee has contributed the maximum amount to former State Senator and former Supervisor John Moorlach who is running in the special election. Moorlach has been a staunch supporter of the rental housing industry and private property rights and was AAOC’s Legislator of the Year in 2017.

priority bills are scheduled for hearings and votes. Red Alerts have become even more important this year because of the restrictions imposed on the State Legislature. The Capitol Building is still on lock-down mode with only one staff member for each legislator allowed inside the building. Only one person at a time can be in each legislative office, including the legislator. The seating on the floor of both the Senate and Assembly is spaced out and limited to only the elected officials. The Committee Rooms have the same limitations and the time allowed for testimony on each bill has also been severely limited.

Political Action Committees

AAOC maintains two active Political Action Committees (PACs), one for candidate contributions and one for issues-based contributions. AAOC also maintains a Legal Defense Fund (LDF) for the legal review of issues and for legal activity in service to the rentalhousing industry. In 2020, our PACs contributed over $600,000 to issuesfriendly elected officials and candidates, and to the “No on Proposition 21” campaign to defeat the expansion of rent control in California. AAOC remains vigorously committed to supporting candidates at the state and local levels whose views and philosophies align with the association and the greater rentalhousing industry.

Questions & Answers I own a four-plex in Glendale. Each unit is metered separately and each household pays their own utility bills. My question relates to the lighting in the pathways and parking area. There is no separate meter for these. The lighting seems to be wired to the closest apartment unit, so the residents are paying for these “common area” lighting fixtures. Is that a problem?

Well, it might be, but it can be easily remedied. CC §1940.9 requires you to

disclose this fact to the residents “prior to the inception of the tenancy” or “upon discovery.” Additionally you should “execute a mutual written agreement with the tenant for payment by the tenant of the cost of the gas or electric service provided through the tenant’s meter to serve areas outside the tenant’s dwelling unit.” This can be done by a lease addendum or amendment advising each resident of the issue and affirming that the resident is aware that

affirming that each unit will be responsible for a portion of the electric charges for the common areas and that amount is included in each unit’s utility bill. I understand that SB 91 passed recently and extends AB 3088. What exactly does SB 91 do?

Just when we were getting used to the mandates of The Tenant Protection Act of 2019, AB 1482, which brought us Just Cause Eviction and Rent Controls throughout California, and the COVID19 Tenant Relief Act of 2020, AB 3088, Governor Newsom has now brought us SB 91, now titled simply the COVID-19 Tenant Relief Act, which extends the mandates of AB 3088. Signed into law on January 29, 2021, the new law took effect immediately. As did AB 1482 and AB 3088, SB 91 will continue to wreak havoc on us as housing providers, making it ever more difficult to continue to provide housing to our fellow Californians. SB 91, like AB 3088 before it, limits a housing provider’s ability to evict a resident for non-payment of rent or other financial obligations (“COVID-19 Rental Debt”) that came due or will come due between March 1, 2020 and June 30, 2021, the “Covered Time Period.” Although it is intended to protect those residents who have experienced “COVID-19 related financial distress,” there are few if any safeguards that would prevent the abuse of these new protections. The new laws create two time periods within the Covered Time Period and establish different rules for each: i) March 1, 2020 through August 31, 2020, is the “Protected Time Period,” and ii) September 1, 2020 through June 30, 2021, is the “Transition Time Period.”

of late fees, and the charging or increasing of fees for services previously provided without charge, if tenant provides the Declaration of COVID-19 Related Financial Distress. It provides a safe harbor to housing providers who had to close amenities due to government or health agency directive or guidelines. It prohibits using the security deposit to cover COVID-19 Rental Debt during the tenancy or applying rent payment to a previous period without written consent of tenant. SB 91 increases small claims court jurisdiction to handle COVID-19 Rental Debt. Cannot file until August 1, 2021. May alternatively file in general civil court. Caps attorney fees at $500 if uncontested and $1000 if contested, in most cases. Requires declaration by Plaintiff affirming attempts to secure financial assistance, allows court ability to reduce award if Plaintiff does not cooperate and assist in securing financial assistance, if available, and if tenant qualifies. And it requires a new notice to be served by February 28, 2021 to all tenants who, as of February 1, 2021, have not paid one or more rental payments that came due during the covered time period of March 1, 2020 through June 30, 2021. The mandatory notice form is available from your local apartment association or by contacting the firm. I’m looking at a single-family residence to purchase. It’s a pocket listing, no signage, not on the MLS or even Zillow. The agent claims it’s a great deal because the seller needs cash quickly, wants a quick escrow, and is willing to let it go for under market. The only catch is, the tenant doesn’t know the house is for sale, and the owner doesn’t want the tenant to know. He says that when I close escrow, I can serve my own notice to have the tenant leave, but he doesn’t want the tenant getting nervous and moving out if the deal doesn’t go

through. Seems like a really good deal, I know the house, I’ve peeked in the windows, and it’s in incredibly great shape. What am I missing, what can go wrong?

Lots. You have actual notice of a tenant in possession. That means that you are bound by whatever rental agreement, or contract, exists between the owner and the existing resident. The tenancy agreement may turn out to be a fixed term lease for a long period of time at less than market rent. The resident may have a lease with an option to purchase the house for a fixed sum, possibly less than what you are paying for it. There may be litigation between the parties relating to the premises, possibly mold or some other contamination issue that you may not be aware of. If the deal really is as described, then prepare a purchase agreement providing a due diligence period allowing you a brief time period to check title, condition and other issues. Once escrow is open, and you are satisfied with title, and the condition of the premises, contact the resident, confirm the terms of his tenancy, get a copy of his rental agreement, and prepare an estoppel certificate for both the resident and the owner to sign, affirming the terms of the tenancy agreement, the amount of deposit, and affirming that he has no equitable or legal interest in the property. Dear Maintenance Men:

I am installing safety grab bars in my showers & bathtubs and I need some guidance on the installation procedure. What do I need to know to install these bars correctly? David

Dear David:

Using handrails and safety bars helps to provide stability and extra support required by the elderly and to people with limited mobility. Approved ADA grab bars are available in a wide variety of configurations, colors and finishes. The most common is the stainless steel or chrome finish. The grab-bars must be able to support a dead weight pull of 250 pounds. The preferred method is to bolt directly into the wall studs. This is not always practical, as the stud might not line up where they are needed. Grab-bars can be mounted vertically or at an angle to match wall stud spacing. If finding studs becomes a problem, alternate installation methods are available. If your walls are in good condition, you

may use large toggle bolts or if you have access to the backside of the shower or bath walls, insert a backer plate or add a new stud for an anchor point. Safety grab bars can be located at any local hardware store. It is advisable that you check ADA requirements with local, state and federal agencies for regulations governing height, distance and angle of the bars.

Dear Maintenance Men:

I am trying to do my part to conserve water and have found my toilets are the biggest offenders. The toilets constantly fill every five or ten minutes. I have replaced the fill and flapper valves but the problem persists. I’m at my wits end about this! What can I do beside replacing the toilets? Benjamin

Dear Benjamin:

Leaks at the flush valve are possibly caused by a damaged flush valve seat which may have a hole or a rim that is pitted or cracked. The seat is the large

drain hole at the bottom of the tank. A temporary repair may be to sand the seat with a steel wool pad or wet/dry sandpaper. This will remove the calcium build-up. If the seat is damaged, replacing the seat would be the next option. “Fluidmaster, Inc” makes a Flusher Fixer Kit that can be cemented directly on top of your old worn flush valve seat. This is a quick fix that may not work on all toilets. If the seat kit does not work, you will need to replace the valve seat. This can be accomplished by removing the tank from the base of the toilet. Turn off the water to the fill valve, disconnect the water line and remove any water from the tank. Unscrew the two or three brass bolts under the tank and carefully lift the tank off. Once the tank is removed, turn it upside down. Remove the rubber “spud” washer from the tank. Spin the large nut from the threads and then push the valve seat through the tank. Reverse the procedure when installing the new valve seat. Always install a new “spud” washer and new brass bolts and washers. Be sure your toilet tank is installed level, as this will aid in its operation. The new flush valve will give the rubber flapper a smooth seat for a positive seal.

Maintenance Men — continued from 16 do I get rid of the smell and keep it from coming back? George

Dear George:

Cigarette odor is very hard to remove even after painting and cleaning the carpets. Chances are, if the resident was long term, the carpets, drapes or blinds will need to be replaced. Remove the carpets, pad and tack strips. The tack

strips are wood and can absorb and release the smell of smoke, urine etc. Thoroughly clean the floors with soapy water mixed with bleach. After cleaning the floors, it is not a bad idea to paint or use a primer to coat the flooring. One of the best ways to remove the nicotine residue from the walls is using oldfashioned elbow grease! Again, wash the walls with soapy water using a brush or rag. Adding TSP (a powdered cleaning solution available at most

hardware stores) or using a degreasing agent will help in the cleaning. If you have flat ceilings, wash them too. If you have “acoustical” or “popcorn” ceilings, that’s a problem. By its nature, acoustical ceiling material cannot be cleaned. Encapsulating the acoustical ceiling with spray paint may solve the problem. You will need a primer coat and a minimum of two coats of paint. If the smell is still present, give it another coat of paint and let the unit air as much as possible. Don’t forget to wash the windows and window frames. You will be amazed at how clean the aluminum or vinyl windows will look after a good cleaning. We need Maintenance Questions! Commentary from a Broker, Owner and Manager Perspective

A Not-So-Well Known Benefit of AAOC Membership

T

hough the COVID-19 pandemic has created both temporary and permanent changes in our rental housing industry, one thing has remained consistent — your benefits of AAOC membership. This came to light when I recently received a call from a long-time member who believed they were being taken advantage of in the disposition of their property and subsequent 1031 trade into a DST. Steve then went to work and was able to get this client extricated from a bad deal on both sides of the proposed deal. Of course, not every situation will have a good ending like this, so we must all take time to fully analyze and strategize any moves we intend to make with our properties. Collecting a team of advisors and communicating with family is essential to strategizing on the way to making possible life-changing decisions. For instance, I can discuss the sales market with you as well as management, but I’m not as well versed in accounting or estate planning tools and considerations. Being on the AAOC board for so many years, I have close relationships with many of these experts who are and can refer you to them. When you bought your building, you did so for a reason. Is that reason still valid today? Personally, I bought units to provide cash flow before and after retirement. I’m much closer to retirement than I was 20 years ago when I bought, and I still want cash flow. But how much? I also now have a family and need to consider what’s best for us, instead of what’s best for me, as was the case 20 years ago. Do I, or do you, have other goals for the property? Are you interested in creating a legacy? Have you

asked your heirs if they want to hold the property or sell it upon inheriting? COVID-19, along with new state legislation and ballot measures, has created a “new norm.” For instance, passage of Proposition 19 last November could significantly alter your goals and strategies and you might want to confer with experts about this. AAOC offers many seminars and meetings featuring many of these experts. Look at the calendar in the front of this magazine for future events. Unfortunately, this “new norm” is in a state of flux due to the speed of the legislature and other changes that impact our industry. Watching and Tracking — Another Look, Six Months Later

W

ith all that has been happening due to the pandemic, along with the extension of the eviction moratorium, some rental property owners may be feeling a little desperate, if not trapped. Back in October of last year, I wrote an article entitled “Watching and Tracking as Both an Owner and Investor.” The basic message was that you need to be monitoring and following not only the income and expense side of your apartment business, but also how sales are trending on comparable properties and what other investment options might be available. Over the ensuing months, we have all coped with COVID’s impact on our day-to-day operations. Since instituting new maintenance policies as far back as last March, everyone is now scrambling for replacement items or faced with waiting months on end and then paying 30% or more for what is received. The reality is that expenses have been increasing. However, how much that has affected the bottom line is probably not as great as what has been happening with rents. Move-outs have continued throughout the entire pandemic. While some residents have been taking advantage of low interest rates to buy their own homes, others have lost jobs and moved back in with family members or friends. To keep vacancies at a minimum, increases in rental rates have slowed if not stopped completely. A few larger complexes have even been offering incentives for move-ins and/or renewals.

At other properties, owners have negotiated with residents just to keep some income flow. With the spread of the virus still not under control, many businesses have not been able to fully reopen and the unemployment numbers remain high. As a result, the eviction moratorium keeps being extended. California has made provisions to utilize federal stimulus funding to compensate participating landlords for up to 80% of rents owed between April 1, 2020 and March 31, 2021, but there are a lot of conditions that need to be met. All that said, there is some basic good news. Although the multifamily real estate market has tightened considerably, there are still buyers and the lack of inventory has kept prices from dropping significantly. Again, referencing back to that original “Watching and Tracking” article, a quick comparison of Multiple Listing Service reports run on four-unit properties in Orange County showed a downward trend in active listings from 67 at the end of July. Six months later, at the end of January, there were only 39 properties actively listed for sale. A very dramatic 58% decrease in inventory. Concurrently, closed sales nearly doubled from 47 to 92. With another 12 properties under contract, the appetite among purchasers remains strong. However, prices are trending downward from their initial listings, indicating that while the market is competitive, buyers are still being cautious.

Thus, unlike what many see in the single-family market, although multifamily property sales are still happening and the market is viable, there is no evidence of frenzied bidding wars, nor an apparent rush to sell. Everyone has a different opinion on how long the pandemic will last. The reality is that very few owners can operate in the negative for too long. Even those who own their property free-and-clear have to stop and do some hard thinking when confronted with major repairs and a significantly reduced cash flow. Does that mean selling or exchanging? Not necessarily. Much depends on your position, your goals and your expectations for the future. What you do need to be doing is evaluating your position on a monthly or, at least, quarterly basis. This includes, on the operational side, not just a review of income and expenses, but also an honest consideration of any upcoming major repair items. On the investor side, even if you have no intention of selling, by tracking what is happening to prices of comparable properties in your area, you are better prepared to make decisions should the need arise. Temporary Eviction Restrictions Morphing into Longer Term Reforms

A

fter nine months of concerted advocacy by NAA and other housing organizations, Congress included $25 billion in Rental Assistance funds in the Consolidated Appropriations Act of 2021. While this is a legislative victory for struggling housing providers and their residents, it has not dissuaded various housing policy stakeholders from continuing to push eviction moratoria and other temporary pandemic eviction restrictions. These temporary policies are coinciding with longer-term policy proposals to reform state and local eviction processes, changes that would have adverse impacts on the operation and affordability of rental housing. Eviction moratoria have become a ubiquitous feature of government response to COVID-19 in part due to academia’s support. A raft of studies were published at the tail end of 2020 focusing on evictions during COVID19. Taken together, these studies form a dual set of narratives that can be used against the rental housing industry, first suggesting that eviction moratoriums are sound policy that protect residents from displacement and by extension contracting COVID-19. Secondly, these studies suggest that evictions cause housing instability and poverty, especially for low-income renters of color, and therefore should be restricted as much as possible. Both positions have been reflected in reporting from national media outlets like CBS, The Washington Post, The New York Times,

and NPR. The first narrative has pushed policymakers to continue relying on eviction moratoria, despite the fact they leave struggling renters accruing insurmountable debt that will eventually become due. The U.S. Centers for Disease Control and Prevention (CDC) recently extended its federal eviction moratorium through March 31, 2021 at the direction of President Biden. The extension means that a federal eviction moratorium has been in place for almost a year in conjunction with various state and local restrictions. That combination continues to produce a patchwork of requirements and constraints that force rental housing providers to absorb and operate under substantial losses. However, the second narrative has greater long-term policy consequences. It implies that rental assistance, in combination with current renter protections, are insufficient to address the ongoing challenges of low-income renters directly affected by the pandemic. Policy proposals included in recentlyintroduced legislation from several state legislatures in January to address this perceived insufficiency fall into five categories. These include: 1. Rent regulation, including rent freezes and rent forgiveness; 2. Just cause eviction restrictions; 3. Eviction diversion programs; 4. Right to counsel; and

5. Eviction screening restrictions. These proposals were frequently debated before the pandemic, but now lawmakers and renter advocacy groups argue they are needed more than ever.

Adverse Housing Policies Given Renewed Emphasis

An apt example of how this narrative is affecting housing policy can be found in Maryland. Speaking about the recently passed $25 billion in federal rental assistance funds on a virtual meeting hosted by Renters United Maryland, Public Justice Center attorney Zafar Shah articulated what is an increasingly common opinion among renter advocacy groups: “It’s clear that relief money is not effective without a deeper reform of the eviction system and investing in holistic services that serve economically struggling households. We look to making housing justice happen for renters, homeowners and housing providers — to make it a top priority as Maryland builds back better.” That position has been reflected in the five-bill Housing Justice Package introduced in the Maryland state legislature this session. One of those bills is The COVID-19 Eviction and Housing Relief Act. While it provides financial relief for housing providers through a statewide program that matches state and county funds, it would implement a series of adverse emergency renter Reforms — continued on page 26

Reforms — continued from 24 protections, including a rent freeze, just cause eviction protections and an expansion of Governor Hogan’s eviction moratorium prohibiting all eviction filings except those in response to imminent threats through April of 2022. The just cause protections in the bill would prevent evictions for reasons not explicitly deemed as legitimate, as well as non-renewals of leases, something many renter advocacy groups claim is a loophole used to get around eviction moratoria. The remaining bills would establish an eviction diversion program and specific associated requirements for housing providers prior to filing evictions for nonpayment of rent, increase filing fees, create a right to counsel for renters in eviction cases and create emergency homeowner protections. Depending on how they are structured, eviction diversion programs may be beneficial in facilitating alternative resolutions and access to rental assistance. However, placing additional restrictions and requirements on housing providers’ access to the eviction process, which represents the legal avenue of last resort for retaking possession of an apartment upon a resident’s violation of the lease agreement, will not solve the underlying financial instability of low-income renters that has only been exacerbated by the pandemic. Implementing expanded eviction moratoria and increased regulation of rental housing would have adverse impacts on the supply of affordable housing. According to an October 2020 report by NDP Analytics and the National Leased Housing Association, low and moderate-income housing providers have experienced 11.8% decline in revenue and a 14.8% increase in operating expenses on average due to the pandemic, resulting in significant financial strain. If housing providers are unable to cover the property expenses and operational costs due to a lack of rental income, they may not be able to

maintain their supply of rental housing and risk foreclosure. The buyers of these distressed properties may not keep them affordable, or even as rentals. The proposed legislation will also negatively impact renter mobility and subsequently labor mobility. According to the Organization for Economic Co-Operation and Development: “Overly restrictive regulation of landlord-tenant contractual relationships is linked with lower residential mobility. To the extent that residential mobility is linked with labor mobility, this can be particularly undesirable during the post-COVID-19 recovery, which will require reallocation of labor and capital towards activities with more promising economic prospects.” Pandemicinduced job and income losses have placed many renters, particularly black and Latino adults, at increased risk of housing instability. As a result, renter mobility and housing supply impacts are likely to disproportionately effect these communities.

The Prevailing Narrative on Eviction and Poverty Is Not Universally Held

An August 2019 study by Yale economist John Eric Humphries, et al. calls into question the prevailing narrative that evictions cause poverty. Using a collection of seventeen years’ worth of Cook County court records, credit bureau records, and payday loans data, the study analyzed the financial strain of both evicted and non-evicted households before and after eviction court. The authors contend that “it is difficult to determine to what extent those associations [between eviction and poverty] represent causal relationships, because eviction itself is likely to be a consequence of adverse life events.” Their analysis shows, regardless of case outcome, that households in eviction court displayed signs of financial strain in the form of falling credit scores, rising collections, and increased inquiries into payday loans two to three years before an eviction case was filled. Additionally, even though eviction

negatively impacts credit access and durable consumption for several years, the effects observed were relatively small compared to the financial instability of both evicted and non-evicted renters experienced in the years preceding an eviction filing. While one academic paper does not settle this housing policy debate, it shows that the narrative of eviction causing poverty is not unanimously held in academic circles. Unfortunately, many of the policies proposed to mitigate evictions in response to the prevailing eviction narrative have unintended consequences. They tend to harm the very population of renters they are designed to help while failing to address the underlying levels of financial instability these renters experience. Extending eviction moratoria and implementing unbalanced housing policy will continue to place financial burdens on housing providers, especially mom-and-pop landlords. The US was already facing a severe housing shortage before the pandemic began and losing a significant amount of existing housing stock to foreclosure is a real possibility. The only responsible solution that addresses the needs of both renters and rental housing providers is swift, substantial and targeted rental assistance that addresses both the current and prospective rental debt. embers of the Apartment Association of Orange County (AAOC) enjoyed a golden opportunity to get the latest tax and estate planning information for 2021, and have their questions answered, during the association’s online General Membership Meeting

on Tuesday, February 16, 2021. AAOC was pleased to welcome back Anson Cain, Esq., with the Irvine-based law firm of Albrecht and Barney. Cain, who has become one of the “go to” legal professionals for AAOC members on tax and estate planning matters, initially noted the startling statistic that 55 per-

cent of Americans do not have an estate plan. Without a plan, an estate could go into probate for up to two years. And for those Americans who do have an estate plan, 71 percent of them have plans that are not up to date. Meeting Recap — continued on page 30

Meeting Recap — continued from 28 Cain indicated that the basic components of an estate plan should include a revocable living trust, a pour-over will, powers of attorney for asset management and an advance health care directive. He then stressed the necessity of having an estate plan reviewed on a periodic basis, and not just stored away in a filing cabinet. He pointed out that assets should be properly titled in the name of the trust, along with indicating desired and timely friends and family members. The presentation focused heavily on the implementation of Proposition 19, the ballot measure that voters approved last November and that went into effect on February 16, 2021. It has, among other things, forced individuals and families to reevaluate their estate plans, given the new rules effecting the transfer of real property from parents to children and property tax reassessment protections. “The old Proposition 58 parent-child transfer rules are out the window,” said Cain, adding, “You can still transfer a primary residence and avoid reassessment, but you must comply with new requirements.” Under Proposition 19, the residence that is transferred from parent to child would have to become the child’s principal residence within one year of the transfer for the property tax reassessment exemption to remain.

If the principal residence requirement is met, the property’s assessed value is then determined based on whether the property’s value at the time of transfer is greater than the parent’s assessed value by more than one million dollars. If the fair market value of the property is less than the parent’s assessed value (plus one million dollars) then the child takes the parent’s assessed value. If the fair market value is greater than the parent’s assessed value (plus one million dollars), then the fair market value of the property over and above the parent’s assessed value (plus one million dollars) will be reassessed for property tax purposes. Cain pointed out there are still many unknowns regarding the longterm implications of Proposition 19, including: How long after a transfer does the child need to use/maintain the home as their principal residence? Does the child need to report the residency to the county accessor’s office? And, if there is more than one child, do all children need to live in the property together? According to Cain, there are a variety of ways to effectively plan and navigate Proposition 19, including creating an LLC, Limited Partnership, or Corporation with a proportional interest transfer, such as a 50/50 split with no property tax reassessment. The key is everything more than 50 percent gets

reassessed. Each situation is different, and legal guidance is suggested to determine the best individual course of action. Insurance coverage was also discussed as part of Cain’s presentation, with him pointing out the possibility of having multiple claims at the same time. He pondered a variety of questions and possible solutions for the consideration of the online audience, including: How do you protect your personal assets in the event your tenants don’t pay their rent, or you are unable to pay the mortgage on your property? Cain concluded his remarks by reminding members of the importance of proper and timely estate planning when the “seas are calm” and then answering a wide range of questions on the topics of the evening. The Impact of Vaccines on Apartment Employees

T

here are several avenues employers can take regarding their approach to the COVID-19 vaccine. As the COVID-19 vaccination effort continues, how will this vaccine rollout impact the apartment housing industry? A recent NAA webinar, “Battling the Pandemic: The Impact of Vaccines on Apartment Employees,” takes a deeper look into the potential pitfalls and benefits of the vaccine in the rental housing industry.

and three, pregnant employees.… The FDA and the CDC have not yet approved vaccine usage for pregnant women, so if you want to invoke a mandatory vaccination program, you certainly can’t mandate pregnant women to receive a vaccine.” However, under the ADA and Title VII, there are certain requirements that must be met for application such as the number of employees. There are also state and local law equivalents to the ADA and Title VII that can apply to smaller employers. Under the ADA, the vaccination is like an employee needing accommodation regarding a broken leg. If someone doesn’t want the vaccine because of an underlying health condition, “you have to engage in the same interactive process as you would if an employee had a broken leg and is in a wheelchair,” notes Cherveny. Similarly, under Title VII, employees who have a sincerely held religious belief that conflicts with their ability to receive

Vaccines — continued from 32 your properties.” According to the webinar, employers have three options when it comes to handling a vaccine program in the workplace. Employers can mandate the vaccine in the workplace, with exceptions. Employers can motivate employees to receive the vaccine with incentives. Employers can also educate employees about the vaccine, which is the simplest and least complex way of handling the vaccine in the workplace. “The number one question I get is, ‘Can I mandate my employees to get the vaccine?’ The answer is, ‘Yes, at least for now you can,’ so long as the EEOC has declared COVID-19 a pandemic or national emergency or a direct threat,” says Cherveny. “If you’re going to mandate the vaccine, you’ve got three guardrails to pay attention to: One, the Americans with Disabilities Act; two, Title VII of the Civil Rights Act of 1964 with respect to religion;

the vaccine, employers must engage in a cooperative, interactive process to identify a viable solution for that employee. One of the biggest questions is what can employers do when employees need to enter occupied apartment homes? This is one question Cherveny receives a lot. “Listen, you’ve just given me the legitimate business reason for mandating the vaccine, and that is our criteria. Do you have a legitimate business reason to mandate the vaccine?” But how important is having a mandatory vaccine program in the workplace? “Are you prepared to fire people or move them into other positions if they refuse to get the vaccine and are not protected by the ADA, Title VII or are pregnant?
