There’s That Saying About Old Dogs and New Tricks…

E

arlier this year, it occurred to me that all of my degrees were from the 1980s and 1990s, and I became gravely concerned that my now 30-year-old skill set was at risk of becoming outdated. I needed a brush-up—a refresher. With that revelation in mind, I decided to pursue a Certificate in Digital Marketing from Columbia Business School Executive Education. For instance, for years, I had used and was most familiar with—and largely dependent on the performance of— platforms like Facebook. I had heard of other social media platforms like Twitter (now known as X), Instagram, and YouTube, but I never explored their potential. As traditional media formats (i.e. print) continue to fade into the rearview, we as both business and community leaders have a responsibility to ourselves and our clients to be adaptable during the rise of digital media.

Just as our marketing needs evolve, our marketing practices must take into consideration new channels available in our markets. Depending on your target audience and goals, different platforms can be used to yield a wide range of—both complementary and compounding—results. For instance, more and more customers are leveraging mobile devices and applications. A lot of us are already using third-party advertising providers, as they are proficient in their trade. Are you maximizing your “spend” by curating your marketing for mobile-users? Not only is the number of available options greater and more specialized than ever, the unprecedented amount of feedback available to us as property owners—and knowing how to leverage this new information—is paramount. At an absolute minimum, I think it is crucial to understand these performance metrics are available, especially regarding the effectiveness of our digital

Red Tape and Bureaucratic Blues for Apartment Renovations; Family Move-Ins.

A

re you contemplating a substantial remodel of your existing residential rental property, or are you considering acquiring a property and then initiating major renovations that will result in tenants being displaced for more than 30 consecutive days? New state law will, at the very least, affect your decision-making process about whether you undertake the task of improving the property to that extent.

Let’s look at how that new law affects the size, scope, type, amount, and necessity of the improvements, the conflict with the constitution, existing privacy laws, and if that was not enough, encourages tenants, city attorneys, county district attorneys and the state attorney to name you a litigant. SB 567 (Durazo) redefines “no-fault” eviction where an owner intends to demolish or substantially remodels residential real property, where: • A “remodel” must not be able to reasonably be accomplished in a safe manner that allows the tenant to remain in the dwelling and must require the tenant to vacate the property for at least 30-days (all of this is open to interpretation and litigation). • The tenants (all of them) are not required to vacate the property on any days where a tenant could continue living in the dwelling without violating health, safety, and habitability codes and laws (once again, this is open to interpretation and litigation). Property owners who intend to remodel must describe the remodel to be completed to all tenants, the approximate expected duration of the remodel, and: • Provide a copy of the building permit (now, the waiting period to evict the tenants will increase exponentially because owners did not need to wait multiple months

to begin eviction and initial remodeling). • Notices to the tenants must state the if there is a need to abate hazardous materials must include for the first time ever, copies of the signed contracts with the contractor hired by the owner to complete the remodel which “reasonably” details the work that will be undertaken. • A notification that if the tenant is interested in reoccupying the rental unit, the tenant must inform the owner of their interest. Where an owner contemplates moving themselves, their spouse, domestic partner, children, grandchildren, parents, or grandparents into the unit, on the other hand, those persons(s) must occupy the property for 12 continuous months as their primary residence and must move in within 90 days following the tenants’ departure (there are limited exceptions). Should the owner decide to pursue this new avenue to regain possession, the owner shall provide the name or names and relationship to the tenant and the tenant may request proof that the intended occupant is an owner or related to the owner. In this case, an owner may violate federal and state law if an intended occupant is related to the owner by requiring the owner to release the name and relationship because the owner may violate the U.S. Constitution purSacramento — continued on page 8

Sacramento — continued from 6 suant to the First, Third, Ninth and Fourteenth Amendments by mandating disclosure of information about Californians against their will. The right to privacy is a fundamental right. The right to privacy is essential for protecting human rights, democracy, and personal freedom. In addition, SB 567 forces owners to violate Article 1, Section 1 of the California Constitution, which gives each an “inalienable right’ to pursue and obtain privacy. SB 567 also forces owners to violate the California Consumer Privacy Act of 2018 by denying some consumers— renters in this case—rights that private citizens have fought lifetimes to achieve. Thus, the ever-present question is why should one new law destroy how personal information is obtained, distributed, used, disseminated, and safeguarded? Why? Because the legisla-

ture and Governor said so! To compound the difficulties of this new law, city attorneys, county district attorneys and the state attorney general are incentivized to sue property owners that seek to improve, remodel, or use the property for their family. There are additional issues to consider should owners want to engage in substantial remodeling or moving a qualified family member into the property because we submit that the new law disincentives owners to undertake substantial improvements to property or help family members live in the property. For an owner to move family members into the property, the owner must be a “natural person” who has at least 25% ownership interest. This will have a dramatic impact on potential owners’ decision-making process to acquire and improve property. It will affect property that is currently owned and rental property that may be acquired in the future. Thus, this will

deter potential owners from investing. The new law serves as an additional impediment to ownership because an owner cannot control for involuntarily distributing personal information about family member(s) that will occupy one or more of the dwelling units. The owner that is to disseminate the personal information about the family members will also have to expect the state Attorney General to sue them for violating multiple laws. Please remind us, then, why would an owner or prospective owner own and improve rental property? Rent Control Supporters are Getting Desperate… and that Should Scare You Even More

B

y now you have heard that the “Justice for Renters” initiative, underwritten by Michael Weinstein’s AIDS Healthcare Foundation—yes, money intended to provide support services to AIDS patients is being used to push for stricter statewide rent control—will be on the November 2024 ballot. However, property owners have started fighting back.

• The coalition to oppose Weinstein has already set out a plan to outraise what it did for its opposition to his previous rent control initiatives— Proposition 10 (2018) and Proposition 21 (2020). • A ballot initiative petition is now also circulating that would ban Weinstein (or others) from using foundation funds for political purposes. • The rental registry in Santa Ana that was launched this summer has been seen as so invasive that property owners and residents, alike, are pushing back on the city’s compliance mandates. • The recall election for Santa Ana City Councilmember Jessie Lopez (Ward 3), who was a major proponent of rent control in Santa Ana, has been set for November 14, 2023. Additionally, there has been considerable progress on AAOC’s lawsuit against the city of Santa Ana which has highlighted major problems in the way the city’s rent control ordinance was passed—with an administrative law judge even recently indicating there may be major problems that the city allowed to occur when it was passed. Furthermore, there has been some notable online coverage on the rent control issue in Orange County— • The OC Independent exposed the issues with the rent registry’s invasive and potentially illegal nature—

Santa Ana Rental Registry Roll Out Criticized As Intrusive and Burdensome—OC Independent (ocindependent.com) • The Voice of OC has identified that the issues surrounding rent control in Orange County will lead to more cities looking at the policy—only to abandon it as a solution—Rent Control Might Be on the 2024 Ballot in Santa Ana; Will Other Cities Follow? (voiceofoc.org) There has been great progress in advocating for property owners’ rights. But that’s when rent control advocates get desperate... The Santa Ana City Council has recently begun working on some egregious policies— • First, council members attempted to require a 2/3 council majority to make future changes to the ordinance. • Then, they tried to override the city attorney’s direction against such a change • Now, they are trying to rush through and place a voter initiative on the November 2024 ballot to make rent control part of the city charter— and require a 2/3 majority to change the policies. In other words—they’re desperate. They know that Councilwoman Jessie Lopez is likely to be recalled this November.


They know they are going to lose their council majority when she is recalled. They know AAOC’s lawsuit poses serious threats to the city’s rent control ordinance and the pro-rent control majority. They see the writing on the wall— the party is over. Now, before you pop the champagne, remember the adage— “Desperate times call for desperate measures.” Take some time and watch the city council members’ actions at the September 19, 2023 meeting. The meetings are archived on the city’s website and viewable on YouTube— Agendas and minutes—City of Santa Ana (santa-ana.org) Erratic is an understatement—but this is what happens when those in control sense their political power is slipping away. The council majority is desperately trying to force through policies without fully vetting the impact of those policies.

• The rent registry that the city just rolled out violates several state constitutional provisions—and many federal housing policies. • The city rent control ordinance still has several state and federal constitutional problems before it is settled. • The city is still trying to decriminalize public intoxication, street racing, and at the same time providing voting rights to non-citizens. And the council majority is trying to jam through policies that not only codify these problematic policies—but would also require a 2/3 majority to make changes when additional shortcomings are uncovered. These are not just desperate grasps on power—they represent an irresponsible way to govern. So, what can you do?

Questions & Answers I keep hearing about the “spread of rent control” and I know Santa Ana has it. But I recently heard it was defeated in Buena Park (as well as Claremont in Los Angeles County) and then I read somewhere that both cities are passing “Just Cause.” I’m a bit confused. Can you tell me the difference between “Rent Control” and “Just Cause”?

While some cities have both “Rent Control” and “Just Cause” rolled up into a single ordinance, (e.g., the City of Los Angeles) the two are very different and govern different activities. “Rent Control” is an ordinance enacted by a city in an attempt to limit the amount a landlord may increase rent during a 12-month period. Some cities have both a floor and a maximum increase, such as a minimum of 1.5% and a maximum of 10%. Other cities cap it at a specific percentage of the CPI change over the prior 12-month period. For example, a city can limit a rent increase to 60% of the change in CPI.

On the other hand, “Just Cause” is a set or laws governing the reasons for which a landlord may terminate a tenancy. There are typically two categories of permissible terminations, including “at fault” and “no fault” terminations. As you might imagine, “at fault” means the tenant did something wrong, such as failing to pay their rent, allowing an unauthorized occupant to live in the unit, or engaging in some type of nuisance behavior. “No fault” terminations mean the landlord is terminating the tenancy even though the tenant did nothing wrong. For example, a landlord may want to move him or herself, a child, or grandparent into the unit, or they may want to permanently remove the unit from the rental market altogether under a law known as the Ellis Act. While Santa Ana does, in fact, have both, Buena Park has “Just Cause” only. Still, even though Buena Park does not have its own Rent Control ordinance, unless your property falls under one of the exemptions provided, (e.g., new

construction less than 15 years old, etc.) residential rental units can still be governed by California’s version of rent control, known as the Tenant Protection Act of 2019 (AB 1482). Recently, I had a disagreement with my tenant who told me I couldn’t come in to her apartment because I hadn’t provided her with “proper notice.” It’s my understanding that as long as I provide at least 24-hour notice ahead of time, I am permitted to enter. Is that not the case? I sent her the text two days before I went over, and she still told me my notice was not “proper” so she didn’t have to let me in.

Sounds like you are dealing with someone who is both a bit difficult and knowledgeable. Conceptually, you are correct. Generally speaking, you can enter the unit upon providing the tenant with at least 24 hours’ notice, provided you are trying to get in during normal business hours. However, there are some limitations. For example, you


cannot simply “text” your 24-hour notice (unless the tenant replies, indicating you are given permission to enter). Instead, you have to either post it on the door, give it to them in person, or mail them a copy (adding 5 days for mailing). In other words, if you mail it, you have to do so at least six days before you want to go into the unit. We own a small residential building in Oceanside. Recently, a tenant failed to pay rent, so we gave him a three-day pay or quit notice. He then paid within the threeday period using a personal check that, you guessed it, bounced! Do I need to serve him a new three-day notice now?

No. Tendering rent is not established simply by giving you a personal check that is returned for insufficient funds. Instead, the check must clear and his failure to provide you a good form of payment amounts to a failure to comply with the three-day notice. You can move

Interestingly, California legislators recently passed a bill limiting landlords to a single month’s rent as the maximum security deposit.

Luckily, you are not required to return, or account for the security deposit until both of them have vacated and returned possession of the property. Instead, the tenant who vacated will need to work something out with the individual who stayed. Once both original lessees vacate, you will be required to account for the security deposit within 21 days of the date on which they returned possession. The accounting should be sent to the last known address of the tenants (unless the lease requires a shorter time

After checking and repairing any roof damage, we recommend looking at the outside walls of the property. Stucco, wood siding, or other vertical surfaces is the building’s skin. Cracks, breaks, and other damage to the siding invite “infection” to your building. This “infection” can take the form of wood rot, mold, siding delaminating or separation from the subsurface, and material breakdown of the stucco will cause discoloration and crumbling. Common siding material found in most buildings is stucco, wood, brick, vinyl, or concrete panels, etc. Water intrusion of the siding can find its way through the smallest cracks by capillary action or more directly from misaligned sprinklers or

other water sources. A little known and often forgotten solution to leaky windows is the clogged weep holes along the bottom of the window frame and track. These weep holes clog with dust and debris and very easily can cause water to enter the building through the window frame or even through small cracks in the stucco or siding at the edges of the window frame.

There are two ways to effectively control exterior lighting: 1. A timer clock 2. A photocell for detecting light and dark Both time clocks and photocells have been around forever. We prefer to activate landscape lighting with a photocell as it is virtually maintenance free. A photocell will ensure the property has light only when it is needed and turn off automatically with the approach of daylight. Be sure the photocell is located where it can “see” ambient light and not near an artificial light source. A time clock needs constant attention in order

I am a new owner of a 1965 four-plex. I am living in the front owner’s unit. It truly is a great place to live but I am quite concerned about my privacy and the fact that I can hear my tenant’s conversations, and their TV or radio through the common wall between the units. I figure if I can hear them, they can hear me. I do know I probably lack insulation but do not want to make the expense of ripping drywall out and so on. Do you have any other suggestions? Tom

We agree, the worst job to do in an occupied unit is significant drywall work. The dust and debris are awful no matter how good your dust control method. Fortunately, in your case, you can address this problem by using a product called Acoustic-coat #150 which is basically a lightly textured, water-based flat latex paint, formulated with hollow ceramic microspheres and sound absorbing fibers and resins. To spare our readers a crash course in


chemistry, we will give you the basic highlights. Acoustic-coat #150 is a sound reduction paint, which can reduce sound transmission by 30% and will also dramatically reduce sound echo in the room. Acoustic-coat #150 can be used on walls and ceilings, and it also has excellent insulating properties. This sound reduction paint is most effective for speech range frequencies. We are getting close to the holidays, which means more people at your apartment buildings. Chances are, some of those residents will be inviting guests for dinner over the coming holidays. For some of these residents, this will be the first time this year they will turn on the oven! What are the odds you are just starting your own dinner or you are sitting down with your own guests when an emergency call comes to you on Thanksgiving Day from one of your residents? That call might be about a clogged sink or non-working oven with an apartment full of guests waiting for dinner. This scenario can ruin both you and your residents’ holiday. The answer is: Preventive Maintenance. Remember, the holiday season starts with Halloween and the demand on your properties only gets worse from there. Check each stove and oven for proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a pilot light being out. Also, check the oven’s temperature calibration with an oven thermometer. Are Your Building’s Balconies Safe?

C

oastal communities provide an abundance of breathtaking views, often enjoyed from rows of balconies facing west to the ocean and setting sun. These perches are iconic in seaside communities—a big draw for tenants entertaining friends, relaxing with a book, or enjoying their own piece of the outdoors. Considered a valuable amenity in Southern California’s multifamily real estate market, balconies, decks, raised walkways and platforms can also be a significant liability. A series of collapses has prompted new laws in California requiring regular inspections of these structures to ensure safety. The most infamous of these collapses was a 2015 balcony failure in Berkeley that killed six young adults and seriously injured seven. Many of those victims were college students from Ireland. The accident sparked legislation requiring stricter building oversight and reporting, along with recurring inspections. The first law, SB 465, tightened

down on surveillance and reporting of shoddy construction. A second law, SB 721, known as the “Balcony Inspection Bill,” requires recurring inspections of decks, balconies and other “external elevated structures” in multi-family residential buildings to ensure their safety. The inspections must take place every six years, or sooner, if the property is sold. A third law, Senate Bill 326, requires homeowner associations to have their balconies inspected every nine years.

What causes balconies to fail?

Dry rot was determined to be the cause of the Berkeley collapse. The structure also had a history of complaints from tenants of a fungus growing out of the wood—a primary sign of dry rot, along with bubbling paint, spots of orange-brown spore dust, and brittle or spongy wood that crumbles at the touch. More than $20 million in settlements were paid to the families of the victims of that fatal fall, a clear sign that the situation was considered to

have been preventable. Faulty construction—including deficiencies in flashings, external joists, supports, and other areas of a structure that permit water seepage—can also significantly damage the integrity of a structure when left alone. The catastrophic Champlain condo collapse in Florida last year is believed to have been caused by years of water seepage and damage caused by an improperly installed concrete slab beneath a raised pool. Cracks in supporting columns, beams and walls had been caulked over repeatedly to cover the structural flaws.

What do balcony inspections entail?

A thorough and accurate inspection requires the right knowledge and experience. Generally, inspectors will look for the following signs that a structure may be compromised: • Moisture damage and wood rot, not just on the exterior, but deep inside framing cavities. Horizontal and parallel beams that support the deck should be inspected, as moisture can lead to decay of support beams. Proper moisture protection should be in place to avoid future problems. • Waterproofing materials and applications, such as flashings, membranes, coatings, and sealants that protect the load-bearing components of exterior elevated elements from exposure to water and the elements will also be inspected.


The construction of a structure will be reviewed. Connections should be installed with proper fasteners. Wobbly railings and loose stairs—usually the result of improper fastening—are all causes for concern. • Corrosion of metal fixtures and fasteners is also an indication of unsafe conditions. • Cracks in wood can be an indication of damage. • Flashing should also be checked to ensure it was installed properly and is not allowing moisture into the wood. Most apartment owners have worked very hard for their property. It may be what they rely on for their retirement income. It’s definitely smart to protect that investment and the income it generates. Addressing IRO Misconceptions An independent rental owner (IRO) is more involved in daily property management activities than one may think—here’s how IROs go above and beyond to serve local communities. BY POWERED BY IRO

ental housing plays a vital role in communities across the country, providing millions of individuals and families with safe and comfortable homes. Unfortunately, aspects of the apartment industry can be mischaracterized, leading to misconceptions about its business models and impact. The National Apartment Association’s (NAA) Independent Rental Owner (IRO) Committee wants to shed light on the realities of rental housing, addressing some misconceptions and presenting a clearer picture of the industry.

What Exactly Is an IRO?

Smaller rental portfolios—sometimes referred to as “mom-and-pop” housing providers—are independent rental owners. IROs are an individual or individuals that are active in both

the ownership and management of their properties. IROs can be smaller in scale or have multiple properties. They’re often on call 24/7 to help their residents and respond to emergencies. IROs are individuals who have invested their hard-earned savings into providing quality housing options for their residents, and this is how IROs pay their own bills, make a living and set aside for retirement. Contrary to popular belief, smaller owners make up the majority of the apartment industry. In fact, the National Association of Realtors notes that 46% of the nation’s 49.5 million rental units are small properties—those with just 1–4 units—and a whopping 70% of these properties are owned and operated by smaller housing providers. By acknowledging the significant presence of IROs, we can better appreciate the

diverse range of rental housing options available to individuals and families across the nation.

Operating on Narrow Profit Margins

IROs—like the broader rental housing industry—do not operate on highprofit margins. A significant portion of the revenue generated from rent is reinvested back into the property and community. Approximately 91 cents of every dollar of rent goes toward essential spends such as staffing, maintenance and critical expenses like property taxes and insurance, those necessary to ensure that rental housing remains operational for generations to come. Independent rental owners are far from distant operators, they are our neighbors and an integral part of our communities—often living onsite at smaller communities. They are teachers, emergency services professionals and members of various other professions, actively contributing to the well-being of society beyond their roles as rental property owners. For many, this is their one and only position—to provide housing as an independent rental owner. SCOTUS Declines to Hear New York Rent Control Case

With this decision, the prior Court of Appeals ruling stands.

O

n October 2, 2023, the Supreme Court of the United States (SCOTUS) denied certiorari (denied review) in Community Housing Improvement Program v. City of New York, New York (CHIP v. NYC). 74 Pinehurst LLC v. State of New York was redistributed for conference and will be reviewed again on October 6, 2023. The National Apartment Association (NAA) will continue to track the outcome of 74 Pinehurst LLC. The Court’s decision not to hear CHIP v. NYC is devastating to an industry plagued by years of ineffective rent control policies that only exacerbate housing affordability challenges.

SCOTUS’ decision also means that the ruling of the Court of Appeals for the Second Circuit stands. Earlier this year, in CHIP v. NYC, the Second Circuit affirmed the district court’s ruling that the owners (PlaintiffsAppellants) failed to state claims for violations of the Takings Clause. The Second Circuit reasoned that “no provision of the New York City Rent Stabilization Law (RSL) effected, facially, a physical occupation of landlords’ properties in violation of the Takings Clause because the landlords voluntarily invited third parties to use their properties.” The Second Circuit also reasoned that the “RSL did not effect a regulatory taking because the landlords

did not plausibly allege that every owner of a rent-stabilized property suffered an adverse economic impact.” However, rent control distorts the housing market by acting as a deterrent and disincentive to developing rental housing, often expediting the deterioration of existing housing stock. While done under the guise of preserving affordable housing, rent control policies hurt the very community they purport to help by limiting accessibility and affordability. NAA will continue to advocate on behalf of its members and encourage policymakers to implement effective policy solutions to help resolve the nation’s housing affordability issues.

Unlocking Tax Relief: Property Owners Navigate a Way to Decrease Expenses

I

n times of economic uncertainty and market fluctuations, property owners are especially motivated to find innovative ways to mitigate financial challenges. This holds particularly true for real estate owners facing a dual threat – sinking property values and an unfavorable regulatory environment. In San Francisco, Los Angeles, Santa Ana, and other cities in California that suffer from restrictive local rent control laws, these factors have converged, prompting investment real estate owners to flood the counties with appeals to reduce their property assessments and tax payments.

San Francisco: A Tale of Shifting Fortunes

San Francisco, a city renowned for its vibrant tech scene and picturesque landscapes, has been grappling with a prolonged decline in real estate prices. As the city’s real estate market bears the brunt of economic challenges, property owners have increasingly turned to property assessment appeals as a means of reducing their tax burden. For the fiscal year that ended June 30, San Francisco tax filers asked for an average 48% reduction on property assessed at more than $60 billion, according to filings with the city’s assessor’s office compiled by Bloomberg. This approach enables them to lower their property tax payments, providing much-needed relief in an otherwise challenging economic landscape.

The Santa Ana Rent Restriction and Multifamily Property Value Implications

Meanwhile, in Santa Ana, property owners are facing a distinct challenge in the form of a 2.54% rent cap, coupled with approximately 20% year-over-year inflation of goods and services related to property ownership, all of which has contributed to the devaluation of multifamily rental properties. Rental properties are predominantly evaluated based on the income they generate, a principle that forms the foundation of real estate investment. In the context of Santa Ana, the implementation of a local rent cap introduced a unique dynamic. While the Rent Stabilization Ordinance aims to alleviate housing costs for tenants, they do not account for the rapidly rising costs of property ownership and have led to lost income and lower property values for housing providers. The constrained rental income potential has diminished the attractiveness of these properties to investors, causing a decline in their market value. Interestingly, this stands in contrast to the trend in neighboring primary residences that are not for rent, where values have surged. These properties, unaffected by rent caps, have capitalized on the robust demand for housing in the vibrant Orange County market, resulting in substantial value appreciation. Likewise, multifamily properties in the rest of Orange County that don’t have local rent control restrictions have also seen a sharp rise in rental prices and property values. This juxtaposition

underscores the intricate interplay between market policies, rental income, and property valuations within the broader real estate landscape. My sense is that cities and counties that continue to unfairly punish housing providers will see more lawsuits challenging these policies, and a reduction in the availability of housing as investments in these markets are no longer attractive. The devaluation of multifamily rental properties in Santa Ana and other cities that have restrictive rent control laws underscores the need for property owners to explore alternative avenues to mitigate financial strain. Just as in San Francisco, appealing property assessments could offer a viable strategy for rental property owners looking to navigate these challenging times.

In times of economic upheaval and market uncertainties, property owners must adapt and explore innovative strategies to weather the storm. The experiences of San Francisco’s real estate community serves as a valuable blueprint for rental property owners in Sant Ana and beyond. By proactively engaging in property assessment appeals, beginning with getting a property valuation from a qualified real estate agent, owners can potentially reduce their tax burden and alleviate financial strain caused by sinking property values and regulatory constraints. Regression to the Mean? What Lies Ahead for Interest Rates

I

keep hearing interest rate forecasts being packaged into three words: “Higher for longer.” However, that phrase uses relative terminology—higher than what, longer than what? Federal Reserve Board member Raphael Bostic offered a kind of mini clue in September when he indicated that the Fed would need to keep interest rates higher for longer [and further elaborated] than historically happens. We’ll touch on the historical aspect later, but for the record, let’s stipulate here that no one is able to reliably determine where interest rates will be in the future, in the same way that no one is able to know future stock prices. Yes, there are educated guesses based on informed analysis, but with market conditions constantly in flux and black swan events regularly blindsiding markets, it’s impossible to predict the financial future with certainty. Rate forecasting is thus inherently dicey by the very nature of the universe within which interest rates operate. With that said, my read of the prediction of “higher” rates simply means: higher than current rates. There are, of course, different interest rates for different loan types. For our purposes we’ll focus on one important interest rate barometer: The tenyear U.S. Treasury security, generally considered the benchmark for longterm interest rates and used by lenders as a baseline for setting interest rates on things like mortgages loans.

As of this writing, the ten-year yield is 4.30%, suggesting that the “higher for longer” forecasters expect the tenyear yield to move above 4.30% in the future, which in turn implies that current 30-year home mortgage rates, now averaging roughly 7–7.25%, would stay north of those levels going forward. As to historical context… The past sixty-year average of the ten-year treasury yield = 6% That 6% sixty-year average breaks down by decade as follows: • 2013–2022: 2.15% • 2003–2012: 3.67% • 1993–2002: 5.89% • 1983–1992: 9.10% • 1973–1982: 9.36% • 1963–1972: 5.82% Given that the current ten-year treasury is at 4.30% versus the sixtyyear average at 6.0%, and applying a simplistic regression to the mean theory to those figures, the implication is that today’s interest rates would need to rise another 170 basis points to reach the sixty-year mean interest rate of 6%, an unpleasant prospect for borrowers. As to the second part of the forecast calling for rates to be higher for “longer,” the consensus view seems to hold to a traditional concept that rate levels will be a function of the strength of the US economy. Recessions bring lower interest rates as borrowing slows, while October 2023

sturdy, growth economies provide no reason that interest rates need soften. So far, the data tells us that the U.S. economy is chugging along with modest growth and running at near all-time low unemployment, supporting the idea that a recession is not imminent and thus that rates can remain at elevated levels for an extended period (i.e. higher for longer). My own view is that already sharply higher short-term interest rates—the Fed has raised short-term rates by 525 basis points since March 2022—are becoming increasingly debilitating for ARM borrowers, portending economic stress in the near term that will soon suppress economic vitality, which would tend to have disinflationary effects and trigger a move to softer long-term interest rates. I don’t doubt the Federal Reserve’s strong resolve to shrink aggregate demand by keeping high short-term rates in place—bank prime rate is now 8.5%—to achieve its ultimate objective: a sustainable 2% inflation rate. Low inflation is what will bring down long-term interest rates. It may take a few years, but the powerful Fed has the tools to accomplish its objective and, therefore, I expect long-term rates to gradually decline as the high inflation numbers of the past almost two years are slowly but surely wrung out. That said, we’re not going back to
