elcome to 2022 — A new year that will surely bring many challenges and opportunities our way. Throughout our history, the AAOC has provided unparalleled service to the thousands of rental-property owners, operators, and vendors who have comprised our membership over the past 61 years. We have also been fortunate, over these many years, to have had some of the best and most qualified individuals volunteer their time and resources, in service to our association, as members of our Board of Directors. The AAOC’s past presidents and board of directors, as well as our executive directors, have always taken a very thoughtful and strategic approach to the protection of our industry, and 2021 was no exception. In the past three years alone, our industry and our livelihoods were threatened on multiple levels and fronts.

This year, we plan to go on the offensive and take the fight directly to those who seek to erode our private property rights, impede our ability to operate our businesses effectively, and diminish our ability to enjoy the fruits of our labor. We must push back against the individuals and entities that are working against us, who are hostile to our industry, and who view the men and women who provide quality rental housing in our communities as a problem. Enough is enough! We are actively reaching out to our property owner and operator members, our Product and Service Council members, and our industry partners to not only get involved as part of our legislative advocacy program, but to also contribute to our 2022 election year war-chest, via our political action committees. This is a critical year for AAOC and our rental-housing industry. The threats to our industry have never been greater. The need for member involvement has never been greater. The time to step up is now. Please make it your new year’s resolution to join the fight in 2022. Advocating Community Interest

S

enate Bill 1196 was authored by Senator Tom Umberg and approved by Governor Newsom on September 30, 2021. The bill’s intent was to amend Penal Code section 396 because the Legislature determined to legally protect consumers because, “some merchants have taken unfair advantage of consumers by greatly increasing prices for essential consumer goods and services,” during a state of emergency or local emergency. As a rental housing property owner or manager, when you read Section 396, you might think, “just how does California’s Penal Code affect me?” But as you go on, you become shocked to find among the bill’s language, lies yet more restrictions that must be learned and practiced within the rental housing industry — in the event a future emergency presents itself and the emergency is determined by government. Emergencies consist of a wide range of issues: wildfires, drought, COVID-19, homelessness, oil spills, etc. Some have even argued the lack of housing, or the lack of affordable housing, constitutes a “state of emergency.” Section 396 says that upon proclamation of a state of emergency or of a local emergency, and for 30 days thereafter, certain violations would be chargeable as a misdemeanor: punishable by imprisonment for up to one year, a fine of up to $10,000, or by both. Additionally, a violation of Section 396 shall constitute an act of unfair competition and the penalties are cumulative.

So, what violations could cost a property owner and/or manager $10,000 or imprisonment? 1. It is unlawful for any person, business, or other entity, to increase the rental price (advertised, offered, or charged) for housing, to an existing or prospective tenant, by more than 10%. However, a greater rental price increase is not unlawful if that person can prove that the increase was contractually agreed to by the tenant prior to the proclamation or declaration. 2. It is unlawful for a person, business, or other entity to evict any residential tenant of residential housing after the proclamation of a state of emergency or upon the declaration of a local emergency following that proclamation or declaration. 3. It is unlawful to rent or offer to rent to another person at a rental price greater than the evicted tenant could be charged under this section. Furthermore, Section 396 creates law permitting the extension of the state and/or local emergencies for additional periods of time, as needed, by a local legislative body, local official, the Governor, or the Legislature, if deemed necessary to protect the lives, property, or welfare of the citizens. Each extension by a local legislative body or local official shall not exceed 30 days. There are many governments that refuse to

identify when a state of emergency will sunset. We know of emergencies that were declared in 2017 and are still being enforced. Pursuant to Section 396, a “state of emergency” and “local emergency” mean a natural or manmade emergency resulting from an earthquake, flood, fire, riot, storm, drought, plant or animal infestation or disease, pandemic or epidemic disease outbreak, or other natural or manmade disaster for which a state of emergency or a local emergency has been declared by the President of the United States, the Governor, or other governing body vested with authority to make that declaration in any county, city, or city and county in California. COVID-19 taught rental housing property owners and managers a brutal lesson because the industry was starved for nearly two years by an eviction moratorium. Section 396 now requires rental housing property owners and managers to learn a new skill…that of fortune telling. Leases are now expected to include contractual language with an appropriately, yet speculated, and calculated rental price increase that will not violate the provision of AB 1482. And at the same time the lease must include contractual language agreed to by the tenant that he/she/they agree to the hypothetical increase, should a subsequent lease for an additional term be Sacramento — continued on page 10

Sacramento — continued from 8 executed during a state of emergency and/or a local emergency. While it is true that Section 396 defines “state of emergency” and “local emergency” with a list of terms, the definition also includes a “manmade disaster for which a state or emergency or a local emergency has been declared…” So the question begs to be asked, hypothetically speaking — what if a city council declares a local emergency based upon a shortage of housing. Should a housing shortage be considered justification enough for a proclamation, which engages Section 396’s time clock? If government creates the housing shortage based upon authored and approved bills written based on reviews, environmental aspects, fees and charges, hearings, etc., how can its constituents be held accountable for the existence of the emergency, or justly be burdened by the emergency the government created? SB 1196 offers no sunset date, which means the provisions set out in Section 396, are indefinite and there must be greater justification for what can be considered a state of emergency or local emergency. By all accounts, the government can forever make declarations of emergency in one or another, whether it be: water shortage, drought, wildfires, oil spills, crime waves. All of which could trigger price control of rental property. Government must be held accountable for its actions…for

the laws it writes and enacts…then requiring laymen to understand and follow legalese.

Reccomendation

Property owners ought to include an acknowledgement addendum for tenants to sign acknowledging the future rental price increase because it “kills two birds with one stone”: 1) it provides notice to the tenant; and 2) the acknowledgement becomes a contractual term and if the tenant so chooses to sign a subsequent lease, the tenant will know what that increase amount is.

Future Challenges

Unquestionably, our industry needs further clarification. Consider the following issues that the Penal Code poses on our industry. • Government does not have to financially assist rental housing owners during any emergency order. • Government has an extremely small hurdle to clear when calling for the establishment of an emergency order. • Emergency orders can go on for years. Emergency orders today don’t even have sunset dates. Why? There must be sunset dates that are set and if government wants to extend a date, they must show they are helping facilitate rental properties coming online. Otherwise, owners will be persuaded to stop the development of housing.

• During the state of emergency government is not required to do anything for the rental housing industry, it doesn’t have to truly help those in need. For example, the governor declared a state of emergency in 2018 when the town of Paradise burned to the ground and at least 85 people were killed and at least 19 people were injured. What, if anything, did government do to provide financing or grants to rebuild the town? For the rental units that were not destroyed, rent restrictions were immediately imposed. • The Penal Code places heavy restrictions on property owners who have not rented before in areas that are subject to an emergency order. Why? We understand the notion of rent gouging. We also understand government is placing major roadblocks for property owners that want to rent the property thereby helping housing shortages. Restricting rental units from coming online will hinder not help adversely affected areas. • Emergency orders must be restricted to areas. An oil spill off Huntington Beach should not affect rental housing in Sacramento County. • An emergency order must be related to the issue at hand. What does an emergency order in Huntington Beach have to do with rental housing in Orange County? Nothing of course! 10 Ways to Fix Multi-Family’s Future

L

ast year taught us that the landscape in which we operate had changed significantly. Over the past few months, we’ve analyzed how an already hostile environment for the housing industry managed to get even worse in California. More importantly, we’ve worked to identify a path forward, and have started to put those plans into motion. Here are 10 ways that AAOC will be working this year to fix multi-family’s future. 10. EXPAND PRESENCE — The Multi-Family Housing Industry needs to be more visible — we house more than half of the country — especially in major cities — and nearly everyone has lived in multifamily housing at one point in their lives. We all have memories, commonalities, and unique experiences of being a part of a multi-family community. We need to use the tools at our disposal to remind everyone about the positive experiences and

the benefits provided by multi-family housing in our communities. 9. ENGAGE OUR COMMUNITIES — Whether it’s through increasing communication, highlighting improvements, or promoting activities, building a stronger rapport with residents to ensure their confidence in your management will help create allies as we work to change the perception of the multifamily industry. In order for residents to think differently about us, we need to think differently about communicating with them and to their needs. That open dialogue will serve as a trust builder that will allow for opportunities to work collaboratively as issues arise that affect the industry. 8. CHANGE THE DISCUSSION — Take the time to really highlight what the industry truly represents: Homes. Neighbors. Community. Careers. Investment. Opportunity. Affordable Housing. Comfort. Quality of Life. Connectivity. Livability. Multi-family housing sets the standards of expectations for all of these categories – and we need to make sure everyone recognizes that. 6. EMPOWER PROGRAMS — Setting the standards mentioned above is the purpose of an organization like the Apartment Association of Orange County. In doing so, we will proactively seek out ways to influence the programs, policies, and structures that regulate and shape our industry. Working with state, county, and city housing programs, AAOC will position itself as part of the solution created by policies affecting multi-family housing. 5. CHANGE LEGISLATION — We are already putting together our legislative agenda for 2022 — and it reflects a great deal of what we’ve covered here. We will be seeking to change the ways laws are written that affect our industry — and how


the industry and its components are referred to in the public policy. We are moving towards changing the terms and phrases used in multifamily housing laws to language that is more inclusive and supportive of the industry, as opposed to divisive and impersonal. 4. AFFECT ELECTIONS — AAOC has long been involved in elections at the local, state, and national levels. However, we have been involved in more traditional ways. While these approaches have been effective in the past — they are losing their effectiveness and becoming less impactful as the nature of elections and electoral politics evolves. Using our partnerships, coalitions, structures, and interests we will become a more influential force in the elections covering our territories, and will change the approach in ways that makes our election success more powerful, impactful, and cen-

tered on advancing the interests of the multi-family housing industry. 3. REFRAME THE PERCEPTION OF MULTI-FAMILY — Last month we detailed how we need to change our public image. That carries through as we find new ways to convey our industry’s messages. Working with traditional media, influencing new media circles, and engaging in promoting the industry will be key endeavors for the association this year. We want to drive the news cycle about the industry and not be driven by its fallout. 2. GROW COALITIONS — 2021 gave us the opportunity to begin regional dialogues with industry partners about our issues. AAOC’s influence on multi-family housing policy was effective both individually and with our partners. However, our setbacks in Santa Ana over rent control and just cause eviction exposed a need for changes in our

strategies and tactics. We will do so by engaging with an expanded group of partners and organizations, as well as identifying new opportunities for shaping public policy. 1. GET INVOLVED — In 2022, we will be developing a network for all industry participants to engage and get involved in the issues that will impact us — BEFORE they become issues. We are going to need folks from all sectors of our industry to step up and be a part of a change. This will be a collaborative effort, with involvement from all AAOC members being critically important to our success. Without a doubt, 2022 will be a pivotal year when it comes to elections, policies, and engagement. Together we will change the relationship our industry has with the public and with decision makers. Apparently, they claim to be ‘disabled’ and that because they are ‘disabled’ they get to

do whatever they want. Huge clouds of smoke literally billow out of their apartment! I’m concerned about lots of things, but mostly, the little girl who lives next door, I believe that she’s asthmatic. How much more of this must I and the neighbors take?

The audacity of some medical ‘professionals’ to abuse and game the system by willfully prescribing the use of ‘medical marijuana’ to non-disabled fraudsters is an affront to all truly disabled persons. As of this writing, the use of marijuana, medical or otherwise, is still illegal under federal law however the current administration has elected to stay any enforcement and prosecution for the use and or possession of ‘medical marijuana.’ California enacted the Compassionate Use Act which allows for the possession of a limited amount of marijuana, for personal use, provided certain requirements are met. According to the California Department of Justice, qualified patients and caregivers may possess eight ounces of dried marijuana, as long as they possess a state-issued identification card. In addition, they may only maintain six mature or 12 immature marijuana plants. Local governments may allow patients or caregivers to exceed these base levels. In addition, marijuana smoking is also restricted by location. It may not be smoked wherever smoking is prohibited by law, within 1,000 feet of a school, recreation center, or youth center, on a school bus, or in a moving vehicle or boat. The right to ‘smoke’ marijuana in your

apartment community is not automatic, and will depend upon the individual facts of each case. The use of non-medical marijuana is illegal under both California and federal law, and cannot be used or smoked anywhere, including your community, and can be grounds for termination of their tenancy. The use of medical marijuana requires that the user be disabled, and the disability must be ‘verifiable.’ Additionally, the disabled individual must request a “reasonable accommodation” from you the housing provider prior to just lighting up. Once the disabled person makes the request for a reasonable accommodation, you are obligated to consider the request, and attempt in good faith to accommodate the request in a reasonable manner. The accommodation does not necessarily require you to ‘grant’ the request outright, but you must make a good faith effort to provide an accommodation that addresses the disability, but does so in such a manner that it does not unreasonably ‘burden’ you the housing provider. The courts will apply a “benefit to the requestor” versus a “burden to the housing provider” standard in determining whether or not you met you obligation to reasonably accommodate the disability. In your specific situation, the initial hurdle for your new residents to surpass is to establish that one or both truly has a “verifiable” disability. Legal Q&A — continued from 14 although highly suspect will generally satisfy the extremely low threshold here in California. The reasonable accommodation, their request to smoke willy nilly within the apartment, must be balanced with the ‘burden’ to you the housing provider, and those other residents that might be affected, i.e. the asthmatic child living next door. It is conceivable, and probably likely, that an asthmatic child when exposed to the smoke billowing from next door might have a devastating and fatal reaction. Certainly, the neighbor child, with a truly verifiable disability, asthma, is entitled to be free of the exhaled smoke as a “reasonable accommodation” for her verifiable disability. When balancing the benefit to Cheech and Chong of being able to light up in their apartment, with the burden to you as well as the extreme life threatening burden to the asthmatic child, courts would most likely find that a reasonable accommodation would be to prohibit the smoking of the marijuana within the apartment unit, or in any place that might affect the asthmatic child, or others with such a sensitivity to smoke, but provide an area within the community, possibly a portion of the outdoor common area that may be used for the smoking of their medical marijuana. Alternatively, there are alternative methods of delivering the active ingredient in marijuana, i.e., ingestion, pills or tablets, food based, etc. Remember, reasonable accommodation issues are extremely fact sensitive and the analysis is dependent on a proper review of the relevant facts. Always contact an experienced attorney when faced with a request for a reasonable accommodation, as the issues are typically complex and a reasoned response must be made in a timely manner. I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or

not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?

Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static; that is, they may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental property or to others. These general rental criteria can and should be applied equally and fairly to all applicants, and in compliance with all fair housing rules. Once applied, the best applicant should be accepted, not necessarily the first to apply. I just put my single-family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because

the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?

The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/ enclosure conform to all state and local codes and ordinances. The gate should be self-latching and should be checked to ensure that it closes properly. Review your insurance policy with your broker to ensure that your coverage is adequate; consider an umbrella policy as well. Your broker can counsel you on coverage limits; consider $3,000,000 as a minimum. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self-latching gate functions properly. Consider requiring that your tenants procure renters liability insurance as well. These requirements should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children. The wood fence patios on my property are not very old, yet the posts appear to be rotting out in the ground. I feel they should have lasted much longer. The fence now leans and is a danger. I will be replacing all the posts soon and want to know how to stop the posts from rotting in the concrete footings. Do you have a suggestion? Mark

Dear Mark:

Your problem is most likely poor drainage. The posts just rotted away because of excessive moisture. For a long-term installation, use either redwood or pressure treated lumber. Dig your posthole at least 6 inches deeper than normal. Fill the bottom six inches of the hole with half-inch sized gravel, then set your post in place, level it, and pour in another two or three inches of gravel. Fill the balance of the hole with ReadyMix or Post-Mix concrete. Taper the top of the wet concrete at a slight angle to

the post; that will help drain water away from the post. For added protection, you may want to consider waterproofing your post with Thompson’s Water Seal or roofing tar. That should help keep your post healthy for much longer.

Dear Maintenance Men:

I have a bathroom sink that is slow draining. I have already snaked the drain and found no stoppage. When I remove the pop-up assembly and have an open drain, water whooshes down with no problem. However, with the pop-up in place, water backs up into the sink and drains very slowly. Paul

levels are above the pop-up plug. The overflow hole allows air to escape through the drain and the water to evacuate more efficiently. What has happened is hair, toothpaste, grime, etc. has built up and sealed off the overflow drain where it exits just below the pop-up assembly plug. Most snakes are too big to go through the overflow drain. Alternatively, a speedometer cable will work great or even a long zip tie will work. Push the cable or zip tie down through the overflow hole at the top of the sink and push any gunk out into the drain. Use water to help push the debris out the overflow drain, a funnel works great to direct a good flow of water. If you cannot get the overflow to drain, disassemble the main drain assembly to gain access to the overflow drain exit. Once the overflow drain has good airflow, the sink should drain a bit faster. If this does not solve the problem completely, look at restricting the water flow coming out of the faucet. Use a restrictive aerator to cut down on the GPM of the faucet.

Dear Maintenance Men:

I have a garbage disposal that is very loud. When it is running with water, it can be heard across the kitchen and into the living room. It runs perfectly and I don’t really want to replace it. What can I do to soundproof the disposer? Kathleen

Dear Kathleen:

You are in luck. There is a very simple


solution. Every garbage disposal unit comes with a rubber drain deflector. When the deflector becomes old, the rubber hardens and stays open to the drain allowing spoons, forks, and other items to fall into the drain, but more importantly, it allows sound to escape. Go to your local hardware store and buy a new rubber drain deflector. The disposal noise will almost disappear. Careful you do not forget to turn off the garbage disposal!

Dear Clint:

Try reversing the entry door. Have the door swing out instead of into the garage. You can reinforce the frame from the inside by installing a 1x2 inch doorstop all along your doorframe. The door will close against this new frame and will make it very hard to kick in. The frame stop can be either wood or square metal tube material. The door should be a solid core exterior grade and use a good quality dead bolt lock.

The hinges will be exposed, so use three heavy-duty tamper proof hinges. This will produce a very solid and near impenetrable door. Without noisy power tools or a police ram, nobody is getting through without a key. WE NEED Maintenance Questions!!! Developing An Emergency Preparedness Plan to Manage Supply Chain Disruptions The first component of a preparedness plan is to develop contingencies and solutions with multiple suppliers.

P

ublic safety emergencies such as COVID-19 are challenging for everyone in a multitude of ways. In the rental-housing industry, economic pressures can escalate quickly in times of emergency as the impact on the supply chain becomes more evident. But quick and confident planning, including having an emergency preparedness system with suppliers in place, can ensure fast access to critical supplies. During the session, “Developing an Emergency Preparedness Plan to Manage Supply Chain Disruptions” at NAA’s Apartmentalize, various industry professionals discussed how they overcame supply chain challenges by working closely with supplier partners. The first component of a preparedness plan is to develop contingencies and solutions with multiple suppliers. “These days, one supplier is just not enough. You’ve got to have backups,” said Andy Haynes, Strategic Growth Director for Avendra LLC. “See who else can provide you the materials you need in case that primary supplier, as much as they want to help you, might not be able to.” Second, communication is of the utmost importance when it comes to creating a preparedness plan. Panelists advised to have a routine communication plan in place with both suppliers and residents. Lack of communication creates panic, so be sure you can relay crucial information to the right people at the right time.

As the pandemic began, operators across the country faced multiple challenges simultaneously. However, a common challenge that they all shared was the uncertainty of the times and its impact on the supply chain. “The largest supply chain problem was that this was very unscripted. Nobody knew what environment we were getting into, and that included our suppliers,” said Wais Khairzada, Corporate Director of Residential Services for The Bozzuto Group. “So primarily for us, and certainly in our multifamily space, the biggest challenge was getting the plexiglass dividers, the masks, all of the PPE supplies and things like that.” Resolving supply chain challenges entailed different approaches, but it was establishing and maintaining multiple relationships with corporate and local suppliers that really kept operations moving. “The relationships with our vendors across the country were a huge proponent of navigating COVID and what our orders looked like,” said Kayt Watts, Director of National Accounts at Advanced Catastrophe Technologies, Inc. “Because ACT was proactive when the Pacific Northwest was being hit, we automatically started making those phone calls to the rest of the country and asked what their turnaround time was. We basically planned for the worst and hoped for the best.” Emergencies change perspectives on

what it means to be prepared, and insurance is a part of preparedness that many operators took for granted pre-pandemic. “Know the devil in the details of your insurance policies,” said David Abbenante, President of HRI Management. “We’ve spent weeks, if not months sometimes, analyzing our insurance policies and getting prepared. You’re always now going to think of opportunities or concerns as it relates to this pandemic well in advance.” Old practices don’t always hold up with changing times and the challenges that arise. Operators should learn from previous challenges and create new practices when developing an emergency preparedness plan, according to the panel. “We’ve got several preparedness manuals in place, whereas we didn’t have a manual format before. There’s also very robust communication plans in place,” Khairzada said. Panelists noted that implementing an effective preparedness plan consists of four parts: • Have a written plan. A written plan should be stored where other team members can access it and find the key information and protocols necessary to handle an emergency if your point of contact is unavailable. • Gain the commitment of your supply partners. Sending Strong Signals — A Luxury No More

O

ver the years, developers have come to recognize the importance of strong in-building Wi-Fi and cellular data systems to be on par with other critical utilities. It’s no exaggeration to say that a powerful signal is nearly as important to building residents and staff as water and electricity! In fact, we are living at the height of the connectivity-conscious era, with remote workers making reliable and stable communications a primary factor in their move-in decision. But what about situations where a strong signal can mean the literal difference between life and death? In the case of Emergency Responder Radio Coverage Systems (ERRCS), that is exactly the case. These systems, which use a network of antennas called a Distributed Antenna System (DAS), allow first responders to reliably communicate even in challenging conditions created by modern construction materials (steel, reinforced concrete, low-E glass, etc.). ERRCS was mandated by The National Fire Protection Association in 2007 and is enforced under Section 510 of the California Fire Code and NFPA 1221. The code is determined by your local Authority Having Jurisdiction, but multi-family developers involved with new projects should assume they are required to have an ERRCS installed by a team of FCC licensed radio testers, design engineers, and integrators.

DAS/ERRCS Explained

A Distributed Antenna System (DAS) consists of a number of antennas located throughout a building connected back to an RF source with cabling designed to help provide adequate radio signals in areas that may otherwise experience poor coverage. In response to the World Trade Center disaster in 2001, the National Fire Alarm and Signaling Code (NFPA72) was updated to ensure that wireless coverage in existing buildings, new buildings, and parking structures was drastically improved. The code mandates that public safety radio coverage shall be provided throughout a building with 99% floor area radio coverage in Critical Areas and 90% floor area radio coverage in General Building Areas with a minimum signal strength of -95db. Testing is required by an FCC Certified Technician qualified with a General Radiotelephone Operator License (GROL/PG), to certify that all existing buildings conform to this mandate. Buildings and structures that do not pass testing are required to install a DAS/ERRCS system to comply with the Building Department and the local law enforcement agencies. Other Signal Enhancements

While not mandated by code, there are other ways to boost cellular and wireless signal strength that compliment overall building connectivity and improve resident satisfaction. Cellular DAS, for example, can significantly boost carrier (e.g., Verizon, Sprint, AT&T) signal strength in your building(s). Frothy Rents…Blame it on Covid?

S

urging apartment rents are turning heads. In the past year rents advanced 12.4% in Orange County and 10.3% nationwide at properties with 100+ units. This is in stark contrast with the past ten years where annual rent increases averaged 3.7% in OC and 3.3% nationally (per rental housing analytics firm, RealPage). What led to the outsized increases in apartment rents? And, as one might inquire in this pandemic era, is this yet another manifestation of a virus-caused anomaly in the economy? Certainly Covid may have played a role, as we’ll discuss below, but it’s not the primary driver of the sharp rent increases. The main culprit is the lack of affordable housing, a condition that investors, rental housing professionals and government officials have been aware of for years. But efforts to grow the pool of affordable rental units have yet to dent the severe supply shortage. Occupancy rates in the third quarter of 2021 illustrate the depth of the market’s supply/demand disequilibrium. As the chart on the opposite page reveals, apartment occupancy in Q3 2021 was a stunningly high 97.2% across the nation, and hold on to your hats, a blistering 98.7% in Orange County. Apartments are re-leasing virtually the moment they go vacant. But while the shortage of rental housing inventory is the fundamental issue that continues to squeeze the marketplace, I would suggest that the eyepopping occupancy rates, as well as

the jump in average rent levels, are at least “wind aided” by Covid in two ways: First, virus concerns incentivize people to live in less dense environments. Thus, young adults living with mom and dad are now more likely to look for independent living quarters, while some apartment roommates are electing to break up to rent their own units. While such “distancing” actions should produce safer, less Covid-risky living situations, they also put upward pressure on apartment occupancy at a time when many buildings in Orange County are already nearly bursting at the seams. And second, substantial governmentfunded rent relief programs for tenants who declare under penalty of perjury that they have experienced “Covid-19Related Financial Distress” have, essentially, brought substantially more liquidity to the rental marketplace, particularly in year 2021. This enhanced market liquidity helped landlords increase overall rent collections in 2021 and more readily raise rents. Government rental assistance programs weren’t as accessible in 2020. Under the California Covid Assistance program, the state sends a check directly to the landlord for 100% of the rent, an endearing program feature to landlords. Two additional likely contributors to the rising tide of apartment rents not heretofore mentioned would be: (1) the strong US economy and (2) recent spikes in inflation…as of this writing (12-15-21) the consumer price index had jumped an unsettling 6.8% over the January 2022

twelve months ending November 2021. Whatever the causation of the high rents and low vacancy, apartment properties fly right off the shelves when put up for sale. And rental housing sales prices are climbing commensurate with upward rents. Even with eviction moratorium issues, rent control concerns, the eventual termination of Covid rental assistance programs, as well as the ongoing unknowns surrounding Covid variants, the multifamily sector shows no sign of losing its strong appeal to investors in 2022. Until the supply of affordable rental housing units catches up with demand to rent them, the asset class will likely remain bullet proof.

Good news on higher Fannie/Freddie 1–4 unit loan amounts in 2022

Due to strong price appreciation on 1–4 unit residential properties the past year, Fannie Mae and Freddie Mac have raised their conforming and high balance maximum loan amounts by a hefty 18% for the new year, providing buyers of smaller properties substantially more loan dollars to finance their acquisitions. On purchases, investors can get 80% LTV loans on a 1-unit property, 75% LTV on 2–4 units.

The Apartment Association of Orange County is an excellent resource, but when it comes to such specifics as processing an eviction or replacing the coolant in your air conditioner, calling upon the help of an experienced professional may be required. Tackle deferred maintenance. So easy to postpone, deferred maintenance items can become costly nightmares. Even a lack of upkeep can create a spiral effect with residents showing less and less respect for where they live and attracting qualified tenants becomes harder and harder. Watch the trends. Sales prices only tell one part of the story. Rents are another key component. However, you also need to look at what is happening on each of your properties as well as within the neighborhoods where they are located. Keep your rents competitive. With all of the turmoil and hardships of the

past year, raising rents seemed inappropriate. But now is the time to do some checking and adjusting. With rent control it is more important than ever to institute a practice of regular increases. Otherwise you fall further and further behind, which impacts both your cash flow and the value of your property. Know where you stand. Ignoring the realities and not tracking what is happening is dangerous at the best of times. Today, with so many impediments to offsetting rising costs, it is crucial that you watch your cash flow and your reserves. Be aware, too, of deferred maintenance items and the need for major repairs. Look at all the options. Rather than staying locked into one position, investigate different possibilities and keep an open mind about the choices. There may be some surprising opportunities and other ways to achieve your goals. Run the numbers. Whenever you are considering an alternative investment, make sure to do a thorough due diligence and a careful review of the

numbers. Use your own experience as well as that of trusted advisors to double-check and verify the fundamentals. Quantify your outcomes. When you are looking at projections, including some “what if ” scenarios can help minimize surprises and give you a better perspective. Consider, too, the benefits to be accrued as well as the potential risks and downsides. And, don’t forget to apply the same analysis in maintaining a “hold” position and not doing anything at all. Talk to your heirs. The last year has brought about many changes and shifts in priorities. Just as you may be adjusting your own bucket list and goals, your heirs may be doing the same. Asking, listening and sharing may offer key insights that will help you better direct your energies towards how you shape your legacy.
